Toyota Scion xB and tC Owners and Lessees File Class Action Lawsuit Against Toyota Over Allegedly Defective Rear Hatch Door Handle and Panel.
A class action lawsuit has reportedly been filed against Toyota Motor Sales, U.S.A., Inc. and Toyota Motor Corporation (“Toyota” or “Defendant”) in the United States District Court for the Central District of California (entitled Salvatore Amata and Daniel Walker v. Toyota Motor Sales, U.S.A., Inc. and Toyota Motor Corporation, Class Action Case No. CV 12-168-VAP SPx) alleging, among other things, that Toyota manufactured, distributed, sold, leased, services and warranted model year 2005 to 2011 Scion xB and tC automobiles that allegedly contain a design defect and/or flaw with the rear hatch door handle and panel (“door opening mechanism”) which breaks off during normal use, according to the Toyota Scion xB & tC Rear Hatch Door Handle defect class action lawsuit complaint.
The Toyota Scion xB & tC Rear Hatch Door Handle defect class action lawsuit is reportedly brought on behalf of the following proposed classes, unless otherwise excluded:
All current and former consumer owners and lessees of model year 2005-2011 Toyota Scion tC Vehicles purchased or leased in the United States of America. (“tC Class”)
All current and former consumer owners and lessees of model year 2005-2011 Toyota Scion xB Vehicles purchased or leased in the United States of America. (“xB Class”)
All persons who purchased or leased one of the Vehicles for primarily personal, family or household purposes, as defined by California Civil Code section 1791(a). (“California Sub-Class”)
All current and former consumer owners and lessees of model year 2005-2011 Toyota Scion tC and/or xB Vehicles purchased or leased in Maryland.
The Toyota Scion xB & tC Rear Hatch Door Handle defect class action lawsuit complaint reportedly asserts claims for alleged violation of California’s Legal Remedies Act, Civil Code section 1750, Song-Beverly Act, Civil Code section 1790, Maryland’s MCPA, and California Business and Professions Code 17200.

Gar: The lawsuit was recently filed in the U. S. District Court in downtown Los Angeles. As a member of the class, you should get something when the case is settled. To the extent I’m able, I will try to keep you updated. How do I become a part of this lawsuit? The rear hatch handle on my 2007 scion tc broke last month. It will cost $200 plus to fix this. I need information to join this lawsuit.
Would definitely like to know more about this. The latch on my 2005 XB broke about a year ago. I’m nursing it along to keep it from falling off completely.

I have a 2008 Scion TC, my trunk handle is broken as well, I’ve had to use duck tape to hold it in place, please let me know how I can become a part of this lawsuit so I can receive something in return!
2006 Scion TC – replaced mine in 09 $200 for the part…just found out from my mechanic that there appears to be a design flaw, at least in the 06 model where the door hatch knocks against the window channel in both the passenger & driver side doors…about 6 months ago just started noticing a knocking noise when opening and closing the doors…found out if window channel is damaged upon repair have to replace the entire door and could cost as much as $1500 to repair…had my vehicle for 80k miles before I had any problems with this…anyone else?
I have a 2007 Scion Tc and my hatch panel broke off a few months ago and I have been trying to keep it on but nothing seems to work, hate to pay $120 for a new one, how to I get in with this lawsuit? Does anyone know?

My 2008 Scion TC trunk handle has just broke off! I take care of my car, even taking it to the dealer for maintenance, BUT to have this incident happen to me and other loyal clientele is unacceptable on Toyota ‘s part.
Owner of a 2006 Scion xB. Currently in the process of replacing the back handle which broke. Big surprise. Not surprised to see this class action law suit. Is every owner entitled to compensation?

yes i have 2006 xb with the same problem what we can do ?
I just bought a pre-owned Scion XB. Within 10 days of normal use, the back door hatch handle broke off. There is a little white plastic part in the upper right hand corner that holds it on; it broke off. I couldn’t use the rear door at all until it was repaired. Iwould like to know more about this Class Action Suit.
