Saxon Mortgage HAMP Loan Modification Class Action Lawsuit Complaint

Homeowners File Class Action Lawsuit Complaint Against Saxon Mortgage For Allegedly Failing To Modify Troubled Mortgages Under HAMP.

A class action lawsuit has been filed against Saxon Mortgage Inc. (“Saxon Mortgage” or “Saxon” or “Defendant”) and in the United States District Court for the Northern District of California (styled Gaudin v. Saxon Mortgage Services Inc.) on behalf of homeowners alleging, among other things, that Saxon took trial payments on loan modifications, delayed processing of certain loan modifications and allegedly improperly failed to modify troubled mortgages under the United States Treasury’s Home Affordable Modification Program (“HAMP”), according to a Saxon Mortgage loan modification class action news report.

The Saxon Mortgage HAMP loan modification class action lawsuit reportedly asserts claims for breach of contract, recission, for alleged violations of California’s Rosenthal Fair Debt Collection Practices Act and for alleged violations of California’s Unfair Competition Law (“UCL”).

      We have been given the run around for the past 2 years by Saxon Mortgage and like almost all the complaints here where in our HAMP was denied and we should apply again along with certain new documents and then the documents get misplaced and then wait for a person to get assigned followed by denial, The fact all along is that Saxon does not want to modify and is just playing the waiting game while getting your money. We have initiated a class action suit against Saxon and would like to see as many of you with a similar modification problem sign up to be included.         We also live in Maryland and have been trying to Modify our home, Saxon also put us into the HAMP program but 2-3 weeks later where told we where denied but could not give us the reason why!! They then said we qualify for a in house modification and then asked us for a $15k-$30 Good Faith Deposit to start the modification process, seriously if we had that kind of money do you really think we would be in this situation, just like others we bought our house 6 years ago when the market was so over priced and now our house is worth more than half what we purchased it for!!! Honestly, I don’t understand what the issues is, they will loose alot more money by short selling or foreclosing on us, why not work with the homeowner who want to save their homes!! Seriously, I don’t think the Government is monitoring nor do they give a crap about all the homeowner that are struggling to save their home, they would rather the US going into deeper debt!!!

        I have been 2 years being denied by SAXON for a loan modification, I have a stable job and income and just need a little help. However I recvd a letter a few days ago telling unsuficient income without any explanations and then the date of sale was set and I went to court to file an emergency motion to stop foreclosure but they solf my home anyways. I went to a hearing to court and Saxon lawyewr said that they do not have to explain why I was denied and have the rigth to sale my house anytime they want. Judge gave me 30 days to submit papers which I will or I have to leave my home in 30 days.

          my story is the same as all of yours.I am sueing them.They have did so many illegal acts on my loan and I have proof.Iam just going to court with this one,already lost the house.So don’t think you are going to save yours.They are the worst lenders of all.

            Saxton is a server for bank of new york mellon, When it comes time they will transfer to Ocwen. That way you have no more power to bargin. They will transfer as soon as they are subject to the gov. prob. They did this to me, and sold the house for 1/5 th the value so I couldnt sue for the house back. 2 years in court I think I can say that this is ALL a gov. plot. The first perp I found in the paper trail was X PRES CLINTON. 1999 loan mod program. read it.

    i made trial payments for the Hamp program thru Saxon for over 1 year and was denied . All of my payments still have not been applied to the loan. they are still adding bogus late fees. My loan # is 11118503 if anyone would like to add us to this class action lawsuit..

      I contacted the attorney for this class action, and he informed me via email that I can’t join, as the case is specific to CA law. I am in PA, and I have contacted a class action attorney in Philadelphia, Ann Miller. See the website – nothing has started yet, but it is only a matter of time, as I’m sure there are many more of us with the same story.

      Participated in loan modification for more than 6 mos, and was forced into a short sale of income property that I owned for more than 10 years! Property was sold in November 2011 and remains on the market to date – May 2011. My pleas to Saxon to work with me fell on deaf ears.       Good morning, I have been having problems with Saxon since they took over my mortgage, recently they sent payment to my homeowners insurance company (when for the past 12 years i have always paid my homeowners insurance seperately) no one notified me of why this was done, my mortgage has shot up an additional 350 a month when my insurance was much less than this, I have been back and forth with them and the bottom line is I have no choice but to pay, I believe they (Saxon Mortage services) is trying to make me fall into foreclosure and sell my property because it is worth 2x’s the amout now then what I paid.

        we have had the same problem with saxton. They started paying our ins. and our land taxes. We have had nothing but problems with them. our payments went from 774.00 to 1200. We would love to join the law suit if we can. I lost mmy job and tried to get a modification loan but was told to try later and i did and was turn down. I hate saxton

        Wow they did this to me too. I reside in Texas and thats exactly what they did to me after paying my mortgage for 6 years with no problems until Saxon took over my loan. They would not give me a modification after adding taxes to my home and i was already paying my taxes on time and insurance. One day i looked at my statement and they added insurance and taxes to my mortgage. Me and my kids lost our home due to this. I have never in my life dealt with such scammers as Saxon.

      I live in pa interested in joining any class action suit. My interest rate was 11 3/4%! Lost home denied everything, paid thousands to keep it but they applied to fees, just received my IFR check for $300 insulting!

    Does anyone know if there is a case in New Jersey? I have a friend who has received the same illegal treatment from Saxon who would like to join a class action. It appears Saxon has been scamming people all over the country in the same way. Perhaps federal action is needed as well to shut down this fraudulent enterprise completely.

    Saxon is not the only bank or mortgage company delaying modifications or not approving permanent modifications in violation of HAMP. I am experiencing an unnecessary delay from Chase Home Finance. I saw one article online that said that these companies make more money if they
    foreclose rather than modify the mortgage. Everything is centered around their profits the American economy does not matter.

    I want to join a class action law suit. Saxon approved me for a HAMP loan, I made the payments promptly and they never sent me the loan documents, not to this day! They denied me, stating I did not make payments even though I sent the verification of payments to them. Then they told me I can only apply once for the HAMP loan, too bad. I have applied for a modification 5 times and have been denied, for reasons that are laughable. I can’t talk to anyone, just customer service and they are absolutely no help. I am in TN, can anyone help me find a class action suit against this company.

      Saxon Mortgage denied that they recieved wired payments from me eventhough that is the only way they would accept payment from me. Then they lied about allowing me to loan modification, they foreclosed on my home while I was away in training for 3 months. I would like to join a class action suit I am in Maryland.       It is so sad to hear how Saxon screwed us all. I live in Kentucky and after I had sent in 2 loan mod applications that somehow always got lost or misplaced. I was sent forclosure papers delivered by the local sheriffs dept. I sold the home for more than I should have owed. Somehow, Saxon considered this a short sale for over $10,000. I want to see them bankrupt in the worst way. What a bunch of crap this Independent Forclosure Review is also. I would like to shove this check up the ass of Saxon Mortgage CEO. I hope someday I get to meet you in person you rotten bastard.

    How do I contact an attorney to be able to participate in a class action lawsuit against bank of America? Is there any such lawsuit going on in Maryland where I live? How much does it cost?     I’m looking for a group of individuals who have been evicted from their home due to Saxon Mortgage. I am planning to discuss my situation publicly. I have been illegally evicted and left homeless in the street.
    I am sitting in a hotel room with my husband, son, and dog and writing
    about this ruthless company who has made our lives hell. This so call American Dream should not play out like this. We need to come together and be heard in the streets. I was evicted like a criminal. Belongings thrown out, harassed by the sheriff, and not given a notice of the exact date of eviction. They knocked on my door like it was a drug house.         I lost my home to Saxon Mortgage in 2008 because they took upon themselves to add an escrow account to my loan and every month the price of the mortgage would go up. Before I lost it the payment was 948.00 for a two bedroom two bath house. Fed up and didnt know what to do in GA.

    I think its great. How do I join Saxon did me the same. Had me on a trial payment for 11 months. I was told it would be for 3 months. Reduce my monthly mortgage from $1,334.76 to trial plan $1,116.00, and still reported my credit as late. In Feburary 2009. I found my home was in foreclosure.     We have been working with Saxon since 2008. Although our mortgage is modified, is was not booked properly (three different MODS). Saxon reported us over 120 days to the credit bureau for over two years. My credit is destroyed and they will NOT do anything to repair it. I have spent endless hours on the phone, telling the same story over and over again. It is frustrating, mainly because I am a teacher, and I can ONLY get a job in a private school due to my low credit score (565). It was well over 700 before Saxon got a hold of it. We are looking into speaking to an attorny on Monday. We also need a new car and can’t get that either.

    Saxon Mortgage company says they are reviewing my paperwork to possibly modify my loan under the HAMP Loan Modification program. I have called several times now to see if the paperwork has been received and if it is being processed. I keep getting different answers. Some say that it has been received, others say that it has not. I was smart enough to send it certified and have a signed receipt. When I tell them that I sent it certified and have a signature, they place me on hold and NEVER come back to me. This modification would not be necessary if they would stop adding fees to my account with no explanation as to what the fees are. I have questioned them over and over about this and they have no explanation of any of the charges. They purchased my loan from the original mortgage lender I had. I requested a copy of all the charges and credits that had been processed on my account. When I got it, I noticed that on the DAY they loaded my account in their system, they added a late fee. I had not been late on my mortgage with my original company and had not been late with them until all the fees started. Anyone else having any luck on getting anything straightened out with Saxon??? Any help would be greatly appreciated.

    These people (Saxon) are criminals! They have been jerking me around for the last 3 years! They wont modify my loan and continue to tell me that I am in arrears while I make payments! They also send a so-called appraiser to my house to take a picture and then charge me 300 dollars! They keep playing their little game!

    I too entered the HAMP program and was denied. They put me in an alternative program that would modify my interest rate. Well, they never modified it. What a two-year nightmare it has been. I also asked for payment history reports twice. Each payment history report shows different payment information. Is this legal? I would think this would be considered cooking the books. I would sure love to be part of the Class Action Lawsuit. I would be happy to supply all my Saxon loan states, bank records, and both payment history reports to prove they wrongfully applied payments and charged me bogus fees.

    They just sold my loan to Ocwen and it has transferred. Ocwen came to me looking for around $23,000. A Qualified Rewritten Request was sent to Ocwen and they straighten the account out in about three weeks. I am sure glad I am no longer with Saxon.

    Anyone out there with a mortgage from Saxon in Texas? My loan was sold to Saxon 6 years ago and it has been a nightmare for the last 3 years. I don’t qualify for the HAMP (self-employed) but in December 2010, they did an in-house mod, where I had to make 3 payments and then they would modify the other 2 months owed over 12 months. So approx. $400 was added to my payment, starting January 2011. For 3-4 months they honored the extra re-pay, without sending me a regular statement. THEN, they said they couldn’t find it, and kept my money in suspense. So I started paying my regular again, and they finally applied my money and I am now only 45 days past due.

    I have just received my notice of default with intent to accelerate – at 45 days late! Also, someone comes by my house regularly and takes pictures. I have over $50,000 of equity in my home and I believe that SAXON MORTGAGE WANTS MY HOUSE!!!!

Saxon has been our worst nightmare losing documents, applying double payments to the same month, denying approval for modification programs after telling us over the phone that we quialify.     We had a layer helping us get our homeloan modified. The trial payments were made and everything they requested was given to our lawyer to give to Saxon. 3 trial payments cashed 4 returned 5 cashed. Then we received paperwork saying we didn’t do everything they asked so we didn’t qualify. At this point they requested more paperwork to modify our loan internally. In April or may I received papers stating the house would be auctioned in june. The lawyer informed them they were working on a modification and they changed auction date to august. When we came home one day there was a for sale sign in front of our house. When our lawyer contacted them they informed us they forgot to change auction date with their lawyer and the house was sold. The mortgage company bought our house back and are going to sell it. We haven’t received any paperwork about anything since April or may. We have 3 children living in our house and have no idea when we need to be out or how to make Saxon pay for doing these things to families and businesses across the country. I hope this class action suit goes infavor of the consumers. I would love to join this class action suit.

    Saxon Mortgage is another Bernie Madoff type pansy scam dealing in home mortgages. Our families and lives do not matter to them, another address is another dollar for them. They are a very dysfunctional company that outsource their dirty deeds to small companies so their wrong doing is hard to trace. They take payments, tell you you have modified and this rate and payment would last 3 months to 5 years, put your money in unapplied accounts, lose documents, felonious fees, illegally changing locks, sending people to our home to deface and steal antiques from and off the home itself and claim no responsibility.

      Yes! I have encountered all these things…including the locks were illegally changed…actually broke off my door knob, installed a new lock and left the damaged lock on the kitchen cabinet! I came home sick and could not get inside to feed my cats…they were terrified…as was I…I am in Tennessee and would like to join any legal action against them.

    I live in Georgia, and I have tried to get a modification from Saxon for 2 years now. Saxon has either lost information sent to them or delayed responding to my concerns. The last thing was that they agree d to modify if I would pay a certain dollar amount and Saxon still didnt modify my loan. I cant afford a lawyer. Is there a lawsuit that I can join in Georgia.     Saxon’s games go way back to when they were known as Saxon Mortgage Funding Corp. in the late 1980s and early 1990s. We refinanced our home with MBAC in 1992. In 1993 MBAC Assigned the Trust Deed and Note to a non-existent entity. However, the non-existent entity’s given name was very close (but different) in sound and a quick read of a then prominent bank that was affiliated with and finally morphed into the now known MPMorgan Chase Bank, N. A. The curious or should I say suspicious part is that in the upper left corner of the Assignment, was a request to send the recorded document to Saxon Mortgage Funding Corp. Other than that, Saxon was not a part of that fraudulent/counterfeit Assignment by MBAC. After extensive search with many banking regulatory bodies and elsewhere the suspected conclusion held true. The supposed new Assignee and Beneficiary named on that Assignment of Trust Deed was non-existent.

    During those days, much such fraud took place in the Texas market and elsewhere during the Mortgage Securitization days. I came across another such fraudulent named bank called “Bogus Bank.”

    Our original refi was funded by MBAC and the servicer was GE Capital on behalf of a non-existent entity until Wells Fargo Home Loan Mortgage took over the servicing of the note on behalf of JPMorgan Chase Bank ever since 1993 to today November 29, 2011. Since the bogus beneficiary name was so close to the real well known bank that ultimately morphed into JPMorgan Bank, N. A., they probably thought no one would ever find out.

    There’s a lot more that fraudulently took place under an apparent conspiracy between Wells Fargo and JPMorgan Chase Bank to defraud us all this time by collecting monies from us every month that did not belong to them.

    If anyone out there reading this has intimate (as in past employee) information about the goings-on of Saxon Mortgage Funding Corp. in 1993, I’d like to hear from you. I’ve had conversation with the then President of Saxon, but I’d like to learn as much more as I can. Your assistance will be appreciated. My address is ronatlifenergydotcom. That’s one e in the middle of life and energy. LIFEnergy. This one will see the light of criminal prosecution as well as civil discomfort. This could open a large can of worms if any attorney besides mine care to dig with us.

    We live in California and have a mortgage with Saxon. They took over our loan from Novastar when that company went bankrupt. We have an ARM loan and were making our payments to Saxon fine despite the fact that my husband suffered a work injury needing 3 surgeries and making it difficult for him to work. When our interest rate went up we found it difficult to make payments. We applied for HAMP, but were denied by Saxon. Now we are in foreclosure and we are trying everything to work with Saxon and keep our home. They are not helpful. We pleaded with Saxon to keep the interest rate down, so that we can continue to afford our house payment, but they igonore us.

    I am in Michigan and need to know about joining a class action law suit out there against Saxon Mortgage for abreach of contract. ai have been trying since April 2011 to try to have someone at Saxon talk to me to try and correct a small problem of Bookkeeping on their part. It has ballooned into a HUGE ISSUE. In 2009 I started trial payments for HAMP program Sept 2009 made Sept., Oct., Nov., & Dec 1st payment. Then around Dec 8th or so I get notice from them that Dec. Payment should of been more. So I send the difference for Dec. I get paperwork needed to be signed, witnessed by seal and overnighted back to Saxon that my HAMP Program had been approved and my payment schedule would be. I have everything on my end sealed with approval. I make my payments from Dec 2009 through Dec. 2011 on time in accordance with my approved Modification loan 2009. Well in April of 2011 , no notices ever from Saxon to let me know there was any problems, I call in to make payment over phone and I couldn’t because oit said I owed 2 1/2 times more than my payment. So here the problem begins. ( I found out they did some kind of computer program change on their main frame) When I have called to try talk to someone about the problem, the toss me around begins and no return of my phone calls. The 4 times I was able to speak to anyone on the phone, they all had a different reason for the mess, first I’d missed a payment back in 2009 which I proved I didn’t. then I missed a payment May 20011 which I had proof again, then one lady told me they had made a mistake in the HAMP I received and I would need to resign paperwork, I was skeptical told her I would not sign if they changed any Numbers on the payment schedule. Sure enough when paperwork was sent to me, HUGE number changed on the payment schedule. I have called 3 times since Oct 23rd 2011, asking for a call back so I could discuss new paperwork. No return calls. I have recorded dates ,times and lft messages of at least 40 calls since May 2011. Now I get a generic piece of mail not certified reg. mail stating that since I now don’t qualify for the HAMP program that I have 4 days to respond to a new program called HAMF, a cooperation for ashort sale to forclose on my home . So I call Saxon to check on the status of my account, I am told by a gal that can only give you basic info, (but has no real authority to help resolve anything serious,those are the only people at saxon you can actually speak with) that my account is $29,000 in arears. WTF no notice to me through mail. Where did they get this number? I have followed every guideline of the HAMP loan very carefully not missing a beat, having been very grateful to receive it. When this first started, I thought maybe my case was an isolated mistake, but when I googled complaints against Saxon I truly was shocked to see so many horror stories about them. I am very frustrated because of not being able to speak to anyone at Saxon that has authority to fix this. I need the help of an attorney, if anyone reads this and can point me toward help it would be greatly appreciated.

    I started with Saxon in 2007, I believe trying to redo my mortgage. They lost my paperwork twice. They turned us down once. When they finally agreed to redo the mortgage they added back payments of $32,000 onto the loan. We are 60 and 61 years old. Our balance became $240,000.00. We have been trying to sell the house all this time as we cannot find jobs in the area where it is in Minnesota. Our last price was $185,000 which was less than we bought it for in 2003. We got no offers. We vacated the home and moved to St. Paul, MN where we are renting because at least we have some work up here. They have now turned our account over to a different mortgage company.

    By the way, when we were in the process of redoing the mortgage, they had an outside company handle that who charged us money to do it. Apparently that is illegal, but we missed out on that lawsuit. That company told us when the mortgage was redone there would be no added payments or interest on the original loan as long as we made the 6 month trial payments on time. We did, but they added more trial payments on and then Saxon added $32,000 of back payments to our mortgage. We live in MN. Is there a lawsuit going on here? We are currently working with Ocwen Mortgage who they turned us over to and their attorneys (same as Saxons) are now saying we are responsible for back taxes). We were told we would receive a relocation grant from HAMP, not a bill for back taxes, so my mistrust buttons are going off all over the place.

    Approved for trial modication paid it for 19 months did not miss a payment have 19 months of bankstatement to prove this. Saxon cancelled my modification due to missed payments. I told them that I did not miss any payments they said I did then they changed my modification by $300 more a month, then transferred me to Ocwen..

    Saxon gave us the run around for a year even though we attempted to stay in touch with them. Never gave us notification of eviction and then we were locked out with half our belongings inside. Is this legal??

    I was also a Novastar customer that got sold to Saxon mortgage, I started the modification with them, waited over 6 months while they destroyed my credit then sold my loan to ocwen mortgage right in the middle of the modification and I had to start all over again with ocwen mortgage which currently holds my loan now, and they also reported negatively on my credit. I have made every payment and made every modification payment as intended. I would like to join the lawsuit as well im from Iowa

    My wife and I has also been a victim of Saxon Mortgage. Two years ago our home went into forcloser, we got help it was (NACA) they helped stop the forecloser on our home. Saxon wouldn’t do anything to help us. I don’t know if anybody heard of NACA, but they helped us with Saxon well I thought. To make a long story short we was set at a price that lower our mortgage about to years ago 2009 and it wasn’t suppose to go up. Well its been going up and the only thing they told us when we called it’s the escrow we are behind on it. Guess what I’ve never been late on my mortgage and from my understanding that’s the only way you get behind in your escrow.     I tried to refi my loan when it adjusted to 9.75% and contacted Saxon mortgage company by phone. They took a $350 deposit on my credit card for an appraisal and mailed the truth in lending statement wirh a fixed rate overnight fedex. I recieved it and opened it and they wanted $12,500 in closing costs and fees. I told them I would never refi with those rates and demanded my $350 back on my card. Three months later and 25 calls to the loan officer,her boss and no $350 for an appraisal that was never done. I deducted the $350 payment from my mortgage payment. They said I was delinquent and behind because of a partial payment and was charged late fees for for 15 months. I filed a complaint with the State of Maine Consumer Protection Bureau who got Saxon to pay my $350 back six months later but did nothing to get the credit dings and late fees. I paid the $86/month plus late fees and intrest and sold my home. I wasn’t foreclosed on but they perpetuated fraud and got away with it.

    Saxon illegally reported to the credit bureaus and caused you damages. I would think you could take Saxon to small claims with a separate complaint for each time they illegally reported. The fact that you were able to get your $350 back after your complaint to Maine’s Consumer Protection Bureau is good evidence for your case. I would think that you could also file small claims complaints against them for the cost of making your 25 phone calls including the time it took to make them. If you list a reasonable rate for your time, that will probably be included in the judgement you’re trying to get against Saxon. If you’ve never been to small claims, it’s not like a real court. It’s more like a conversation between you, Saxon and the Judge. But, because Saxon will unlikely show up for the hearing, you’ll win everything you asked for by default. With a judgement, you now have the legal right to demand payment from Saxon. If it gets to the point where you don’t know what else to do if they don’t cut you a check, which they probably won’t, you can call the sheriff or marshal for your area and ask them about their help in assisting you to collect. Such a levy could go so far as the marshal and you in essence foreclosing on Saxon by going to one of their offices, where the marshal will inventory and seize everything in there for an auction sale later so you can collect your money. It won’t go so far as the auction or even physically moving the furniture, computers, etc. out before they agree to cut you a check. A customer of Wells Fargo did exactly that when Wells refused to pay an amount that was owing him because he took them to small claims and they didn’t show up. They usually don’t. It’s not worth their bother and they think you’ll get tired of the game and just go away at some point. Learn what you can do. The internet has a lot of info. about such matters. Just start searching. Being awarded a judgement in small claims court. Ask questions. Heck, a person could make a good living by keeping track of their rights that are trampled on all the time. Start learning. I am not an attorney, just an experienced entrepreneur. All of the above should not be taken as legal advice. They are just some ideas you may want to pursue.

    It seems that the only way to force Saxon Mortgage Services, Inc. to PERFORM under the Obama HAMP program is to sue them. So be it.

    Therefore, let it be known that:
    I am interested in becoming a party and participant in an Arizona Class Action against my mortgage company “Saxon Mortgage Services, Inc.” I have repeatedly applied for a loan modification under the Obama HAMP Home Affordability program over the past two years and I have been denied every one with a letter stating that, “The investor does not allow modifications to your loan”. However, I found out that Saxon not only services my loan, but is also the investor of my loan – a clear conflict of interest!

    I have filed a formal written complaint against Saxon with the Arizona Attorney General’s Office back in February, 2011, but no remedy or benefit came of it. I just keep receiving more HAMP applications. My home was in foreclosure by Trustee Sale in December 2010, but I was able to save it with a monetary gift from my Father. Now, I’ve just received another “Notice Of Default And Intent To Accelerate” letter. My W2 employer work hours and home business Clients have been sharply reduced due to the ongoing recession and struggling local economy, and all the jobs in my industry that have gone overseas so my income is much lower now than it was in years past. Right now, I am one month behind in my payments. In addition, Saxon has been applying all the payments I’ve made since my loan was reinstated to the prior month, so I’m constantly in arrears and I get a 30 Day Late on my credit report every month. But all my records, bank statements and canceled checks show that I have been current. I fell behind this month which apparently triggered the new letter of default. I have lived in my home for 11 years. I love my home and I and my Fiance’ want very badly to keep it.

    From everything I’ve read on the Internet, it feels to me that Saxon would rather take their chances on the auction block with our homes than accept our small monthly payments under HAMP. They want the cash NOW, not our monthly payments – even if it is far less than the remaining principal on the loan.

    I am very angry with Saxon and I wish to participate in a Class Action to force Saxon to perform under the HAMP program to modify my loan with payments I can afford, and to hopefully recover monetary damages for all the mental anguish, pain and suffering and worry I’ve had to endure over the past two years because of their non-performance. The foreclosure could have been avoided if Saxon had granted me the modification and reduced my payments in the first place. I had refinanced in 2005 through a local lender in Arizona, and the loan was quickly sold to Saxon as part of a pool of loans. Thus, mine is not a Purchase Money loan. I have all hard-copy records and correspondence available to anyone who should ask. I hope a legal professional can help me. Thank you.

    My husband and I had owned our house for 11 yrs. then I had a stroke and contacted Saxon about a modification on our home loan. When thru so much hassles from the “customer service” department, losing all of our information to when a “load personnel” called, and having just a very difficult time to answer the phone call …. I had to start the paperwork all over again (which I had submitted everything over 6x’s prior).Then it came down to us in a forced short sale of our home …. SIGN US UP TO TESTIFIED AGAINST SAXON !!!

    I have been having MAJOR problems with Saxon as well. We were making the trial payment on time, never late, and we too, were getting a bundle of late fees added to the loan. Always denied with the HAMP program, always switching representatives, syaing they needed more information, not having the correct documents and have had to sent all paperwork in at least 4 times in 2 years. They always seem to mis-place something or loose it. No one knows what the other is doing. PLEASE, tell me how to get on this lawsuit also. We currently reside in Wisconsin.     If any one can help me please do so. I to had problems with Saxon. I kept sending in the paperwork for a loan modification, and kept getting told it was not recieved. I was told not to make payments because I was able to be part of the loan modifacation program. This went on for months, I was told not to worry when the loan was recaluacted it would all be put on the whole new loan. I did what I was told, and it was all lies. My house was forclosed on in 2009. I was forced to move out with only a few days notice. I was told that there was nothing they could do for me. 2 weeks after I had to leave my home, I got a phine call to my cell saying they had recieved my paperwork. What a crock.
    I would love to see this company go down. Thank You

    we live in Maine and Saxon processed everything through HAMP accepted payments and after trial period told us we did not qualify and we did not send them the information requested…not true! They then suggested an in house modification which we were working on and waiting for a response….we got home one day and there was a for sale sign in our yard when our lawyer called they said someone forgot to inform the attorney they had and the house was sold in attorneys office…..To top it all off one of Saxons affiliated companies purchased it for fairmarket value so it was never really auctioned they just bought it back and said they could not do anything since they forgot to communicate with their attorney. Having 3 children living with you makes relocating difficult and not very affordable.

    Lost my home on January 6, 2012 to these bastards. I’m a single/divorced mom with 3 disabled children & we were literally thrown out to the wolves. :(.. Despite my hundreds of phone calls & requests for payment assistance, I was told in the last hour before our home was auctioned off that it was simply “just too late!” There is so much more to my story that I could write a book, but lets just say that I have lots of evidence against this so-called company to win in court if only I could find an attorney to take my case?     Where did Saxon go?
    We were told by Saxon in MAY 2012 that we were being serviced by a new mortgage Co. (RCS). We were given great news that we had to make May and June payments to RCS at the CURRENT rate and in July (2012) our NEW payment (trial) would be mush lower. We never received any other form of confirmation. THEY EVEN GAVE ME A PAYMENT FIGURE!!!! I was told by RCS (Residential Credit Services) that it would take 30-60 days to receive the paperwork to confirm it from Saxon. We tried contacting them, and *POOF* they cannot be reached. The first time they tried to help in 2010 only seemed like a ban-aid. In the beginning were told we could re-apply… so we did.in Feb. 2012. After months of calls and never-returned call backs, and re-sent and re-sent paperwork, you get fed up. IS THERE A MASSACHUSETTS FIRM HANDLING THE LAWSUIT? Now in July we sent everything to RCS, well at least they got it. and say they are working on it.

      Need Help ASAP!!!! Initially, we were approved for the HAMP 3-month trial period with Saxon starting in Jan 12. Completed/notaized documents back to Saxon and continued with the payments now Jan 12-Apr12. Rec’d letter from Saxon – loan transferred to Ocwen in Apr. Immediately called Ocwen – no knowledge but do have original past due arrears and now due in full. May and June still no knowledge of approval but I faxed numerous of times, overnight twice, emailed and mail my documents with Saxon. Late Aug, approved but we are still behind and violated the HAMP program.

      Well we are behind because Saxon did not commuicate with Ocwen and Ocwen rejected our payments. I’m sick literally sick trying to work this out with OCWEN. I’ve gotten no were with my relationship manager and fear losing our home. We have been here 14 years now grandkids fulltime and one with a physical and mentally injury due to shaken baby syndrome. I’m stress and my heart races when I think about Saxon/Ocwen and this nightmare. I don’t have the 6800.00 to get out of this mess. I’ve stayed in contact with Ocwen…Saxon don’t return calls…now the Ocwen relationship manager will try a inhouse MOD. This is crazy. Maybe I should call the HAMP program office because this is not Right

    I need legal help in Jacksonville, Florida for a foreclosure in 2009 with Saxon Mortgage. I have a lot of fraudulent mortgage increases by Saxon along with a year and half of negligence to consider short sale offers to sell our home for close to the bank cost. Now I face a Summary Judgment on October 15, 2012 with the PMI insurance carrier that paid off Saxon and is now demanding $47k+ lawyer and court fees. No lawyer in Jacksonville, Florida will even consider reviewing our foreclosure and instead all lawyers highly recommend bankruptcy as the only solution. Why are all lawyers afraid to go up against banks and insurance companies to discover fraud? I know that the banks and insurance companies will pay them better to go after all of us who lost homes…but now that I have nothing they can take or manipulate for their books to sell – they are still wanting more from me? There must be a financial or political benefit to drive us foreclosed people into the dirt….I just don’t get it. Any lawyers out there in Florida who want to do what is right for a change????? I dare any of you to right a wrong that was done by Saxon Mortgage company and make them pay for unlawfully raising my mortgage up $300.00/month for an unexplained increase that eventually led to our foreclosure.

    We too lost our home here in SC after 2 years of paying the mortgage, we got behind due to health issues and we tried to HAMP several times and SAXON didn’t even reply to the requests. They foreclosed without even considering any modification. Pleas help me get in on this class action lawsuit. They have to be the worst lenders ever.

    I KNOW YOU NEED TO TAKE THE PREDATORY LENDER TO COURT WITH THE MONEY I HAD TO PAY OUT TO ROBERT BULTLER WHO WORK FOR HAMP. SAXON WAS SO TOXIC WITH THERE UNPROFESSIONAL COMPANY. THEY NEED EVERYTHING COMING TO THEM.

    We start with modification plan process since December 2008.

    We sent all the document required by fax, by mail, by FedEx , by UPS in different dates and they always said there were a missing documents.

    At that time nobody knew how to work with the FEDERAL GOVERNMENT’S HOME AFFORDABLE MODIFICATION PROGRAM.

    Finally after back and forward communication they send me the package for the modification program with the mortgage amount we have to pay during three months and after that, they will send me the second package.

    We start doing the payments in June 2009. We were expecting the second package by September , 2009 but we didn’t received anything.

    I called to Saxon Mortgage and spoke with Elsa -Cashier- # 18937 and made the September payment by phone. Confirmation number 5480732.

    In October I call again to make my October payment I talked to Gabriela and she said because my process it was almost finished she couldn’t receive my payment by phone. She instruct me to send the payment by mail or thru a wire transfer; that sounds rare to me but I said I would make the payment thru a wire transfer.

    She told me I’ll need some information to make the wire transfer and she gave me this information:

    Account number 41217763231 under the name of SMSI WIRE CLEARING at 420 Montgomery St.

    San Francisco CA. 94104 – Route 121-000-248

    I set the account to make the wire transfers with this information and I made the October and November payments.

    I received a letter from Saxon Mortgage dated on November 2 2009 stating that after reviewing all the information submitted, Saxon had been determinate that we do not meet the underwriting and/or delinquency standards of the programs as established by the Federal Government’s Home Affordable Modification Programs, because the payment have not been received according to agreement.

    On November 12, 2009 we received another letter saying that because we have been made all our trial payment on time we have been qualified for a one-time Trial period extension (“The Trial Period Extension”)  

    In order to allow them time to work with us to insure our documentation is complete and reviewed by them, before the expiration of the Trial Period Extension,, we must return all missing documents by December 31, 2009.

    They were requesting for copies of:

    – The two most recent Bank Statements

    – Copy of HOA/Condominium Association Dues Bills for November and December 2009

    – Original signed Trial Plan ( Already sent 2 originals- They said they received only one)

    – Copy of the most recent Profit and loss statement.

    We were preparing the new documents required by Saxon and send again those they loss, when one day on November 2009 on Thanksgiving evening, one man come to the house claiming he have been bought the house in an Auction on November 20, 2009

    We did call to Saxon Mortgage and talked and let her know what’s happening, but she didn’t knew anything about it.

    She told me to hold on the phone and a few minutes later, she said that effectively, the house have been sold.

    I ask her about the letter dated on November 12, 2009 where they give us the Trial Period Extension and she said this letter doesn’t appear in the system.

    As it could see, Saxon Mortgage didn’t have the trained personnel required ( everyone said something different, they loss the document, and the don’t have a good communication between them and with the customers. The don’t give the correct information.

    I need information about who to contact I live in Oregon? It’s been 4 years, damage is done, doesn’t mean they don’t owe us thousands of $$$$$$, it cost us more than $$, it cost us our marriage.

    I was paying trial payments through Saxon, and in the middle of the process, they sold my loan to another company. The new company at first said they do not have any of my information and then later said they did. They advised me to keep on making the trial payments until i hear from them, but this was 2 years ago! now i am delinquent and 25k in the red! i would like to be included in this class action please!

    I too had so many problems with Saxon…ended up losing my house after paying on HAMP and then denied and tried everything in the book to save my house and even paid $1500.00 a month to “recover ” for almost a year and never saw where the money went to…or how it was applied and everytime I requested a copy of my payment schedule i was told they had to get someone to send it to me…after all the steps I followed it never showed where the almost 14,000 went to. I lost my house and went into a very bad depression for years….I too want to join anything AGAINST SAXON MORTGAGE!

    I bought my home in 2006 made on time payments up to 2008 when my husband suffered a stroke. Contacted Saxon to explain financial situation and to request modification. I spent the next year sending in documents 2-3 times because they always got “misplaced”. finally got denial letter in Sept. 2009 and soon after a letter with sale date. I called Saxon to ask why I was denied modification, but was not given an answer and was basically told there was nothing I could do at that point to save home. My husband and I moved out of the house. Two months later, We got a letter from Saxon saying that we had been approved for modification, I was dumbfounded. I explained to the lady that we had just entered a contract on the house we were renting and besides that I did not have the 4K that they would need as good faith deposit for the modification. Dealing with Saxon during my husband’s stroke recovery and facing losing our home was the worst time of my life. Last week I did receive a notification that I was eligible for payment from the Independent foreclosure review, so I’ll see what happens with that.

    Has anybody rec’d their “check” from Rust Consulting yet? The postcard I rec’d stated that the check would come in 6 to 8 weeks and/or early April. It has been more than 6 weeks ago and its now getting into the middle of April. Anyway, just wondering if checks have started somewhere.

      I would like to join the lawsuit. Live in Ohio loan was with Saxon and then sold to Ocwen. Unemployed through those 2 years and did everything in the modification, even got attorney to represent us. agreed on a payment and then the next thing that happened after we agreed on an amount, the first payment doubled and we were unable to afford it. It has cost us more than what the so called check from Rust Consulting we will receive.

    Saxon mortgage sold my home as i was trying to get a loan modification
    I had no where to go and they just told me I HAD TO GET OUT. I had to find an apartment that i could not afford and I had this home built from the ground. I was so heartbroken. I want the phone number of the class action lawyer

    We too had Saxon Mortgage A few weeks ago we received a post card saying this. “We are eligible to receive a payment as the result of an agreement between Saxon and federal Reserve Board- announced in January. This payment is related to am enforcement action regarding deficiencies in the mortgage servicing and foreclosure processes of Saxon. Payment will be made by the paying agent- RUST Consulting, Inc”
    We received a check for $1,000 . Void after 90 days.
    Has any one received any letters or moneys from this Rust Consulting?

    That’s strange cause when our mortgage loan went to RCS Mortgage in 3-1-2012 we were told that Saxon was being shut down due to wrongful mortgage pratices.. We called Saxon Mortgage to find out if it was true & the lady told me that Saxon Mortgage was no longer servicing mortgage loans & that Saxon Mortgage was indeed shut down as of 3-2012 (she never gave me the day, only month & year, We have the letter that shows the day, month & year that Saxon Mortgage stopped servicing.) We got our Lawyer involved & this case with Saxon Mortgage & RCS Mortgage is too large of a case, Lawyer tols us that we’s have to get a Lawyer to handle this type of case.

    saxon began foreclosure on our home after two missed payments. we tried several times to get them to work with us until the house was sold. They refused to work with us and when the house sold they took all our profits claiming that two house payments and foreclosure fees totaled what we had made on the sale. fifteen thousand dollars was way more than we owed them which we were willing to pay but I will never believe that legal fees could possibly add up to ten thousand dollars given that only the paperwork was started. I wish there was a way to get some of the money back. I would also like anyone who reads this to know they also took all the money we had in the escrow account. I wish I could talk to an attorney. Weren’t these people given a bailout by the feds?

    Because of the bad deal received on Modification that was Transfer to another Loan Co. before it was completed and the Loan is much higher than what we was paying. 6.5.

    I lost my home while trying to modify my home loan w the hamp program, I tried everything,sent everything-time and time and time again-I even sat at rhe HUD ASS. for hours while they resent everything, I took enough notes during every single conversation with every single csr to fill 2 notebooks, everytime my modified amount was to become permanent, they would send another letter telling me that I had not included the correct docs, and would extend the trial -period—- I was told I was doing everything correctly by one of their CSR and was told to”hang in there” when the banks (rust) began sending checks to those whom had been affected by the dirty things the banks were found guilty of–some recieved a check, some their homes, if they were not sold, and still some recieved both, my two children whom awoke to a ten days to vacate notice, notifying us our home had been auctioned without prior notification to me, had been sold at auction– we were homeless for a short period of time, even worse had to take the 1st available rental we could find, and it was a nightmare!-$200.00

    I’m interested in a class action law suit against Saxon mtg for loan modification, they did not do! They took my home and my money I was in my home 8 years paying 1 1/2 mortgage to pay off home in 15 years my husband lost his job in 2007 and I called Saxon for loan modification and they said they would help and did nothing the foreclosed January 2008 my husband had a new job 30 days after I contacted them in 2007, they did not have to take my home they took my home and money!
