Mother & Daughter File Class Action Lawsuit Complaint Against McDonald’s Over Alleged Unfair, Unlawful, Deceptive and Fraudulent Advertising Of McDonald’s Happy Meals With Toys To Young California Children.
A class action lawsuit has been filed against McDonald’s Corporation and McDonald’s USA, LLC (collectively “McDonald’s” or “Defendants”) in the Superior Court of The State of California for the County of San Francisco (styled Monet Parham and Maya Parham v. McDonald’s Corporation and McDonald’s USA, LLC), alleging, among other things, that McDonald’s exploits young California children and harms their health by advertising unhealthy Happy Meals with toys directly to them since children eight years old and younger allegedly do not have the cognitive skills and the developmental maturity to understand the persuasive intent of marketing and advertising, according to the McDonald’s Happy Meal class action lawsuit complaint.
The McDonald’s Happy Meal class action lawsuit complaint is reportedly brought on behalf of the following putative classes of persons, unless otherwise excluded:
All California children under the age of eight who have seen marketing for Happy Meals during the “Class Period” (“Children Class”).
All California residents who are parents of members of the Children Class and purchased Happy Meals during the Class Period (“Parents Class”).
The McDonald’s Happy Meal class action lawsuit complaint reportedly asserts claims for violation of California Unfair Competition Law, California Business and Professions Code § 17200, and the Consumer Legal Remedies Act California Civil Code § 1750, and reportedly seeks to enjoin McDonald’s from continuing to advertise Happy Meals to California children featuring toys.
