Wrigley Class Action Lawsuit Complaint Filed Over Wrigley Eclipse Breeze Exotic Mint and Exotic Berry Flavored Chewing Gum

Wrigley Chewing Gum Customer Files Class Action Lawsuit Complaint Against Wrigley Over Wrigley’s Eclipse Breeze Exotic Mint and Exotic Berry Flavored Chewing Gum.

A class action lawsuit has been filed against W.M. Wrigley Jr. Company(“Wrigley” or “Defendant”) in the United States District Court for the Central District of California (styled Dwight Sityar v. W.M. Wrigley Jr. Company, Case No. CV 10 5965-CAS-SSx) alleging, among other things, that Wrigley markets and sells a brand of gum named “Eclipse Breeze” in two flavors, Exotic Mint and Exotic Berry, that contain labeling that states that the gum is made “with Cardamom to Neutralize the Toughest Breath Odors” and alleging that Wrigley lacks reputable scientific support for such a representation regarding the alleged effectiveness of cardamom in neutralizing “Toughest Breath Odors,” according to class action lawsuit news reports.

The Wrigley Eclipse Breeze Exotic Mint and Exotic Berry Flavored Chewing Gum class action lawsuit is reportedly brought on behalf of a class of all persons who have purchased Wrigley’s Eclipse Breeze Exotic Mint and/or Exotic Berry flavored chewing gum for personal use during the class period as defined in the Wrigley class action lawsuit complaint.

this is so stupid, is this really lawsuit worthy? is there some damage to be sought b/c the cardamom didn’t freshen the worst types of bad breath as promised? this type of crap in the legal system makes me sick

  • Marie November 11, 2010, 8:57 am

I love the taste of the gum…if I want fresh breath, I brush my teeth. It also helps your breath if your teeth and gums are healthy. I agree with Cassandra.

Epically stupid. In fact, I doubt this is even real. I’m just upset I can’t find this gum (not the berry, the regular cardamom) in stores any more — it is the B E S T.

Omg.. This lawsuit is RIDICULOUS!!! I am also VERY upset that I cannot find this gum anymore!! My grocery store used to sell it and I would buy multi packs of the 3 packs!! Cannot find anymore.. I am devastated!! Where can I get my gum?? Has it been discontinued because of a few people that probably need Perio surgery to cure thier halitosis!! They r blaming my gum because they have a more serious issue other than just bad breath!! BRING BACK MY EXOTIC MINT PLEAsE!!!!!!

  • Chris Waldrop January 18, 2011, 1:26 pm

Does this explain why I can’t find it anymore? I could only get it at my local Kroger to begin with, and now they sold them all on discount for a dollar per 3-pack because they were discontinuing sale of it. I’d be really pissed if they stopped making it because of this. It’s my favorite gum ever. I bought every single remaining 3-pack of this gum, and if that’s all there is left now, I’m gonna have to ration it out!

We should start a petition for continued production of this gum!

      • Lynnette December 8, 2011, 4:21 pm

omg! My husband and I love this gum. We also had difficulty finding it. You can buy it off amazon.com. Hope they make it again, it was truly great at helping bad breath.

  • Aaron January 31, 2011, 10:38 am

I don’t care if wriggleys is lying or not, I am addicted to this gum, it tastes amazing and it promotes fresh breath. For those of you who can’t find this, I found a great deal on buy.com. I believe it was $11 or $12 for a case of 12 packs

    • steph December 7, 2011, 1:03 am

thank you, i am searching for it!!

  • Kate February 19, 2011, 5:54 pm

This is the best gum ever!!! I am so addicted but I can’t find it anywhere anymore. Does anybody know what happened or where to get more?

  • Eslinda March 19, 2011, 4:15 pm

Dear Wrigley Folks: Please just drop the claim and continue producing that terrific gum. I’m desperate to have the gum, raid every store in every city that I’ve been to in the last six months, searching for this gum. Cardamom is the best thing that’s happened to gum since discovering chicle! Please bring back Exotic Mint!! And, BTW, just who brought this lawsuit in the first place?

  • Billy March 23, 2011, 9:38 pm

My lady Sherri found this gum for me. I’m not a gum guy, never had been, gives me a headace to chew it. But this Gum (Eclipse Breeze Exotic Mint) is small and the taste is great! Is just another stupid lawsuit geared to make decisions for others without asking our opinion.
I know that this note will not fix this (it takes money and lawyers for that) but jusst know that I will most likely go back to SKOAL and finish getting mouth cancer. And they won’t stop making that because the lable said it will! So to whoever started this Thanks for being there for all of us! YaPUTZ

  • Debbie April 13, 2011, 2:47 pm

Unbelievable. Do people really have nothing better to worry about. The gum is good and it does freshen breath. The people that filed the class action probably have other dental problems that causes them to have bad breath.

Please stop wasting everyones time with a trivial lawsuit and bring back the gum.

  • Anon May 19, 2011, 1:13 am

Interesting…I wonder if this suit is filed by the same Dwight Sityar who was sued by Star Wars for copyright infringement.

  • Patti Ireland June 21, 2011, 9:30 pm

I honestly did not know the product was no longer available until last week when I asked one of my local retailers to try to get it in, as I had not seen it recently. How ridiculous! I have never been a big gum person, but I loved the exotic breeze flavor. it was one of the few gums I found that did not have a sickly sweet aftertaste from sugar substitutes, or a too much sugar. while they did make some claims as to breath freshening capabilities, anyone who believes that a cure for breath odor from a systemic problem can “cured” by gum is way off base. I never purchased it on the basis of any “mystical” powers. I find it interesting that the plaintiff claims so many people were somehow “irreparably harmed” by the advertising of the product is ludicrous. I hope the company will re-market the product without claims for anything other than it is a delightfully flavored gum.

  • Sara July 2, 2011, 5:23 pm

Exotic Mint is hands down my favorite gum–it’s all I buy,
or used to be, until it disappeared from the shelves of every store in town. Please re-label,drop the claim, do whatever you need to do to bring it back; I miss it!!!

  • Milton August 22, 2011, 2:23 pm

Im a smoker and by far, this gum was the one that made my breath fresher. I could get close with my woman, and she wouldnt complain about smoke from my breath. Cant find it nowhere but online.

  • Ellen August 26, 2011, 2:44 pm

I have chewed this gum (exotiv mint) since it arrived in stores in the Metro Milwaukee area – was the best ever !!!! I had my entire family searching every store and gas station only to find that it was pulled from the shelves for something so ridiculous. Do people out there have nothing better to do with their time? Why don’t you use your empty hours to volunteer for a worthy cause – like helping cancer patients… Another case of people wanting something for nothing !

  • Jen October 5, 2011, 3:05 pm

I used this gum (exotic breeze) to successfully get through nicotine cravings when I quit smoking because it had a unique flavor and texture. It was different than the many boring gum flavors on the market that lack originality, lose flavor too fast, and then turn in to annoying flavorless, rubbery substances that do nothing more than aggravate. I actually found exotic breeze to be a perfect substitute to cigarettes while quitting. I have recently tried to find this product again as I have been chewing only xylitol gums and I am feeling bored with the options. I have purchased other brands and common flavors but, I cannot find this much loved flavor. I would love to have it back.

  • Kiara October 6, 2011, 10:32 pm

I’m so upset, that gum was awesome! I could literally eat anything, onions, garlic, etc, then chew that gum and you couldn’t smell anything!!!! I was wondering what happened to it cuz i couldn’t find it in the stores anymore. Now I know and it sucks, that was the best gum EVER, better at freshning my breath than Winterfresh Gum, I wish it would come back. I need it cuz I LOVE garlic and onions in my food.

  • Jill October 21, 2011, 8:21 pm

Completely INSANE!!! I have been looking EVERYWHERE for Eclipse Breeze Exotic Mint Gum! I’ve stopped in each and every gas station and grocery store trying to find it and THIS is the LUDICROUS reason I can’t buy it anymore??? I totally agree with everyone else, how anyone can believe that chewing a piece of gum will ‘cure’ the worst case of bad breath on Earth is beyond unreal. Gum doesn’t solve a medical problem, period. Now, that being said, I have suffered w/serious migraines for 30 years and on a fluke was given a piece of this gum to help w/the nausea from a particularly bad migraine & it was a HUGE help! I am NOT saying this stuff cures migraines or whatever, but whatever the formula is for this gum, it is FINALLY a gum geared to grown-ups and Wrigley’s WE LOVE IT!!! PLEASE BRING IT BACK & JUST DON’T MAKE ANY CLAIMS! PLEASE!

  • Hilarie Kelly October 26, 2011, 11:09 pm

This was the only gum I chewed and it was solely because it did have cardamom in it. Best tasting gum ever. Now I just chew cardamom pods instead. Whoever brought this suit is gaming the system – bet it’s a company that will come out with its own brand of cardamom gum, without the claims

  • Patsy December 14, 2011, 5:29 am

Love the gum – Hate the lawsuit! Let’s get the gum back on the shelves, there’s nothing else on the market that compares to it.

  • Deloras Sullivan December 15, 2011, 2:36 pm

I called Wrigley today, hoping to locate the gum. It is truly the best tasting gum out there. I bought it specifically, because it has the cardamon in it. I am on a desperate hunt for it! I hope they bring it back!

  • Lori December 23, 2011, 2:02 pm

Have been searching for this gum for a year…now I understand why I can’t find it!
Wonder how many ridiculous lawsuits this guy has filed…?
Justice system needs a serious revamp…all class action/money based lawsuits that get filed must go before a panel of sane, rational individuals ‘the common sense grand jury’ to determine merit and feasability of damages. Give them the power to ‘mediate’…”hey, Wrigley, take of the ‘scientifically proven’ statement on your gum package so we can deny this lawsuit!”
Wow! $5 mil because a company relied on herbal lore and a ‘mis-statement to sell a product…(a product I think was wonderful and did freshen my breath, despite lack of ‘scientific testing’).
Really disappointed – but if anyone finds/knows where to get some of this FANTASTIC BREATH FRESHENING GUM (exotic mint)…please let me know!

    • lmn March 2, 2012, 10:20 pm

Amen! I loved this gum, and yes I found that if I ate onions or garlic, that all I had to do was chew a piece of this gum and the bad flavor in my mouth would be gone. It also helped calm my upset stomach. Would love to see them bring it back.

  • Dawn D., PhD January 1, 2012, 11:40 am

I have a small stash of this gum, and after reading this site, I just bought the last 90 packs I could find on eBay. This lawsuit is ridiculous. So it didn’t cure your bad breath, Dwight? Just don’t buy it again! It’s that simple. But to sue for $5M? And deny the rest of us our consumer power to buy into what may be hype? Supplement/vitamin companies make unregulated benefit claims all the time with the disclaimer that the FDA doesn’t regulate their claims. Perhaps all Wrigley’s needs to do is say “These statements are not FDA approved,” or just take the claims off the package and simply say “cardamom-mint flavor.” Whatever packaging design you choose Wrigley’s, just bring back the best gum ever manufactured…PLEASE.

  • V January 3, 2012, 3:33 am

Oh my effing G I am so mad if this is why I can’t find this gum anymore

  • V January 3, 2012, 3:34 am

Also, aren’t there millions of claims on millions of products with no scientific proof whatsoever..why did my favorite gum have to get under attack

  • D. M. January 4, 2012, 6:43 pm

Why doe we sue those responsible for the class action suit for taking away a favorite gum, bad breath credibility be damned!

Soon all Wrigley’s gum will increase in price because of the suit, and before you know it there will be a suit about the increase in price causing undue burden on the market.

Litigious moron. Get a freakin’ LIFE!!!

  • A. M. January 15, 2012, 10:19 am

This is the dumbest S**t I have heard about in a long time! You mean to tell me I can’t find my Exotic Mint gum, because of the actions of a few jackasses?!!!
I like the taste of this gum!!! Bring it back! If your breath is that foul and the gum doesn’t work…don’t buy it!!! Get a life…you stupid losers!!!

  • L.B. January 19, 2012, 10:44 am

Agrees with most above. I normally hate gums but the mint with cardamom is really good and I like the fact they used real cardamom, a natural flavor, like I think they sometime give at Indian restaurants after the dinner. Please come back! What idiots spends their time suing for something that doesn’t hurt anyone, is that well spent time or what? Get yourselves some decent jobs and some tooth brushes that will help against bad breath.

  • C.A. January 30, 2012, 11:32 am

I heard of the exotic gums with Cardamon and couldn’t find them. Now I know why. I used to buy the Chicklets with Cardamon and it was the best tasting gum. It was imported from overseas and found in Arabic specialty stores. I was crushed when I couldn’t find it anymore.
Thanks to the idiot who screwed up a market. Doesn’t he have anything else to do with his life? Maybe his breath stinks so much because he’s full of s**t.

  • Laura February 3, 2012, 8:32 am

Probably some other gum company put some idiot up to start this stupid lawsuit =/ I love this gum (both) more than any other gum I have ever tried. Havent been able to find it lately & now I know why! Grrrrr !!! I would like to say to the moron that started this lawsuit, that he is so full of $#iT & thats why this gum supposedly didnt work for him/her. Get a life & bite me =)

  • greg goetsch February 15, 2012, 11:14 am

This is stupid…I love this gum (the non-berry) and can’t get it anymore. So basically all the people who want this gum and surely are smart enough to decide whether or not it effectively remedies their bad breath, can’t get anymore. Why? Because one greedy person wants a make big bucks from a big company. I’m not defending the statement on the gum or the Wrigley, which may be a big uncaring corporation, but seriously, I’ve tried a number of gums out there which I didn’t like, which say all kinds of things about whitening and long lasting flavor, etc. So what they don’t work for me. I’ll try something else…but will I sue them for not whitening my teath? Wrigley, if you read this and have a case of your gum, I don’t need to freshen my breath…I just like the taste…please send me some.

  • Vilma Lesesne March 8, 2012, 9:40 am

Who cares if it’s not helping people with their breath then they need to get a good check. The flavor is wonderfull and the mouth feels clean without an abrasive tast.

  • Laura July 5, 2012, 8:48 pm

What a jerk. You either hate the gum or you love it above all other chewing gum. Why did he have to wreck it? No gum is as good any more. If he’s that worried about breath he should go to the dentist. Wrigley’s, please just change the wording on the package and give us back our gum. Court, please through out this frivolous BS!

  • Aquarian12582 July 16, 2012, 3:50 pm

Glad to know I am not the only person who has been searching for this gum and who has been obsessed with it!

  • Sherri October 26, 2012, 6:08 pm

This has been long enough. Its a frivolous lawsuit. The Plaintiff is an idiot. We all LOVE this gum and want it back desperately.

  • Lucy February 14, 2013, 10:30 pm

How stupid of a lawsuit — in America people sue for any reason. Think of alkaline the money the lawyers wick make and you will get $10.00. No one forced you to buy the gun which is great tasting!!!.

  • Lorinda March 4, 2013, 4:34 pm

I adore Eclipse with Cardamom gum, and was wondering why I could not find it. Tastes like the herbs used in India to freshen breath after a meal. I WANT THIS GUM BACK!

  • Sherri March 5, 2013, 3:08 pm

Not to make any one jealous or anything but I was looking for something in an old suitcase and found just one pack of this wonderful gum. I am savoring every piece. Oh how I wish they would bring it back. And I agree with every one…what a stupid lawsuit.

  • Natalie Cleckler March 25, 2013, 1:40 pm

Thank you, bloody idiots who brought this lawsuit. Now nobody can enjoy this gum anymore. I hope you didn’t get any money out of this.

  • Aimee March 10, 2014, 7:34 pm

I bought mine in bulk years ago and still chew it even though it’s getting a little stale. Best gum ever! booooo to frivolous lawsuits! please find a way to bring back cardamom gum!!!!

  • David Henderson March 23, 2015, 1:44 pm

What a shame. The cardamom gum was incredible tasting, and long lasting. Most brands of gum claim to freshen breath. They do while you are chewing. Look at the claims made by the supplement industry (snake oil) they get away with (almost) murder. Sadly I have used up my stash. Please bring it back.
