The Gillette Company (“Gillette”) and The Procter & Gamble Co. (“Procter & Gamble”) (“Defendants”) have reportedly agreed to a class action settlement of a lawsuit against Gillette and Procter & Gamble in the United States District Court for the Middle District of Florida (styled as Poertner v. The Gillette Company, et al, Case No. 6:12-CV-00803-GAP-DAB) alleging, among other things, that Gillette and Procter & Gamble misled consumers in purchasing Duracell Ultra Batteries by making statements such as “Up to 30% Longer in Toys* *vs. Ultra Digital” and “Our Longest Lasting,” according to the Duracell Ultra Batteries Class Action Settlement notice.
The Duracell Ultra Batteries settlement class reportedly includes, unless otherwise excluded, all persons in the U.S. who bought AA or AAA Duracell brand Ultra Advanced and/or Ultra Power batteries at retail (any physical or online retail store or outlet of any kind whatsoever, including club membership wholesalers and warehouse club stores such as Sam’s Club, FedMart, Costco, BJ’s) any time after June 2009.
Under the Duracell Ultra Batteries Class Action Lawsuit Settlement, class members can reportedly file claims to recover $3 to $12 depending on the number of battery packs that were purchased and whether the class member has proof of purchase or not. The settlement provides that Gillette and Procter & Gamble will stop using the advertising statements at issue in the suits and will pay $6 million in the form of Duracell products to charitable organizations.
