ConAgra Foods Parkay Spray Butter Class Action Lawsuit Complaint

Purchasers of ConAgra Food’s Parkay Spray Butter File Class Action Lawsuit Against ConAgra Over Alleged Fat Free and Calorie Free Representations.

A class action lawsuit has reportedly been filed against ConAgra Foods, Inc. (“ConAgra” or “Defendant”) in the United States District Court for the District of Nebraska (styled Pamela Sue Trewhitt v. ConAgra Foods, Inc., Class Action Case No. 8:12-cv-00287-JFB-TDT) alleging, among other things, that ConAgra’s Spray Butter is deceptively labeled, marketed and sold to consumers as “fat free” and “calorie free” when it allegedly contains 832 calories and 93 grams of fat per bottle, according to the ConAgra Foods Parkay Spray Butter class action lawsuit complaint.

Plaintiff reportedly brings claims in the ConAgra Foods Parkay Spray Butter case pursuant to Rule 23 of the Federal Rules of Civil Procedure individually and on behalf of the following a class of individuals (“the Class”) unless otherwise excluded:

All persons who purchased Parkay Spray from August 13, 2008 to the present (“The Class Period”) in the District of Columbia or any of the 50 States except Missouri.

The ConAgra Foods Parkay Spray Butter fat free and calorie free class action lawsuit complaint asserts claims for the following alleged causes of action: violation of the Nebraska consumer protection act, violation of the Nebraska uniform deceptive trade practices act, breach of express warranty, breach of implied warranty, unjust enrichment, misrepresentations and fraud by omission or concealment.

The Plaintiff and the putative class in the ConAgra Foods Parkay Spray Butter class action lawsuit reportedly seek damages in the amount of monies paid for Defendant’s Spray Butter and/or other consequential or incidental damages, actual damages, statutory damages, punitive or treble damages, pre-judgment and post-judgment interest, equitable and injunctive relief and reasonable attorneys fees and costs.

    Who would I contact to be one of the plaintiffs in the Parkway lawsuit? I am so upset about this. I’ve been using this product for many years thinking I was cutting back on calories and fat. I feel betrayed by this company. Shame on Conagra.

    So basicly, this product is no better on calorie/fat savings than a regular tablespoon of butter, as the bottle contains 8 oz. (1 oz butter = 100 calories). I’ve bought probably close to 50 bottles of this product since 2005, thinking I was using a “calorie free” food! In addition, the butter spray variety costs much more.

    I would also like to be contacted. I have purchased this spray butter over several years thinking it was fat free and calorie free to spray on my steamed veggies, and now to learn it is all a LIE…….

    I have been purchasing this product since it came out on the market and purchase at least (1) one bottle per week. I always thought it was better than regular margarine and now I know why still have the belly flab! I currently have a bottle in my fridge and just threw away an empty bottle 2 days ago. Maybe I will throw this one out as well.

    Although I don’t use the product it is the false labeling and ability to label a product “calorie-free” if it is under 5 calories that triggers me to not eat. I am already always stressed and freaked out about food that has more calories, I don’t need to stress out about my food that I think has 0 calories… Ugh I think an act under the FDA should require foods that have under 5 calories to label wither with the exact number of calories something has or to put the calories<5 like gum packets do so people like me don't now feel the obsessive need to not eat anything. I already don't trust food now this just makes it worse…

    I would really like to know who to contact about this. I am beyond furious, I have a son with a rare metabolic disorder and can only have 20 grams a fat A DAY!!!! We have beed using this product for years trusting it was fat free! Really this is not just about trying to eat healthy for us this about my little boys life, eating to much fat will kill him!!!!

    I have avoided anything that says it has zero calories as I am very skeptical of the claim. If anything comes from this law suit, I wish there could be a requirement that products not only list the per serving nutrition but also the entire container information. I have seen a few products that do that and it provides reality check.

    I have been trying very hard to reduce my weight for medical reasons. I’ve never been fond of the taste/texture of this butter substitute but have used it since January 1, and more sporadically in the years before 2012. I feel really cheated. How do I become part of this class action suit?

    Where is the FDA in this content labeling disput?e If the aligation is true and there is an FDA violation (and it should be if not), this would appear to be an example of why business hates and blames TO MUCH REGULATION as a deterrant to profits. This company has made huge profits on this stuff, SO WHAT’S IN IT????? My wife use to pure this crap on corn on the cob thinking there was nothing in it. Several other brands have cropped up in the last few years sellin the same type of stuff, and most can’t be kept on shevles.

    BLAH BLAH BLAH. That is what this is. I have been using Parkay butter spray for over 12 years. In fact, one bottle per day. I use it on everything. I am a very healthy woman weighing only 125. Money is the root of all evil. Ya’ll remember that.

    For years I have used Parkay Spray Butter thinking I doing such a good job of taking care of my body by cutting calories. Now I find out I was a lie. Shame on ConAgra!

    I have been using this product for longer than I can remember. I thought it was the only safe margarine since it didn’t contain the chemicals that made margarine solid. I would say I purchase at least one per every three weeks since 2009.
