Wells Fargo Class Action Settlement Of Class Action Lawsuit Against Well Fargo Brought By Wells Fargo Homeowners Over Release Of Mortgage Liens.

A multi-million dollar class action settlement has been reached in a class action lawsuit against Wells Fargo Home Mortgage, Inc. and Wells Fargo Bank West N.A. (collectively “Wells Fargo” or “Defendants”) pending in the Cuyahoga County Court of Common Pleas (styled Bartley v. Wells Fargo Home Mortgage, Inc., Civil Action Case No. CV-02-469375 and Coleman v. Wells Fargo Bank West N.A., Civil Action Case No. CV-02-471327), alleging, among other things, that Wells Fargo failed to release mortgage liens within 90 days after payoff, purportedly in violation of Ohio law, according to a class action settlement news report.

    My mortgage was a part of this issue. However, since the mortgage recording dates, I have since divorced but retained the house (& mortgage). While both names were on the original mortgage, only my ex at his current address was sent the info. I completed the information, supplied all necessary documentation including the divorce decree, copy of the quit claim deed and everything required. The settlement was sent to my EX, again at his current address and nothing to me. Therefore, I have not seen the money. I’ve sent SIX letters including the original packets of information to the original P.O. Box in reference to this issue. Way to go geniuses…….am I really going to have to file something against you for this too?? Come on!!

    I’ve just found out about this,and am not surprised.My husbands’ disability check was frozen in his Wells fargo account,and even after we fought for its’return and recieved LETTERS FROM WELLSFARGO LEGAL DEPT.,RELEASING THE FUNDS,THE BRANCH OFFICE STILL REFUSED TO RELEASE MY HUSBANDS FUNDS!THESE ARE THE WORST IN THE INDUSTRY,AND THE PROOF IS PILING UP AROUND THEIR EARS AT W.F.

    I am not sure what to do, I received a letter which made no sense to me since the property had already been foreclosed on and thought that it did not pertain to me since I had been out of the home for 3 years or more and my son informed me that it did pertain to when I had the loan and that I needed to find out more and what to do. So I am asking for advice here on what steps I need to take, because of this foreclosure I had to file bankruptcy and I don’t know what this is all about and what and how it involves me? Can someone please lead me in the right direction?

    I have a mortgage loan with Wells Fargo/ ASC and it’s a shame how this company has done. I had started two Mods with them and each one they mailed back payments and sent me into forclosure. They filed another bank in bankrucupty court with my mortgage loan. and while in bankrucupty well fargo once agan tried a loan mod but i was afraid they would do the same thing and i have been in bankrucpty twice with each mod onec they mailed back payments. I am looking for some release and a lawyer to file suit for my hardship that this has put me and my family in.

    I have been late by 1 month with my mortgage payment and was charged an additional $150 because they sent an inspector to see if I still lived at the home. Nevermind Wells fargo called at least 5 times a day to as me for payment; also, I have never seen or known of anyone coming to my home. How can they tell just from the outside if I still live here…furthermore, if I didn’t live here, I don’t think I would be trying my best to get up to date with my payment (which is almost impossible since they continue to add “inspection charges”, late fees, etc. to the current montly payment!!!!!!!

      have had this same issue with WF as well as 100 others. They have not been applying my payments or over 1yr even tho. I have paid promptly. I hate this company! Every time I have called them about anything I receive a different answer. When I asked about the fee for someone coming by to see if I still lived in my home; I was told that if the house is maintained then you live there and they charge a varying fee depending on what company came by to see if you were still living in the house.
      I have refused to pay this fee so it stays attached to my statement each month as other fees. I had one employee tell me as long as I made my regular payment they would consider me up to date on my loan. So far that as been the case so when pigs fly I will pay those other fees. I need to sue these con artist for all the things they have done to me but again until pigs fly I cannot do so because I cannot afford a lawyer. I did however send a letter of complaint to my states attorney about their cheating, lying, stealing ways I hope this does me some good. I am also included in two class action law suits with them but I expect to be dead before I ever see one penny from those law suits and it probable will be a literal penny too.

    I was recently divorced (minus an income) and both my kids were of age where my child support payments were to stop (minus an income)…I contacted Wells Fargo and asked to remodify my mortgage because I was minus 2 incomes….I tried for 5 months (each month filling out income documentation), but nothing happened. I called them on month 5 of waiting, and asked what was going on. I was told that my claim went into arbitration…I asked if that would take another 5 months of waiting and that I was sinking further and further behind…I was told “we don’t know how long it will take”….I then told the customer service rep. that I could not wait and that I would be returning my keys…she said you cannot do that and I said “watch me”. I told her that Wells Fargo was of no help to me and no one cared if my 2 kids and I lost the house and lived on the street. I am glad Wells Fargo got sued and lost this case. They treated many people unfairly.

    I would love for WF to reimburse us for all the deceptive charges and a forceable foreclosure that they did through fraudelent means, lies and more lies. We lost our new home after my husbands layoff and WF offered a loan modification agreement but only if we let it default for 3 months to get this program. They lied and changed payment amounts, charges, etc and even though we had a realestate investor contacting them for weeks to buy it they misled him into believing they would sell the loan/home to him all the while sending us to foreclosure, which they did in April of 2006! They notified us it was foreclosed on and gave us 10 days to vacate the home which we did…they are the most fraudelent mortgage/bank we have ever had to deal with! They bought our loan on the home from our original lender and from that point it was down hill!

    Class actions are such small returns for all they stole they should be in prison.Straight up stole my home. hope to see more or everyone foolish enough to still be doing business with them pull their money on same day .And what happened to the overdraft fee settlement? I guess they have stolen enough of our money to buy whatever kind of justice they want.Don’t get me started with our pathetic government.

    Wells Fargo forclosed on my Ocala, florida home. After trying and was promised a modification my home was foreclosed and I was put out. I am now staying with friends in Lake Worth, Florida. I believe I am owed some restitution.

    I have been dealing with the fraudelent behavior of Wells Fargo since 201o. I tried to get a modification with them due to not being able to afford my mortgage from the constant increase sometimes twice a year base on “short escrow”. The first modification took me over 7 mos to obtain after they constantly lied about not getting faxed documents they requested or having to constantly re-tell my problem to each rep that answered. In the end, they kept lying about sending me the modficiation documents to sign and threatened to cancel the entire agreement if they did not recieve the “never sent” forms back. I had also sought help from NACA as well while dealing with W.F. and only after telling NACA what I was going through, did they finally give me the modification. The payment lasted 9 mos and then began to increase again. When I called the 2nd time to seek help, the customer service reps were rude and would give me the run-around. After becoming frustrated, I began telling them I was recording our conversations. At that point, they would hang up on me. After months of getting no where, I recieved a letter from their attorney stating they were foreclosing my home. I again tried to seek help. They finally agreed to a modification but told me foreclosure proceeding would continue. I am now on a trial 3 mos payment plan but is still getting notices from various law offices stating foreclosure filing has been done by wells fargo…. I feel they want homeowners to lose their homes and dont want to help you. Not sure what will happen to my situation in the end.

    yes our pick- a -payment was fraud the file has my wife and i making $7,600 monthly, we make $ 2,400. monthly, and on fix life annuity benefits, so this is fraud.

    I have been with Well Fargo Home Mortgage, Inc ; for some years,they tried to forclouser;at the same time my retiredment check was in the mail, I paid them in a hurry ,becauswe I had heard how they”ll do you…I pay”em every month automatic dedction with 6% interest and I have been with’em for atleast 20 years,need to file a class action law suite with Allstate Inc.I have home owner Inc. but cannot add my car…They should look at your pay HISTORY,and consider to lower your INTEREST Rate;this would be good BUSINESS

    Wells Fargo Home Mortgage wouldn’t let me sleep! They called me when I fell behind late on my mortgage hundreds of times day and night, (7) days a week, Monday – Sunday from 7:am-12:midnight with some machine recording. I told them to stop calling and the calls increased.
    Well, can someone tell me if they are customer friendly or collection gangsters? I couldn’t believe they call on Sundays when they aren’t even open for banking! So disrespectful and distasteful of Wells Fargo!

    I was with wells fargo since 1995 and never miss a payment they received payment every month by military allotment and never miss one had nine years to pay off then they stuck it to me trying to still what I have done since 1995 then one I was told to get out because they had foreclose my house I was stung shark and hurt I fault for my country and to see what they done to me and other soldier I hope they learn a lessing and may god bless wells fargo

    I missed one payment on my home in Missouri and went in to the Wells Fargo office and explained to them that I had lost my job and that I would try to pay them in 15 days. I was told that they were going to foreclose. I then went back to them and asked them if I could move out, hand over the keys and give them a deed in lieu of foreclosure since I wanted to avoid having a foreclosure on my credit report. They refused….I was amazed! This company would rather pay the costs of processing a foreclosure, ruin your credit rating and foreclose after one missed payment. I have nothing good to say about these a**holes.

    My nightmare began in 2007. I had purchased a vacant lot from my village and used the city engineers building plans. I had FEMA come out and assess the property, mind you 18 years prior. I never missed a payment nor was never delinquent. Wells Fargo purchased my mortgage in 2007 and two years later I was out of my home. I was a single mother of two and I had never encountered such mayhem in my entire life. I would make a payment electronically so I made sure my payment was on time. After three months I would recieve notice that I was entering the foreclosure process. So quarterly I would get a notice that my payment was placed in a unapplied account and that I had to come up with the last three payments to put me back on track. I was then notified that my home was in a flood zone and that they had purchased me some from Lloyd’s of London. Shocked, I went and paid for another engineer to access my property and purchased my own flood insurance from Farmers. Wells Fargo would not accept that. They insisted I bought the policy from Lloyd’s of London. Again, I’m a single mother with a low wage job that just happened to be good with the dollar. Unfortunately, after two years of playing this cat and mouse game and never getting the answer as to where my funds were in their so called unapplied account. To this day I don’t! After 18 years of hard work I lost it all. Just like that! I did not remortgage my home so therefore I did not borrow more than I could afford. I just wasn’t fortunate enough to fight this beast! Thanks you greedy bastards!

    I have a 2003 King Ranch with two Dealer EGR and one factory turbo that has been replaced by Fresno Ford Dealers under Ford warranty at 80,000 miles. Within 1,900 miles the turbo went out again, with another factory extended warranty at $2,400.00 the dealer would repair it. At just shy of 100,000 miles the turbo went out again! Ford was not able to fix it so I took it to Browns Automotive in Riverdale CA. They installed a new after market turbo, EGR, and re-programmed the the transmission. Ten thousand dollars later and I still worry whats next.

    I was one of those included in the class action suit against Wells Fargo. Unfortunately, I have spent five months in the hospital or rehab, and lost track of what was happening in the case. My big problem is, I can”t remember the name of the lawyer who was representing me, and I am at a different address. So the lawyer can’t reach me. So I can’t find out if I have any money coming to me. And, at 76 I could really use some financial help.

    Does anyone have any suggestions? Help!!!…Please!!!

      I am 70 and write everything down, and put copies in two places. I do NOT trust my memory. Have your mail forwarded from your old address to your new one. The Post Office has those forms.

THEY HAVE HARRASSED ME ON A REGULAR BASIS FOR NO REASON, ADDED CHARGES TO MY ACCOUNT THAT I HAVE NEVER HEARD OF SUCH AS REGULARLY SEND OUT A INSPECTOR TO CHECK CONDITION OF HOUSE AND IF ANYONE LIVES THERE, I HAVE NEVER SEEN A INSPECTOR AT MY HOME AND NEITHER HAS MY NEIGHBORS, AND THE PEOPLE THAT WORK THERE ARE UNDERTRAINED IDIOTS. THIS COMPANY SHOULD BE PUT IN PRISON.

    I have a second mortage that Wells Fargo underwrote we signed the paperwork and then a couple of days later the mortgage underwriter called to say that there was an error on the original paper work and they needed us to come back in to take care of it. Then recently found out that they changed the first loan for an interest only loan with the loan amount ballooning at the end of the stated time period. We live in Florida and when the housing market dumped we had to declare bankruptcy at that point Wells Fargo would not deal with is or the bankruptcy court . Can anyone tell me how we can get them to work with us to reduce the loan?

      YOU declare bankruptcy. Wells should have no say what you can include or not include. Your lawyer is the one who should tell you. Get everything in writing. Send emails. Don’t be a sheep. Above all, don’t listen to Wells Fargo.

    I paid my mortgage off that was with Wells. They tried to sc-re-w me with the extra payments I was making to “Principle”. They applied it to “An advance monthly payment”. I checked every month with their mortgage dept. that this was corrected and got written confirmation. After the third “Mistake” I complained to the “Comptroller of the currency” (The government agency that regulates Well Fargo) and things went smooth from there.
