A class action lawsuit has been filed against CVS Pharmacy, Inc. (“CVS Pharmacy” or “CVS” or “Defendant”) in the United States District Court for the Central District of California (styled Lee Cheramie v. CVS Pharmacy, Inc., Class Action Case No. 10-cv-09527-R AJWx) alleging, among other things, that CVS Pharmacy brand of the dietary supplement valerian in 450 milligram (mg) capsule form exposed consumers who took it to 1.2 to 3.5 mcg of lead per day based on a dosage range of 1 to 3 capsules based on ConsumerLab.com testing, according to the CVS Pharmacy Valerian Herbal Dietary Supplement class action lawsuit complaint.

The CVS Pharmacy Valerian class action lawsuit complaint is reportedly brought on behalf of the following putative class of persons, unless otherwise excluded:

All consumers who purchased Defendant’s CVS Pharmacy brand of the dietary supplement valerian in 450 milligram (mg) capsule form during the Class Period, which is described as the period extending four years back from the filing date of this Complaint, or from the filing date back to the introduction of the Product, whichever is shorter.

The CVS Pharmacy Valerian Herbal Dietary Supplement class action lawsuit complaint reportedly asserts claims for violations of California’s Unfair Competition Law (“UCL”), Business & Professions Code 17200, and California’s Consumer Legal Remedies Act (“CLRA”), Cal. Civil Code 1750 and for breach of express warranty, fraudulent concealment, breach of implied warranty of fitness for purpose, negligence and strict product liability defect in design or manufacture.

The CVS Pharmacy Valerian class action lawsuit complaint reportedly seeks, among other things, an injunction, restitution, pre-and post- judgment interest, disgorgement, actual damages, punitive damages and attorneys’ fees and costs.

    I took 2 CVS brand Valerian capsules per day for at least 2 years. I tried to purchase more a few months ago and when they tried to ring up the sale, the cashier got a message NOT to sell the product. She actually went to the shelf and immediately pulled all of the stock, all brands and said she could not sell me any Valerian Root. Please let me know if I should have myself tested for toxic levels of lead.

    I’ve been taking CVS brand Valerian for at least 10 years! Two to three capsules per night. I haven’t made it to CVS for several months, so I filled in with another brand. But I’ve been planning to return to CVS for my valerian because the price is better. I just tried to find their valerian at the CVS website to order it online, and I was confounded that it wasn’t there. So I searched it on Bing and found your site. My questions are have I been contaminated with lead, and is there anything I can do about it?
