Gold’s Gym Class Action Lawsuit Complaint Filed Over Alleged Privacy Violations

Gold’s Gym Members File Class Action Lawsuit Complaint Against Gold’s Gym in Elk Grove California Over Alleged Hidden Video Imaging & Recording Devices In Unisex Tanning Room.

A class action lawsuit has been filed against Elk Grove Fitness, LLC d/b/a “Gold’s Gym” “Gold’s Gym Elk Grove,” Capitol Fitness Network, LLC, Customer Built Personal Training, Inc. (collectively “Gold’s Gym” or “Defendants”) in the Superior Court of California, County of Sacramento  (Class Action Case No. 34-2011-00098086) alleging, among other things, that there existed a hole in the ceiling in a unisex tanning room of Gold’s Gym in Elk Grove, California on or about October 2010 in which management and employees of Gold’s Gym were allegedly notified that purportedly contained hidden video imaging and recording devices, according to the Gold’s Gym class action lawsuit complaint.

The Gold’s Gym privacy class action lawsuit complaint is reportedly brought on behalf of the following putative class of persons, unless otherwise excluded:

All individuals exposed to surreptitious recording of a private nature in a Gold’s Gym in Elk Grove, CA, beginning at least October 2010 and continuing through December 2010.

The Gold’s Gym privacy class action lawsuit complaint reportedly asserts claims for violation of the California Constitution, invasion of privacy through instrusion of private affairs, California Civil Code Section 1708.8, negligence, negligent and intentional infliction of emotional distress,  and fraud under common law and California Civil Code Sections 1709 and 1710.

    Is there any legal action being taken about there contracts? I know there are many complaints on the internet about their contracts. My husband and I have contract issues that Golds is currently harrassing us over. If there is any info on this subject please forward it to us. Thanks

      From what I’ve read, issues of that nature with Gold’s Gym are all over the U.S. Class action suits are hardly ever worth it for members…unless someone else has started it. A couple of years ago, I got something in the mail for 24 Hour Fitness and their cancellation policies – apparently their charges weren’t legit (which I paid), and I got a whopping $20.

      After this invasion of privacy fiasco, you can bet I will cancel my membership by the week’s end. Sorry you had trouble with your contracts – I won’t be surprised if I go through the same thing.

    If anyone knows of a class action lawsuit against Golds or Custom Built please contact me. They have wrongfully taken money for services not rendered and have locked many into their contracts, even with medical disabilities. They need to be held accountable and they need to return monies taken.

      I purchased a trial membership in Gold’s Gym , Arlington, VA in March 2008 and paid by credit card. I cancelled the btrial membership in August of 2008 and subsequently credit charges ceased. My last payment to the Gold’s Gym was August 25, 2008. I used Gold’s Gym facilities 2 times only in March 2008. Sometime in 2010 the relevant credit card expired, no additional charge for Gold’s gym appeared before the expiration of the credit card with which I made original payment. on August 2, 2011 I received a letter from Gold’s Gym claiming that I owed an additional $32.99 in charges. on August 16, 2011 First Credit services, Inc. sent me a correspondence indicating that I was indebted to Gold’s in the amount of $57.99. I contacted Gold’s by phone and was told by one Lisa Johnson, a Gold’s employee that in fact I owed “hundreds of dollars” and that my payment of $57.99 would not be sufficient to eliminate my “debt”. On September 30, 2011 I received a new letter from First Credit Services indicating that I owed Gold’s Gym $267.92. All the correspondence actually asked for new credit card information, savings or checking account numbers noting that Gold’s had tried to run the charge described in their correspondence of August 2, 2011 through the credit card I had paid my 2008 invoices with.They are aggressive on the collection effort which may or may not be based on some cancellation fee that Gold’s gym never invoiced me for.On the other hand since this was a “trial membership” a cancellation fee would be poor business practice. The telephonic claim of much larger additional debt may be a collection scare tactic, an employee mistake, or part of a scam to collect additional charges since 2008. Is a complaint to the Virginia State Police Economic Crimes Unit a consideration?

      I contacted Gold’s by phone and was told by one Lisa Johnson, a Gold’s Gym employee that in fact he owed “hundreds of dollars” and that his payment of $57.99 would not be sufficient to eliminate his “debt”. On September 30, 2011 I received a new letter informing that I owed Gold’s gym $267.92. All the correspondence from Gold’s Gym and First Credit Services, Inc actually asked for new credit card information, savings or checking account numbers noting that Gold’s had tried to run the charge described in their correspondence of August 2, 2011 through the credit card he had paid his 2008 invoices with. I have checked the Internet and found a number of people indicating longstanding problems of a similar nature with Gold’s. Some postings even suggested that people who complained should get together for a class action law suit.

        I agree this company needs to be brought down. Unfortunately this was my first gym I decided to go to and they are a total scam and the least bit certified in training.

    Hello everyone, I’m going through the same thing right now I froze my account last year in July when my account re-open in March I call to cancel I was told I need to close my account in person. In March of 2020 I went their facility to close account I just found out that my account is still open it’s now November 2020 they will not close my account….. I’m ready to move forward in the next step. COVID is slowing me down, I’m not going to stop. THIS IS UNFAIR TO THE PUBLIC AND SOMETHING NEEDS TO BE DONE.
