RadioShack Store Managers File Overtime Pay Class Action Lawsuit Complaint Against RadioShack Over Alleged Failure to Pay Overtime Compensation At Time & One Half.

A class action lawsuit has been filed against RadioShack Corporation (“RadioShack” or “Defendant”) in the United States District Court for the Middle District of Florida, Tampa Division (styled Roy Hancock and Mark Linsenmayer v. RadioShack Corporation, Class Action Case No. 8:11-cv-00011-RAL-AEP), alleging among other things that RadioShack has a policy of employing store managers who spend the majority of their time on retail sales and who do not have the power to hire or fire employees, who do not spend the majority of their time supervising other employees and who do not use their independent discretion in making key decisions on matters of significance for their store and allegedly fails to pay them overtime pay (i.e., wages at a rate of one and half times their regular rate of pay for hours worked above forty hours), purportedly in violation of the Fair Labor Standards Act (“FLSA”), according to the RadioShack store manager overtime pay class action lawsuit complaint.

    This practice has gone on for decades. I was a Radio Shack store manager in Seattle and Phoenix from 1977 to 1986.

    In addition to never paying overtime, the company (Tandy Corporation at that time) held back a large percentage of managers’ pay until the end of the fiscal year. This was referred to as an “annual bonus”.

    A terrible employer in many ways. Unreasonable sales quotas were issued every month, along with the implicit and explicit threat of being fired for missing said quotas.

      I recently left my position as a Radio Shack store manager partially for this very reason. Since my departure, I was offered an entry position with one of the company’s competitor that pays $10k more a year for nearly half the hours. After I went on vacation, I worked 20 days straight with hours reaching 60-65 hours a week. Which was mandatory!

      The company, with it’s “iron fist” ruling, is completely taking advantage of employees that doesn’t know any better. This really needs to stop. As I do more and more research, I am finding law suit after law suit explaining how they mistreat their employees. Such a shame, the company has so much potential which over it’s 90 years of being in the business, it still hasn’t been reached.

    Radioshack has boasted about having a $720 million cash reserve that comes from continually cheating their employees. In Chicago a lawsuit was filed against Radioshack (2011-CH-05309) because Radioshack through executive directives have forced managers to work off the clock to stay within their store budgets. Most managers regularly are forced to keep their working hours off the books to keep their stores within their weekly allowed hours for staff and manager. The over-time that is kept off the books are not being addressed in these other law-suits but the suit in Chicago will reveal what this despicable company has been allowed to do nationwide.

    The district Managers , Regional Managers and above . Always set
    quotas HIGH .

    I often exceeded those numbers and my reward was “DEMOTED ” for no
    specific reason 3 yes three times . Usually just in time to cut me out of large bonuses.

    I left after 17 Yrs. of chasing the carrot .

    I worked for radioshack as a manager for 3.5 years. I recently left after constant verbal abuse. My district went over 6 months without a district manager leading us and once we got one he threatened all of us saying that he had fired many managers at his previous job and had plans to do the same.They refused to give me vacation time when I requested it off and denied my vacation once I left the company. they do not work with you and build up your weaknesses, they just simply dog you down until you cant do it anymore and treat you as though you are constantly in the wrong. I had to drive 3 hours a day to my store because my DM refused to give me a closer store that might help me get rid of my black rings around my eyes from being sleep deprived. this company is a bad company to work for and will tear you down to the bone and leave you with nothing.

    I am a current radio shack manager and the pay is not fair. The over time they pay is bogus and hardly ever work over the 40 hours because they can keep their $3 extra an hour. Unfortunately/fortunately I am pregnant and am stuck here till who know when. My DM is very degrating and talks down to everyone. I am currently moving out of state and he is trying to tell me that a transfer is numbers based and it does not say that anywhere in the company policy!! If I am good enough to stay in my current store, why am I not good enough to willingly step down to a full time assocaite to another district and store??? This makes no sence to me at all. I am sick of this company and the lies they tell. This company lies not only to its employees but it’s customers as well. Sick and tired and don’t know what to do 🙁

    Im presently working at radioshack and having the same issues, you do, lets say 12000 of a 10000$ goal one year, and then they jump your quota up to 25,000 the next year, knowing its unnatainable. they pay us garbage, they just changed policies to say if you dont reach quota u dont get your commission at all. so your basically working for min wage in a high stress sales environment. they pay managers half the industry standard for the same job. and force us on unpaid conference calls every week just to give us more work, more requirements, and yell about not hitting goals.. needless to say im looking for new employment as we speak

    The company recently fired me and is refusing to pay me my bonus that i got for the previous month, because i was fired before they paid it out the next month, they are also refusing to pay my vacation time. This company should be shut down, they refuse to pay overtime, they just changed the policy so if you dont sell 100$ an hour u get NO commission, so your basically working for base pay, they cut payroll but extended the hours, when you do make bonus they increase your goal 200%, they ruin their employees lives with all these pay cuts and dont care. its pathetic. oh and BTW they have been holding unpaid mandatory conference calls for years, and guess what, i just found out thats illegal.

    After four years of dedicated service in management, across four locations, I was summarily dismissed while in position of Interim District Manager.

    The profitability of the district I was in was at an all time high, I had no prior warnings, corrective actions, write-ups of any kind. I was extremely loyal to the company and was proud of the integrity I brought to the position.

    The reason(s) for dismissal as reviewed on a conference call with H.R.? Multiple complaints had been brought to management that: I was feared, I had led others to believe that I had developed friendships with other members in the organization(H.R.) that insinuated retaliation if any complaint would be issued, I violated the code of ethics.

    There were no specific instances that H.R. could quote, just that “I seemed to want to portray that I could do a better job than my predecessor.”

    Uh? You think so? Of course I wanted to do a better job, and I did. : )
    Profitability was through the roof!

    (My predecessor was moved into an interim position as RSD at the same time I was interim DM and moved back to the DM position I was in after I was released from employment)

    I never threatened anyone, harassed, yelled or did anything other than work to make a positive environment to achieve positive results. I have my own thoughts and opinions on the remaining politics of my situation that do not matter in this communication.

    My advice to any reader… Stay AWAY from Radio Shack! A once great proprietor of electronics, now confused and flailing like an angry baby. There is no true career path for anyone to join this organization and the integrity of upper management is found to be wanting at best.

    This company has turned into a temporary machine that uses people up and spits them out.
    I am saddened with my belief that something good could have been great again but I suppose that is what you get when you bring in employees from a failed company to run another company.

      I’m sorry to hear that this has happened to you also. I also was used and abused 🙁 I ask myself how and why did I allow them (RS) to do , what they did to me. I was so so hurt nov 2 2012 when this happen to me. I almost felt dirty in a strange kinda way. The way LP spoke to me…. Omg! I have it all on recording, just have to find a lawyer that would take my case. Hang in there bud… God say ” when a window closes , a door opens” maybe we needed this so we can find a company that would really appreciate our hard work.

    I also along with all of you are in the same situation. Is there an attorney that is willing to hear us, represent us. I to was recently termed… I was gathering intel ie… Statements, had a recorder on me for two weeks. And omg there is some good stuff on that recorder on sexual harassment against DMC (district manager candidate)

    So I’ve been at freakin shack for 10yrs went from sales, to ASM, to SM back to Wireless Consultant well u name it. They used and abused me every which way they wanted to. And they came to me Nov, 2nd while my recording is on… LP accused me of taking gift cards that belonged to customers promo $25 back in early July. And used two of them for personal use. Well I tried to explain, that I had purchased GC for the promo time used mine on customers tickets and at the end of the day I would whine up with an extra one which I would keep and used at a later time. Sam the LP guy yelled at me!! Be littler me, made me feel like maybe I was a theft. Well I ended up getting termed.

    Then I ask the questions what is happening with the sexual harassment complain… It is still under investigation. I replied I want in writing what is going to be Alan Scott outcome. They insisted they need not to let me know what goes on with him. That’s its no longer my business. Comments like “with that gourgoues ass, you can sell anything” Hmmm?
