Volkswagen VW New Beetle Tiptronic Automatic Transmission Class Action Lawsuit Complaint

2003-2007 Volkswagen New Beetle Vehicle Owners and Lessees File Class Action Lawsuit Against Volkswagen Over Alleged Tiptronic Automatic Transmission Defect.

A class action lawsuit has reportedly been filed against Volkswagen Group of America, Inc. (“Volkswagen” or “VW” or “Defendant”) in the United States District Court for the Western District of Arkansas (styled Shirley J. White v. Volkswagen Group of America, Inc., Class Action Case No. 11 CV 2243) alleging, among other things, that Volkswagen VW sold model year 2003 to 2007 Volkswagen VW New Beetle automobiles equipped with a Tiptronic automatic transmission that allegedly has a defect that causes the transmission to malfunction and require replacement thereby forcing vehicle owners to sustain monetary damages and leaving them with a malfunctioning vehicle, according to the Volkswagen VW New Beetle Tiptronic Automatic Transmission class action lawsuit complaint.

Pursuant to Federal Rule of Civil Procedure 23, Plaintiff brought the action as a class action on behalf of herself and all other similarly situated owners and lessees of model year 2003-2007 Volkswagen New Beetle vehicles within the United States equipped with a Tiptronic automatic transmission.

The Volkswagen VW New Beetle Tiptronic Automatic Transmission class action lawsuit complaint reportedly asserts claims for alleged breach of express warranty, breach of implied warranty of merchantability, strict liability, negligence, violation of the Arkansas Deceptive Trade Practices Act and unjust enrichment.

Ok, Now that there is a Class Action suit against VW America on the Beetle Tiptronic Automatic Transmission and there is a hearing, Is the 2005 and up Jetta’s included or do us Jetta owners have to start our own class action suite against VW on the Tiptronic Automatic Transmission

    Thanks
    Glenn

      Glenn:
Have a 2004 Jetta with 83,00 miles that fits right in with the Beetle Class Action. VW doesn’t want to offer anything, claiming there aren’t enough claims against the Tiptronic to have them get involved. All this despite the internet being “loaded” with Jetta owners with many Tiptronic problems. If you read the Beetle Class Action Suit you see that VW admits a valve problem but only wants to take care of that problem. Since the Tiptronic is a sealed transmission that does nothing. You have to replace the whole transmission. The Beetle suit summarizes everything we are going through but has details. All Jetta owners with problems need to contact the NHTSA so we have numbers. There is no way I can afford to fix the Jetta and just like the statement in the Beetle suit – no transmission should “go” after only 80,000 miles. The bottom line to the whole situation is that there is nothing you can do from a service standpoint to see this coming. You are told to check the fluid for any leaks at 40,000 and 80,000 and that’s it. We need to know how many Jetta owners have had problems – in numbers there is strength. Are the Tiptronic Transmissions the same as the ones put in the Beetles to some degree and were they assembled in Mexico as were the Beetles and do we share the valve problem that VW has admitted to in the Beetle suit?

    Hello all,
Im just another drop in the big bucket of victims of this Triptronic transmission mess. It slams into 1st as I am slowing down for a red light and lunges hard and also drops out of gear or power as I am accelerating and I have to let my foot off the gas pedal for a moment and then I am able to accelerate again. Unreal! We bought this car from a used car dealer and the car was super clean with under 65,000 miles on it. The problems showed their ugly head soon after and of course the warranty for the used car dealer was a very short one that didn’t cover me. VW should be absolutely held responsible for selling these vehicles with this type of transmission that have these obvious problems.
Does anyone know the status of this class action lawsuit???…because I was ready to call my lawyer immediately and see about getting one started and then I came across this post.

    Sincerely enraged,
    Elliott

i would like to know HOW TO add myself to this law suit for the 2003 beetle transmission issue! please advise thanks charles

      • Hayley August 14, 2012, 2:00 pm

I’m having the same issues. How do I add myself to the complaint/law suit?

        • Wendy Alas October 12, 2012, 9:16 pm

I am having the same issue with my 2005 convertible. When I took it to the dealer they said it would cost me $5,000 to replace the transmission. The car only has 47,000 miles. This is ridiculous. I want to be added to this list.

          • KN November 1, 2012, 3:19 pm

I just emailed the law firm that handled this case – http://katriellaw.com/. The case is no longer listed – but it sounds like they may have enough plaintiffs for another one. I just took in my 2006 New Beetle Convertible – same thing and a $5k bill.

    • Peggy October 21, 2012, 2:19 pm

      Elliott:

Your case sounds exactly like mine. At 60,000 something miles I bought my 2005 vw beetle off an elderly lady who bought it new and she had all warranty repairs etc. After driving it across country and about 3000 miles later transmission started doing the same as yours. VW dealer in Tucson, Az. said I needed a new transmission body $1600. Humph! It is doing this intermittently and they told me I should have it done or ruin the trannsmission. Figure I will have to wait and see. Now afraid to drive it too much. If you hear anything at all about this lawsuit let me know

  • Crystal April 23, 2012, 10:51 am

My car also, “drops out of gear or power as I am accelerating and I have to let my foot off the gas pedal for a moment and then I am able to accelerate again.” It has only happened about 3 times in the past month but it is by far one of the scariest things I have ever expereinced. My car is at the shop right now and from what I have read above and in other vw forums it sounds like my car and I are going to be in major financial trouble. What do I do? 🙁

  • Chris April 27, 2012, 11:09 pm

05 New Beetle convertible from Gossett VW in Memphis. When my wife selected the car, I asked the salesman if the transmission issues noted in the 03 and 04 had been resolved. He said they has redesigned the transmission. It began hard shifting in the first 1000 miles: 2nd to 3rd gear. We had this car to the dealer many times and they stated they could not duplicate the issue. Treated my wife as if she were a lunatic. Later in the life of the car they reprogrammed the shift points; to no avail. Did this just before warranty ran out, stated we were fine. We weren’t. Took the car back after the warranty was out and asked for goodwill repair when they told us the transmission had failed. I asked about the valve body and they said that wouldn’t help. VWoA in Virginia refused to help but offered $1000 off on a new VW. Really? Ha. Snort! Got a letter that year on the valve body recall. Went to the dealer, got the only if your transmission still works slap in the face. Wife in tears. Service writer had been told by her about this problem on every visit beginning with the very first 30 day check up. Discovered he did not not it on all the repair orders. Lying schmuck. Saw the original salesman, Ron Owens at Gossett VW in Germantown, TN. He said, “Hey, just bring it over and I will get them to take it in trade.” Really, Ron? I look that stupid? Sacrifice the 25,000 dollars paid for the car by trading it at a lowball price so you can fix it at dealer cost and then resell it at a handsome profit. AND make a killing on yet another sale?? The bug is sitting in the driveway in limp home mode where it has been for over a year. My wife is driving the 99 Nissan Sentra that we gave our daughter in high school. Daughter, now out of college, bought new Honda Civic. A mockingbird has recognized the bug for the piece of sh*t that it is and uses it for a perch and a bathroom. Al Gossett’s receptionist recently told my wife that Gossett would NEVER help us. That was when she called to see if they would split the cost of a repair. A couple of weeks ago we got a mailer from Gossett VW manager Billy Smith noting that he was desperately looking to buy 2005 New Beetles. I left him a message today offering to let him buy ours for $25,000. Arghhhhhh. My sweet wife has PTSD from nearly getting nailed over and over at red lights when the car failed to accelerate properly or lurched when downshifting. Deutschland Deutschland uber alles! Hitler is alive somewhere giggling about the tiptronic transmission in the New Beetle.

    • Annick December 7, 2012, 10:02 am

My 2004 Beetle convertible started loosing coolant so I had to replace the timing belt, water pump and thermostat. Just found out today that I have to do it again. I also got the glorious news that the transmission is having issues. The same kind of stuff that has been stated over and over again in these comments about the gears changing roughly. The transmission guy told me there was a lawsuit about this very issue but I can’t find anything out about it or what to do. So far my bill which I refuse to pay is thirty eight hundred dollars. What do I do now?

    • Doug December 29, 2012, 6:32 pm

i have a vw beetle 2005 its doing the same thing!! HELP?

  • randy May 8, 2012, 12:33 pm

05 Beetle has the exact same problem. Has had the ‘stalling/no acceleration’ randomly since I bought the car with 50K miles. Now at 82K miles it has the nasty downshift described above. I took it to a reputable transmission shop and they think it’s a solenoid but you can’t buy those separately, you have to buy an entire valve body, which is almost the cost of a new transmission. My beetle is also sitting, while i figure out my options.

    • Jack September 18, 2019, 12:03 am

Bought our beetle new in 2012, turbo Tiptronic. Was in the shop about 5 times always the transmission would not shift taking off. Nearly hit severely times from slow take off. The dealership acted like they never heard of this before. We still have the car and love everything about but the transmission. I just take off in sport mode and shift it, this is the only way to drive the car without holding the gas to the floor and counting to 4 before it launches you and spins the tires…

  • Alice Stanton May 19, 2012, 12:57 am

I currently own a 2005 New Beetle convertible with turbo. I have a laundry list of problems with my car. As of recent a timing belt break at 71,000 miles caused engine damage and 4,400 dollars in repairs not to mention the several other current issues. But to relate to this lawsuit the very first thing I ever had replaced on this vehicle was the valve body on the transmission because there was something wrong with it. I’ve experienced jerky transmission issues and have had the car to the shop several times complaining of transmission problems. Please contact me I want to know more about this. alicestanton@yahoo.com

2005 new beetle convertible, called VW North America and filed a claim #, brought to 3 different VW dealers, all could not reproduce the problem. also attached to my VAG COM and still no codes shown.. something is totally wrong. I’ve driven many cards for decades and have never experienced losing or falling out of gear in the freeway until I drove this dangerous vehicle, losing power in the middle of the freeway is dangerous…almost been rear ended twice in the fast and middle lanes. Wish VW would do good but I don’t have reason to believe in them. How do I join the suit?

    • harry June 7, 2012, 6:58 pm

      “cars” not “cards”

  • Valerie June 29, 2012, 5:04 pm

2003 new beetle convertible. Since I wasn’t the original owner I never knew about the extended warranty. My car started having lurching issues and I went to my dealership to see what was the problem. Said it was the body valve and quoted me around $2000. Since my dealership has screwed me over in the past I took my car to several transmission shops. No one wanted to work on it. Said that VW was replacing the body valve with another defective part and that it would be just the beginning of my problems.

I asked/wrote/email VW and never heard a word back from them. I am so mad. My car is dangerous. I just look for places to break down. It is scary to drive but, in this economy, I have no other choice.

Why can’t anyone tell us about this class action suit? I am so frustrated!! I have owned VW’s since the 70″s but I will never, ever again own anything from that corporation. Shame on them!!!

  • Dean July 2, 2012, 2:45 pm

My daughter’s 2006 beetle has 100,000 miles been having problems the same as everyone else..

  • Mike July 2, 2012, 5:11 pm

2003 gls convertible 2.0 93k miles another victim of the transmission issue. I was hoping to see some suggestions on fixing after getting a $2400 quote from a local Atlanta transmission shop. Never buy vw again! Parting it out now there is no hope for these big car makers to care about the consumer until you punish them with your dollar votes.

  • Ann July 5, 2012, 8:20 pm

Just before my younger daughter’s 16th birthday in June 2009, my husband bought her a 2005 Volkswagen Beetle. To say that she was speechless and absolutely thrilled is an understatement. We were happy to have her receive the car especially since at that time I was unemployed. Instead of carrying a Loan on the car, my husband borrowed against his 401K because of the better interest rate.

The Beetle was purchaed ata Hyundai dealership and it appeared to be in good shape. My daughter loved driving the car UNTIL that awful day that the car started hard shifting. The Beetle would jerk, sometimes lunge forward unexpectantly at a higher speed or slow without warning to almost a stop. My daughter was terrified that someone might hit her or even worse she might hit someone else when the car made these unexpected movements. My husband received the VW of America letter stating that the valve body should be replaced so the car was taken to an authorized Volkswagen dealership for the repair. It didn’t take the dealership but a couple of days to tell us that the car our daughter loved needed a new transmission at a cost close to $6000. Since we were a one income family already struggling to make ends meet, we could not afford to make the repair. We parked our daughter’s car in early 2010 and the car has not moved since. We also contacted VW of America to make a complaint, but we were told nothing would be done to correct the problem.

I would love to be a part of the class action lawsuit against VW. There seems to be a number of people with similar problems. Hopefully by banding together, each individual affected by the defective transmissions will find justice.

  • judy m. brundige July 17, 2012, 9:06 pm

I HAVE THE SAME SHIFTING PROBLEM ON MY 2007 TRIPTRONIC TRANSMISSION AND THE VW DEALER JUST IGNOERD IT FOR 2000 MILES AFTER THEY WERE TOLD SO THEY COULD GET PAST THE WARRANTY

  • Terry July 19, 2012, 10:05 pm

My daughters car has the same problems listed above. I need to get in the Class action law suit. I hate that my daughter has to drive this car but we don’t have any choice. What will it take, someone to die on the road in this car before vw is forced to fix this problem?

  • Paul Jones July 23, 2012, 10:43 pm

2006 Beetle bought it new , has the same triptron problem.

  • James July 30, 2012, 2:59 pm

I also am a “proud” owner of one of these great German cars (not). I was wondering if you can still become part of this lawsuit or not? If anyone knows please email me at jamesf9691@yahoo.com
    Thanks

  • Teresa August 14, 2012, 8:12 pm

I purchased my 2005 VW beetle convertible in 2009 and my problems are just beginning the car jerks so hard sometimes from 1st to 2nd gear that my tires squeal! I also just had the regulator on my rear passenger window fixed! And my rear cup holder and front cup holders are both broken which is minor to the transmission problems and the window! The jerking doesnt start when you first start driving it’s usually after you drive it for awhile. Please give me some information on the lawsuit!!

    • Teresa November 15, 2012, 5:24 pm

The problem with my transmission have worsened over time! I am experiencing the same problems but they are ten times worse. I took my 2005 VW Beetle Convertible to Smith Volkswagen in Wilmington,DE. And I was told that I needed a new transmission that was going to cost $5,598. I told the service guy that I may as well come pick the car up now because I did not have that kind of money! That’s what it will cost to pay the car off I would be a fool to pay to have the transmission replace! Thinking about trading the car I will never buy another VW I can tell you that!! LAWSUIT INFO PLEASE!!

  • Mike Pursifull August 19, 2012, 11:18 am

Please note: This tiptronic transmission was installed on many other VW products besides the Beetle. The VW Beetle, Golf and Jetta are all on the same “platform” along with some Audi models.
The class action suit missed about a million others.
My wife’s 2004 Golf TDI has the same shifing issues with the same Tiptronic 5 spd CODE GPC transmission.

  • Lisa whiting August 25, 2012, 2:33 pm

2005 new beetle convertible same issues would love to join this class action lawsuit. Called vw dealership today about my shifting issues and they told me my warrenty was up july 1st .

  • kelly peterson September 8, 2012, 10:39 pm

I have had the sane problems recently with the shifting issues when accelerating and also when idle at a stoplight the rough shaking feeling. i just had all of engine coils replaced just a few weeks ago when my car almost stalled on the freeway and now they said the transmission has been damaged! and the VW dealership are trying to say it is something I did driving over something! My sister had the same exact problem with her VW beetle and had to have the entire transmission replaced before whe found out about the lawsuit. Also my airbag light has been on and ive had other owners day the same exact problem with that as well.

  • Fharen Conner September 11, 2012, 10:22 am

Hey, wanted to see if anyone who owns a VW Jetta 02-05′ had any of the same problems and wanted to ban together to form a class action suit against VW of America. My parents bought me my Jetta when I turned 16. It was brand new and had never been driven before. I’m its first and only owner. Back when it was still under warranty it would sometimes pull back and shift hard into the next year and I told my dad about it, but he could never duplicate it and neither could the dealership. Skip a few yrs later when the warranty ran out and unless I let my car sit and warm up it would have to worst time shifting between certain gears. The rpm’s would rev up like crazy, but it was still driveable and I was a broke college student anyway. Btw, my dad contacted VW of America and they fed him some bs story about how they’d give him a discount if he bought me a new VW and traded mine in. Wtf is wrong w/ them, clearly we will never by one ever again! The weird thing was the problem stopped for awhile, want to say 6 months or so. Skip to now and I have had to have my engine rebuilt because I never had the money to fix my transmission and then put a new transmission in the car. It got so bad I thought I was going to die one day when I was driving 60mph and my car just revved up and a truck almost smashed in to me. The crazy thing is this problem with the transmissions is known, my mechanic wanted me to by a brand new transmission from Germany b/c he said the ones that are having problems are the ones that came from Mexico and I’ll prob have to end up replacing my tranny again. There are numerous message boards of people complaining about having the same issues. I just spent almost $8,000 fixing my car and a month later my new transmission is starting to act like my old one did in the beginning 🙁 I say we do something about it and stick it to VW just like they stuck it to us!

    • Seth Wrobel October 11, 2012, 9:42 pm

I just bought a 2005 GLI (mk4) from up in the DC area. I live in South Carolina and the car was fine up there and all the way home. On my way to work today, the car went from driving 40mph to an almost dead stop like it had down shifted all the way to 1st gear. I had to limp it home and thank goodness I have a 1999 Jeep grand cherokee with 210,xxx miles that works just fine. Maybe this needs to be a VW tiptronic class action lawsuit instead of a New Beetle transmission lawsuit….

  • Rick Hamilton September 15, 2012, 4:08 pm

My 2004 SuperBeetle also drops out of gear or power as I am accelerating and I have to let my foot off the gas pedal for a moment and then I am able to accelerate again, after a hard clunk into 4th gear. Seems to happen more when the car has warmed up, but sometimes cold as well. Some clunky shifting up and down to other gears as well. How do we join this lawsuit?

  • cindy cole September 20, 2012, 10:52 am

I also have a 2005 VW Beetle that has faulty triptonic switch. My car will actually fall into nuetral while driving and start decelerating. It has died twice in the middle of the intersection from a stop to go. I would like to join this lawsuit if possible as well:(

  • harold September 23, 2012, 5:44 pm

I have the same problem as Cindy Cole, 2005 New Beetle Convertible
    1. Car goes into neutral, and decelerates rapidly on the freeway. Press Gas, Breaks, and nothing happens. few seconds later the car goes back into gear.

    2. Car decelerates, then suddenly the transmission slams and lunges forward rapidly.

    • harold September 23, 2012, 5:46 pm

forgot to add #3, car dies in the middle of driving. Car also dies when driving up the hill. and coming to a stop.

Pressing accelerator has no effect on the Tachometer, it drops to zero.

      • john lange October 3, 2012, 11:33 am

how do you join this lawsuit???. just found out about it and i guess my dealer, bill jacobs vw in naperville, ill forgot to inform me of it. like the 7 year 70,000 mile bumper to bumper warranty i purchased that only covered the bumpers because every time i took it there for something i had to pay for it. i actually found a heavy equiptment operator who was faster than the highly trained vw techs. and all it took to get him to make the repair was parts and coors lite. what lawyer do you call to join this class action??

  • Dana N. September 24, 2012, 9:55 pm

I am so freaked out about driving my 2005 New Beetle 300 miles to my new home this week that I decided to Google the Valve Body complaints of VW’s. I am reading horror stories similar to mine. I have owned dependable Euro cars: 1976 Superbeetle, 1984 Jetta, Audi Fox….but this 2005 Beetle is such a joke! My husband thinks that I can manual shift when the power cuts. Right! On the 15 freeway with 18-wheelers breathing down my back! I just want my money back. I only trust the car around town. Love the convertible. I even had the window broken into and installed a backup camera. I am even more petrified to take the drive to Vegas after reading dozens of comments. Maybe I will tow it out there.

God bless Shirley J White for filing the lawsuit and for asking for a jury trial!

  • Laura B November 10, 2012, 10:28 am

Bugslug is exactly what this piece of junk is, I had to drive my vehicle with this transmission problem or not have a job. VW told me my car was past warrenty, and then they told me there was no class action suit on this tiptronic transmission that they KNEW was faulty.

The case # is 2:11-cv02243 if anyone is interested. I am strongly considering starting this lawsuit myself. If I do I’ll need as many of you with this issue as possible.

  • Julie Hickman November 14, 2012, 4:50 pm

I would like the contact information to add my name to this class action lawsuit. I just purchased a 2005 VW beetle convertible from a used car dealership and after 2 days driving it, it is apparent that it has transmission problems with all the symptoms described by the other owners. All I would wish for is for my transmission to replaced without cost to me.

I have an 05 VW Beetle with a TripTronic Auto Trans. At 70,000 miles I started having issues with trans shifting… It dies on me and only restarts when holding gas pedal all the way down and then takes off only to starting sputtering. Help please

I just found out my tiptronic isn’t working and I need a new switch assembly. They want to charge me $582.00 to fix it at the dealership. I tried to look for the parts and cannot even find a price! I was going to go to another garage for cheaper repairs and they can’t even locate this part. So…whats my next step here?

    I need my car fixed!!

I want to be included in this lawsuit.

    Hi There Fellow Victims,

I bought our 2004 New Beetle TDI 6spd DSG Three years ago…what a nightmare..it had 60K on it and we put another 37K on it. I have spent hours maintaining this thing and am totally disgusted with it. Last week while driving the family home, it started making a whirring noise like a fan belt pulley needing replacement. We were only 10 miles from home so I figured I would deal with it after we got home. No chance…3 miles from home it stoped the noise, but the car lost power…I shifted over to the self shift, and tried to drive it home limping…got another half mile and boom…white smoke everywhere…tranny dead. what a piece of junk…no notice, just dead. I had it towed to our house and there it sits…the VW dealers here at DFW Texas quoted me between 6-7 thousand dollars for replacement…what a rip off…how do I join the class action suit? thanks, Andy

  • Mary morrow March 4, 2013, 11:21 am

We have a 2004 new beetle convertible and are having the same shifting problems as others . This car has only 67000 miles on it.
How do we join this class action law suit?
    Thank-you,
    Mary and Leroy Morrow

  • Roxane Cheap March 4, 2013, 7:33 pm

Does anyone know if this class action suit is closed? If it is, looks like there are enough of us to get another one started! I too, am a screwed owner of an ’05 VW New Beetle. I purchased the vehicle 5/22/12 with 68k miles on it. Within 3 days it was back at the VW dealership having the Tiptronic casing and housing replaced. 3,000 miles later started with the same transmission problems everyone else describes: Hard downshifting, lurching @ upshifting, especially 3rd to 4th gear. Took it back to VW dealership on 1/15/13 complaining about transmission. Tip-tronic switch broken, again, and replaced. Was hit with a $550 bill for replacing alternator harness, aux fuse box and a 110A fuse. Walked away with same problem! I was told they would have to pull the transmission to see what was causing slipping and lurching to the tune of $1700! Told them to leave it. Was also quoted $5k for new transmission. Since the car blue books at $6K…this repair makes absolutely no sense! I FIND IT HARD TO BELIEVE VW CAN STILL PUT THESE CARS ON THE MARKET WITH KNOWN TRANSMISSION PROBLEMS! INSANE! If anyone knows of an open lawsuit, will you please e-mail me info? roxane.cheap@hotmail.com

I have a 2004 vw bettle convertible. It has 74000 miles on it. Hard shifting started at about 55000 miles had a recall on valve body. took it to a dealer and they said it wasn’t related to the recall said the trans was burned up BULLSHIT

  • jerome jowers March 9, 2013, 4:30 pm

Looks like 6000 for a new one or 4000 to have it rebuilt. This car is a peice of SHIT. The interior is coming lose from the doors .It had a recall on the air bag sensor. A recall on the on the catylistic converter. The fuel pump went out at 40000 that was 400 dollars.I have had to replace both back window regulators that was 250 dollars a peice.Voltswagen needs to settle up with the people who bought this peice of shit bug.

  • Debby Mcbride March 12, 2013, 9:11 pm

Have a 2003 convertable VW beetle. Bought it used but still under warranty. Needed many repairs under warranty and has continued to need one repair after another since the warranty expired. Some of them the same repairs fixed under warranty. It now has 80,000 miles and has been having this transmission problem for several months. We couldn’t seem to get any answers. We feel helpless. This car has cost us a fortune and now the repairs for the transmission cost more than the damn car is worth let alone all the other things that just keep breaking on the car. Is ther still an open lawsuit?

  • Sean March 18, 2013, 12:00 pm

Can I still get on this lawsuit? My story’s the same as MANY others here. 2005 Beetle with 62000 miles on it. Hard shifts, slipping, and today it started skipping gears! Went from first to fifth and then wouldn’t down shift back to first! This was supposed to be a reliable car (that the dealer had promised) for my daughter. She no longer drives it, and it sits in the garage until we figure out what to do with it! I will NEVER purchase another VW product!!

  • Derilyn March 25, 2013, 7:30 pm

how can I be added please let me know. I have written and spoken with VW thanking them for turning my “dream car” into a nightmsre

  • Daniel Griffith March 29, 2013, 3:56 pm

I have a 04 bettle GLS convertible with the 6 speed Triptronic. The dealership said that the valve body in the transmission needs replaced. Part and labor $2400. The dealership told me the parts are on national back order and they do not know when they will get the parts.

Ok, can someone tell me how I can add my name to the list of people with the same VW problem?

  • Ryan March 30, 2013, 2:03 am

Same here. Would love to be part of this lawsuit.

  • Roxane Cheap April 11, 2013, 12:06 am

Update to my previous post. Found out thru VW of America that, due to so may complaints, VW extended their warranty on valve bodies to 7 years or 100,000 miles. This warranty follows the car so you don’t have to be original owner. Amazing this information was never offered by the VW dealership! I had my car in for service on 1/10/13. VW America denied any warranty work because my warranty expired 12/31/12. TEN days before I had it in the shop!! Check to see when your 7 years are up. If you’re still under warranty, I recommend you contact your service department asap. Hope this will help some of you with newer cars than mine! Like others on this blog, my cute little bug is a driveway ornament. Since I live in Fla, maybe the next hurricane will blow this bug to OZ! I’m so disappointed in VW! I need to breathe before I decide my next move! Best Wishes!

Oh forgot to mention! About 3 weeks ago was driving about 5 miles from home when my car acted like it was in neutral while it should have been shifting. Almost got rear ended because the car stopped moving forward. It then stuck in 3rd gear. Had to drive it home 20-25 mph. Rush hour traffic loved me!! Can’t even put it in gear now or it feels like the rear end is going to drop out!

  • Michael April 13, 2013, 1:04 pm

03 VW GTI, 5-speed auto trans with tiptronic. Transmission started going at 85,000 miles. Let it warm up so sometimes it slips into gear but most times I have to take it up to the red line to get over 3rd and into 4th. Violent downshifts with a lot of cars coming close to ramming from behind. This problem affects ALL Volkswagen and Audi cars with automatic transmissions from that time period.
I am hoping to find a government agency to stand on the side of the consumer here. VW is too big and has no problem trampling their customers with $5,000.00 repair bills.

  • susie rain May 7, 2013, 4:48 pm

    May 2012
I started noticing jerking with the car. It seemed to happen intermittingly from time to time. As time went on, the pattern of this event happened after about 20 minutes of driving when approaching a red light to stop after leaving the highway and reducing speed quickly. There would be a jerk or maybe defined better as a slip in shifting down at the lower gear.

    June 18, 2012
After much discussion Metro Volkswagen, 2400 N. Story Road, Irving, Tx 75062 (972)696-999 Advisor Laurie Sherman agreed to replace the bad valve body at no charge. She said the valve body was causing this problem. On the internet I saw lots of information that indicated that the warranty for this part had been extended to 7 years from 5 years on this part due to massive amount of faultiness that car owners experience with this part. She acted like she did me a big favor.
    January 2013
I started noticing the exact same thing as mentioned above.

    January 29, 2013
    VW recommended $6200 transmission replacement.
    January 30, 2013
I went to pick up the car. The man said I need the transmission replaced. He tried to explain the problem to me. He was unable to answer any of my questions because he said he was new. He said he would have another technician call me to talk about this situation. No one ever called me back. Some of my questions:
The invoice from 29jan13 says “opened up vta.techlined advised on transmission replacement” but the report does not elaborate on what is wrong with the transmission or that anything is wrong with the transmission. I asked what the problems were with the transmission. How did they happen? What is vta.techlined? Did having a bad valve body damage my transmission? If so shouldn’t VW be responsible for the repairs? Why are the symptoms exactly the same but the diagnosis different than last summer when the valve body was bad? Why would a car with only 72k miles have a bad transmission when fluids have been maintained? What government agencies oversee consumer protection in the auto maintenance industry? Are there any recall items for my car? Are there any other extended warranties still active on my car?

February 18, 2013 at 1601 (5minutes) I called VW and asked when my call would be returned and was told by the persona after waiting on hold for several minutes that “Laurie my technician was with another customer but that she would definitely call me back tonight.” No one called back.

Have an 07 Beetle convertible. Bought in January 2011 with 23k miles. Just hit 70k yesterday. For three months now I’ve had the same issues as above with had shifting, jerking, lurching when accelerating, but only after car has been driven for at least 10-15 minutes. I’ve always noticed a problem with the car jerking into first when decellerating and turning corners. I’ve replaced air filter, cleaned gas tank with fuel injector fluid, changed spark plugs. No change. I purchased an extended warranty at Carmax that covers me at 100k. So I will be calling them first thing Monday.

I just bought a 2005 beetle vow convertible and already I have jolting problem shifting from 1st to 2nd and a little less to 3rd. It has about 88k miles on it but still should not have this problem. Please somebody tell me about the class action suit vs VW. I would appreciate it so much.

  • Bunny Reddick May 25, 2013, 8:44 pm

So, I too am the proud owner of a 2003 Volkswagen Beetle that currently resides in my garage because it as many others have stated to dangerous to drive. It’s interesting that the one car that I ever bought brand new off the showroom floor, now gives me such pain and suffering. My 2003 currently only has 85,000 miles and just started the lurching and stalling during shifting. If I take my foot off the gas and allow the car to shift it works okay, but when I go to stop I have to keep patting the brake, as to try not to hit them to hard or wham your whole body slams forward. Yes, I did receive the notice from Volkswagen of America regarding the warranty extension – Transmission Valve body. But, to little to late – I purchased my car on May 18, 2003 and received the letter/notice from Volkswagen in November 2010. So, do the math – warranty extened to cover the transsmission repair to 7 years or 100,000 miles, whichever occurs first. Well, my 7 years was in May – OMG called my dealership and I go no where, just sorry. So, I have a car that has been well taken care of – great body and interior with only 85,000 miles sitting in my garage. Guess I should start finding ways to use it as storage. Need help – have not seen any other class action suits listed….anybody listening?

  • Shean Klatt July 28, 2013, 5:45 pm

Has this ( class action ) Taken place or covered by VW if no add me to the list

  • Harry MacCord August 19, 2013, 10:14 am

Add me to this list. Brought a 2005 VW Turbo Beetle new … had problems with sun roof water leaks early on and got dealer run arounds until I got a lawyer. Now, after maintaining the car for 91k miles and not driving the car hard … need a new transmission … over $5600 at the dealer! I have had many new cars over the years and all have gone well over 100k miles without any significant problems. And now that I saw this suit got dropped recently … little choice but to shell out for repairs; which truly sucks. I am really disappointed in and unhappy with VW … not what they used to be at all. Glad I’m driving Fords now.

  • Mellisa Jiron August 21, 2013, 10:36 am

Same problem here – 2003 VW convertible with 69k miles on it, needs trans valve replaced to fix hard shifting… only one place around here (dealership) is even willing to touch it. It also has a shorted fuse panel, needs new alternator wire, check engine light indicates catalytic converter is failing, faulty air bag issue, and they also suggest if I’m planning to keep I should replace timing belt and water pump… $5500.00 all together which is about what the car is worth… very disappointed in VW. I bought this beetle 2 years ago from a Man who took very good care of it (have all records, garage kept, etc.) Now I own a very large paper weight. :-\

  • Rod Burnett September 9, 2013, 8:30 pm

Just purchase a 2005 vw convetable beetle with 68000 miles and tranny is acting like all the others posted. VW says that I missed the ext warranty by a year. They admit a problem and wont help me out.

  • James Snyder October 22, 2013, 9:51 pm

Tiptronic and DSG? I think some are mistaking the DSG (auto/manual) for automatic with torque converter (Tiptronic). My 2006 VW Jetta has a DSG transmission and I have spent $10,019 over the past year in repair and then replacement. NHTSA has agreement with VW for them to repair all 2007-09 DSG VWs for up to 100,000 miles.:
    Details Of Complaint
History: VW and NHTSA have agreement to repair up to 100K mi. ALL 2007-09 DSG transmissions due to NUMEROUS failures. VW refused to assist in repairing the DSG on my 2006. It was in for DGS problems on 5/19/2007(22314 mi)and 7/9/2009 (79031 mi). I had manufacturer and extended 100,000 mi extended warranty. Both times dealer could not find anything wrong. Problem on 7/9/2009 happened under high temperatures (indicative to mechatronics failures). NO WORK WAS PERFORMED! June of 2012 on trip to Arizona, extreme DSG failures: would not go into gear from stop then violent engagement; going through desert from Arizona border to Riverside under high temperatures the car would loose power to the wheels and coast and then resume for a distance of about 200 miles until temperature went down (again mechatronics symptom). I had the mechatronics and temperature sensor replaced on 10’2/2012 by independent VW service Eurocode but was informed about 10 days later that Pacific VW had sold them the INCORRECT mechatronics. Pacific VW agreed to install the correct mechatronics. Shortly afterward (October 2012) the “clutch packs” failed. The total cost is now $4755.25. Several emails and calls to VWofA and no offer for help. August and September of 2013: failure to engage drive(intermittent) and now a loud howling sound from DSG transmission. Returned car to Pacific VW (October 2013) and they said my “one year” warranty ONLY covered the clutches. They wanted $7200 dollars plus tax for a rebuilt DSG transmission (no discount). I then took the car to another dealer near my home and they completed the DSG exchange for $5263.87 including tax. TOTAL cost over a one year period is $10,019.12 I have pages of documentation regarding other VW owners with DSG transmissions having problems including a fatal accident in Australia blamed on the failure of the DSG transmission. I can fax you MANY pages of documentation concerning this. This is a URL/webpage from a VW owners group concerning “DSG”: http://forums.vwvortex.com/showthread.php?3968936-The-Unofficial-DSG-Issues-Thread 28 pages!!

We own a 2008 VW Passat 2.0 with 36,000 miles. Our automatic transmission began shifting and down shifting nearly 10,000 miles ago. The VW dealership says there is nothing that they can do about this since we reported it just out of warranty. Really? And there is no preventative service recommended. We too would like to be added to any future action.

Please include us. We have been complaining to the Dealer Boardwalk Auto Redwood City, CA since 2009. Could never find anything wrong. Check Engine Light on, Transmisson failing and has now failed. So many other problems too. Never found anything wrong with it until it fell out of warranty. To hard to write a proper complaint here. What is being done about this??

  • Rene Halterman February 4, 2014, 4:16 pm

Same problem with my 2005 Beetle. Since I am not the original owner, I did not receive notice of the extended warranty which expired in 2011. I only bought the car in 2010. $4600 to repair the car. $1600 for the valve body which tore up the tranny when it failed. $3500 to rebuild the tranny. Not to mention the car has sat for over a year while I am still making payments. VW was absolutely no help. Offered me a loyalty voucher of $500 to buy a new VW. As if! If there is a class action suit regarding this, please add me. As of now, I have a very big but cute lawn ornament!

  • Kim McAndrew March 14, 2014, 2:16 pm

2005 Beetle convertible 95,000 miles that began lurching forward while downshifting. Twice we were told there were no problems. Finally it started skipping gears. Needed to rebuild the transmission and recondition the valve body. $3,880 dollars later at least its drivable. In the last year alone we have replaced timing belt, water pump, radiator, brakes/calipers, battery, transmission, two front axles, window motor assembly, and now its coding for an 02 sensor or catalytic convertor………really?!!

I told vw corporate office about and they told me that they cannot do anything about it because the warranty has already expired. And I replied to them that if that is the case vw cars are just like food products once it expired it is garbage. Pls put me in this class action. Thanks.

  • Teresa L. Newby November 18, 2014, 7:42 pm

I would like to be added to a class action lawsuit as well. In 2012 my car was experiencing all the same issues stated above along with a few other issues just months prior which at that time was expensive enough, it was $2000.00. With the transmission issue (miles 68,000) and an electrical issue with the locks/alarm working off and on, I ended up with a bill of nearly $8000.00. Being unemployed at that time I didn’t have the freedom to get another car, my brother and sister helped me get the car fixed. Here it is 2 years later and I am having the issue again! This is a safety issue, these cars are unpredictable, I have lost track of how many times I have almost rear-ended the car in front of me. I do not have the money to fix this car again nor am I able to buy another car. All because what apprears to be VW’s lack of ethics and decision to put profits before safety.

    Thank you,

I don’t know what is going on, if there is anything going on with a Class Action Lawsuit. Does anyone have any updates? Since my last post in November my car has been sitting in the driveway. I did put another $1,200.00 into the car and it is slightly better but I don’t dare drive it. I am considering contacting 60 Minutes to help get resolution for all of us who have had to go down this road with VW.

If anyone has success on getting resolution around their car issue please share with the group and I only seen a few people post that they had any luck.
