Volvo XC 90 MY 2004 Purchasers File Class Action Lawsuit Against Volvo Cars of North America Over Alleged Defective Transmissions.

A class action lawsuit was filed against Volvo Cars of North America, Inc. in the Superior Court of Bergen County, New Jersey (styled Jason Ludwig & Christopher Larsen v. Volvo Cars of North America, Inc., Case No. L-4624-10) alleging that the 2004 Volvo XC 90 had a defective transmission but that Volvo failed to provide a recall, service bulletin or dealer campaign, according to a class action lawsuit news report.

The Volvo class action complaint reportedly alleges six counts:  breach of implied warranty of merchantability, breach of express warranty, fraud and violation of consumer fraud act, violation of Magnuson-Moss Act, strict liability, and punitive damages.

    how about volvo xc90 2003 models also?; all research on the internet shows the problem to be with 2003 moel also and ours had to be replaced and intitial comments to me via the dealer was that is was common for failures on the 2003 model and a backlog on replacement transmissions. mike krebs mikekrebs@embarqmail.com

    I am in the same boat with my XC90. Has anyone contacted you in Canada yet. I spoke with the firm in the US they have not heard of anything in Canada yet. If you here of anything let me know.

    I purchased a new 2004 Volvo XC 90 T-6 AWD in May of 2003. I paid cash $48,000. With Volvo’s reputation I decided against an extended warranty. Huge mistake! Including all of the mentioned problems that everyone has with this vehicle i.e. (front end noise, tire wear, radio, leather, lights, stereo, etc. etc.) I have also had to replace the entire Rack and Pinion steering system around 70,000mi., $2,800.00. At 90,000 miles the ABS braking system had to be replaced, $3,000.00. Ever since I had the timing belt replaced at 105,000 mi. the vehicle makes a engine noise at speeds over 30 mph. Now, at 124,000 mi. the transmission has gone out. I have complained for years about the transmission slipping and jumping, and the front end grabbing and slipping on turns. Everytime, the dealer says it was a computer adjustment and it has been fixed. Volvo refuses to replace or help pay for a new transmission because the vehicle has over 100,000 mi. Now I’m out another $6,000.00 for a vehicle that is only worth $10,000 at best.

    I have a 2004 XC90 101,000 miles and the urgent transmission light came on. Volvo dealer stated I needed a new transmission over $7,000. Please advise how I can be part of the class action suit.

    How many miles? Where are you located? It is my understanding if you take it to a Volvo dealer and it is under 100,000 miles and have service records, Volvo Corporate will repair. Mine had 101,000 and Volvo customer service people were prefessional or courteous, however the dealers I worked with were great!

    also interested in being part of this. Barrie’s post is haunting as we also bought our 2004 XC90 new and are the original owners. Transmission Service Urgent light came on this week as well. Vehicle is at the dealer right now and they are contacting VOLVO USA to see what their response will be, they are hopeful that VOLVO USA will take care of this. We had no knowledge about the issues with the transmission until yesterday and are quickly becoming educated.

    My XC90 mileage was approx 105,000 kms. After three weeks, Volvo corporate agreed to pay for the parts but not the labor. My dealership, Volvo of Surrey (BC), offered no assistance, other than their co-operation with head office in verifying the problems. I learned that my dealership’s service department and sales staff had been aware of the XC90 transmissions problems, but had never warned me. After further lobbying both the dealership and corporate office in writing, Volvo corporate reconsidered and agreed to cover the labor, too (remember, they don’t pay the same rate as consumers for parts or labor). Factors that I believe were taken into account to reach this final decision were: my long history as a Volvo owner, the fact that all of my previous XC90 repairs had been completed by the dealership, proximity of mileage to that magic 100,000 km, the fact their staff knew and never warned me when selling and repairing the vehicle, and my promise to share the outcome — good or bad — with simply everyone I know, including the online community. I am keeping that promise. The whole exhausting process took a month and completely destroyed my confidence in both the Volvo product and the company’s care of its customers. After 30 years of owning Volvos (my husband does, too) I now drive an Infiniti and highly recommend this brand.

    Was curious as well in knowing if the 2003 XC90 would be considered in lawsuit. My Volvo has 80,000 and the transmission urgent repair light came on. Service department is saying the transmission needs to be repaired but better yet, replaced. Having a transmission go out at 80,000 is ridiculous for any car, let alone a Vovo which is considered to be a very reliable, well built car ….. at least I thought? Would like to know more about the lawsuit.

    I have a 2003 xc90 as well and have had major issues with this car. Had the transmission replaced with70,000 miles on it and beleive I will have to do the same again. Will find out tomorrow the leather is falling apart, front end noise, braking system failure and the list goes on and on…..never thought I would have so much trouble with a car made by Volvo!! I have a 1993 Volvo wagon that just keeps on going and then this piece of junk that keeps on going to the repair shop. So frustrated.

    I had a transmission replaced at 72,000 miles. At 110,000 miles it went again. I paid for the first transmission. Volvo paid for the second transmission, but with the second repair I had a $1200 drive shaft replaced and an $800 car rental fee. When I finally got the car back, transmission fluid was pouring out of the car. I took it to two dealerships and got an estimate of $550 and $1200 to repair the leak. I got so disgusted I practically gave the car away on Craigs list. I also went through five sets of tires because it was always out of alignment. Volvo customer service never replied to any of my letters

    Bought a used 2004 XC 90 with 50,000 miles from a GM dealer (trade in). Dealer sold me an extended warranty $1,500. Three days later my wife was driving the car and was 90 miles from home when it went into limp mode and gave the transmission service warning. Towed it to the local Volvo dealer and they said it needed a new transmission. 1st….the extended warranty company said it was not coverd because it was “pre-existing”. After numerous emails and phone calls to Volvo …..they sent me a coupon for 20% off my next service and accessories and basically said good luck with that transmission thing. The GM dealer paid for the transmission replacement and the rental car….the GM dealer went way beyond what they had to do. Now I have a bad ABS module ($1500) which has locked up the odometer….so I don’t know how many miles I have currently….I estimate just under 100,000. Just last week the transmission is not shifting exactly right and it feels like the power steering goes out when the transmission acts up. The local dealer told my wife that Volvo was fixing the transmissions now…when they fail. I guess I may be finding out soon if the factory is finally going to do the right thing.

    I too own a 2004 Volvo XC 90 6cylinder and we are just beginning the transmission problem – interesting that our dealer -who we have trusted up till now- told us the problem was the head gasket – only after contacting several mechanics we have discovered that we are having a trany problem – all the same messages and lights are going on and the dealer said it’s a “head gasket” problem.
    We live in Newark California – has any class action begun on the west coast….

    My 2004 Volvo XC90 had the transmission replaced 22 months and was well under 100K miles, just last week they told me it has to be replaced again! I have an estimate now of $7331.90 and this after I just paid them $4K 22 months ago. We definately want to be included in a class action lawsuit. The dealer even told me over the phone, this is a “known issue”.

    How can I also be included? I am having the same issues with my 04 XC90, at 133K. I also found out to late that this was a common issue with these and that Volvo has failed to address the issue and make good on their warranties and liabilites for this. Many customers have already paid for the repair and are again having to go throught the same issue again.

    We own Volvo XC90 2004 for over a year, and it has about 115K. My wife was driving 2 days ago and the transmission is gone. we had to tow it and the repairs are above and beyon reasonnable cost. I think enough is enough, Volvo needs to take care of this problem seriously. If they know about this problem it should have been a recall long ago. Please ad me to the class action. I started hating Volvo for their denials.

    I too live in WI. My 05 XC90Volvo is in the 90k range. It just came back from Fields in Madison due to the ECM, ICM, wiring harness, and rear wiper motor all being shot. This was due to the bad plenum allowing water in and that was a known service bulletin and I need in on that class action suit as well. Did you have your transmission work done at Fields in Madison? If so was it easy to get them to replace the tranny? Mine isn’t out yet but with all the things I have replaced I just get that feeling it is coming. Any info you have is greatly appreciated.

    I am wondering if this lawsuit can be extended to the XC70 – I am having the same transmission problem – I have been having it for the past year and software updates did not work. At this point, my only choice to keep the Volvo is to replace the transmission. I will most likely trade this car in for a Honda. I am so disappointed with Volvo and will never purchase one again.

    2004 XC70, 110,000 miles, transmission just went out today. $5300 price tag. I bought this Volvo brand new, and put up with the criminally expensive maintenance issues, and absurdly high labor costs of my local dealer in Denver, CO with the expectation that Volvo was a safe, reliable car that I was smart to invest money into for the long term, hoping all the while like a fool that this was a vehicle that could make it to 200K with proper maintenance based on the older model Volvos I see tooling around town. This was the first, and the last Volvo I will ever own.

    I am the owner of a 2004 XC90 and at 126,000 need to put in the 4th transmission and replace the radiator where metal debris has clogged the cooling lanes. The vehicle has never been off road, abused and is serviced regularly by the dealer we purchased it new from.

    I have had a Volvo XC 90 T-6 AWD for approximately a year which has about 104K miles on it. A few weeks ago a “Transmission Service Urgent” message appeared on the message screen so I took it to the nearest transmission repair place. I ended up having to come up with almost $3,000 to pay for the transmission work. When I contacted Volvo, I was told that there was no chance my repairs would be considered because I did not go through a Volvo repair center. I don’t know what has happened to the Volvo name but I think it’s deplorable that Volvo would not voluntarily make whole the very people who’ve trusted in them. Please include me in any current or future class action lawsuit against Volvo!

    I purchased a 2004 XC90 T6 new and had it serviced regularly at the dealer. At 83,000 miles the transmission went out. I took it to Weiss Brentwood Volvo who imediately worked with Volvo to replace the transmission, radiator & oil cooler for NO CHARGE. I didn’t even have to contact Volvo, the dealer took care of it. My car was repaired in 3 days and had a loaner car. I know others have had problems but it seems Volvo is now stepping up.

    Our transmission just went out. We are waiting for a reply from Suntrup Volvo in Ofallon. We bought our car new from the Brentwood dealership in 2003 (2004 XC90 T6). Hopefully Ofallon will follow what Brentwood is doing. I contacted customer care and they are now aware of the problem. They also informed me for my particular model that there are two extended warranties. One if for the fuel pump, 10 yrs, 150,000 miles, and the other if for faulty check engine P45, 10 yrs, 120,000 miles. Will keep everyone updated.

    Volvo of Ofallon did the right thing and replaced not only the transmission for free, but also a few other parts as well. If you don’t get the answer you want from your local dealership, contact volvo headquarters. They will get you taken care of as long as the car has under 100,000 miles.

    I have a 2005 XC90 T-6 that went into the Volvo dealership this past week due to transmission failure. I bought it new from the same dealer, our 9th Volvo purchase. Is the 2005 model year T-6 included in the class action?

    I also bought an XC90 used with about 60,000 miles and the transmission went. I had the trans rebuilt. It seems like there was a problem with the
    T6 turbos and Volvo knew it but did nothing to help cover the cost. I just had the brake booster & brake vacuum replaced at a cost of $1500. I am now told that I need the DEM Module replaced for $1895 and a timing belt & tensioner for $935. My Volvo has only 104k miles on it. Volvo will certainly lose a lot of customers if they don’t stand by their product and help everyone out.

    I also have the 2004 XC90. Last month had the CEM replaced (over $1100.00), due to Electrical failures, now having issues with slipping and sputtering during acceleration or uphill about 40-50 mph and fear this is also a transmission issue. At dealership now holding my breath to see what THIS will cost! Loved the car before fear now buying a Volvo was a very bad investment!

    I own a 2004 XC90. I am the original owner and have taken very good care of this car. I have to start by saying I love it! I can’t think of any other suv I would rather be driving. That being said, I found out today that my 104,000 mile volvo needs a new transmission $5500. They have offered to pay for the parts and I would pay for labor $1400. After reading all of the above comments, I will be calling them tomorrow. I have had so many problems with this volvo since I brought it home from Sweden in early 2004, all mentioned previously. I just don’t want any other car. Kinda stuck between a rock and a hard place here.

    Just got our estimate for $10 K to fix our transmission and engine support pads on our 2004 XC90. It first started the warning light at 86,000 and no one could figure it out. We will not pay that amount to fix the car. Rather sell it for scrap than pay that amount! I would like a lawyer to contact us if this class action litigation goes through

    I too have an 2004 XC 90. Just hit 80k today on the way to work and tranny quit shifting, just engine rev. Towed and stranded! Have put countless dollars in this car. 4 sets of tires in 79,000 miles, power steering pumps, fuel pumps, tie rod ends…..when will it end? Include me in this suit. What a piece of junk.

    At 158,000 miles and 2 transmissions later my 2004 is in need of a THIRD transmission!! The second transmission fell under my extended warranty and was replaced at the dealership but now the dealership is saying I would have to pay 5500 for a replacement.     Same problems. Had transmission replaced at 60,000 miles. Replace steering column (rack and pinion), replace radiator and coolant system, replace bearings at 90,000, blown shocks,faulty alarm system (it would randomnly go off). Luxury inside, but I’m always scared of what’s going to break next. We bought it, because I commute to work and we wanted something safe. Research before purchasing this pricey car!

    We should all take this class action lawsuit to General Motors, they build the transmission for Volvo on the XC90 T6. GM supplies the transmission to Volvo. Volvo products are good, is the supplier.

    Mine went out a little over 100K. I had repeated reported tot he dealer that there was funny noises and a slipping shift feel to the transmission. I was told it was anti-abuse software to prevent excess wear. So much for that. Volvo offered no help so I replaced the transmission. Volvo is obviously aware of the problem. Count me in.

    Hi all, I have just bought 04 xc90 t6 last week with 80000m on it and guess what? Yes the trans warning came on, I got a friend mechanic to lug his OBD in and came up with the usual fault codes 4th ratio out of phase and sticking solenoid!!! I took my car to local Volvo dealer here in the UK and they want over £7000 for the privelage of fitting a new trans and radiator etc. My car has full Volvo service history apart from the last two services which were done at other garages. The people I’ve spoke to at Volvo won’t commit to say that these transmissions are flawed and not fit for purpose. I would like to know if there is similar action against Volvo over here in the UK and if there are people here getting replacements even when they are out of warranty. Thanks

    We have a 2004 XC90. First transmission went out at 45,000 miles and the entire steering rack pinion, tie rods and cv joints replaced at 93,000. Transmission service urgent message arrived at 96,000 miles diagnosed as software needing updated. 99,000 miles…………2nd transmission replacement. This is our thrid Volvo and up until the XC90 we have been very happy. This car unfortunately has been a huge disappointment. Would love to join class action suit!

    I just bought a used 2004 xc90 and just found out about the tranmission problems. We asked the dealer if there were any problems with it and they said it was a solid car. It has 64000 miles on it and am afraid that I bought a lemon. I would like to be part of this suit since it is already in the shop for the check engine light and I haven’t even driven it off the lot yet.

    You think you have problems ? Listen to my story!
    We bought used Volvo XC90 from the Grand Honda dealer in Elmhurst , IL( oh, yes , I want the whole world to know !) . The car had around 23k miles on it! We got a good deal and we were happy driving it for about 2 years!
    One day we couldn’t start the car ! We towed it to the Volvo dealer in Lisle, IL. After few days they couldn’t figure it out what’s wrong with the car! They suggested to replace the some computer part( I ‘m not sure what was the name of it!); then they put the old part back, and gave us a new one in the box, because, it have gotten programed to use only on our car! It cost us probably around $1500.So ,we have a new part we don’t need and we can not sell it too!
    That worked for about 2months. And the car started dying again. We found an authorised Volvo mechanic , who numerous times had to take car apart, trying to fix it ,and the would started acting strange again! We can not comprehand the money we spend on that!
    When the car had around 45K miles on it he suggested to replace transmission! R u kidding me?.. We got away with around $2800 . But the car was not fixed! It kept dying on us…In the fall of 2010 we took it to the Volvo dealership for a recall ( fuel pump!), the car was fine till June of 2011. And it stated dying gain! We couldn’t take any more and decided to trade it in! We were in for an another surprise! The car was a lemon! It was declared a lemon when it had 8k miles on it and was bought back by manufacture ! The Grand Honda in Elmhurst, IL didn’t disclosed it to us! It doesn’t even show up in the title! Somebody offered us $5k for it,when with the low miles it sells for about $13k. We have this car for 5 years now, and if wouldn’t known about it if we wouldn’t had ALL of those problems!
    Thanks ,Volvo ! Your are truly for life! You owe us around 40K + 3years of life!

    My Volvo 2002 XC90 T6 AWD has had nothing but problems. I’ve complained to the dealer. No sympathy at all and he knows about the problems but won’t get volvo involved at all. I’ve spent thousands on it fixing it. I replaced the transmisstion at 75k miles. It’s had numerous problems, in the shop all the time. It goes through brakes like crazy, and is now making this horrible shrill sound when I drive. The dash board where the radio is gets so hot you can barely touch it to change the radio stations. It almost cooked my cell phone when I put it in the little storage area there. It goes through tires every 25K miles (why?). I can get the dealer to print out the repairs since I’ve owned it. I can’t afford to keep fixing this car. I can’t sell it because it has such a bad reputation. I want Volvo to give me what I owe on it (about $8,000) so that I can go get a car that’s safe to drive. I’m a single female and driving back and forth 150 miles each way sometimes once a week between two jobs. It scares the heck out of me to drive this thing.

    Similar story to others here….replaced 2 drivelines, transmission was replaced by dealer at 50k miles, transmission light came on 2 days ago and took to dealer who tells me repairs will be $7k. No help from dealer due to SUV being at 117k miles. Also headlight module went out at 90k miles at a cost of $1400.
    Please include me in class action suit if possible.

    Joining the club. I have an XC90 that I bought new in 2004. It has 41600 miles on it. Symptoms are transmission slips in 4th gear, with loss of torque and the tach just revs up. It also slips shifting from 1st into 2nd gear at around 20 mph/3000 rpm. On the freeway when it went into 4th gear slippage, I tried shifting into manual. Oddly it would not go into manual, ie, the “D” indicator would not go into numeric “4,3,2,1.” I thought maybe there was some rule at play, like “can not shift into manual while going 60 mph” or something. But when I pulled off, shut off and restarted the engine, and got back on the freeway, found that I could shift freely back and forth from “D” to manual “4″. That sounds like software, but after reading some of these posts, its obviously more than software. Anyway, the other problem is the shift from 1st to 2nd, which I find I can do reliably in manual. At any rate, the Volvo mechanic is saying, “new transmission, $5600-6000.” On a prestigious SUV like the XC90 with 41600 miles on it, a whole new transmission is just NOT RIGHT.

    I might also add I had an electrical issue with my headlights. One kept burning out and it ended up being a regulator of some sort. As you know, just replacing headlights on this thing will make you gulp. Replacing several within a year was ridiculous.

    Volvo needs to make this transmission thing right.

    2005 XC-90, Transmission gone at 122,000 miles. Will cost an arm and a leg.

    I have a Canadian 2004 XC90 with 137,000 kms and the tranny just went. Can Canadians get in on this too? I noticed that it is Volvo Cars of North America – not just US.

    I too am appalled at this quality. I had an ’88 744TGO with over 425,000 km on it and had few problems!

    I have a 2004 and the transmission light never comes on but it’s leaking fluid all down the driveway.

    Not to mention the tire wear, leaking coolant system and A/C fan problems.

    My 2004 XC90 engine blown. Volvo won’t replace. 89,000 miles. Disgraceful that this expensive “luxury car” company did not recall or pay to fix EVERY SINGLE ONE OF THESE PROBLEMS!
    Take your messages to twitter and to consumer affairs to get the word out. Consumers should be protected.

    2002 XC90 had the transmission replaced at 50K. Originally Volvo was not going to help , but, because I had just taken the car in an complained that the trani was slipping and was told it was fine, they replaced the trani for free. Now, at 99k miles, the head gasket is blown. The Volvo dealer said I had probably used cheap oil, but, the dealership is the only one to have ever worked on the car. Jack Tehar of SilTehar Volvo dealership was told me that ” my year was a lemon”. That was as he was trying to sell me a new Volvo. The car has been a nightmare in repairs.

    I have an 04 XC90 and have had a lot of issues. I filed a warranty suit individually, back in 2007 because of all of them so I’m assuming I would be precluded from this lawsuit. I do want to share my thoughts though because Ive just started to have transmission error messages. The transmission has never worked well, but until this month I haven’t had any breakdowns. If there is a lawsuit, I’d like to be a part.

    I HAVE THE SAME PROBLEM,106,000 MILES AND SERVICE TRANS.URGENT LIGHT IS ON.THE TRANS IS STUCK IN 3RD GEAR AND HAS NO REVERSE.YOU CAN INCLUDE ME IN O N A CLASS ACTION LAWSUIT.IF ANY ONE CAN GIVE ME ANY INFORMATION ABOUT GETTING MY TRANSMISSION REPAIRED PLEASE CONTACT ME. THANK YOU

    Same problem. Bought our 2004 T6 Volvo XC90 used with about 60k miles at CarMax in Raleigh. Bought the extended warranty. Before we reached 70k miles, the transmission (along with the rear axle, the DVD player, other small things) failed and was covered under the extended warranty. Glad we bought the warranty! Now the ext warranty has expired, we’re at 123k miles and the transmission has begun to slip again. It has just recently begun to get cold here and that is when the symptoms began. Count me in on the class action suit.

    I have a 2004 XC90 T6 AWD which was purchased as an “upgrade” to my V70. As an educated person, I did my research on the models I was considering and found no Volvo transmission related recalls, warnings, etc. on the XC90. Based on all these posts, clearly Volvo knows there’s a problem with this model year. On my way back from a Christmas trip, I experienced the loss of power, got the classic “Transmission Service Urgent” triangle AND the Check Engine light. Now the car shifts whenever it wants, will not shift out of second gear and does not accelerate properly. I have not yet visited the local Tampa dealer so I am not sure if they will offer any assistance but please add me to the lawsuit as a pre-emptive strike for when they probably choose NOT to help. Thanks.

    Drove my 2004 XC90 off the show room floor back in 2004. Now at 110K miles the transmission service light is on, I took it to two dealers who both told me I need a new transmission 6K, I asked if there was a known problem with the transmission but I was told no, asked if they could rebuild it but was also told no. Stopped in a Aamco shop and there was two Volvo’s on lifts for transmission problems. The shop owner told me that he can rebuild the transmission and that Volvo recommends a service few modification, they will warranty the job for 1 year at $2,500.00. As for the class action lawsuit how do I get on the list, Im here in Bergen County.

    I purchased a 2004 Volvo xc90 in the summer of 2011. Within the first week of driving my volvo the vehicle was making alot of noise when turning, after calls to the dealership and rescheduling over and over after 3 months finally when I got the truck into be checked the check engine light was on. Of course after taking it in they turned the light off and said I needed a steering rack and pin and new shocks in rear. Also when it rains my driver side floor is soaked with water. They claimed they fixed the steering problem but there is a lot of play in the steering wheel. Now @ 80,000 miles I was on my way home from work turning left at a very busy intersection when my transmission just went, now there was no warning light, nothing until After the transmission went, then it said transmission service required. I also have replaced my headlights 3 times since I had this vehicle, low beam failure warning always kept coming on. And as I have read above I figured since this was a Volvo and they are usually good vehicles I did not get the extended warranty, Big mistake there! If anyone has any advice please feel free to tell me! I will be contacting a lawyer and I am curious as to why this is not a recall,or lemon law for this vehicle!
