A class action lawsuit has been filed against US Airways, Inc. (“US Airways” or “Defendant”) in the United States District Court for the Northern District of California (styled Hayley Hickcox-Huffman v. US Airways, Inc., Class Action Case No. 10-cv-05193-HRL) alleging, among other things, breach of contract, unjust enrichment, breach of covenant of good faith and fair dealing, negligent misrepresentation and negligent interference with use of property arising out of US Airways alleged handling and transportation of passenger baggage, including US Airways alleged failure to refund checked baggage fee to passengers whose luggage or baggage is delayed, damaged or lost, according to the US Airways checked bag fee class action lawsuit complaint.
