Nissan Maxima, Altima & Quest Automatic Transmission Class Action Lawsuit Complaint

Individuals Who Purchased or Leased Any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest Vehicles Equipped with an Automatic Transmission File Class Action Lawsuit Against Nissan.

A class action lawsuit has reportedly been filed against Nissan North America, Inc. and Nissan Motor Company, Ltd. (“Nissan” or “Defendants”) in the United States District Court for the Central District of California (styled Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Class Action Case No. CV 12-00332) alleging, among other things, that Nissan manufactured, distributed and sold 2004 through 2006 Nissan Maxima, 2005 through 2006 Nissan Altima and 2004 through 2007 Nissan Quest vehicles equipped with automatic transmission that allegedly contained a defect that causes breakdown, transmission slips, delayed shifts, acceleration surging and/or mechanical failure, according to the Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit complaint.

The Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit is reportedly brought on behalf of the following proposed class pursuant to Federal Rules of Civil Procedure 23(a), (b)(3) and/or (b)(2):

All individuals in the United States who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicles equipped with an automatic transmission. (the “Class”)

All Class Members who are “consumers” within the meaning of California Civil Code s 1761(d) (the “CLRA Sub-Class”)

The Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit complaint reportedly asserts claims for alleged violation of California’s Consumer Legal Remedies Act, California Business and Professions Code s 17200, breach of implied warranty pursuant to the Song-Beverly Consumer Warranty Act, breach of express warranty and fraud by omission.

    Less than 2 years ago, I experienced the same symptoms with my 2005 Maxima. It had about 70,000 miles. I was told they had no knowledge of any past problems with the transmission. They finally agreed to pay the cost for a new one but I had to pay $500. About 13 months later I started having problems again.

    Yes i get same problem whit my nissan Maxima 2004 the transmission kick in first gear also in reverse some Mecanic tell me is probable the motor in transmission mount in ipaid $900

    Hey guys i think maybe you guys dont drive good then cause i got a 06 altima s special edition with hitting right now 220,000 miles and ive had it brand new and only thing need to replace is oil, my struts and shocks (normal were and tear) and CV boot and breaks and tire road , I did replace the cat converter also around 190,000 miles and no problems car runs like a champ, this is a 2.5 not a mustang so must drive it like one and ive drove this care all over the United State from NC to NY to Florida to cali to utah this car had drove threw all weather conditions and is great car problems are usually the driver not the car , take better care of your car and it will last .

      hey omar, i think maybe you don’t know anything about how people drive their cars nor the problems they are experiencing. Save your judgements and assumptions about other people’s driving habits until you actually know them personally.

      Woo…. how lucky you can be my friend… that is a miracle. I own a 2006 nissan maxima with a lot of problems. I had been at the dealership for at least 10 times. electrical problems, transmition problems, etc. thanks God i had the extended warrantee, which just expired; i just had another problem which is on my own now.. this is been a very dissapointed experience with nissan. I really like my car but i guess is time for a change, but never Nissan again.
      I think this class action is honored by people like me… who actually live this problem.

        I am glad you say that. I am sick and tried of my 2005 Nissan Maxima. My car is doing the same thing, but i don’t have any warrantee. This is crazy why would a billion dollar company do something so crazy to build such nice cars and put a defected
        tranmission in them. I hope something is done about this before
        mine be sitting in the drive way broke and i have to pay a car note on a broke car.

          I have Nissan Maxima now transmission is gone need to replace it. Will never ever recommend this to any one. Stay away from everything that have NISSAN/INFINITI on. Can we have or hire some lawyer to sue them. I spent over 32K on this car now its doing nothing beside sitting on my drive way. car only have 71K miles. None I’ve talked to expected this kind of problem on new car while other gave ask me to tell them something new.

      You have to also understand this is for the altimas with the 3.5 liter engines. And I am a certified ASE. I was at a wits end with my maxima until I found a company that had s fix that was a great thing. After there kit the car has not one once of slippage and is better then day one. 5 spd auto is nice as long as it works. Do not talk bad about peoples driving because they might even drive better than you, and also know more on the issuse at hand then even nissan themselves.

          I used level ten transmission. Talk to pat tell him Steve thompson told yo to get a hold of him for information. They will help you out a fourth the cost for a perfect working tranny now shifts like a dream.

      I own a 2005 Altima SE/R and the transmission went out on it at 50,000 miles. i had a trans shop fix the transmission. they got the replacement parts from Nissan and repaired my trans. i drove it 1 1/2 years more and the transmission went out again with the same problem. the car now has 70,000 miles on it. Not only do their transmission have a defect but the replacement parts do as well. i hope Nissan has to repair our cars for free and return the money we paid for them. i could use the $36,000 dollars i paid for this piece o crap.

    My husband and I bought a 2004 Nissan Maxima and it is TRASH!! Transmission is horrible. When it gets hot it slams into gear extremly hard. The car is beautiful on the outside but a total mess under the hood. The mechanic at the dealership had the nerve to tell us that we were the first to ever complain because Nissan transmissions simply don’t go out. Really??? We will NEVER purchase another Nissan!!!

      Did your transmission go completely out??? I’m having the exact same issue now?? Please advise, were they able to repair that transmission or did you get a new one??? I also took my car to the dealership and they also denied any issues and now my car is getting worse.

        Jackie, I am having the same issues. I’m supposed to take my 2004 Nissan Maxima in to the dealership next Tuesday to look at it but I’ve seen lots of complaints that Nissan doesn’t do anything except tell you your transmission needs to be replaced. Did anyone do anything for you? I’ve loved my Maxima since the day I bought it but have been having transmission problems in the last few months.

    I bought a 2006 Niaan Maxima SE back in 2009. It was used and only had 11,000 miles on it. Today, 2012, I have only 78,000 miles on it now, which I’d like to consider as being “Not even broken in yet” as far as “ANY” vehicle goes in my mind and experience. However, I noticed over the past few months the transmission was acting up a bit. Started out as a slight slip and now its not only slipping, but it bucks, grinds, locks up and sometimes wont even go into drive!! And when it does it takes a few minutes. I’ve honestly never been more disgusted by any other vehicle in my life. This has been an absolute nightmare financially and I’d advise anyone looking into, or even thinking about buying a Maxima to take heed to theses posts 1st. Everything from one bumper to the next is a months salary gone if it fails. Headlights starting at $95 per bulb and there are X3 on either side!! Ive changed both sides once every year since I purchased this car. Tires.. dont even bother there… They start at about $5-600 each. So disappointed and wish I’d researched further before purchasing this car. Never again!!

      Funny, I bought an 05 in 2006 that had exactly 11k on it. My transmission started to slip at the low 60k miles. I raised my complaint to Nissan and they would do nothing for me. 3500.00 to repair a prematurely defunct transmission.

    I bought my wife Kelley a 2005 Altima in November 2004. This is our third car we bought from Nissan. About 2 weeks ago the transmission broke down and was needing replacement at 82,00 miles. The cost at Nissan service; somewhere betwen $500-$4,000, according to their ball park figure. They wanted me to pay for them to diagnose the problem. (ha ha ha) As if they did not know there is a defect among that year and make.
    To make a very long story short, we ended up getting an estimate from AAMCO, thay waived the $98 fee. The cost would have been $3500+taxes+rental for 7-10 days.
    Due to all that chaos i traded the Altima in and bought my wife another Nissan. Being under pressure for tranportation, i made a terrible decision i regret it. We got robbed on the trade in and i spoke to the Corporate office once, she treated me terrible. I am waiting for a call back from her Supervisor. If i am not treated properly, with respect i will dump this new Nissan and buy American Made like i should have to begin with…

    I have a 2005 Nissan Maxima SE with the same transmission problems i read here.Mr. transmission shop replaced my transmission for 3680 $ at only 91600 miles. It should be a recall or a reimbursement of replacement cost.When i changed my transmission there were two more nissan Maxima’s in the shop with the same problem.

    I have a 2004 Nissan Maxima with 60,000 miles. I should NOT be experiencing transmision troubles. I maintain regular maintenance on my vehicle and have always taken care of it. Nissan wants 5,000 to repair something that they knew was an issue. I personally know of someone who experienced the exact same issue with their 2004 Maxima. Omar, save it. You don’t know what you’re talking about and I can only assume you work for Nissan.

    Own a 2006 Maxima with 66,000 miles on it, in very good condition, have kept up all with all mainteance. Car is jerking, not accelerating properly, having delayed shifting, and the Nissan Dealership says that I need a new transmission that will cost $4400! Please help!!!

    Wish – oh how I wish – I had known of this. At 50K my Nissan transmission began a slight slip – at 80K it was a thump every now and then and would not do it (imagine that) when I took it for checking – until the transmission gave it up because they use aluminum (cheap) and it can’t stand heat – warps.
    I called the company and filed a formal complaint – for all the good that did – I wrote the government and posted furious blogs because I went to the dealership prior to the ultimate failure and they told me nothing was wrong. HOWEVER, the head of service told me they WERE aware of this problem but that Nissan was doing nothing for the customer until the transmission totally went and then only if under warranty. Well, read all over the net – there are hundreds (if not thousands) of complaints exactly as mine. Hope you stick it to them but good……
    I live in TN and almost went to their plant, parked my car, and spray painted “lemon” on the side. I was considering inviting every Nissan owner with the same problem with cheap transmissions to pick a day and join me in protest (I’m a child of the 60’s) . I will never…NEVER purchase another one. I’m getting a Toyota (REALLY want to buy American, but the quality is not what it used to be for the price ) . At least they stand up and say “I was wrong” (albiet forced).

    I am so mad. My Nissan Maxima started missing gears and I was afraid I was going to have a wreck. After almost running into the back of a car I called the Nissan dealership in Franklin where I bought it new in 2006 and ask if there were any issues with this on these cars and they told me No. Wel now $3200 later the transmission has been fixed but I have bought my first and last Nissan!!!

    I bought my 2005 Nissan Maxima brand new. I even bought an extended warranty. But, at roughtly 80,000 miles last December I experienced rough downshifting. It progressively got worse and worse. I feared for my safety in this car!! Ultimately, I had to have my transmission rebuilt at an expense of almost $3000. I, too, will never buy another Nissan.

      How can I get in on the class action lawsuit I bought my granddaughter a 2004 maxima and it is doing the same she hasnt had a heat off and on all winter her transmission jerks and gears so hard it scares me that she will wrecked the Nissan co told us it was her driving and not the car after I paid them 1200.00 dollars to fix it and they said it was fixed but it was nowhere near being fixed but I will never buy another Nissan.

    How can I get in on this class action lawsuit? I Bought a 2006 Nissan Maxima only had 300 miles on it. I took great care of my car and kept all dealership repair slips. Started having transmission problems at 120k miles. Transmission started having delayed shifting. Dealerahip was no help. I traded it due to transmission problems for a 2007 Nissan Maxima. Now this vehicle has 130k miles and having transmission problems.. WOW NISSAN!!

    I have 05 nissan altima and it jerks shifting from 1st to 2nd and when I put it into drive. It also flares up from shifting from 2nd to 3rd.

    We bought out our 2007 Nissan Quest about two years ago. Just finished rebuilding the transmission with 74,000 miles on for $4,100 out of pocket. We are determined to get our money back from Nissan!!!!!!!!!!!!!! We had done several other “big ” repairs such as replacing all engine mounts when we realized that the transmission was responsible for all the jerking, slipping and jumping during normal driving for no obvious reason. The car became life threatening when we were driving on the freeway at 70 miles/hour with two little kids and the transmission jumped into different gears, yanking the entire car multiple times with all of us in it. We called Nissan right away and got the “out of warranty” line a couple of times. Not trusting Nissan anymore, we asked our friends for recommendations of a reliable transmission shop. I am not even mentioning that the car rattles like a diesel and does not start all the time. We were in the shop several times with these complaints but the root cause of these problems were never found. Based on our experience, definitely no Nissan after we get rid of this car!

    My 2006 Nissan Maxima SE has the same issues as all of the other complaints. It slips, slams into gear, jerks, etc. I took it to two dealers that didn’t want it because of the transmission issues. I will NEVER buy another Nissan. I am mortified that Nissan will not admit their error and make it right.

    In the past I have only purchased Hondas and had great success with Hondas. My last Honda died at 303,000.

    I’m shock to hear about these problem. We have a 2005 Quest and it now need a new transmission. The sad part is from what I’m hearing Nissan is not doing anything to correct the situation. That is wrong!!!

      I wish I would have known about all this before I bought my wife’s 2005 Nissan Quest. Although we have not had any major issues with the vehicle but just last week the entire transmission had to be replaced, well is actually being replaced as we speak.

    Problems Nissan Altima special edition 2006 moter was replaced with a manufactured engine at 56,695 than I had to take it to another Nissan dealer because car wouldnt start sometimes just shut off at 69469 because they didnt replace sensors. now my car is getting hot I hate this car problems I going to take it back to Nissan to see what they are going to do. Do I need an attorney now car is jerking when I take off and Ive researched the web and found that im not the only one with this problem

    If any of you have not experienced this problem with your nissan altima 2.5 motor, just know it is coming .. My check engine light came on had them tell me what the code meant.. #3 cylinder misfire with blown head gasket. (this is actually my 3rd nissan and last one)
    Nisssan was aware of the problem with this 2.5 motor.
    so first transmission then motor gooo luck

      ok so my check engine came on and I was told its crank and cam sensors need to be changed. Did that Friday today check engine went on again and now they say its transmission. Also that I need some gasket changed. Does this sound correct?

I reached out to Nissan and once they discovered the depth of my transmission problems, I recieved no help. How can I get information on this lawsuit? Thanks

    I have a 2004 Nissan Maxima that is currently having the transmission rebuilt because of “hard jerking” when I shift from 1st through 3rd gears. I would like information on the lawsuit. This car/transmission is a huge safety concern and Nissan should issue a recall.

    greeeeeaaat!!!! my stomach is cringing right now!! This all confirms what the issue is with my 2004 Nissan maxima that i JUST bought on 8/31/12. Of course the gears werent slipping during the test drive but after signing the paper work and taking the car home “AS IS” only four day later after a big rain storm did I experiece the jerking and gear slipping that is being described by everyone. My fingers are crossed that it is somthing simple to be fixed but i’ll be damned if I pay $3,ooo+ to fix a car I just bought!! I’m so mad right now!

    Unfortunately I just bought a 2004 Nissan Maxima 9 days ago and I am now experiencing the hard jerking shift change. Just tonight, the AT CHECK light came on. I’m just sick. I owned a 2003 Maxima and loved it and didn’t have any problems with it. I have not heard anything about this very common problem, but I wish I had. There doesn’t seem to be much info on this class action law suit. But I will definitely be on the look out!

    I too had this issue – replaced the tranismission at 70k miles (2006 nissan maxima). The more people that call and document your case with a lawyer the better. You dont have to request to be a part of the lawsuit (you are automatically part of it as an owner). If you sell your car you are still able to benefit from a resolution should that ever take place. Documenting your case does not take long and will do us all some good. Please take the time to contact them at the site below. Also – call the BBB if you have to. With the number of problems, i cant see how they wont do something. – its just a matter of when

    Guys i have the same kind of issues with my 2004 nissan maxima transmission,i got it 2.5 years back when it was 50k i started getting 1st transmission problem about 60k ,dealer replaced some solenoid inside the transmission,all of sudden these days some times my car wont move in the Drive gear so i move it in 1st or 2nd then change it to Drive while moving ,not sure what’s wrong with this ,

    Ok guys. I have been having the same problems with my 2004 nissan maxima transmission jerking into gear when the car gets warmed up. Service Engene soon light came on yesterday car didn’t want to move manually put it down to drive manually and it said it was in 5th gear but it drove like it was in 1st. Called dealer took it in it drove fine to the dealer just very minor feel when shifting gears. they came back now i have to pay 3,900 for a new transmission. they said internal transmission failure. Car looks brand new on outside and within the last 6 months I have had all new tires, serpintine belts and tune up done on car. Oh, also they said I have to replace the timing chain assembly so I get my car back on Friday for a whoppig $5,400.25. The car only had 134,000 miles on it I have driven chevrolets over 200,000 with no problems. Guess I should have stayed with american made car.

    I bought a 2006 Nissan Maxima brand new. My car just barely hit 50,000 miles. My warranty expired in Feb of this year and I had my car at nissan for a good week so they could do a complete service work up before my warranty expired not even a month later my car starts jerking and coming to a stop sign it feels like it is slipping. It is very scarey I have three litte kids and their heads are whip lashed every time it jerks. I try not to even drive this car when I have my kids. So I took my car to Nissan and what do they say oh you need a new transmission and it is going to cost $3,600 estimate and I said oh that’s great say who will be paying for that. So I am very disappointed that this is a known problem and Nissan is not willing to help customers out. This is my second car that I have purchased from Nissan brand new and I have not had any problems till now and this is awful that they treat their customers this way knowing it is a problem.

    Yes this maxima are all defective. I rebuild my transmission at a coat of $3500 after it just stopped working and it still not working right. Took it to the nissan dealer and they said I need a new transmission after 3 months from the rebuild.

    I owned a 2002 maxima and loved it. It laster for ever. So I bought a 2004 Maxima. The car started jerking foward when downshifting a little bit. Over a few months it got worse and worse. Now it jerks like a bucking bronco and all the time. Its horrible. I regret ever buying this stupid piece of junk, I will never buy Nissan again after I got screwed so bad on this. I can’t believe there is no recall on this!

    My 2006 Nissan Maxima started having transmission problems at 53k! What a piece of junk! This is my 4 Nissan and never again! When I called the company, I was told that the car was 6 years old and they could not help me. It’s all a rip-off!

    I own a 2006 Nissan Maxima. I have never been as satified as I was with my 2002 Nissan Maxima. I tell have my 02 with no problems, but this 2006 transmission has had me on the edge with this car. It is in the shop now they are trying to find a rebuilt transmission for it. Nissan need to step up and take responsibility. I will never purchase another nissan or tell anyone they are good cars.

    Hi my 4th and last maxima, 2005 44,345 mile as of 11-14-12. as a prevention i had nissan change and flush fluid at 30,000 mi. Took a trip to NY and started with the bucking 1st to 2nd, P to D. Knew I was having a problem with tranny. Heard about the Trans-go. Kit, with labor under $600. and max is running better. Though holding my breath. I don’t drive fast, and change the fluids, other than syn. oil. at the dealer. told much of the tranny was under sized and of older parts, because they knew a change to CVT was coming. Bad nissan corp. you will pay

    I have a 2004 Nissan Maxima. It had 71,000 miles when I bought it. Started jerking hard from reverse to drive at about 90,000 miles. It seems to be worse when it gets hot. I can go for several days and nothing, then BAM it feels like I have been hit. Someone please do something!

    i have a 05 altima 2.5 with 139k on it it started jerking when it shifts from 1st to 2nd and then slips when shifting from 2nd to 3rd. i replaced the catalytic converter (the one in the header) about 5k ago. had a problem with it turning off going down the road for no reason and then it may or may not turn back on 5-10 min later. had that fixed about 10 months ago. i will never buy another nissan and i wont let a friend buy one either. i cant wait to see how much this tranny problem is gona cost.

    My 2006 Nissan Maxima was purchased brand new, has less than 100k miles and has been in three times for transmission repairs and still not resolved. The manager at the Transmission Repair Shop tells me he sees this problem quite often with the Nissan Maxima. This RIDICULOUS!!!

    My 2004 Maxima has been doing the Transmission SLAM for 2 years now. I’ve had it repaired at the Dealership twice for $400 each time. I got my car back from the second time “repairing” it, and within a week it started doing the same SLAM thing again. And, when I say SLAM, I mean it scares the sh*t out of me…feels like someone just rear-ended me. I have no clue why this continues to happen. So, now I have to have it repaired for the third time!!! It’s too bad, because my husband and I have purchased 4 Nissans in the past 15 years, but NEVER again will we RISK our hard earned money on a NISSAN!!!!!! I am so afraid everytime I have to drive. We “baby” that car by trying to be extra careful so that it won’t SLAM!! It seems to happen only after driving the car for about 20-30 minutes when going about 15 mph.

    In March of 2012, I paid Dick Smith Nissan $3,200 to rebuild my transmission. I was having problems for 2 years and after many consultations, I was told it was the transmission. I have been trying to file a complaint to Nissan but to no avail. I would very much like to be included in this class action lawsuit. I am still paying on this car and would like to be reimbursed for the trouble. I mean it is ONLY A 2005 and I started having problems with it 2010.

    I owned two Nissan Maximas. The first one I purchased is a 1996. This car has been great. It has 285,000 miles and has had no major issues, just minor things. I later purchased a 2006 Nissan Maxima. This car has been a night mare. I currently have 146, 000 miles and have been having major problems with my Transmission. The car started jerking foward when downshifting and jerkes when placing in reverse or drive. In addition, It slips and slams into gear. This car can be dangerous. I took it to a Nissan Dealership and they told me the car needs a new transmission which will cost about 4700. I also contacted the Nissan headquarters and try to get some assistance and nothing was done. They said they have a recall on CVT Transmissions but not the 5 speed automatic. Having being a part of the Nissan family for 16 years, I am very disappointed that Nissan did not do a recall on the 5 speed automatic Transmissions. I will never buy another Nissan again.

I too have a 2005 Nissan Quest I am now on my second transmission problem replacement day should at least paid for some expenses not all since they know the problem! all of us should go into the National Highway Safety website and put our complains for a reason call. All complaints need to be reported to NHTSA as safety complaints and not about the money to push for a recall. If you check the page above you’ll see the components to file a complaint about; they are the ones that are being tracked. One lawsuit was settled but all Nissan is doing is covering a certain amount depending on the mileage and the owners are still stuck with a huge co-pay. This does not take care of the real problem, which is a very poorly run company that has no loyalty or concerned about their customers’ safety.

    I have a 2005 Nissan quest. I’ve had nothing but problems with it since day one. I purchased this van brand new. When it turned 60000 miles I started noticed that it started to slip in 3rd gear. Now it has a little over 63000 miles and every gear slips and 3rd gear shifts so violently, it thrust the whole car foreward. Nissan is a terrible company that makes terrible cars and I can’t wait.to get rid of this POS. Even the gold warranty is worthless. Nissan will simply say that the car is fine to avoid honoring the warranty. This happened to me on more than one occasion and. More than one dealer. It really seems its their policy to mistreat and swindle their customers. do not buy Nissan! If you already did, sorry.

    My 2006 Nissan Maxima is my retirement car. I have had so many problems with the changing of the headlights at $95.00 a piece,I took my car in for this slipping out of gear, locking up on me,jerking and slipping all the way to work.I took my car in for this problem and they told me my right front motor mount has to be replaced. I had this replaced and in August it started again. I had no warranty and no money to have this done again. So I parked it for a while and my son drove me wherever I needed to go in his car. I had too many close calls
    by other cars on my bumper and I could not go fast enough to get out of there way.In october it hesitated just a little and now that I have to go to work in it I just pray and keep going.The problem wasn’t the motor mount but the transmission.When I heared about this class action suit I was just floored, to think that Nissan has not recalled this car, knowing about these problems.They knew these cars had faulty
    Transmissions put in them.I will never by another car from them.

    I JUST today bought this car and then it started jerking when I got home. I got screwed at the dealer and I tried to complain and ask them why they sold me a faulty car and they said It’s a typical problem all car’s experience at some point or another and they can not be held responsible for every repair my car will ever need. Too many people have this issue. I am 5 months pregnant and thought I spent my savings on a reliable dependable car. Now I have a broken new car and I certainly don’t have $4-5,000 to fix it. How can they get away with treating people this way. Don’t they care that they have knowingly endangered peoples lives? Was my $10 grand THAT important to you that you would sell a broken car to a pregnant woman?!

    I spent 3,400 on my 04 Maxima. It had a design flaw in the valve body and a bad transmission. The car would over jerk when accelerating the RPM would go in the RED–there have been several dangerous experiances I have encountered with my Maxima. Nissan will not back their product why? I guess they want to stay FAT and have their customers to continue to have OUT-OF-POCKET experiences. Somebody let somebody know we shoud not have NISSAN dictate to us about all these problems they know and do not want to back up we all are out of money. Where is the honor system from this corporation.

    I took my 2004 Maxima to a transmission shop that insisted they could repair the VALVE BODY !!! what a JOKE! $1700 later, I still have the SAME hard shift and JERK that I had $1700 ago! My only alternative was to let Nissan put a new $4000 transmission in at only 120,000 miles. Nissan Sucks! I’ll never invest with Nissan again! What a shame that they have so many unsatisfied customers and are not willing to do a thing about it!! I’ve tried to find information on the class action lawsuit but don’t seem to be getting where I need to be to add my name as this is highway robbery! They need to be stopped! LET’S STAND TOGETHER AND STOP THEM!

    Same shit… my 2004 Nissian Maxima is fucked up and I made a formal complaint with Nissian Manufacturer. The dealer wanted me to replce my cad converters and put in a rebuilt tranny …. the car isn’t even worth the charge! These cars were known to have problems before they even sold them check out Ntb04-035 technical service bulletin 3/10/2004.

    My 2004 Maxima is in the shop now getting a new transmission. It has 109,000 miles and has been a money pit. We purchased the top of the line maxima and it was wonderful for about the first five years but after that we average 5k a year in repairs.

    I also have a 2006 maxima I had the same issues with the transmission slipping jerking I took it back to the dealer at 30,000 they said I dont see nothing wrong they changed the motor mounts, its been a nightmare with this car i bought this car in 2005 right now I have only 68,000 miles on it, I have the paint fading which I always kept my car in a garage i see the same with other nissans is their a paint class action.     Mechanics will always say its the motor mounts to get extra money out of you. When you come back a second third or fourth time they’ll finally get around to saying you need a new transmission. I bought my car under warranty from Carmax in 2009. It began acting up 2010. I took it back to Carmax and they said it was the motor mounts and fixed those, but not the jerking. So I took it to Ammco the so called transmission experts, and they could find nothing wrong but did fix the front struts and changed the transmission fluid, but did not fix the problem. Even more frustrated I took the car to the Nissan dealership, and they said the transmission was burned out. The sad thing is that all this happened within a three week span. Carmax, Ammco knew about this car. The dealership knew as well because they put a used transmission in the car which lasted me until yesterday. THEY ALL KNOW THESE CARS HAVE TRANNY ISSUES BUT THEY’LL ALWAYS TRY TO MAKE MONEY FROM YOU BUY FIXING OTHER THINGS FIRST THAT ARE DEFECTIVE ON THIS CAR. IT’S A MONEY PIT!!!!!.

    I bought my 2005 Nissan Altima in Sept of 2004. I have 165000 miles on my car and with in just a few months the transmission started acting up while turning corners like it couldn’t figure out which gear it should be in. Took back to dealer couldn’t get it to act up for them. Then after a couple of years the jerking from 1st to 2nd gear started. After reading about people putting alot of money into the car and not getting it fixed I’m just living with it. If this problem was happening while test driving the car no way anybody would buy it. Nissan should be looking into this and fixing the issue.

    I started noticing transmission issues in October 2011. I took the car to Nisaan service center but they couldn’t diagnose it and each time I had to pay them $400-$500 for some unrelated issues. I finally took the car to AAMCo and they diagnosed transmission failure. I paid from my pocket close to $4000 to replace the transmission. The car had close to 85K miles when transmission failed.

    We took our car into the dealer at least 8 times. These clowns just shake their heads like they have NO IDEA what is going on. “couldn’t duplicate,” “needs fluid,” “no issues detected,” were all the crap explanations we were given WHILE the vehicle was under warranty. They could have fixed this car long before our warranty ran out but instead they played games and kicked the can down the road. Now, today, the car has been sitting in our driveway for 1 year. These issues started at 65k miles and there is no way a transmission should blow in that time period.

    It is my firm belief that they never recalled these vehicles b/c the transmission most commonly acts up while slowing down and speeding up, or coming to a stop, or just getting started, and as such posed little risk for personal injury. If people were crashing their vehicles into pedestrians, or better yet vehicles on the lot at the local Nissan Dealerships everytime they took their cars in with this issue then we may have some action from Nissan. To say i’ll never buy Nissan again is a joke. I will activly sell away from them for the rest of my natural life (my after-life will be busy with other things).

    I can’t believe the U.S. trade commision has not stepped in on this. There is NO OTHER car defect impacting more people than this one. Original estimates based on warranty claims and repair shop reports indicate more than 30% of the Nissans sold with this transmission have incident.

    Saying there were 3-4 in the shop each time we visit would be an gross understatement.

    Shame on Nissan, and shame on me for trusting they would handle their business professionally.

    I had the same issue with my 2004 maxima and had the transmission replaced at 100K miles. Now Here I have a 2006 Nissan Quest with 103k miles on it and the transmission slips, jerks and sometimes just stays in one gear. It started around 75k miles and my local dealer knows all about it. I paid 41k for the quest brand new and drove it right out of the showroom and to hear them tell me there’s nothing they can do makes me not want to buy another Nissan.
    How can I get on this law suit also?

    I purchased a 2004 Nissan Maxima SL it’s a beautiful car besides the fact that it too has a very serious shifting problem that Nissan is well aware of. I had it in the shop two different times for the same problem and it still hasn’t been fixed. Both times Nissan replaced parts saying it would fix the problem which it did not. I took it to a local mechanic and he diagnosed the real problems and tried to talk with Nissan about getting it taken care of and they refused. So I would like to file s complaint and become s part of the class action law suite against Nissan . Please if you could get back to me and assist me in trying to do so.

    I purchased a 2006 Maxima and I began experiencing the same problems at about 76K miles. Took in it to the dealership to have it checked and they didn’t acknowledge being aware of any transmission defects previously. Actually, they recommended a flush/service and said that “it may resolve my issue, but there was no guarantee”. As soon as I got back in the car, it was back to the same routine of slipping, jerking and hesitating. Any information on how I too could get involved with this case and release any updates on it thus far would be appreciated.

Took it to the dealership to have it checked out, didnt acknowledge the problem.Then I took my car to Cottman Transmission they told me that the transmission was bad. So I had a new transmission put in and at a 122k transmission started slipping and jerking again and hesitating again. please help.

    Purchased my 2007 SL and the whining sounds started around 45-50k (right out of warranty) and has steadily increased – now that I’m at 85k.. its so pronounced family members always ask me whats wrong with it! You cant even talk/hear inside the cab its so loud – radio has to go up.. at slow speeds it does buck once in a while in and out of gear – my wife drives like n 80 year old lady so i know its not her racing it down the street. This will be gone this weekend.. with 3 kids i don’t have the $4k to fix it. I feel sorry for the next person that gets this thing.

    Purchased 2004 Nissan Maxima – what a nightmare! Transmission is jerking slipping , when accelerating the RPM would go in the RED and the car would only get to 20-40 mph. I was told it was a sensor so I replaced that for $800.00 which did not fix my problem. I would not recommend purchasing a Nissan Maxima. I think Nissan should do the right thing and back their product.

    I bought a 2005 Maxima three years ago in 2011. About a week after I bought it, the transmission started acting up really bad. It jerked so hard I thought I was going to get whiplash. It was scary to drive because I had to brace myself every time it switched gears. I had the transmission rebuilt for $3000. After two years it’s starting to act up again but a little differently. Now if I am in stop and go traffic for any length of time the car jerks upon stopping and going. At stop signs or red lights it just creeps when I get ready to go. Finally it will kick in but it’s not safe trying to take off from stopping in a busy intersection. It’s like it gets too hot and confused on what gear it should be in after all the stopping and going. Once it sits for awhile then it’s fine, unless there’s more stop and go traffic. Whenever possible, I purposely take routes that won’t have bad traffic. I avoid major highways because on the Dallas area, all the major highways are always backed up. I take the rural routes on my commute to and from work. I shouldn’t have to do that but I cannot take the risk of completely tearing up my car.

    I own a 2006 Maxima that has 76000 miles on it. When driving at 20 MPH the car rev’s up and kicks into gear. It makes the car jump forward. It isn’t giving any codes at the dealership but the mechanic rode with me and hooked the computer up. The car continuously did its thing and the codes still wouldn’t show up. They have determined that it has to have a new transmission at a tune of $4000!! I don’t have a choice as this will be my daughters car and its much too dangerous as it stalls for a second before kicking forward. Its an accident waiting to happen. Nissan is refusing to give me any assistance. I have called twice pleading for any help. Not only did they say no but they are RUDE!
