Honda Civic Owner Files Class Action Lawsuit Complaint Against Honda Over Allegedly Defective Front Brake Pads.

A class action lawsuit has been filed against American Honda Motor Co., Inc. (“Honda Motor” or “Honda” or “Defendant”) in the United States District Court for the Central District of California (styled Rivella Dunner v. American Honda Motor Co., Inc., Class Action Case No. CV11-01181 SJO), alleging, among other things, that the Honda braking system installed in the 2008, 2009 and 2010 Honda Civic vehicles suffers from a defect that causes the Honda Civic’s front brake pads to wear out prematurely and require replacement approximately every 10,000 to 15,000 miles, according to the Honda Civic front brake pad class action lawsuit complaint.

The Honda Civic front brake pad class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of the following persons, unless otherwise excluded:

All (i) current owners or lesees of a 2008, 2009 and 2010 Honda Civic; and (ii) former owners or lesees of a 2008, 2009 and 2010 Honda Civic who paid for a repair related to the Braking System (the “Class”).

The Honda Braking System reportedly consists of braking components (rotors, calipers, master cylinder and brake pads), an Electronic Brake Distribution system, a Vehicle Stability Assist system, a Brake assist system and an anti-lock braking system.

The Honda Civic front brake pad class action lawsuit complaint reportedly asserts claims for alleged violations of the California Consumer Legal Remedies Act, California Unfair Competition Law UCL, Magnuson-Moss Warranty Act, breach of express warranty and breach of implied warranty.

    I purchased the 2010 honda civic for my daughter for her safety on the road. I thought this would be reliable and safe this car. Shocked that my daughter told me that the car was making a strange sound. Brought it to the dealer then they inform me that it needs breaks at 7500 miles………is that a joke. They told me it was aggressive driving, I had to laugh. Honda needs to stand behind their cars and solve their problems to make the consumers happy. My daughter is NOT safe driving a car with break problems. There are so many complaints……….now they want me to pay to repair their screw up!!! Honda you need to admit and deal with the break issues before there is a tragedy!!!!

    I my self just recently took my car in for the same problem I currently have about 22,000 of my car and now my front break pads need to be replaced which I think is ridiculous. Breaks do no wear out that quickly, and I was also told that it was due to aggressive driving. I work in the evening and do not have to deal with a lot of rush hour stop and go traffic. I believe that it should be a recall before even more consumers began to complain.

      join in on the class action lawsuit. This is not good or fair for us having to replace brakes this often. The bad part is the noise is loud. I am joing the lawsuit.

    I have just bought a 2009 honda civic, and have less than 60,000 miles on it. I have had it for one year, and all of a sudden my brakes started to make this loud squeeling noise. It is the worst noise. I have owned more than 20 cars and I know how brake indicators sound, this is worst. It is loud and very embarrasing. I am so glad to see that I thought this was more than just pads needing to be replaced. I thought something major was wrong, and here it is. I will join in on this lawsuit.

    Linda, consider yourself lucky. I have had 3 sets of brake pads on my 2009 Civic in under 60k miles + 2 sets of rotors. I have had nothing but issues with this Civic. A/C has gone out, 3 of 4 door locks gone out, warping tires, LOUD road noises. Worst car I have ever owned in my life. I can’t even count the dollars I have spent on repairs.

    I purchased a 2010 Honda Civic approximately one year ago and with an elapsed mileage of 15,900 the front brake pads required replacement.
    The dealership replaced the pads at no charge, as a “goodwill one time replacement”.
    This is the 4th Honda that I have owned and I still own a 1999 Honda Accord that did not require the brake pad replacement until it had over 60.000 miles on it.
    I work for a State Department that regulates the Automotive Repair Industry and I am an ASE Certified Technician. I can tell you that replacing the front brake pads at 15,900 miles under normal driving conditions is just not right and is obviously a defect in design. Well after all these years of owning a Honda and considering them at their cost one of the most reliable best built vehicles, I will now have to reconsider my view.

      I had EXACTLY the same issue…15800 miles and needed the same service. The dealership refused to fix it stating they cannot give me preferential treatment since lawsuits are going on.

    I brought a 2009 Honda Civic for my son. at 12,000 miles the brake started to shake and make loud squeeling noise. Took the car in and was informed that it is normal wear and tear! They replaced the pads and resurfaced the rotors. I did some research in the internet turned out that there are hundreds complains already. I called Honda Headquarter filed a claim and was reimbursed for the cost. I was told that this is a onetime good faith gesture in Honda’s part…….give me a break, this is a factory defect for the minimum and they are putting my son’s safety in jeopardy!
    Now, at 20,587 miles, less than 8,000 miles later the brakes started shaking and making loud sounds again. Took the car in today and was told that they need to replace the pads and ROTORS! I have to get it fix or my son won’t have car to go back to college! The cost is $469! Well, I certainly had enough with that………I’m taking this to Small Claims Court! I can’t wait for the Class Action Suit, it could gone for years before settlements! Honda knew they have a defect but like all BIG corporations……they’ll deny….deny….. and stone wall you to dead before finally settle it!

      How do you join the lawsuit, check out my comment as to what happened to me…SAME THING! I’ve had my Honda for 5 years and I’m going on my SIXTH brake replacement. My car just hit 70,000 miles.

    Please include 2011 Honda Civics! Just repaired my brakes at 15,333 and I’m only in my 1st year of lease. The service manager drilled me about driving aggressively and hitting my brakes too much.

    I have a 2009 Honda Civic 51,000 miles. Break pads, and rotors resurfaced 4 times as of today! I am very angry. This is my 3rd Honda, and have never had this problem till now. I will never buy another Honda, ever!!!

    HOW DO I JOIN TH IS LAWSUIT TOO? I’VE HAD TO CHANGE MY BREAKS GOING ON 3 TIMES. I HAVE AN 09 CIVIC. YOU TAKE IT TO THE DEALER AND THEY SAYS ITS NOT COVERED BECAUSE ITS CONSIDERED WEAR AND TEAR. I’M AT LOSS. I DON’T KNOW WHAT TO DO ANYMORE.

    Thank god my friend showed me this article – now I KNOW I am not alone!

    I purchased a 2008 Honda Civic LX April 2008 in Tysons Corner, VA.

    Brake replacement #1: April 2009, at 17,838 miles (I did a lot of driving back and forth from VA to Pittsburgh, PA). I didn’t go to a Honda dealer, but to Sears Auto Center. I moved back to Pittsburgh that month.

    Brake replacement #2: May 2010 at 28,695 miles (also replaced at Sears Auto Center). Along with replacement #2, I also had to get new front rotors…at 28,695 miles….is this normal!?

    Brake replacement #3: August 2011 at 44,557 miles (this time I went to my local Honda dealer). They also resurfaced my rotors.

    Brake replacement #4: April 2012 at 54,034 miles (this time I also went to my local Honda dealer). They also resurfaced my rotors.

    Brake replacement #5: October 2012 at 61,773 miles (this time I also went to my local Honda dealer). They also resurfaced my rotors.

    The brakes from Sears lasted 1 year, the brakes from Honda, 6 months. In the past YEAR AND A HALF, I have had to get my front brakes replaced, THREE TIMES, about to be FOUR because I need new brakes, AGAIN! This time I am buying the parts myself and taking them to a friends mechanic shop. We’ll see how long these ones last.

    I’m really anxious as to see how this lawsuit turned out. You take your car to the Honda dealer and they say it’s due to heavy driving or your braking patters….BULL CRAP. The fact that alllllllll of these people on this forum have the same problem is a little suspicious, don’t you think?! It’s ashame because I’ve never had any other problems with my Honda (knock on wood), and I love it. I just wish their Customer Service was reputable!

    Please don’t think that the problem with your civics is in America only. I live in New Zealand and own a low mileage 2008 model and am having all of the same brake problems listed. Honda NZ agent has suggested using lower gears instead of braking to help alleviate the problem! What is the progress/result of the class action by Rivella Dunner? Can anyone please tell me?

    2013 Honda Civic EX

    I bought my 2013 civic off the showroom floor. At 13,985 miles, it started having a shake and surge when I went to stop. I took it to the dealership in meridian ms and the service manager said they had to replace both front rotors. Ten thousand miles later, 23,973 miles, I began having the same problem. I returned to the same dealership and this time, the manager said they was able to turn both front rotors. Just as my civic approached the factory warranty, same problem began for the third time. I wasn’t able to get to the dealership before the warranty expired so I’m now at pep boys in Huntsville Alabama having both front rotors and pads replaced. I just called my dealership to get my history of the problems and was advised by the same service manager that the dealership never “replaced” the rotors; instead, the first time they “resurfaced” both front rotors and the second time they “turned” both rotors. Is it safe and normal for a dealership to perform such repairs on a vehicle with less than 24,000 miles. I think not

    I purchased a new Honda Civic 2010 towards the end of 2010. I had to get my brake pads replaced in 2/2012 with 29000 miles. My brake pads are again needing replaced at 54000 miles. I’m a single parent and can’t afford to pay $250 every 2 years for vehicle repair; the reason I purchased a new car!! My love for the Honda brand is gone. I will go with Toyota from here on out!

      I have a 2009 Honda Civic LX and have just changed my front brake pads at 42,974 miles. First of all I am very light on my brakes, the pads could go another 10,000 miles. BUT I am here to state my observations. The front pads when removed and examined had angles to them, pads forced into rotors on a slight angle. Next Im seeing the rear brake SHOES not pads have almost no wear on them, making me believe they are not contributing any braking force, which makes the front ones take all the brunt.
