Consumers With Tire & Wheel Protection Agreements  From NWC File Class Action Lawsuit Complaint Against NWC Warranty, NWC Administration & Great American Insurance Over Insurance Coverage.

A class action lawsuit has been filed against NWC Warranty Corporation, NWC Administration Inc. (together “NWC”) and Great American Insurance Company (“Great American Insurance”) (collectively “Defendants”) in the United States District Court for the Eastern District of Pennsylvania (styled Joseph A. Deluca v. NWC Warranty Corporation, NWC Administration Inc. and Great American Insurance Company, Class Action Case No. 11-3768) alleging, among other things, that NWC provided insurance coverage on automobile tires and wheels through Tire & Wheel Protection Agreements and that NWC and Great American Insurance denied claims for tire or wheel damage that was covered under the consumer’s primary automobile insurance even where the Tire & Wheel Protection Agreement contained no express exclusion for such claims, according to the NWC Warranty, NWC Administration & Great American Insurance Tire & Wheel Protection Agreement class action lawsuit complaint.

The NWC Warranty, NWC Administration & Great American Insurance Tire & Wheel Protection Agreement class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of the following persons, unless otherwise excluded:

All persons residing in the United States, or in the alternative all persons residing in Pennsylvania, who (1) obtained a Tire & Wheel Protection Agreement from Defendant NWC Warranty Corporation and/or NWC Administration Inc. that does not contain an express exclusion for claims covered by another insurance policy; (2) submitted a claim for coverage under such Agreement to any or all of the NWC and Great American Defendants; and (3) had their claim denied or placed on hold and never subsequently paid on the grounds that the claimant must first exhaust any coverage provided by his or her primary automobile insurance.
