A wage and hour overtime pay class action lawsuit and collective action was filed against Gentiva Health Services, Inc. in the United States District Court for the Eastern District of New York (styled Rindfleisch, et al. v. Gentiva Health Services, Inc, Case No. 2:10-cv-02111-JFB -ARL) alleging that Gentiva Health Services wrongfully classifies certain visiting health care providers (registered nurses RNs, physical therapists PTs, and occupational therapists OTs) as exempt from overtime compensation under the Fair Labor Standards Act (“FLSA”), 29 U.S.C. 201, et seq., and for failure to pay certain employees for all hours worked in violation of state law, according to a class action lawsuit news report.

    Misclassification of employees as exempt from overtime is one of the most widespread and common violations of the Fair Labor Standards Act and state wage and hour laws. Class action lawsuits are an effective way for employees to obtain the overtime pay that they have earned.

    I worked for Wiregrass Hospice in Montgomery, Al. I put in a lot of hours that I did not get paid for because we were constantly being warned not to get overtime. I was fired from Wiregrass in August because I did not approve of some of the ethics violation that I witnessed. A nurse manager was hired and she befriended me and told me a lot of things and told me not to tell the branch director. She got me fired because she thought that I would rat her out. I have been a nurse since 1981. I worked in two hospitals in critical care. I am a very good nurse. I have high morals and didn’t fit into their concept of doing business. Do you think that I might have reason to bring a lawsuit against them. I have not been able to get another job. I was devastated when I got fired and I have been very depressed. I have always been a very good employee. I am 61 years old and this is the first time I have ever been fired.

    I quit and they wouldnt pay me my vacation pay. Because they said I didnt give 2 wks notice. They said its in the “new” handbook that I never recieved. If their going to change their policies they should legally give every employee a “new” handbook!

    I know I worked for Gentiva in Foley, AL for 3 yrs and decided to leave because of the pay. Much more work is involved on the computer after the 30minute-to 1 1/2 hr visit. Getting paid per visit was not paying the bills because I was not compensated for hours and hours of computer time that had to be done within a certain amount of time. And I had to chart at home, AFTER WORK. Supossedly the per visit rate included the visit and the charting. How obsurd is that? I’d like to see one of the uppers try it. Not possible. So on a better note, I am glad to see something is being done.

    I worked for this co for 12 long hard years.Te in house nurse supervisors were clinically challenged and mostly concerned with icd 9 codes and reimbursement.The office was understaffed and the visiting nurse always had her license on the line due to incompetent staff and administration who could care less wht was happening with patients.I have generated hundreds of thousands of income for them due to a clientele that I generated as an exceptional.Supervisors never answer calls,always in corporate meetings.Adm not for their main money maker THE RN>Hope they pay their debt to the staff that was killing themselves to help pts.They are greedy and do not give a crap about their nurses or patients,bottom dollar.I have worked with toooo many below standard nurses in this co,scarey.

    I gave an exhaustive deposition in Fla in DEC. 7 years of forced PPV. What is the status of the suit. The lawyer Forrest Horne stated his suit should be resolved in the next few months. I have heard nothing further. Comments?
