Honda Accord owners and lessees file class action lawsuit complaint against Honda over alleged defect in Honda Accord’s engine piston ring or valve guide seal that allegedly can cause oil to enter engine combustion chamber and lead to excessive oil consumption.
A class action lawsuit has reportedly been filed against American Honda Motor Co., Inc. (“American Honda” or “Honda” or “Defendant”) in the United States District Court for the Northern District of California (styled Alex Soto and Vince Eagen v. American Honda Motor, Co., Inc. , Class Action Case. No 1:12-cv-1377) alleging, among other things, that 2008, 2009 and 2010 Honda Accord vehicles suffer from a design defect that enables oil to enter into the engine’s combustion chamber, causing excessive oil consumption, premature spark plug degradation and engine malfunction, according to the Honda Accord engine combustion chamber and oil consumption class action lawsuit complaint.
Plaintiffs bring the Honda class action lawsuit on behalf of themselves and a class of persons defined as follows:
All (i) current owners and lessees of a 2008, 2009 or 2010 Honda Accord vehicles; and (ii) former owners or lessees of a 2008, 2009 or 2010 Honda Accord vehicles, who paid for a repair related to the defect or for oil replacements beyond what a reasonable consumer would expect.
The Honda Accord Engine Piston Ring or Valve Guide Seal & Engine Combustion Chamber Oil Consumption class action lawsuit complaint reportedly asserts claims for, among other things, Consumer Legal Remedies Act, Unfair Competition Law, Magnuson-Moss Warranty Act and breach of express warranty.

I have Honda Accord 2004, I think this problem is extende to this model. Since I bought it I never reached an inttended miles after oil change.

will not retun as a customer. My 2008 burns an enormous amount of oil.

How do I get in on this suit? My 2009 accord goes through almost two quarts every 1000 miles. Firs the dealer said this is normal! Then they said they had to reprogram something. Then I got a recall in late 2011. Brought it in. Same problem. This is absurd. Back to toyota forever after this box. Don’t know why I ever switched. How can I get in on this lawsuit?
My 2008 Accord has the same problem. I am a long time honda owner and believer until now. This car has just not lived up to any of my expectations for quality, reliability or cost of ownership. I had to replace the rear brakes at 26,000 mi. ($1,000 job with some other repairs), then the rear brakes again at 46,000 when they admitted that there was an issue…but I still had to pay again. Myriads of other issues and annoiances: Head lights blinking when the AC comes on, steering tracking is poor, on an on…
Now the excessive oil consumption which I noticed at about 40,000 miles. The honda dealer told me: :we can check the consumption for you, but Honda will not acknowledge an excessive consumption unless it’s 1 quart for 750 miles or less. Seriously? All of my other Hondas wouldn’t burn that much oil with more than 300,000 miles on them.
Very disappointed…but I guess if they proceed in this way, they can go the way of Ford in the 80’s. I guess my next car will be a Toyota
Just had my 08 Accord back to the dealer after the recall noise was back. Was told the car was 2-3 qts low and the oil indicator says I have 60% oil life left. Car is about at 30k miles. Disappointing to say the least Hinda calls this normal oil consumption?

I got interested on your reply regarding the recall noise. What is it about? I did not receive any recall notice regrading this. I noticed a fluterring noise on my 2009 Acoord LX-P coming from the front when I am driving on the freeway once I get to over 40 mph.

I just purchased my 2008 Honda Accord EX-L, thought I was buying the BEST of the BEST. Car has been in the shop since Monday, 2 recalls from 08/2011 were just done last week, and now it is in the shop for the VTR, I have had the car for a week and 2nd week its in the shop for the full week. I used 10% of the oil in a week, 200 miles. Honda has really lost its touch. I am under the 30 day warranty so it is to be covered by the dealer in which I purchased, however, I am dreading the life of having the car because of all the stories I am seeing. Definitely feel swindled and unsure of the future with Honda. Would love to know how to join the class action law suit. Any information, please respond. Thanks!
I just had this happen to me. Had my oil changed at Honda on April 11, 2012 and June 5 I had to pull over because my car went to safe mode and engine light came on. It felt like it was missing couldn’t go over 25 mph! Pulled off the road and my husband checked the oil stick and there wasn’t a drop on it! The car never gave a single sign of any malfunction until it went into fail safe mode! Had it towed to honda and they told me that two spark plugs had broken and it was my fault do to poor maintenance! Since it’s still at Honda he told me it wasnt there fault so I owed 310.00 and Fidelity nationwide warranty said they font pay for spark plugs. I don’t think spark plugs just break! An opinion from an expert would be greatly appreciated!!

Thought it was a fluke at first, but now it’s a quart of oil every 1,000 miles on my 2009 Honda Accord. I get the oil changed every 3,000 miles and still have this problem. I’m always 3 quarts low at the oil change if I don’t keep on top of it. I see that Honda is responding the same way as when my rear brakes wore out at 14,000 miles. Yeah, “this is normal”…I don’t think so. Last Honda ever.

I am glad I found this websight. My 2009 Accord has been having the same oil problem. I took it back 3 weeks after I bought it for a
VTC Acctuator recall supposedly to help regulate oil flow. That’s when they told me I didn’t have any oil on the dipstick. 1 month later a noice again checked my oil, again none on the dipstick! 1 week before this my oil was full!! I had driven maybe 500 miles from when it was full. I am supposed to go in every 1000 miles to let them check my oil level but I have to check it everyday just to make sure it still has some in it! And Honda keeps trying to tell me this is normal! I am contacting my own attorney about this. Honda sold me a Lemon! I suggest everyone with this problem at least go for a free consult with a lawyer!
This is what my car is in the shor for now. I have only had the vehicle for (in my poessesion) for a week, the second week, car has been with the dealer all week, the dealer I purchased from heard the grinding noise on Monday and the Honda dealer has had the car since Tuesday and as of today they hear the noise, the shop guy told me that until they hear the noise there is nothing they can do. I am LIVID at this point. Honda needs to do better. The resolution for this should be that the problem is fixed permanently on their thousands (which is what it will end up costing the consumer).
I am certainly willing to provide information to support this class action lawsuit. I have a 2008 Accord that has been using excessive oil since its purchase (just slightly less than the 1 qt per 1000 mile limit that Honda deems “normal” usage). I’ve had an oil study done by Honda, consisting of several visits to the dealership to record my mileage and oil consumption. I believe I have some of the documentation and the Honda dealership should as well. This has been extremely costly for me because I drive 90 miles round trip a day for work, in addition to this being the primary car used for weekend and long trip driving. My car mileage is currently in excess of 115,000 miles. I’ll let you do the math on the oil usage and cost over a 4 1/2 year period and try to tell me that’s “normal”. The engine is just beginning to sound “different”, which I assume bodes for costly repairs related to this problem. I had hoped to keep this car as long as other Hondas that I’ve owned (upwards of 300,000 miles), but I am gravely concerned about the costs of doing so. I also have a conscience about passing along this problem by attempting to sell the car, if it would even be possible to sell this car with this defect now that a class action suit has been filed.

My family loyalty to Honda is three honda’s; one civic hatchback and two accords. My 2008 honda accord is a lemon. My husband and I were driving about 45-50 mph and suddenly slow down and came to a halting stop. The dealership is pretending not know the problem but want permission to take the engine apart with a fee of $575 diagnostic test. Though, Honda Accord 2008 has had numerous recalls from break pads, oil consumption, and engine issues, Honda Corporate takes no responsibilty. Why should I pay anything for a car with numerous recalls and complaints. Are there any other complaints about this issue that will help me.

I have the same problem. My car has 94k miles on it and at about 80k, my car started eating oil. I have no leaks and didn’t realize the pattern until yesterday when my oil light came on. In July I had $2200 work done on my car involving my clutch and a few other things. Here it is Oct. 3 and my car has no oil in it. Husband checked it and it didn’t show up on the stick. Have not been to dealer yet about this but intend on bringing it in next week.

I was told my 2008 accord needs a new short block, after threatening a lawyer. Now you are saying your car has had it done and still having oil consumption problems. Now I am really leary of any resolution to this problem.

I am beyond disappointed with my 08 Accord. I have this issue and other brake issues as well, and have had the experience at the dealership already where they won’t acknowledge a defect in their product and try to put the repair cost on the customer. Shame on Honda, I will not be a repeat customer, and will not advise any other person to buy their products. What else can I do? Hopefully this bad business practice will become apparent soon in their bottom line.
I’ve been a proud Honda owner for 25 years. This week, I’ve had my 08 Accord towed 2x due to a burned out #3 spark plug and computer upgrade. I’m down $350, 2 towing costs, 2-1/2 days of work and worst of all my Honda pride is fading. Wow that’s hard to say out loud.

Same issue with our 2008 Accord EX. It consumes a quart of oil every thousand miles or less. It also makes a grinding/clicking noise when you start the engine. Bringing a copy of this to the dealer, as we’ve been debating replacing the short block.
Same issue here on Accord 2010. When I took the vehicle in for service I raised the complaint and when the service manager told me 1qt per 1000 miles was normal I could have smacked him in the face! I have owned 4 previous Hondas with no such issue. I have a ME degree with Automotive specialty. The Service manager was talking to me like I was some sort of idiot. Very smug. He seems to take the offensive in the conversation. Really make me feel like crap for buying the car. There has to be a cover-up. What mechanic worth his salt will tell you 1qt of oil per 1000 miles is very normal. Makes me cringe. Had to have back plug replace from fouling at 37k miles.
I am on oil consumption test and every week or so I go in to get my oil topped off and recorded on their dime. Yes it is inconvenient for me, but I sure to get them riled up ever time I go in! If your car is using oil, make them top it off and bitch every time you’re there!!

Went to 5 different dealers, did 5 oil consumption tests that they consider normal. 1 qt per 1000 miles, what a joke! why dont they advertise that in their commercials? My 2010 Honda Accord is also burning oil. It has been to the dealer three times in 6 months. The first visit they replaced 3 spark plugs for miss-firing. I was told the oil usage is normal.
Second visit they replaced all six spark plugs and did the manufacturer update to the computer to correct the problem. The third visit they are waiting for approval from Honda to replace the short block.
I purchased a pre-owned Honda from them to avoid these issues and for the Honda reliability. The only reliability I’ve received is, the dealer sees me every few months with issues.
2010 6cyl 16k miles – Burns 1 quart every 500 miles. Honda is giving everyone the run-around on this. There is no simple way to fix/adjust this. When an engines burn oil, it is shot and replacement is the only solution. Replacing the short block leaves clogged O2 sensors, catalytic converter and other latent defects that will surface later. Engine replacement shows up on Carfax report and diminished the resale value. Savy buyers will never buy a used car with an engine replacement record. Honda dealers are the worst and are knowingly reselling these lemons on their used car lots too. This problems is thruout the Honda product line. About 1 in 5 cars. 80% are totaly uneffected, but you will not know until you drive for a few thousand miles. Honda does not honor the warrantys on new or used cars. Buyers beware! This defect exists in over 1 million Honda vehicles.

Like the rest of you, my 2009 Accord is burning oil like it burns gas. At first the dealer says its normal to burn 1 qt in 2000 miles or more. A year later, they change it to 1qt in 1000 miles or more. How can Honda keep changing when they offer warranty repairs and call that fair?!?! Feels like Honda is just trying to cover this up so they can up their quarterly earnings. I’ve already started a claim with my state’s Attorney General and will elevate it if needed (don’t bother with BBB…they’re useless when Honda continues to claim this is normal). The way Honda is treating its customers, you can probably target the individual dealers with lawsuits and Honda of America will probably cut them loose and distance themselves to cover their own arse.
I have a 2008 identical problem and they will do nothing about it. When new this car burned less than a quart every 8k miles now one quart every 1300 miles. The say I have to bring car in 3 time at set intervals for them to verify it but if confirmed will not commit to fixing anything. It obviously can’t be ultra low emission engine burning this much oil. How does anyone pass an emissions test? I suggest we all go and demand an emissions test and also complain to EPA. I found this tonight as I sit here trying to decide if I should sell my car or what?? Found out my car had this issue as well. It was “fixed” prior to my buying it from a large Honda dealer in Birmingham AL. I had an oil change recently where they broke something and the oil poured out as I drive down the road. Since I have heard tapping/rattling sounds. Dealer is saying this was caused by this oil usage recall not them…BS or not?? I can’t believe this continues to go on and on and everybody being told the same thing and there is still nothing we can do or they have to do about it!! I have a 2010 V6 EX-L Accord and staring telling them about the “bluish-tint” puffs of smoke coming from my car 3 months after purchasing my car. “That is normal for a new car” they kept telling me. Then they started telling me 1 quart every 1,000 miles is normal for ANY car. They said Honda has that in my book and to “read my car book”. The best is my dealership told me “they have never heard of this problem before” even the sales manage told me “this is the first I am honestly hearing about this issue” !!! Imaging, what did he think I am stupid!! No more honda’s for me and I want to be in this class action lawsuit. I just got back from the dealer. They are now telling me that I need a new engine because of the same issues in the lawsuit. I have taken my car to the dealer for EVERY scheduled maintenance & every problem. I’ve changed the spark plugs..everything they suggested. And now this. I wish i knew how to join the lawsuit.
I Just sold my 1997 Toyota Avalon with 210,000 miles for a 2008 Honda Accord exl v6, because my wife wanted a new car. What a mistake!! I have always owned Toyotas ,but decided to try a Honda. I have always changed my own oil every 3,000 miles. Never noticed any consumption in any of the Toyotas. After a 3,000 mile oil change on the Honda, i noticed it was down almost 2 qurts of oil. I could not believe it! I will never buy Honda again!
I have a 2009 Honda Accord EX-L V6 and have the same problems. The check engine light keeps flashing, the VSA light keeps flashing, the car rough idles, and constantly misfires. I was following the maintenance minder for oil changes, and the oil change places kept telling me the pan was almost empty. Paramus Honda wanted to charge me $700 for engine wire harness that they said was causing the misfires. I search on in en and see so many reports of the same problems. If I try to accelerate quickly, the car gets stuck and starts jerking.
2009 Accord uses 2-3 quarts per half oil change . Honda says its normal.went through oil consumption test and do not trust Honda any longer.

Oh my gosh… I thought I was the only one with this problem! It’s good to know I’m not alone. The dealer keeps telling me “let’s do more tests”. These tests have been going on for months now. 2009 Accord 4cyl 5spd EX 4dr here. Just rolled 100k on my 4th accord and its about due for an oil change and noticed the dipstick is dry as a bone! This is one of many MAJOR quality complaints I’ve had with this accord that I never had with my 81, 91, 95, 99, 02, or 04 accords my family has owned at different times. Sadly will probably be my families last Accord as the 04 is also nearing its end of life.
The 2009 though has gone through 2 sets of rear brakes in the first 60k miles, the center console and drivers door armrest both bubbled then ripped to shreds before 50k miles and was told I was being too hard on the car only to find 100’s of similar complaints from other accord owners online. Looks like a Camry in my future if Honda doesnt get their act together.

I have 115,000 miles on my 2008 Accord and although I haven’t noticed excessive oil useage, I have been plagued by fouling of especially the No. 4 spark plug. Oil is getting into the spark plug for some reason and fouling it. It has happened 5 or 6 times so far. driving along and all of a sudden the engine starts running real rough and the ‘engine symbol’ light starts flashing. I get it to the dealer – the last time only 3 months after I spent over $800 replacing all the plugs and wires, etc – they tell me that after they replaced the plug it cleared the code and that I was on my own. sounds like a related problem at least.

I started having engine problems a couple weeks ago with my cylinder’s misfiring on my 09 Accord EX-L with only 62k miles. It took them over a week to inspect the engine and discovered carbon buildup with the pistons/cylinders and the short block needed to be replaced. Since I have 3yr extended warranty from a 3rd party, they did not cover it. Waste of $2500! Instead, my dealership offered to replace the short block. It’s been over 2 weeks and I haven’t received my car back yet. My sister has a 08 Accord v6, I’m very curious if she’s been experience this problem.
I’m going through the same process, my car is at the dealer right now and they are giving me all kinds bs excuses as to why this is happening.
I am also loosing a lot of oil. Honda is giving me the run around. Telling me it is normal to loose that much oil. They had me do an oil consumption test to come in every 1000 miles. They would top it off and make me come back in 1000 more miles. Well of course if you add a qt. it is going to make the oil thicker in car and not burn as fast for the next 1000 mile check. I just had an oil change so this time I did not add any oil and I am at 2500miles. I am hearing a loud rattling noise from engine. Just checked my oil and can not even get a reading on my dipstick. I have never had a car where I had to add oil before my 3000 mile oil change. They better do something, like replace my engine or I am never going to buy a Honda again.
My 2008 Honda accord, 2 door coupe has caused me many problems. The oil gauge indicator, the vast consumption of oil, the subsequent vtech activator and premature brake where. Now! As a result of the oil/engine problem, I have a $1300 bill for timing belt/engine repair. I will tell anyone I encounter, that never buy a Honda! I have take for a bad ride.
As it stands now, I am certain that I am a victim of a scam that was perpetrated on me by an employee and/or employees of South Motors Honda, 16165 South Dixie Highway, Miami Florida, 33157, (305) 256-2250 and my extended warranty company that involved a premeditated, pre planed procedure that would allow the South Motors Honda employee (s) to void the extended warranty and at the same time, generate profit for Honda. It goes like this; I came in with a complaint of an engine knock. Honda takes the vehicle like they are going to check it. I leave to go to work. I get a call later from Honda telling me that there is an oil leak that needs repair and that it is a rear main seal and it is covered by the extended warranty. I am happy, everything is going to be fixed and covered. Then I go to pick up the car and as the employee’s is bringing the car to me; he stops, he opens the hood and checks the oil. He turns to me and tells me that the engine is very low on oil, 2 to 3 quarts of oil (supposed to be 4 1/2 to 5 quarts) and suggests to me that the engine has not properly been maintained and there is engine sludge that damaged the engine which will not be covered by the extended warranty. Of course I am stunned by this alleged revelation the Honda employee is telling me about. Of course the Honda Employee does not realize that I am a Transportation Fleet Administrator and have been a vehicle mechanic for 30 years. I question the Honda employee and challenge him on his diagnosis asking him if the engine had a rear main oil seal leak wouldn’t that cause the engine oil level to drop which would overheat the oil causing it to sludge and if he replace the rear main seal didn’t the mechanic check the oil level before or at least after the repair in case it was low from the oil leak. The Honda employee cannot answer me and gives me the invoice that shows a 1300 dollar claim to my extended warranty company that was paid to Honda for replacing the rear main seal. The employee refuses to speak about it anymore. So, thinking that they will help me, I call the extended warranty company and report what I find. They tell me that they do whatever the dealer says and can’t talk to me about it.
In the mean time I need a car. It is obvious Honda is not going to do the right thing. I search for a used engine and find one with 22k miles. I pay an honest vendor to replace the original engine with the used one total cost approximately 3200 dollars. I ask the mechanic to look to see if the rear main oil seal had been change on the original engine and he tells me definitively no and he will testify in court needed. I have the stored the original engine in a safe place and I am waiting to see if Honda ever pays me for the cost or if I have legal recourse. Whatever the deal, I tell everyone I know not to buy a Honda ever, they used to be a good company but they are not now. I have in storage invoices, receipts, notes with names.
I bought a 2009 Honda Accord Coupe last November. Since then I’ve had to change the spark plugs, at which time the mechanic said in all of his years, he had never seen a spark plug damaged in the way it was damaged. I also had 2 oil consumption tests. They both said I am burning one quart of oil every 755 miles!!! I contacted Honda and, of course, they refuse to pay for repairs. I purposely bought another Honda because my prior Honda Accord has 230,000 miles on it when I sold it and never had problems. Well, never again!
I have a 2009 Honda Coupe; i have to get an oil change EVERY month and a top off. I changed from regular oil to synthetic when I first bought the car thinking that it would be better for the car, apparently it has only cost me more money every year!! I called Honda about the problem and they said there was no recall, and that if I wanted to have them check out the problem I would have to pay $100 just for them to DIAGNOSIS the car…REALLY?! Something needs to be done about this, I bought this car brand new and it has this issue? Along with the car going through so much oil, the engine is loud also…I dont know if this is because of the oil or what?! Honda needs to take some responsiblity in this if us consumers are paying for the vehicles and an oil change every month! My car is the same with all of yours…once i get to 1000 miles after the oil change I need to get a top off, couple weeks later another oil change! At this rate I will have to buy another car before the end of the year – this is ridiculous! I also have all receipts of my oil changes…SOMETHING HAS TO BE DONE ABOUT THIS!!!

Does this apply to the 4 cylinder engines of the same years? My 2009 Accord EX-L burns about a quart of oil every 3k to 4k miles.
i’m facing the same problem with my 2012 honda insight. i’m from malaysia and it seems that honda malaysia declined my request to bear the cost due to exceed warranty.
this is not fair to me because the problem occur at 100863km mileage and they simply rejected on beyond honda malaysia goodwill guidelines reason. i’ve read some of the comments that the same problem occurs at average mileage 90000km to 115000km. to me, this conclude that the same problem occurs to most honda models at the same range of mileage regardless mileage. to my opinion also, this can be considered as manufacturing defect and honda must take full responsible on it.
worst case now, my car eating the engine oil rapidly in a month. warning light indicator appear frequently and had to go to authorised service centre for refill. many tests have been carried out and it is so frustrated due to waste of time, energy and money. i’m so worried if bad thing happen such as engine burn and such.
since there is no precedence case in malaysia, i’m clueless on what i should do next. i really need advise on legal aspect on this.

Had brake pads replaced within the first couple years of purchasing 2009 accord, which was under a class action lawsuit. Recently took car in for oil change and fella says you need your rear brakes replaced soon. So I took car in about a week ago got a call from fella stating the rotors had to be replaced due to hard spots and the front rotors needed to be shaved. Cost $600. Mil. is 56,000. Seems to me I wouldn’t need the rotors replaced if Honda had put some decent brake pads on it to begin with. Looks like a racket to me.
I have a 2004 Accord and recently after 196K miles got one of the Engine Piston Bolt
broke / damaged and stalled the engine on the highway while driving.
So this should extend to 2004 as well.
Hello, my husband and I purchased a used 2009 Honda Pilot from in mid-September 2018 with one previous owner, all highway miles, and detailed servicing information including the timing belt replacement, emissions repair, and transmission fluid replaced at100,00 miles. Two months later, as agreed upon when we purchased the vehicle, we brought the Pilot into the dealer for repair for the backup camera, a tear in the driver’s seat armrest and we also requested that the emissions and engine be checked as the engine and emissions lights were on. The backup camera and tear were repaired and the dealer/repair checked the emissions and engine. The vehicle has been cared, for (oil changed etc) and less than average miles have been put on it as I work locally. However, on Sunday, March 24 at 11:40 am, I was driving east on 64 in Virginia and suddenly the pilot suddenly stopped accelerating and I pulled over to the side of 64. As I did, smoke began pouring out from under the hood and I could smell gas, smoke and oil and I got out quickly as I was afraid that it was going to catch on fire – I had no idea what could be wrong or what could have happened as we have had NO PROBLEMS with, it and it has been serviced regularly. As the car began to cool off a state trooper and my husband arrived and we were able to check the oil and the coolant – there was oil in the car and coolant but it was quickly leaking all over the ground and the state trooper could not put up flares due to fire. We called Triple A and we even found a piece of the motor that had broken off (we have the picture and the piece) and Triple A towed the vehicle to the mechanic for repair where we were informed that the engine had been destroyed and needed to be replaced. This is hazardous, dangerous, and ridiculous and we are shocked as we have always bought Hondas! ANY ADVICE ON WHAT TO DO?
I just bought a 2012 Honda Accord two years ago. I didn’t know the O Rings went bad. So now in 2021 I’m stuck with a major repair bill for a bulletin Honda shouldn’t have put a limit on. Never buy a Honda! They are out of touch with their consumers and don’t give a flip about their customers.
