A class action settlement has been reached in a class action lawsuit pending against Twentieth Century Fox Film Corp. and Twentieth Century Fox Home Entertainment LLC d/b/a Foxstore.com (collectively “Twentieth Century Fox” or “Foxstore.com” or “Defendants”) in the United States District Court for the Northern District of Illinois (styled Victor Lozano v. Twentieth Century Fox Film Corp. and Twentieth Century Fox Home Entertainment LLC d/b/a Foxstore.com, Class Action Case No. 09-06344) alleging, among other things, that Twentieth Century Fox and/or FoxStore.com caused unsolicited text messages advertising the DVD release of animated motion picture Robots to be sent to consumers’ cellular phones, purportedly in violation of the Telephone Consumer Protection Act, 47 U.S.C. section 227 et seq. (“TCPA”), according to the Twentieth Century Fox Robots DVD TCPA text message class action settlement notice.

The Twentieth Century Fox d/b/a FoxStore.com Robots DVD TCPA unsolicited text message SMS class action settlement reportedly provides that Defendants have created a settlement fund of $16 million (the “Settlement Fund”) from which Settlement Class Members may be entitled to receive $200 in the form of a check, unless the expenses, fees, and the number of valid claims requires that Settlement Class Members receive a lesser pro rata share of the Settlement Fund.
Twentieth Century Fox d/b/a FoxStore.com Robots DVD text message class action settlement class members who wish to receive a settlement payment must submit a timely, truthful, accurate and properly completed Claim Form that is submitted to the Settlement Administrator online or postmarked by mail no later than May 30, 2011.
Twentieth Century Fox d/b/a FoxStore.com text message class action settlement class members who wish to exlude themselves or opt-out of the class action settlement must send a signed letter (with name, address and 2005 cell phone number) requesting exclusion no later than February 15, 2011 to the Lozano v.
