Consumer Files Class Action Lawsuit Complaint Against Learning Curve Brands d/b/a The First Years Company, Summer Infant, Kid Brands d/b/a Sassy, Dex Products, Kiwi Holdings d/b/a Basic Comfort, Prince Lionheart, Baby Delight and Munchkin Over Marketing & Sale of Baby Sleep Positioners.

A class action lawsuit has been filed against Learning Curve Brands, Inc. d/b/a The First Years Company, Summer Infant, Inc., Kid Brands, Inc. d/b/a Sassy, Dex Products, Inc., Kiwi Holdings, Inc. d/b/a Basic Comfort, Prince Lionheart, Inc., Baby Delight, Inc. and Munchkin, Inc. (collectively “Defendants”) in the Circuit Court of Cook County Illinois (styled Xochitl Caldera v. Learning Curve Brands, Inc. et al., Civil Action Case No. 10 CH 44099), alleging, among other things, that Defendants falsely represented that their baby sleep positioners are effective in preventing crib deaths and that the baby sleep positioners are safe, according to class action lawsuit news reports.

The baby sleep positioner class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of the following:

All persons in the state of Illinois who, at any time within the applicable statute of limitations purchased any of one of Defendants’ baby sleep positioner products. Excluded from the Class are Defendants’ officers, directors and employees.
