Remington Arms Model 597 17 HMR Semi-Automatic Rifle Purchaser Files Class Action Lawsuit Complaint Against Remington Arms Over Recalled Rifle.

A class action lawsuit has been filed against Remington Arms Company, Inc. (“Remington Arms” or “Defendant”) in the United States District Court for the Middle District of North Carolina (styled Ronnie Maxwell v. Remington Arms Company, Inc., Class Action Case No. 1:10-cv-00918-UA-LPA) alleging, among other things, that Remington Arms made certain representations concerning the Remington Model 597 17 HMR rifles and ammunition that were false, misleading and deceptive since Remington recently recalled all Remington Model 597 17 HMR rifles and the ammunition for them allegedly due to safety and performance concerns and issued a notice to consumers instructing them to stop using their Remington Model 597 17 HMR semi-automatic rifle and to discontinue use of Remington 17 HMR ammunition, according to the Remington Arms Model 597 17 HMR class action lawsuit complaint.

The Remington Arms Model 597 17 HMR Semi-Automatic Rifle class action lawsuit complaint is reportedly brought on behalf of the following putative class of persons, unless otherwise excluded:

All persons who purchased one or more Remington 597 17 HMR semi-automatic rifles (“the Class”).

The Remington Arms Model 597 17 HMR Semi-Automatic Rifle class action lawsuit complaint reportedly asserts claims for violations of the North Carolina unfair and deceptive trade practice act and the federal Magnuson Moss warranty act, and for unjust enrichment and seeks for purchasers full refunds of their purchase price.

Lawyers for the plaintiff are Ben Bingham of Bingham and Lea in San Antonio Texas and Gary Shipman and William Wright of  Shipman & Wright in Wilmington, North Carolina.

    I also purchased a Remington 597 17 HMR & just found out about the “partial” buy back. Not happy.
    I read that there was a repair that could be done, but if that is not feasible or possible then I want FULL price back in cash, not a coupon for another Remington. If I have to give this up, I want to purchase a Mossberg or Savage bolt action.

      i Heard in the begining of this( when the issues with the .17 597) started to surface, remington was offering to re-chamber the owners rifle in .22mag. To me, that didn’t sound too bad. With doing that, the rifle would be useable again, instead of being a $400 closet or safe ornament. However, I have since read that this is NO longer being offered, and I have yet to find out if it had EVER been done. At this point i think I will take my ‘coupon” and get a bolt action remington and let this be the LAST remington I ever purchase. BTW, Mine blew up on me twice. The first time i was unaware of the issue and thought i had gotten a bad round of ammo, i purchased another clip and damned if it did it again. Very scary.
