Ford Class Action Lawsuit Complaint Filed Over Alleged Defect in 2004 & 2005 Model Year Ford Freestar and Mercury Monterey Transmissions & Torque Converters

Ford Freestar and Mercury Monterey Owners and Lessees File Class Action Lawsuit Complaint Against Ford Motor Company Over An Alleged Defective Transmission and Torque Converter In Model Year 2004 and 2005 Ford Freestars and Mercury Montereys That Allegedly Can Cause Sudden Power Loss and Loss of Acceleration.

A class action lawsuit has been filed against Ford Motor Company (“Ford” or “Defendant”) in the United States District Court for the Eastern District of New York, Brooklyn Office (styled Judy Azose v. Ford Motor Company, Case No. CV 10-3634) alleging, among other things, that the transmissions and torgue converters in Ford Freestar and Mercury Monterey 2004-2005 model year minivans suffer from an engineering design defect that manifests itself when, without warning or prior signs of transmission problems, the output shaft splines in the torque converter split and the Ford Freestar and Mercury Monterey vehicles suddenly lose power and cannot maintain speed or accelerate, according to class action lawsuit news reports.

The Ford Freestar and Mercury Monterey Model Year 2004-2005 transmission and torque converter power loss class action lawsuit complaint is reportedly brought on behalf of the following class, unless otherwise excluded:

All (i) current owners or lessees of a 2004 or 2005 Ford Freestar or Mercury Monterey minivans residing in the United States; and (ii) former United States owners or lessees of 2004 or 2005 Ford Freestar or Mercury Monterey minivans.

The Ford Freestar and Mercury Monterey class action lawsuit complaint reportedly alleges statutory violations of the New York General Business Law section 349, breach of express warranty, breach of implied warranty of merchantability, violation of Magnuson-Moss and unjust enrichment.

Shepherd, Finkelman, Miller & Shah, LLP can get your information and put you on the list for information regarding the class action.

My 2004 Freestar gave out on the entrance ramp to the freeway. 90,000 miles on it. Last Ford product for me.

      • Tony December 2, 2011, 11:48 am

Everyone that has this issue should notify Ford about this issue at 800-392-3673 press 5, 1 ,2 to get to customer service agent. Enough people calling could trigger a recall or help the class action.

On 9/15/2011 I just left the gas station driving home with my son in the back seat. All of a sudden I had no control at all. All of my lights worked, the motor would just rev but that was all. It would not accellerate. I had a long line of traffic behind me so I pulled off the main road to a side street. Thank God I was not in a bad part of town. I had a tow bill and now after my mechanic looked at it. He said it is a transmission and maybe a converter issue too. I will have to have it send to a transmission specialist since he doesn’t fix transmissions. I just had my van’s fluid changed and tires check as you are suppose too. My van doesn’t even have 90,000 miles on it yet. But here comes another tow bill with a transmission bill of anywhere from $2200-$2700. I didn’t know anything about this. Ford never notified me of this as they have of recalls. I have three kids and now I’m down to my husband and I sharing one truck becuase I don’t have the money to have this replaced right now.

I am experiencing similar issues with the PCM. Whenever it rains, and the vehicle is exposed to wet weather, the tach starts bouncing around and the engine runs really rough. It shuts off at idle when it gets this way. I would love to be in this class action lawsuit if it will give me the ability to fix my car.

    • David W. Young December 3, 2011, 3:23 pm

John, there is a Ford TSB out on the PCM problem you describe, there is a drainage issue in the cowl area over the firewall that lets water get to the PCM. Any Ford dealer should be able to do this fix for you, and at no cost if they want you business in the future. P.S. My brother is a plaintiff in the Torque Converter class action lawsuit against Ford, and he even worked for Ford for over 23 years.

      • Andrew Hitchner December 6, 2011, 5:48 pm

David, while traveling home to florida from south carolina this past weekend my mothers 2005 ford taurus, with no warning, had a complete transmission failure. With no warning, the vehicle began decreasing speed however the engine was running and rpms were up. After researching we’ve concluded its the torque converter, basically an identical issue. Repair shops have been getting 20 of these a month, and there is an overwhelming amount of identical issues with this model. Im wondering why this model is not included in the lawsuit or if anyone affiliated with the suit is aware of this model as well. Hope i wont be to much of a bother in asking if perhaps you could run that question by your brother? I will be waiting anxiously to hear from you, and i hope i am not a bother. Thank you.

      • Mary Kubinski January 16, 2012, 5:34 pm

I have the same problem with the PCM and had to have it replaced at my cost with only 40,000 miles on my van. I was also on a trip at that time and the dealership the van was towed to would not even give me a car to use to get to a hotel. There was no public transportation, and of coarse it was raining. The problem only happens when it’s wet.
Then again at 80,000 miles the same thing happened and I had to have my van towed. This time the garage that the van was towed to took it apart and dried out the connectors and I believe the codes were reset. The trac light stays on most of the time now. Ford never offered a fix for a drainage issue, only that the PCM was not covered under warranty because the issue originated with the cowl panel. Fords design flaw at our cost.

      • Melanie Zuber July 30, 2012, 9:09 am

Have a 2006 with same issue. Engine light came on but went off 2 days later after dry weather. Was wondering if your situation was ever resolved with ford? Afraid to take to dealer.

    • tim November 2, 2012, 8:37 am

my van, 05 ford freestar is doing all of the above mentioned things. it is connected to when it rains. is there anything i can do to get ford to cover the repairs etc?

  • Pam Boyce September 30, 2011, 4:05 pm

I have a 2005 Ford Taurus with 70,000 miles and just last Monday i was driving to work and just happen to be in town when all of a sudden my car quit pulling so i had to coast to the side of the road. I had no warning whatsoever that this was going to happen. I had to have my car towed to a shop because it would not pull in any gear. My mechanic said that it is the Torque Converter and that he had replaced several within the last few months on Ford Taurus. My car should be ready today to pick up but the total bill for repairs are gonna cost me around at least $800.00. I want everyone to know this just in case you think about purchasing a Ford Taurus.

  • Jay Saph October 2, 2011, 10:17 pm

The transmission on my 04 freestar just died this morning. No forward, reverse, just revving up. Worked fine when I shut it off. When I started the van…the problem immediately began. I have always babied this vehicle as I am very upset

  • jason peng October 4, 2011, 9:30 pm

Today my 2006 Ford Freestar gave out on me without any prior warning. Thank God i was able to push it into a service center. Ive got 189,000 miles on it. I did have slight problems with it before after it rained but after i got ah tune up ,it was fine. Now im reading this stuff about possible transmission failure and water in the pcm. will see what they tell me tomorrow.

  • Paul Hembree October 5, 2011, 6:40 pm

I own a 2004 Ford Freestar. On October 4 2011 my van suddenly lost power. I was on a busy highway. I coasted to the side of the highway. My van was completely in danger of being hit. I could not move it. After hours of waiting and a near miss from a semi that wasn’t paying attention my van was towed. I have always been a Ford person but if they don’t deal with the issue they will be losing alot of loyal customers.

    • STEVE G October 12, 2011, 4:32 pm

They dont care about the class action suit and are refusing to do anything other than charge me over 3 grand to fix it. I am furious !!!!!

  • STEVE G October 12, 2011, 4:30 pm

Last week my 2004 Ford Freestar stopped accelerating exactly like the hundreds of people I have read about, they just called and stated I need up to $3300 worth of transmission work. When I advised of the class action I was told that was not his issue. Bethlehem Ford in Pa…..I am so angry right now, this car has been a disaster from the day I purchased it, from electrical problems to now this, a transmission going after only 90,000 miles??? If this was 1975 I could maybe accept it but 2004??? Please stay away from Bethlehem Ford and all other Ford dealers. I will not allow them to fix this..I will park it until someone has the sense to force them to recall these vehicles.

  • Jean October 24, 2011, 3:06 am

I purchased a 2004 Ford Freestar 10/20/11. I did some research -User Rating 7.9/10 -MSN Autos Rating 7.8/10 I got a good deal and thought I was purchasing a quality product.
Only 2 days later while driving home, my driver side window quit working. The buttons on my radio quit working, although it randomly kept trying to reprogram “preset 2”. Finally, at 65mph on a busy road, I rapidly lost all acceleration. Almost exactly like many of you have explained with the erratic RPM.
I called a friend to come get me, he drove it home and it seemed to drive fine for him. I flushed the transmission fluid and hoped that it was just a fluke. We fixed what seemed to be a loose connection on the driver side door, and got the window working again.
Bummed about the radio still acting up, but feeling confident I hopped into my ‘NEW’ van only to have it NOT START AT ALL.
I finally decided to do some additional researching; I came across countless similar horror stories. I am heartbroken. I know I could turn around and sell it to try to recoup some money while it is still ‘test drivable’, but I wouldn’t sell this FORD to my worst enemy.

    • trishia February 2, 2012, 11:03 am

I have a 2004 ford freestar minivan and it has been trouble from day 1. I bought it used but it only had 84, 000 miles on it, was kept up nice and was a one owner vehicle. One week after getting it my transmission light kept coming on all the time. Any time I have to go under 55 mph I have to drive it in 3rd to keep the light from coming on and for it to accelerate correctly. My passenger side window will not roll down, it did for about a month and then stopped. The rear AC stopped in mid summer and was making life unbearable for my kids, there are no windows to roll down in the van and it gets unbearable in the back, so we bought some fans for the back of the van…utterly ridiculous…we have only bought FORD, but they screwed up when they made this style!!!!!! They need to fix the transmission that is slipping in the vans, the part is only a few bucks but they have to take the whole thing out which cost a lot but now it needs a new one…

  • cheryl Vann October 27, 2011, 10:26 am

Just picked up my 03 Windstar from shop Torque converter just went out while driving down road Thank god I was not on freeway No warning in days preceeding just stopped.

  • marisol October 29, 2011, 4:27 pm

hi. I am having the same problem. i have a 2004 ford freestar. it makes a sound at front and looses power and turn off sudently. why is ford so bad. they should deal with this before this reaches a worst point of resolution and other charges be applied to them. if someone get hurt and kill they are going to have to pay more.

  • marisol October 29, 2011, 4:32 pm

save all charges you dealing with and the missing work and any charges related to malfunctioning of your car.at the end they have to respond. I know someone will hear hour voices and make sure you go to the bottom of the page and report your complain.

  • jean paul October 29, 2011, 5:18 pm

Why don’t they include owners of the 03 Windstar as well. They have the exact same problem.

  • Jamie Mabie November 2, 2011, 12:16 pm

Count me in. I just spent 4 hours at night waiting for a tow truck to arrive. All most got hit by a Semi trying to get this POS off the road. That was $150 for the tow and now I need to spend $2500 more to get this 2004 Taurus running. I am a Ford fan as you can tell by my Email address. I even drag race Mustangs. I am thinking about going Honda for my daily driver. My neighbor’s Honda just turned 350,000 miles and has only had normal maintenance and one alternator.

  • Larry Simanek November 2, 2011, 5:23 pm

Count me it… For a Class Action suit on the 2004 EXPENSIVESTAR cause there is not free about it. We purchased as a lease return and had it since 2006. Since 2006 we had to replace the A/C before 60K, replaced the driver window motor, Sparkplugs and coils cause coils went bad, Cam Syncro. And now the Transmission problems started at 90K wondered about warranty and expired. So now after fluid changed still having issue and was told that the tranny will need to be replaced. EXPENSIVE STAR…. Worst car FORD MADE..

2004 FREESTAR 94K MILES TRANSMISSION DIED……PAYING OFF A CARD I CANT DRIVE OR AFFORD TO FIX

  • Ron Michel November 6, 2011, 7:36 am

How do I join Class Suit ?

  • Leah November 7, 2011, 11:51 am

After buying my 2005 for freestar back in 2006, with 19000 miles onit, I came accross a website that had thousands of complaints about the torque converters and transmissions failing with no warning so I have been looking out for this. This morning it happened to me just like others have reported. No warning. Driving on the interstate and all of a sudden, it was like it slipped in to neutral. Tachometer revved way up. I immediately knew what had happened. If anythings comes of this lawsuit, I’d definately be interested. Still owe $8000 on it. Can’t afford to fix it. Guess it makes an expensive lawn ornament.

  • Colin Dussault November 7, 2011, 12:43 pm

2005 Ford Freestar exhibiting all of the same symptoms and problems as others who posted. Tranny failed. Replaced it. Several weeks later van dies on busy highway with my 3 year old in the vehicle. I have presense of mind to shift to nuetrual and restart van while coasting. Van starts and sputters and lunges forward and I am able to barley get to side of road before semi rear ends us and killls us. Have garage change fuel filter. Van drive home fine. 2 weeks later go to start van after running errands and Van would go into gear

Towed back to Tranny shop. Tranny shop disconnected PCM. Van shifts. They claim issue is PCM not Transmission. Wired Right Auto replaces not one, not two, but Three PCM’s. Gives back van.

This past Saturday, Nov. 5, 2011 drive van from Cleveland to Canton and Back to Cleveland no problem.

Sunday, Nov. 6, 2011 Drive back to Canton from Cleveland. No Problem. Later in the evening Van will not start. Finally starts but won’t stay running. I leave van over night and get ride back to Cleveland (1 hour and 10 minutes each way) Come back to Canon today, Monday, Nov. 7 to see if any change. Van starts and idles ok now but will not shift into drive or reverse. Sputters, won’t stay running. Had to shift to nuetral, restart and inch it back into driveway like this. Waiting on Tow for third time for this defective vehicle.

My 2005 Monterey trans pump just was replaced 2 months ago — same problem as others, pump spline failed. What is the status of the Class Action suit?

  • Dennis Bodary November 9, 2011, 10:50 am

Driving down the road in Kentucky, All of a sudden it stopped accelerating. On a 2-Lane road i could not pull over no room. Luckily got a tow truck in a hour.
Got it to the dealership after they closed on Saturday. Monday they called and said the torque converter splines stripped.
Bill for the torque converter, labor fluid and a trans mount. $1379.88
Bill for a rental car from Saturday thru wednesday $420.76
Bill from the towing company $95.00
Extra gas to get back from Michigan to Kentucky and back to pick up my van $70.00
This happened with no warning what so ever. I had the extended warranty to 72,000 miles to bad this happened at 85,625 miles

  • Mr. Martinez November 9, 2011, 2:00 pm

I have 102,000 miles on my 2005 Ford Freestar. My family and I were riding I-75 and our van stopped going forward. We stopped and it wouldn’t get on any gears. We had to pay $450 to get it towed to our house. Rent a vehicle for a week and $1,400 to get the transmission rebuild. No warnings, it just went out on us. Thank God we didn’t have an accident in I-75 but what a headache it has been!!!! I wont buy any more Ford vehicles!!!!!!

  • Brett & Dana Adams November 9, 2011, 8:24 pm

We just spent a WHOLE lot of money replacing the torque converter on our Mercury Montery 2006…not happy.

  • Marshall Dabney November 10, 2011, 9:02 am

How do I join this law suit? My torque converter went out at 76k and Ford wanted 4k to rebuild it. Still having problems. Not happy with Ford at all.

  • Mountains Taxi November 10, 2011, 9:52 am

We have 2 Freestars, an ’04 and an ’05. Had to rebuild the transmission in both. Same problems, driving along and lose all forward motion. Have towing bills and repair bills. How do we join the class?

  • Tina November 12, 2011, 5:01 pm

My 2005 Ford Freestar’s transmission just took a crap. With Christmas coming and 3 kids, sure makes for a huge unexpected dent in the wallet. Too bad Ford wont step up and fix the problem for the ppl that put their trust in their brand. I wish I would have done some more research on the vehicle before purchasing it. I would like to join this Class Action.

  • Colin Dussault November 13, 2011, 10:48 am

Exact same issues and failures with my 2005 Ford Freestar. Replaced Transmission at 95,000 miles. Now on 4th PCM and 8th trip to repair facility due to stalling, rough idling, no reverse etc. PCM issues persist!

  • Melissa Lawson November 17, 2011, 2:03 pm

I purchased my ’04 Freestar in 2007 and had no problems until this year in March 2011 when it started shifting funny. Then one day it just quit. I had the tranny rebuilt (which took a month). Got it back and the shift cable broke. Then the cam synchro needed to be replaced. Then November 2011, it was shifting funny again. It is currently at the shop awaiting the verdict. I will NOT pay for another rebuild!

  • Kristin Jentoft November 22, 2011, 12:37 pm

Include me. This van is a piece of junk. We have repaired just about everything on it. The transmission was already replaced under original warranty. Today I was informed that it has to be replace yet again and that it is under the original warranty of 36,000 miles; which means I have to pay for it. Total mileage on the van is just under 90,000. What a joke.

  • Anthony Peot November 22, 2011, 9:32 pm

Include me. 2004 Freestar, transmission went out tonight on the freeway. 90,000 miles on it. The original battery outlasted the transmission. Had it flushed and serviced as recommended. No more Fords for me. My 2003 F250 needed the front suspension replaced twice in 80,000 miles.

  • Terry November 30, 2011, 9:44 am

To all Owners of Ford Freestars with problems with PCM’s getting wet and shorting out. Please contact the NHTSA ( http://www.nhtsa.gov/ )
so they know just how many people out there are having problems. I contacted them and Ford also. I’m sure they both know there are a lot of complaints out there but without formally filing a complaint with the NHTSA there will probably never be a recall so we can get our vehicles fixed like we deserve. My vehicle started off by stalling going down the road with no warning and now after several months of putting hundreds of dollars into it to fix it the power train totally went out which I’m sure is from the pcm continually getting wet from the bad design of the housing box which finally led to a full catastropic loss of the pcm.I believe the people who are having problems with torque converters may be related to this pcm problem too. Because my problem started out with stalling and now the Transmission isn’t working either. Please contact NHTSA and file a complaint so we can all get our vehicles fixed. Thanks

Shepherd, Finkelman, Miller & Shah, LLP can get your information and put you on the list for information regarding the class action.

My 2004 Freestar gave out on the entrance ramp to the freeway. 90,000 miles on it. Last Ford product for me.

  • Kim Mckay December 4, 2011, 2:48 pm

I own a 2004 ford freestar, the same thing happen to me and my famly. we were driving on the freeway, then all of a sudden the engine rpm went up…after that we lost power to the transmission. we had to get out and push the van to the side of the freeway. We were 50 miles from home, the engine runs fine, but when shifting gears-nothing works. I never had a problem with this van until now. the van is parking in my drive way now. If I know that this van had problems, I would have let it stayed at the dealership. I bought this van new in 2004, I only had 80,000 miles average went the transmission fail. I had no warning signs of transmission trouble at all.

  • Christine s December 5, 2011, 5:25 pm

So i am sitting here looking for a transmission for my 04 murc Monterey and I stumble a cross this. Well last tues on my way to bring my sons to school my van stops moving into gear. I don’t have a pot to piss in non the less now pay for a tranny p.s I just replaced the whole motor a month ago so this is a major kick in the a– . I’d really like more information on this action. Please let me know any information my email is xzabia19@aol.com—– thank you

  • Sheri Moore December 6, 2011, 5:48 pm

Same as the rest, yesterday i was driving to work on the interstate and the torque converter went out without warning. my 2004 freestar was towed to shop and i’m expecting to hear bad news in the morning.

  • jOHN December 8, 2011, 9:52 am

175,000 miles torque gone what ya gonna do but fix it and go on.

  • normanga December 20, 2011, 6:12 am

with out any warning 2005 montery transmission quit while going 65 on Insterstate 85 in Atlanta, Coasted to get off road, since it was a Sunday evening called 911 and was assisted with the police in having thr van towed to the nearest ford dealer.

The dealer appeared that they did know about that problem(would have if they looked it up goolge) have the van for 2 days and claim they are going to have to tear it down to find what is wrong and estimate at least $2.000 to repair,

This van has a little over 90,000 miles and is like new. My report is very similiar to the other postings. Ford has a defect and should have a recall.

This problem should not have happened at the owners expense but Ford has a defective part and it should be a Ford expense’

  • Randi Tieken December 20, 2011, 5:11 pm

We bought a 2004 mercury monterey van in Auguest 2010. I so wish I had done my research and saw these posts before I bought it. We were on a trip last friday and the same thing you all have described happened to us. We were going about 60 mph and our van lost power. Thank God we could pull over to the shoulder. We have our van at a ford dealer now, and are looking at a 3200.00 repair bill for a new transmission. I did see that a class action lawsuit settled last August 2010 in New York. Does anyone have any info on that? I sure feel that this cost should be paid by Ford. Im sick over this

  • monty nelson December 22, 2011, 6:27 pm

My wife was on her way home tonight and the van started running rough next thing she knows the van will not speed up. Luckily she was coming up the off ramp. She called me and I went to get her, sure enough the van will not go forward or backwards!!! Called a tow truck and here we go.

  • GayAnne Spezialetti December 26, 2011, 8:56 pm

I owned a 2004 Ford Freestar, and five months before it would have been paid off — the transmission went. No prior warning signs! I had it replaced, thought my nightmare was over (after a mere $2500.) and a month later, it went again! Only to find out when the garage replaced the transmission, they “disturbed” the PCM — so now I was unable to get the car wet!! needless to say, I now drive a hyundai, and have a payment AGAIN!!! Count me in on the lawsuit!!

  • Thomas Turner December 27, 2011, 11:08 am

I have a 2004 With 104,000 miles drove in my driveway put in park shut off, went back out Runs fine but won’t go into gear never had a problem???

  • Margaret loudin December 27, 2011, 1:28 pm

My transmission went out at 66,000 mles unbeleivale im 67 with limited income when something gonna happen

  • Brian Hilsabeck December 27, 2011, 3:01 pm

I have a 2003 ford taurus and it has been a great running car. I was parked in a store came out put in reverse and nothing. Could only rev it up and there werent any warning signs or nothing. Tranny is shot. What an inconvience and a bad reputation for ford!

  • Rick Jenks December 30, 2011, 8:16 pm

My 2005 Freestar’s transmission just failed two days ago. As I was looking up info on getting it fixed I found all of these posts. I can’t believe that ford is not recalling these. It looks like I can get it fixed and wait for it to fail again. I have owned nothing but ford vehicles for the past 20 years and it looks like I will be looking for another domestic manufacturer to buy from. That sucks! Ford, do the right thing.

  • jon December 30, 2011, 10:22 pm

Wow,it makes me question fords integrity after reading posts all over the internet of electrical problems and transmission problems, all kinds of problems, the transmission and electrical problems seem the common theme.

I was going to uy a used one,and usuually it takes a lot to scare me away from somehting,as I do my own automotive work, but transmissions that go poof in the night, everyone complaining about the same issues, low mileage out of the blue transmission failures-

I am not going to but the free star-

  • Teresa January 1, 2012, 8:24 pm

I have a 2005 Taurus that this happened to us as we were getting ready to get on the highway from an access road. My husband thinks it must be the tranny. But others on here are saying it’s the torqu convertor. we had replaced one in an older Taurus we had many many years go but with that one we could not shift it at all as with this car we can but it does not engage even though the engine is still on. Any suggestions?

  • April Dawn January 3, 2012, 2:11 pm

The Ford Taurus 2004 should be included on this class action list. As well, i know that i would like to join this suit.

My 2003 (119,000) Taurus quit on the highway today. The trans let go and the engine just reved up. All gears are gone but it still engages into park. A few months back, it gave me a scare in the Home Depot parking lot when I started it up. The engine would not go into gear or rev and an exclamation mark warning light was on in the dash. I shut it down and re-started the car and it was fine. Not sure if the two are related or not.

  • Patricia Pereira January 5, 2012, 10:25 am

Kindly, add me to the class action please. I live in Canada and I had my vehicle break down in the middle of the highway. Luckily no one was around so my husband and I had significant time to move aside. We replaced our transmission month after purchasing the van and now the PCM is acting up. I can’t afford this, it’s too much I feel like I put my life on the line every time I get into the vehicle.

  • Emily Davis January 5, 2012, 5:37 pm

I too have a 2004 Mercury Monterey that did the exact same thing. We live in a very rural part of North Carolina and as I was taking one of my son’s friends home in the dead of winter with a temperature of 40 degrees my tourqe converter did the same thing. I had to have it replaced and the whole transmission. I didn’t have all the money to get it fixed so I was having to use my mother in laws car for 6 months until I was able to get the parts. My father in law had to put the new transmission then also had to take it to another mechanic because there were some things that he couldn’t check because he doesn’t have all the computers or the lifts. We have also had to replace the spark plugs and wires 5 times and had to have both new lower control arms. To me it seems like it should be covered under the lemon law but I don’t know we bought it used.

  • Preston January 10, 2012, 8:52 am

Had this exact thing happen to our 2004 freestar. Sudden loss of power, park gear is the only one that worked. sign me up for this.

my 2004 Ford Freestar stopped accelerating , and to have it towed 60 miles to my local garage that does all my repairs….. called Forsd Motor Co. about this and told them I took out an extened warrant plan and wanted to know if it will cover the $3,000.00 worth of transmission work . They told me I would hve too take it to a local Ford dealer to look at it; (35 miles away) ; I did this, and the FORD DEALER told me that I needed a coverter, and that my extended warranty RUN OUT,
(under 100,000 miles BUT OVER the 5 YRS LIMIT, and they CHARGED me $ 80.00 to tell me the same thing my local garage said. !!! ( FORD couldn’t tell me that over the phone ?? )my last FORD !!! I want to sue their ass off !!

  • Nicole January 12, 2012, 9:15 am

Same problem here. This van has been a piece of junk since day 1.

2 days after driving it off of the used car lot, the back hatch stopped opening. Then the drivers window died. The “Reset Tire” light was constantly on, despite doing what the manual said to turn it off.

Then, more electrical problems. Then on morning, it died as I was going through an intersection! I kept honking my horn and flashing my lights (although they probably weren’t working), just hoping that the cross traffic would hear/see me and stop. Cost me thousands. Then a year later, dashboard lights coming on and off. Had it taken in and they thought it was my alternator, but they couldn’t be sure. The van would die when idling too low. I would have to sit at stop lights with my foot on the brake and the other foot on the gas to keep it alive. Finally had the alternator fixed and the emergency brake light keeps going on and off.

Absolute piece of junk and I have always been a loyal Ford owner. It is disgusting knowing that Ford is not taking responsibility for this obviously dangerous vehicle. I am a single mother with a 6 year old and a 4 year old that I am transporting in this vehicle on a daily basis. Along with the other 205,000 owners listed in this latest recall.

Please Ford, our lives are not worth your profit margin.

  • Alyssa January 12, 2012, 1:57 pm

Just saw the recall on the news and as happy as I am for the owners of the 2004-2005 models, I have a 2006 Freestar with the EXACT same issue. I have owned my vehicle for 17 weeks and it has been in the shop 4 times totaling 12 weeks! There have been two incidences of out vehicle just shutting down placing us in a very dangerous situation. Thank God that the other times the car died on us we were not in a dangerous situation. Already called ford and put in a complaint as well as with the NHTSA. What are owners like me supposed to do now? It should have included the 2006 model as well. Ford needs to address ALL problems that they are responsible for!

  • Philippe Vidori January 13, 2012, 10:49 am

I have a 2004 Freestar and the transmission died on me in 2010 ( 150,000 kms ). I had it replaced for a total cost of $2,500 CAD.
Lucky for me, I was in a parking lot when I heard a big bang.

Ford has announced a recall for the torque converter problem. I was given a letter by the local Ford dealer outlining the details of this recall and it states that parts will be available starting in the second quarter of 2012 and all owners of affected vehicles will be notified. If you have a problem before then, they will handle it promptly. I have the letter at home and will publish details over the weekend.

  • Stacy January 20, 2012, 9:46 am

I own a 2004 Ford Freestar which I haul around five little children daily. Less than 24 months ago, I had the transmission go out as I was crossing an intersection. Thankfully, a tow truck was there immediately to help me. However, the cost of a new transmission was beyond what I could afford so I had my van towed to another city (two hours away) and more affordable. Transmission was replaced, two weeks later I had more transmission problems and the van again had to be brought back to the Transmission Specialist who then worked on it again. Since, my van has never run perfectly and today my van was losing power as I drove my children to school. Keep in mind, the weather here is cold and snowy which would not have been good conditions to stall out! I called Ford today, they transferred me to a local (1.5 hours away) Ford dealership to fix the torque converter, then another dealership; only to find out that none of these dealerships have the parts and are unable to fix my van until late “Spring”! I asked the Ford representative what I should do until then, she is unsure and told me not to take it to a private mechanic because Ford may not cover the charges! Also was told by the representative that towing charges would be covered if towing was required but by a Ford dealership only! I need this fixed before Spring, if you have any information that would help, this would be fantastic!

  • Kurby L. Perrigan January 20, 2012, 10:13 am

I own a 2004 freestar. It wouldn’t go in reverse, it would go a few feet in drive and then die. After four or five times of starting the vehicle and going a few feet, it wouldn’t start at all. It is now parked in my driveway completely dead.

  • Glen and Kathy Ford January 27, 2012, 6:41 am

2004 Ford Taurus 92,000 miles runs great. We were coming home from vacation. 400 miles from home, going down the Kansas Turnpike running 78mph in cruise when the tac jumped up to 6. Shut down the cruise and pulled over to the side of the road. Nothing, no forwrd, no reverse. We have never had a problem with this car, new tires were the only thing we ever fixed. I won’t feel as confident in my car as I once did. We had to tow it to a tow company and rent a truck and dolley to tow it home. Then pay a guy to tow it to the garage. Now we can add another $3000 to our vacation fund. No warning…nothing.

  • Elaine Snyder January 28, 2012, 10:18 am

I own a 2006 Ford Freestar with 120,000 miles on it. I just picked up my car from the mechanic last night and had to get the transmission rebuilt. I was parked in a parking space at a store and then could not back out. It just went out without a warning.
The mechanic stated that the torque converter feel apart causing metal pieces go into the rest of the transmission. Because of this situation, I had to get a new torque converter, pistons and clutches, and new filter and fluid. This cost me 1300 total. I am very upset about this and it seems lots of other people have had problems with this as well. I would of never thought this would happen since my car is only 6 years old. I would like someone to contact me from the class action lawsuit!!!

  • Debbie Zahradnicek January 30, 2012, 12:04 pm

Add me to the list. I have a 2004 Mercury Monterey with 70,000 miles. I was merging into traffic and just changing lanes when all of a sudden the motor was reving up, but did not have any forward momentum. I tried putting it into lower gear, but nothing happened. I pulled to the side of the road and tried all the gears including reverse, but nothing happened. I was lucky that I was able to navigate quickly to the turn lane and turn onto side road, which was right next to a Ford dealer. They are saying it sounds like the torque converter problem, but it will be $800 to find out. Time for new car.

My 2005 ford freestar the transmission went gave up it just stoped right on the meadle of the highway on my girl friend after paying $28000 in cash what you get a peace of junk for that kind of money that we pay for this crapy cars they should run at least 300000 miles before you should have any big problems like this my van it has been seating on my drive way for over a year and the other problem is i cant find a trasmission for it because it is to new this looks like a setup problem by the engineers every transmission has broken after 110000 miles for every one right after your insurance coverage has finished it’s kind of od to me i hope more people would get together and get what ferly and ethically they payed this companies.

  • Tim Jackson February 5, 2012, 6:26 pm

this last week the transmission on my wifes 2005 freestar started what felt like slipping so we took it in the next day and had the transmission serviced at the local ford dealership. Got the van back with the comment on the sevice slip that there where no problems with the transmission. The next day while on her way from work traveling at 35 mph the van just died. She was able to get it to the side of the road just before traveling onto a narrow 2 lane bride that is heavly traveled by the loggind and dump trucks where they have to communite with each other when they are approching as not to meet each other on the bridge. Had it towed to the local repair shop. she was able to restart the van but then the rps would race when put in reverse and then die again. That night I was researching the problem and read about the water in the PCM module issue. Contacted the repair shop advising them of what I found and was even more shocked when they called and said that it was the water issue and they could not believe the amount of water that came out when the module was removed. They said they found a 7 page report in there tech notes from ford about this issue. I cannot believe Ford has not gone public about these issues and hope no one is killed before they do. Guess my transmission in next.

  • Scott Crockett February 7, 2012, 12:22 pm

2003 Ford Explorer Transmission started leaking and slipping at 28,750 miles, at 39,825 miles and again at (currently) 77,256 miles. Each time McCoy Mills Ford in Fullerton Ca. claimed to have repaired the issue. I’ve never wanted an American Company to fail, but Ford is a different story; what a poor product….I’m considering a small claims actions against the dealership and naming Ford Motor company in the complaint as well! I will NEVER buy FORD again! NEVER!

Get this……I have had my 2004 Mercury Monterey in and out of the shop for the past 4 months trying to figure out what is causing this “mysterious shudder” it has. Finally, my mechanic said he had read about this torque converter recall online and that this was probably the problem. He told me to contact my local dealership to get it taken care so as to not have to pay “out of pocket” for anymore repairs. The dealership said they had to first verify that this part was indeed bad in order to do anything. So I took it to the service department this morning, they verified that this was indeed the problem took digital photos as per the Ford Motor Company’s request and told me since Ford hasn’t sent out the parts for this recall yet there was basically nothing they could do. They deemed my vehicle “safe to drive” and sent me home. I then called the Ford Motor Company’s customer service number and again was told that “since the vehicle maintains maneuverability when the afflicted part/parts fail that they agree with the assessment that my vehicle is therefore SAFE TO DRIVE until parts become available sometime in March or April!” Now, I am a mother of four children with no alternate vehicle available for me to drive. Now I am supposed to transport my four small children, one still in a car seat and two still in booster seats, on a daily basis in this vehicle that could potentially “stop” at any time on a five lane highway, a bypass, or even worse….the expressway!!! ARE YOU KIDDING ME!!!! SAFE??? REALLY??? Can anyone help me avoid this potential disaster? I can’t afford to buy a new vehicle or even rent one! How, as a mother, am I supposed to fasten my children into this van and leave my driveway all the while knowing this danger? PLEASE CAN ANYONE HELP ME!!!

  • Milt Smith February 16, 2012, 6:05 pm

I have a 2005 Freestar , Transmission went with this problem in February of 2011 at 44,000 miles. This is now February of 2012 with what appears to be the same problem, a shudder in the transmission when it shifts in and out of overdrive at 58000 miles. I don’t suppose I’ll get my $3500 back from last year?

  • Dave Gibson February 19, 2012, 8:15 pm

07 free star, same problem trans took a dump with no forwarning Have it at shop now-waiting for the good news should have stuck with GM or anything without a F in it.

  • Carol LeBlanc February 23, 2012, 8:20 pm

Please include me in the class action suit or let me know how to be included in this. I have a 2008 Taurus AWD and the same thing has happened to me 3 times. The car suddenly losses power with no warning. Happened twice while pulling out onto a major highway and once taking a right hand turn onto another street. After a few seconds the power returned and I was able to drive it. This started happening at 46,000 miles. Ford will not do anything about it unless it happens to them while they are test driving my car. It happens at random so I cannot predict when it will happen again.

  • Billy R Hensley March 1, 2012, 8:35 am

My 2004 Ford Freestar has low miles. The first time I had a loud pop
and the transmission would not change into a higher gear. Got it off the
road by driving under 35 miles per mile. Had a new transmission
installed. The van would not start, but it had started fine before the
installation. The dealership has had the van several weeks. It is
now ready to go,they say, with a new pcn module and a piece of
new wiring harness in the dash area. I have lost faith in this Ford.

  • Margaret March 2, 2012, 11:21 pm

My Ford Freestar 2004 started acting weird with the electronics: the emergency brake light came on for nothing, then the oil light. Next I noticed the interior lights wouldn’t come on. When I stopped, the door wouldn’t lock. After being parked for half an hour, it seemed fine. Then after another quick stop in the grocery store, when I started it, it seemed like the battery had been disconnected because the clock reset itself. I started to drive it to the dealership, and the turning blinker wouldn’t shut off; then out of nowhere I suddenly lost power, and it seemed like there was a loss of steering control for a minute. I was able to get it off the main road as it chugged slowly along, and park it on a side road. As I took my foot off the gas pedal, when the van was already almost at a complete stop, it just lunged forward. I called the Ford dealership to book an appt. and they never even mentioned anything about a recall. My son looked it up on line for me, and found out that so many other people had the same problems as me. When I called back the Ford dealership, they said my VIN # was not one of the Freestars to be recalled. I asked how could that be when it’s a 2004? He put me on to someone else who said I would have to pay the towing fee and the diagnostics, and if the torque converter was the problem, I’d have to wait until April or so until the parts were ready. I asked about a loaner, and that was out of the question. Later, I talked to the manager, and he said that my VIN was on the list to be recalled. But since I had had the tranny replaced when the van was only a few years old, they would have to check the tranny serial number to see if that fell under the recall. I would have to pay all diagnostics which would cost $135/hour and would definitely cost more than an hour. This van has been in and out of the shop since I bought it – power steeringhose replaced every year, loss of power on other occasions, and told there was nothing wrong with it.

My wife and I own a 2004 Ford Freestar. I am in the military and my wife and children just left washington state going back to georgia when the vehicle with 98,000 miles stops accelarating and starts jerking when climbing hills or slowing down. We have replaced spark plugs, spark plug wires, fuel filter , air filter, and cabin filter but it has not fixed the problem. My wife has taken it to 3 different mechanics all stating that the transmission and torque converter was shot. My wife took the vehicle to a local Ford Dealer where the service supervisor told her that the parts would not be available to fix the transmission until the second quarter which is around the last of may. We have a disabled child that has many doctors appointments and this is the only means of transportation we have to get him back and forth to the doctor. Thanks alot FORD MOTOR COMPANY! We will NEVER buy a ford again and we have also told our family and friends to steer clear from purchasing a vehicle from Ford again!

  • Noah Norman March 7, 2012, 5:54 pm

I have a 2005 Freestar 92,000 miles, and no major issues. The torque converter went out. Took to local mechanic who was honest enough to tell me about the recall. Had ford tow to dealership and they replaced the converter under the recall. Now I guess i have been fortunate, I have had only 2 sensors go out (roll over sensor and an O2 sensor) but no other issues, the van actually has ran very well. But when my wife picked up the car from the dealership, it was slipping real bad, she drove it home so i could test it out. I took it back to the dealership, told them the problem, they told me that since it was not running when it came in, they have no idea if it was slipping before or not. So it is my problem, because Ford says this is not part of the torque converter issue, and the dealership swears the work they did can not cause it to start slipping. All I know is it was running great before the converter went out, and now it is like riding a bull out of the gate, and if I want it like it was before the converter went out, then i have to pay for it. (also, i went 2 weeks waiting on the converter to get fixed, and they would not pay for a rental car)

Boy, Am I glad I found this page. I have a 2005 Freestar that is stuck at a friends house as I type. Undrivable. I can’t get it it move 3ft. Check engine light is on and transaxle light is flashing now too. This is the 5th time this van has left me stuck. Each time it was a different sensor and a tow charge. Camshaft sensor, crankshaft sensor, transmission position sensor. PCM box itself is covered in silicone per Ford’s TSB “fix”. Who knows what it is this time. I am from a ford family and can’t imagine driving anything else. I guess I’ll see how they handle this. I know vehicles aren’t perfect and I usually don’t complain when there is an issue but this vehicle has pushed me to my limit. I am over this car. I’ll try to post an update.

Same thing, I was driving 55-60mph down St Rd… and out of no where the engine revs (cause my foot was on the gas) and we slowly coast to a stop… My 12 yr old daughter recovering from emergency surgery in the passanger seat… Now can not even get her to the doctor… currently on hold with Ford as I type this!

  • Michael Nesbitt March 14, 2012, 1:18 pm

2004 Ford Taurus approx 60,000 miles and same transmission problem yesterday. How do I get involved in class action law suit?

  • Michael March 14, 2012, 8:46 pm

Is this lawsuit still open? If so i want to join the rank of complaints. My van is currently in the shop as we speak with PCM issues and it needs to be replaced. This is after I have had $760.00 worth of work already last week. I have already replaced a tie rod, the a/c unit and the torque converter a few years ago. I also have had issues with the driver side automatic sliding door not closing at times ( it will just pop back open ). I have also had the rear latch rust shut on me so that I could not open it. I had to take the panel from the inside off and spray WD40 or some other rust remover to get it to open again. This van was a complete design flaw and the engineer must have been on something when he/she did. Terrible, why oh why would you put the PCM under the windshield where water could possibly drain into it?? AND then have the audacity to charge me to fix a flaw in the design! We need as many people possible to file a complaint to https://www-odi.nhtsa.dot.gov/ivoq/ so that this really starts to get attention. I did this a few years back when my torque converter failed and now they are issuing a recall on it. File complaints, do not let FORD win this one. The 2004 freestar was piece of crap from the start and they charged alot of people alot of money for and are still making money off of it from repairs.

Add us to the list of disgruntled 2004 Freestar owners. We’re on our 3rd transmission. Now, after only 6 months…same problem…loss of acceleration. I had to “limp” home from the market today at 10 mph!

March 16, 2012, my 80 Yr old Mom along with my sister and me were on vacation 500 miles from home, driving a 2002 Ford Taurus SES with approx 63,000 miles on it, the torque converter went out while driving on a 2 lane desolate road. The car kept going forward until we came to a stop sign, then no gears at all. Thankfully 2 men stopped and pushed our car off the road and then very shortly a Florida State trooper came and stayed with us until the tow truck got had the car loaded. The car had to be towed to be closest town 15 miles away where there was a Ford dealer, $1390 plus tax and 3 days later we were on our way. It’s my mom’s car, how does she join this class action suit?

  • Allison Thompson April 3, 2012, 10:43 am

On Friday July 24, 2009 the day before leaving for vacation I had to drive to Allentown Pa. to drop my dog off at my sister house which is about 65 miles from where I live. On our way back I was traveling on Interstate 78 when my van broke down. The only fortunate part of this whole ordeal is that it happened at an exit ramp which I was able to glide down the ramp and in to a gas station. Thankfully my husband was with me. We are not experts however we both felt it was probably the transmission due to no power when pressing on the gas accelerator when in drive or reverse. There was no slipping of the transmission, the indicators on my dashboard were OK, no smoke, no funny noises, etc prior to this trip to Allentown. There were no warning signs that this was going to happen. Our van had to be towed to a Ford Dealer in Allentown and we had to call my sister who could drive us to that location. The diagnostics confirmed that it could be pump and convertor or the entire transmission. The estimated cost $1550.00 or $3069.95. Since it was Friday at 3:30 pm it couldn’t be confirmed until Monday morning. At this point I was so upset for many reasons. We were in Allentown and needed to get home, not sure if we should go on vacation and if we decide to go how would we get there or afford it. My daughter who is 18 years old had to drive to Allentown to pick us up. Once we got home of course our daughter and son were very upset because of what happened to us. We had to make a family decision about vacation because it not only involved us but there were 2 other families going. We had to borrow my parents van for vacation and on our way home from vacation pick up our van which ended up costing $3107. Once home from vacation I reached out to Ford Customer Relations by phone followed by 2 letters. No one wanted to listen to my complaint or help me. At the time my van only had 47,000 miles. I also want to be part of the class action suit not just for the recall but the way I was treated by Ford Customer Relations.

I have a 2004 Monterey and received the recall notice the other day. I had no idea until then that there had been a recall. I guess I am one of the lucky ones so far because I have not had the problem of sudden loss of power (I have had other problems, just not that one.) I like others here am now very concerned with my families safety. I have called Ford Customer Service and several dealerships about the recall. No one knows ANYTHING! The person at Customer Service kept reading the same thing that was in the letter. I finally told her that I can READ and that she was not answering my questions. Bottom line was that even though parts were to be available 2nd quarter and we are into the second quarter, the parts won’t be available until June or July! Even the dealerships weren’t sure what they were supposed to do when the parts become available. So now I am supposed to drive this death trap for 3 more months???? I have already cut down my travels to necessary trips and have cancelled all fun weekend drives. Since the vehicles have been recalled and the NHTSA doesn’t agree with Ford that they are SAFE I think it is negligent on Ford’s part that loaner vehicles have not been provided to all the owners of the recalled vehicles. I am pricing loaners now, but not sure I can afford it. Then again I don’t think I can afford not to get a loaner either. I am not sure why it took Ford 2 months to get the notice letters out from the time they decided to Recall, nor why it is taking 6 months + to get the parts. Sounds like Ford is willing to gamble with their customers lives rather then doing the right thing. I was planning on my next vehicle being a Ford, however their lack of concern for their customers has changed that. That is over 200,000 customers plus family and friends that Ford is willing to throw away just to save a few buck.

I was driving home from my son’s little league practice last night and with out warning I lost acceleration. I slowly coated off the road and and to walk about 2 miles to get back to the park where my sons practice was. After I called the customer care line today I found out that ford has in fact issued a recall for the torque converter. My van matches the symptoms described by the previous posts. Its going to take up words of a week to fix my car and Ford has explained they will not give me loaner. We are a single income single car family. My heart is broken over this unfortunate situation I am in. I will post the results of the repair as soon as I can. Thank you for reading– Lauren

UPDATE– My local dealership did in fact confirm that it was the Torque Converter. Customer care has given me a courtesy car, paid all my towing bills, and will cover all the repairs 100%. Borgman Ford here in Grand Rapids has been extremely helpful. While it did take about 4 days to get the diagnosis and it be uploaded into the computer I am very relieved and happy.

My 2005 Ford Taurus lost the ability to accelerate when trying to pass a car. There was no warning that the trans would fail. Trans would not move the car in any gear. Trans fluid was full, and not discoloured, or burned. Trans shop reported mainshaft spline stripped at the torque converter. Total costs: $250.00 towing, and $2200.00 for trans repair. Ford taurus cars should be added to this class action lawsuit. This the absolute worst car I have ever owned. The car had 77,000 miles on it when this happened. At 85,000 Mi the fuel pump quit. This was a $700.00 repair, with a $200.00 towing charge. The gas gauge quit soon after I bought the car with 44,000 mi on it.
Ford will get a lot of negative advertising from me. (I am still badmouthing Allstate Insurance after they cancelled my fathers car insurance for an accident that was not his fault that occurred in 1960.)
