A September 2008 decision of federal Judge Jack Weinstein to certify a class action lawsuit pending against Eli Lilly & Co. (“Eli Lilly” or”Defendant”) in the United States District Court for the Eastern District of NewYork, Brooklyn Division (styled UFCW Local 1776 and Participating Employers Health and Welfare Fund v. Eli Lilly & Co., Civil Action Case No. 05-CV-4115), alleging among other things, that Eli Lilly engaged in the improper marketing of the schizophrenia drug Zyprexa, to pension funds, union and insurers, allegedly causing them to pay more for Zyprexa than it was worth, purportedly in violation of the Racketeer Influenced and Corrupt Organizations Act (“RICO”), has been reversed on appeal by the U.S. Court of Appeals for the 2nd Circuit, according to a class action lawsuit news report.
