Consumers File Class Action Lawsuit Against Capital One Bank, Capital One Services and United Recovery Systems Over Alleged Deceptive Debt Collection Practices

A class action lawsuit was filed against Capital One Bank, Capital One Services and United Recovery Systems in the U.S. District Court for the District of Connecticut (No. 3:10-cv-00398) for alleged violations of the Fair Debt Collection Practices Act (FDCPA), according to a class action press release.

The Capital One Bank, Capital One Services and United Recovery Systems class action complaint reportedly alleges that class members were sent debt collection letters with the Capital One logo enticing them to make a phone call on a no-lose offer, which calls were allegedly redirected to United Recovery Systems debt collectors in a “classic bait-and-switch.”

    On August 1 2007 I had a friend pass away and leave me as executor of his estate. There was no money at all for any debtor. I sent Cap 1 a letter informing them of no money and a copy of the death certificate. Heard nothing for a few months, then got a letter again from a collection agency. Sent then the same info. Heard nothing for awhile, and guess what, they then turned it over to an estate collection agency. Had to go through the same process again. This company is no good. I advise anyone to stay away from the credit cards and banks and any other services offered from these lying, dispicable thieves. They are true scumbags.

    I became disable & I had the insurance to cover the card, guest what Capital One refused to allow me to use it, they said I didn’t have it. But, about a year ago they (Capital One) sent me a letter saying they refunded the amount of the insurance to my out-standing balance. Capital One took me to court over 2 years ago & placed a lein on my home. Capital One needs to be taken down. They are a big joke!! They are lying thieves & will rip you off in a heart beat. Avoid Capital One at all cost!!!!!!

    credit card fees–I went over my 300.00 limit by a penny and Capitol i owed 70 the next month including an over the limit fee of 35 and a late fee i could not pay and I did not know it went over by a penny until i got the bill. it was sent to collection when all i could make was the minimum payment and now they want 700.00 and they sent it to a lawyers office on the east coast. I have no job

    I don’t have a class action story but I do have a story. I had two cards with capital one. I got laid off from my job a few years ago and could not afford to keep payments on the cards. One card had a balance of 300 on it and I’m sure the other one had a zero balance or at least less than 100 on it. The card with the 300 balance swelled to 1700.00 and was sent to collection. I didn’t hear anything for years from Capital one about either card. Then I got a letter offering a settlement on the card with the original 300.00 balance. Instead of paying the 1700.00 that the card was at I was offered a settlement of 450.00. I took it and paid it off. Not even a month after doing that I get a collection call from Capital one for the other card. They had been holding it and had never submitted it to collections. It is now close to 2000.00 and they are threatening to send it to collections. It seems like to me that they held on to both cards till they had inquired a large amount of money owed on them; and then sent them to collections. It sounds like fraud to me. What am I to do now?

      today i get papers delivered by some guy representing capital one. portfolio recovery. they did the same thing with me in 2009. here it is 2013. they have charged this debt off and sold it to them. i literally went thru hell to get this account resolved. they use the wrong name when you ask for it. they promised me that the amount we agreed on would settle the account and close it. they lied the scums. and i spoke to several ppl who claim to be supervisors. a lie. now they say i have to 30 days to answer this letter or call the number above the front page. i’ve read other stories and i just dont know. dont want them to lein my home. advice on how you settled your situation. please

    capitol one is are the only bank that hires low class dirty bitches and people that steals all work for capitol one bank people like Shertia H. McGown she stole my money for capitol one she signed my name and took out $10,000 in fromy account total she stole $16,000 from account at this bank located in Nash Texas I reported her and guess what she still works for capitol one at there main location head office they fired this nice lady by the name Centeria S. and kep the one that stole my money now they want to sue me when they would not file on my claims for disability after I had 2 surgeries and was off work for 6 months. they would not file my cliams the Red River Credit union did the same thing to me once before then they want to sue you for being late and having added this old crooked lawyer fee’s on making the amount go higher and higher in stead of working with you helping lower your repayment. When they keep on hiring and keeping these no good crooks as clerks and finanicial officers working there stealing from us seniors citizens money out of our on accounts signing our names and stealing our money from us . they want do a investigation in fairness to see where or who took our money. Why do they do this?Why are the system protecting banks like capitol one?

    They use unsavory collection practices and debt collectors who verbally harass you and threaten your home and to garnishee your wages. When I complained to the Attorney General’s office & FDC, they stopped calling. About a year later, they hired attorneys who are trying to sue me. They are not to be trusted!

    Capital one put a lien on my property for 1,300 debt, I tried to settle with them last year and get it paid off they refuesed to except a payment plan then and because I spoke with them it somehow gave them the right to re-do the lein and add interest its now over 10,000.. they say they can keep it on forever until I descide to sell my house and give them all the money for my house and they do not negotiate anymore, all for a 1,300 debt. If anyone knows of a class action suite against them for unfair collection practices please let me know

    We made payment arrangements with Cap One back in November. We have made every payment as agreed yet they have filed a breach of contract with the courts and have a repo order on the vehicle. I was followed by United Auto Recovery (unitedautorecovery.com/) today. The driver was going down the road honking at me and telling me to turn around and tried his best to push me onto the shoulder of the road. He risked my safety and the safety of other drivers.

      we purchased a 2006 Chevy Silverado with CAPITAL ONE in Sept of 2014, had the truck repossessed on May 30th with no PA required 15 day notice to repo, then found out they reported it late and behind because of “term of contract” clause between them and dealership for $1,500 that we were not told about!!! Our daughter has her motorcycle thru them as well and has made all her payments and continues to get harassing phone calls from capital one of “repo”, yet she isn’t behind , and they closed her account??? someone tell me how these companies get away with lying and the consumer pays.???

    Good lord. Can ANY of you people spell, type, punctuate, capitalize or form a complete sentence in any way? If you want people to think that YOU’RE not the ones who are at fault, maybe try seeming a little more educated. If you don’t even have a rudimentary grasp of the English language, how do you expect people to think that you’re capable of understanding the finer mechanics of how credit works?

    Immediately after the credit card act of 2009 went into affect Capital One incresed the interest on my account by 3%, which many other banks must have done–as you recall the act was due to take effect in February of 2010, however congress moved the date back to November, nonetheless Capital One did not reflect any willingness to comply with the intent of the law, so continued with my higher interest rate, which simply made it impossible for me to live on my income. Later Capital One sued me for the balance + interest, of course, in 2013, and even-though I am sliding down the economic razor blade, they are now searching to find any mechanixm they can to collect the ammount awarded by a rural court judge, no brilliance there. Capital One has not notified me directly but they appear to be hounding my other creditors. Capital One is a Rouge corporation so please include me in any class action suit regarding Capital One, it may please you to know that Capital One did receive bailout money, however did nothing to ease up on it’s debtors, and as near as I can tell, simply used their bailout money to pay off the the debt accrued by the bailout money.
