City National Bank Debit Card Customers File Class Action Lawsuit Against City National Bank Over Overdraft Fees.

A class action lawsuit has been filed against City National Bank in Kanawha Circuit Court, West Virginia alleging that City National Bank unfairly assessed overdraft fees due to the way debit card transactions were posted, according to a class action lawsuit news report.

The City National Bank overdraft fee class action complaint reportedly alleges, among other things, that City National re-orders debit card transactions from the highest to lowest dollar amount so as to deplete the customer’s available funds as quickly as possible while maximizing the number of overdraft fees, charges overdraft fees even where a customer has not overdrawn his checking account, and charges overdraft fees even where City National did not pay out more funds than were in the customer’s City National checking account.

    Just wondering what’s going on with this.Starting to sound like a scam.
    I have not gotten anything in the mail,phone call,e-mail nothing at all.
    I have saved all my letter’s that I have gotten about this suit when it 1st,
    Started but nothing else.Lost all faith in the judicial system in this country.If any one out there has gotten there money in this case,please,
    let other people know.The bank sure didn’t mind taking our money what
    were asking for is what is rightfully our’s to begin with.

      I responded to the first letter which said the account was closed and the money would offset negative balance. Received email and letter stating that many letters were incorrect. My understanding from the last letter was that settlement was to occur end of July. I have emailed twice since and still no response. Maybe you are right and a total scam. Funny, I had contacted the bank when they did put me into arrears that way, and was told it was policy.

      I would not quote Obama when it comes to class actions. He was involved in a discrimination in lending lawsuit against Citibank in the 90s and pockets hundreds of thousands while only the three initial class participants gotten any money. The others were sent coupons.

    from all my research only expect about a Third of whatever you lost in Overdraft fees Mr. In your Interest, will be keeping the rest for services rendered.

      I wish it would be a third. That would still be way over $1,00o for me but I don’t have any hope that will happen. On the facebook website, one guy said the lawyer called him back and confirmed he was part of the class but said “if any” funds were available he would get a check. I think we could end up getting nothing or so little it feels like nothing. They are apparently now saying there are more people in the class than money!

    Its all just a racket to try and make money for the lawyers. Until the American People stand up and refuse to be a part of the greed it will continue. If you really want to put a stop to it and make change you have to put a little effort into it, when you get a notice, sign up to be excluded, if you want to sue, then sue on your own behalf. Until people start doing that, well these lawyers will keep getting rich

    Okay City National Bank you gave us letter stating that we are going to be compensated for what you took from us. I also think this is some sort of scam too. I have been waiting since July and August but they came and went so what they hell is goin on. You all need to let all the members know if there is any updates or not and if you or the lawyers are going to pay us back the money or not. i am about to give up.

    I received an email from the lawyer and he said they are trying to get it deposited by the end of the week. He told me 7 days ago I would have it no later than today. Now it is the end of the week. I now don’t look to have it at all.

    I have actually talked to the law firm handling this case and it is not a scam, it just takes a while to process every thing. The case itself took almost 2 years to even be settled.

      I agree John that it is not a “scam” but what is upsetting to most of us is that they continue to deduct admin cost from our share of this until it is settled. The longer it takes the more they get the less we get. It that sense it really is a scam.

    I really thought we would see something by today, Saturday. I am very disappointed. If they drag this out another week – we all need to do something. I understand that BB&T, JP Morgan Chase, and Bank of America have class actions against them. United National Bank does the same thing – pay the larger transaction first. Banks run the country and they were the ones given the 750 BILLION stimulous and then they would not help people on their home loans. The Bush administration made sure a war would take place and look at it – 11 years later and we are still not better off, Iraq still has AlQuada (if they exist)( running their country) – lots of CONTRACTS with our government overseas of people like Chaney making billions. (Halburton) – You never hear of Rumsfield – he sort of disappeared off the planet with all his billions – and our soldiers getting killed for what. Our freedom ??? Iraq freedom? No, it was all a lie and an illusion. Iran admits they DO have weapons of mass destruction but we are not attacking their country! – Life is a scam along with all the evil, fat cats, wall street, while we slave away and fall for their lies. I understand their is about 5 million involved in this class action suit and that is like 5 cents to the bank and the lawyers. I make 23.33 an hour and I just barely survive by the time taxes are taken out of my pay and I have a dependent. 23.33 an hour today is like $2.65 an hour was in 1970 – in 1970 at 2.65 an hour (I was married at the time and my x made 2.65 an hour) we were young and we had 2 cars, 1 motorcycle, lived in a nice apartment in a big city with nice furnishings, was able to save 1500.00 a year – so—–due to inflation, 23.33 an hour is less than 2.65 an hour was in 1970! I am lucky to pay my utilities because to drive to my job (round trip is 89 miles a day) costs me 306 for car payment, 122 for car insurance, wear and tear on my vehicle and 435 a month for gas – so add it up – just to get to my job and pay gas and expenses (not counting lunch or other things) – it costs me one whole paycheck! The other check I try and live on paying utilities, groceries and some small bills. IT is a SHAME that it is like this in America. The RICH rule it people and we working class are screwed!!!!!! I have worked 41 years. I know people who make 90,000 and up a year and they struggle and complain! 48.00 hr up to 67 an hour! they all complain how tight things are. So, 23.33 an hour is like poverty wages. I have no idea how people who make minimum wage even exist. I believe wages of 15.00 and below should NOT be taxed at all. 7.35 an hour , if you are lucky may buy a loaf of bread and a gallon of milk. Gas is reaching 4.00 a gallon (In Gauley Bridge last week it was 3.99). We are being ripped off – the fat cats must owe big money somewhere (oil companies) – Also, think of this, WHY is all this happening just within the last 60-100 years (technology, dollar shrinking) out of all the millions of years we have been here – why IPHones now – why is it like it is in such a very very very short time in life compared to all the other centuries!

    I see a lot of people that are really stressed out about this money, I really do hope that you all know or at least have a thought that it is VERY unlikely that your going to see very much money. I had thousands stolen from my husbands business account with these practices and there was nothing I could do since changing the bank was next to impossible, when I finally did………….it took 8 months!

    I am thinking I will see less then $50 bucks, I estimate I lost upwards of 5K ore more over the space of 3 years, and I doubt I will see more then $50

    I know a lot of you are looking at this like I am gonna get my money back, or at least a few hundred dollars………don’t set yourself up for that disappointment when the check does get there. Do not put off your bills or plan with that money, because I think a lot of people are gonna see very small checks, many with likely around $9 Its the way these class actions work folks. The lawyers clean up the original complainants clean up and the bulk get pennies………I have seen these class action suits wind up with members getting coupons only.

    I have seen many people complaining about how the bank is still doing it, yes they are……….not to me anymore because I became proactive with my checking account.

    First thing, run down to the bank and refuse bounce protection, tell them you do NOT want it! This is the BEST way to prevent this from happening, if the bank can not clean up in fees, they more often then not run them in the correct order.

    2) Once you have that set up, any charges made on your debit card will be denied if you do not have the money in the account (With the exception if you wrote a check that has not processed yet)

    3) Get online banking, check your account EVERY day! I check mine sometimes 3 or 4 times a day. This will keep you better informed of what you have to spend and your less likely to go over.

    4) If you keep bounce protection, do not use it like a loan……….stop charging stuff folks!!! Pawn shops suck, but at least your not paying $36 for every charge!

    5) Do a budget……….I know budgets suck, but if you see a pattern of over spending, or of being short every week a budget will help you stay on track.

    At the least you should grab a notebook and write down every little thing you spend your money on. Make 2 columns, one for necessities and one for non necessitates. After a few weeks take a good long look at what your spending your money on. You would be shocked at how a coffee every few days adds up, or grabbing a breakfast sandwich on the way to work costs quite a bit over a month!

    When I went over my spending, I found a few interesting things. One if I stopped wasting money on little things I could save myself a few hundred each month, and two that money could be used to save up for the future. By just taking away Slurpee for the kids on the way home from practice, eating breakfast at home all week, avoiding the coffee and packing my own, cutting out some cable channels, upping my deductible on my insurance and cutting down eating out to once a week………….we were able to use those savings to go buy my husband a new truck, we were wasting over $400 a month on silly stuff, a dollar here, a couple dollars there, would go to Walmart and buy stupid little things that we really did not need……it adds up really quick folks.

    Fact is you work HARD for your money, why let the fat cats influence you on how you spend it? Instead of shopping hungry, eat before you leave, don’t make rash purchases and above all, if you get a little tingle that you really don’t need it………………put it back 🙂

    I have noticed that this Blog has now slowed to a snails pace and I believe that “THEY” watch it. It just seems to me as the steam dies down they’re feet dragging delaying continues. All the while they continue to draw interest on held funds. Carolyn’s Facebook page has now become the place to go for info. I know fron Carolyn’s page that some individuals have even contacted the judge in this case. Where it all will lead,only God knows. Hang in there folks, I think the Shit is going to hit the fan soon and there are going to be some lawyers finding themselves in “Contempt of Court”.

    I am so frustrated. I’m not concerned about how much money I will get, if it’s one cent – I want it back from those thieves. I’m calling the attorney’s office and the judges office today and will update everyone on what I find out but don’t hold you breath because no one gives a shit about any of us. They have what they want so tough crap for the people they are supposed to be helping. I appreciate all the helpful advise I am getting from some people on here on how to handle my finances. Maybe if it was understood this was “not the result of anyone mishandling their finances”. If that was the issue, there would be no lawsuit. This is the result of the bank purposefully processing debits in a way that benefits them the most while screwing over the customers. I agree with Patrick, this site has become silent – is everyone going to roll over since they put that out there they are working on it with no date for resolution? That’s now how we get things changed folks – it’s the squeaky wheel that gets the grease. Update to come later.

    There are a lot of people who are watching the facebook page even though they are not friends with the page. (I don’t want this information on my facebook so I opted to not join, but watching and reading and when someone is ready to stand up to these folks, just let me know.

    I have sent out emails to 2 class action lawyers. One emailed me back and asked for a link to this page as well as facebook, and told me if I want to file as a early claimant then I would get the big bucks…….Unless I hear from Mr. Bailey before Thursday letting me know why I should not go forth, I will be meeting with the lawyer on Friday morning.

    I emailed Joyce Williams today and asked for a itemised report on what the momeys was used for and how it was split up, i think we all should reseve this info if we are infact plaintives in this case, and not just pondes used by City National Bank to get out of trouble, and told her that I would fill a complaint if they added plaintives after the court and the bank agreed on a amount with what people they had in the class acction suit, If they added people to the action after it was setteled it only benafited the bank, and should not be alowed by the courts and If so I do intend to fill a complant with the courts of WV this should not be allowed by the courts or by are so called law furm that repasented us, if so do they have to use more of their awarded momeys to pay out to them ,I think not, we will be the ones that get the shafet as well as the ones that jumped on board after it was setteld, they could have gotten more by a new suit bet the bank and the law furm didnt tell them that, sorry for all the bitching just needed to blow

I even answered that email and explained to her I have specific questions that need answered. I again received another email with the copy of the update that was put on the web. So, your just wasting your time because your not going to get any information out of them. I think they are just sending that update to all email inquiries no matter what the questions are. This whole thing has been a nightmare for the people who were treated unfairly in the first place. We should not have to go through all this crap to get back a few pennies on the dollor of the money that was stolen from us. If this was done by a private person and not a bank, they would be in prison for life, but all the banker’s get is a bigger bonus at the end of the year. It’s a disgrace.

    I get the feeling that many think they are going to receive most if not all of the fees that were taken from them. I have been reading up on many class action suits and to the contrary you’ll be lucky to receive pennies on the dollar. You can GOOGLE class action payouts to give you an Idea. As I’ve stated earlier I was involved in a class action which reaped the lawyers a $44,000,000.00 payday and that was with them receiving anywhere from 20 to 30% of the judgement. There were so many claimants in the suit that I only received a check for NINE $9. I threw it in the trash I was so pissed. waited over two years on that one. I’m trying to prepare you now so it will not come as such a shock. You’ll be lucky if you get the equivalent of ONE overdraft few,if that. It’s the way the system works! It may not be completely broke but it diffidently needs fixed.

    Mr. Mason from the case called me yesturday and said he got a email from the moderator and it was explained to me that the checks will be on the printer and in the mail or direct deposited no later than this coming week.. I have been told this from him 1 time before. I figure nothing is coming, cause i got 2 cards and then when i called he couldn’t find my name on the final list of pay outs, and when he called me back it was because city had not ever changed the account standings and they was sending me debt forgiviness and had to change it..

    I called and spoke with the AG’s office last week to file a complaint about the lies and misleadings. They informed me that I would have to contact the law firm handling the case. Well, I called the firm and I was sent to voicemail, and no surprise I never received a call back. I was under the impression that there were laws that prevented this type of thing, guess I was wrong. I am sure the lawyers have their share and are probably vacationing on some tropical island laughing at all of us fools that thought they were helping us.

    I just spoke with Arnold Mason with the attorney’s office. I insisted on holding which I did for almost an hour. After he came to the phone, he told me that he was on a conference call with the folks from the bank. He said checks are starting to go out the door today but it’s hard to estimate how long it will take to get to your house. He also said the direct deposits are going to be put in checking accounts first before the checks go out.

    Mattie – did you really hold for 1 whole hour on the phone? I think that is soooo funny – if the checks are going out the door today (17th) and direct deposits are going to be put in checking accounts first – I just checked my checking account at 3:25pm and there is nothing in there so I would think it would be showing going in by now. What do the rest of you think? It is all so strange. If we were going to see a direct deposit by Tuesday, it would be showing now. What a rip off.

    I tried to get information today from the bank to check my balance to see if there was a deposit, and surprise! All computer systems are down and have been since Saturday. I asked when it would be fixed, and the lady said she didn’t know. Why even open then?

    I spoke to mason today and he stated the same thing. as matte said above so we should be seeing something deposited by at least wednesday due to going through two different banks.

    He said checks are starting to go out the door today and He also said the direct deposits are going to be put in checking accounts first before the checks go out.Lets see checks going out today but deposits first? There have been NO deposits today. Mr. Mason’s credibility is in the SHITTER and if the mans lips are moving he is lying. He’s a Lawyer he can’t help it. I wouldn’t trust this individual or anything he is associated with. Mattie don’t call these pricks, their just going to continue to jerk you off and in the end there still is going to be next to nothing. All of us are going to get screwed and not even kissed, now that you can take to the bank. Just make sure it isn’t City Bank.

      I got money…!!! Wow… $6.72 was deposited in my active City National Account today for the Class Action Settlement… Unbelievable… I paid enough in overdraft fees to build a new Wing onto the Bank over the years…

    OMG a Wopping $80 bucks.. That pretty much covers 2 of the over drafts they owed me.. I know of 50 times they pulled that shit on my account.. I’d like to know how they came up with these numbers. In 2007 alone ( my college days) I was charged over $700 in OD fee’s that year alone.. and I know some were actually ligit.. but there were several that were not.. Is anyone going to purse this further? If so.. add me in!

    Even if we averages 50.00 each – that would be 40,000 persons. I am calculating if the settlement was for 2 mill. However, I think it was for 3,000,000 to be distributed to us and 2 million to lawyers and Mr. Casto was to receive 7500.00 Let’s use the 3 million figure – and if each of us averaged 100.00 each that comes to 30, 000 people! Some of you are just getting like 5.00 and 6.72 and 20.00. This is really something. Can someone help me out here in figuring this?

    I received a whole 53.77. I know I had a minimum of $3,000 in charges over a 6 year period. If we were to have 3 million distributed to us – and we EACH averaged 100.00 – that would be 30,000 people to be paid. The Lawyers and administrators received 2 million. Mr. Casto was to get 7500.00 – I read that somewhere and 100.00 each is average only! So, I think we were ripped off! What do you think – what did others get.

    $134.41 for me. It seems everyone’s post on here and fb are pretty close to being multiples of the lowest amount that i have seen…$6.72. So for every overdraft fee that you were charged AS A RESULT OF THE REORDERING OF TRANSACTIONS you should be able to multiply by $6.72 to come up with the amount.

    $73.93 and I was shocked I got that. I had one week where they got me for over $300. Well I’ve been preaching to the choir since this started that we shouldn’t expect much if anything. My past experience rang true again when it comes to class action. For my part I’ll never be party to one again, I’ll hire an attorney and file my own suit if the need arises.     So in other words we were given 6.72 for each fee charged but if I remember correctly the minimum amount of overdraft charge was 28.00 then 30.00, 32.00, and 36.00. Where did they come up with 6.72.

    I don’t think these yahoos know what they are doing, hell they dropped my husbands settlement money into my sons checking account…..assuming because they share the same name and address. I have heard folks say they got $60 and had one over draft and others say they got less then $20 but had many many overdrafts on account of re-ordering. I would LOVE to know how this stuff was done, because I am starting to think that they just sent out random amounts.

    Received $320.17……Huh? What recourse do we have now except a complete Audit, and if so How? do we go about it. Does anyone know how long CNB posted transactions of debit cards highest to lowest? We have had a active account with CNB since 1990. Can another Law Suit be brought before the court for any outstanding dates?

    I closed my accounts along time ago because of what they city bank were doing and had my son close his too. got a letter about the settlement, and nothing happened: so went to the Bank and now my accounts have been reopenned; i didn’t do it all i want is my $7500.00 just like everyone….

    I received a 60.45 check today in the mail in addition to them putting 53.77 in my checking account. I had 2 accounts years back and the 60.45 check was for the closed account. I was surprised I received the check.

    I got 13.44. but here’s the kicker. My son got a letter saying he would get debt forgiveness in the amount of $90.00. Then he received another letter saying that was a mistake that he did not owe anything. So you would think he would get a $90.00 check right? He got a big $13.44 also. LOL What a joke. They only paid what they got to keep!

    If anyone actually takes the time and does the numbers, it will amaze you. From what they’re paying the lawyers and what they’re paying the people they stole from, you will see that it was very beneficial for them to do what they did. They have made millions. And I am not exagerating one bit. They literally stole money from customers. If they didnt get caught they get millions. If they get caught, they still get millions. It was a win win for them. The only way it could have hurt them was if 40000 customers said to hell with it and closed their accounts. And they knew that wouldnt happen. They did very good with all this.

    Something is VERY WRONG! I’ve had a couple of accounts with City National Bank since 2004 and probably have paid over $10,000 in overdraft fees. I’m getting a check for $13.44. All my accounts were properly closed. My partner had one account with City National Bank that we closed and was rarely overdrawn but is getting a check for $114. We need an AUDIT!

    I received a check for $215.06 on Saturday. I agree there needs to be an audit done. There is no way this is a fair and just settlement. I will never again not opt out of a class action. Lesson learned.

    Recieved another letter in the mail today. It says we are recieving debt relief in some unknown amount which will reduce my unknown balance to -$65.04. (only number they used in the whole letter.

    Funny thing is, we have a current City acct. with a pretty decent balance that has never been in the negative. Our previous account was closed 5 years or so ago and paid off then. Im so disgusted at this point. This is utterly ridiculous.

    Well we got our “settlement”. 13.00!!! Are you serious??? City National took hundreds of dollars from us and that is all we get? What a ripoff and a joke! I’m really disappointed and disgusted by this so called lawsuit. I’m just glad we are now with a new and awesome bank, Putnam County Bank that treats us well.
