Apple iTunes Gaming App Class Action Lawsuit Complaint Filed Over Gaming Apps In-App Gaming Currency Purchase Authorizations

Parent Files Class Action Lawsuit Complaint Against Apple Over Alleged In Game Currency Charges or Purchases Incurred By Minors In Free iTunes Gaming Apps.

A class action lawsuit has been filed against Apple, Inc. (“Apple” or “Defendant”) in the United States District Court for the Northern District of California (styled Garen Meguerian v. Apple, Inc., Civil Action Case No. 11-Cv-1758), alleging, among other things, that Apple, a leading seller of “Apps,” i.e., software applications that users download on their mobile computing devices on the Apple iTunes platform, offers many gaming Apps that are designed to induce purchases of “In-App Purchases” or “In-App Content,” i .e., virtual supplies, ammunition, fruits and vegetables, cash and other fake “currency,” etc., within the video game (“Game Currency”) and allegedly enabled minors to buy such Game Currency, in one click sums of $99.99 or more, without entering a password and without the authorization of their parents,according to the Apple Gaming App In Game Currency class action lawsuit complaint.

The Apple iTunes Gaming App In Game Currency class action lawsuit complaint is reportedly brought on behalf of a putative class of persons as follows, unless otherwise excluded:

All persons in the United States who had an iTunes account and paid for a purchase of Game Currency made by their minor children without their knowledge and authorization (the “Class”). Excluded from the Class are Apple; any entity in which it has a controlling interest; any of its parents, subsidiaries, affiliates, officers, directors, employees and members of their immediate families; and members of the federal judiciary.

    I HAD THE SAME PROBLEM. 11 YEAR OLD, BAKERY GEMS AND 30 OTHER GAMES $479. APPLE REFUSES TO GIVE THE MONEY BACK. THE FTC SHOULD SHUT THEM DOWN. !!!. THANKS FOR YOUR EFFORTS. WHAT WOULD IT COST ME TO JOIN YOUR CLASS ACTION LAW SUI T? I TUNES ACTION IS THE MOST UN AMERICAN ACTION I HAVE SEEN IN A LONG TIME DON

      I completely agree. I am going to keep on them. Don’t communicate via their ridiculous email support. Call their head office in California.

    This has happened to me, also. My seven year old downloads apps, inadvertently making purchases. The total charges stand at over $1500.00. Of course, apple refused to refund or credit the charges. They are committing highway robbery, making money hand over fist with these apps. I am not done yet. I don’t intend to take “No” for an answer, especially knowing I am not the only one to be taken advantage of. The apps are so misleading. If you have charges, keep fighting…they don’t deserve anyone’s hard-earned money. Not to mention, many other people will complain, if they haven’t already.

    I suggest you contest the charges through your credit card issuer. It shouldn’t be a problem demonstrating how were ripped off, and the credit card bank is obligated to refund any money obtained fraudulently.
