A class action lawsuit has reportedly been filed against Nissan North America, Inc. and Nissan Motor Company, Ltd. (“Nissan” or “Defendants”) in the United States District Court for the Central District of California (styled Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Class Action Case No. CV 12-00332) alleging, among other things, that Nissan manufactured, distributed and sold 2004 through 2006 Nissan Maxima, 2005 through 2006 Nissan Altima and 2004 through 2007 Nissan Quest vehicles equipped with automatic transmission that allegedly contained a defect that causes breakdown, transmission slips, delayed shifts, acceleration surging and/or mechanical failure, according to the Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit complaint.
The Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit is reportedly brought on behalf of the following proposed class pursuant to Federal Rules of Civil Procedure 23(a), (b)(3) and/or (b)(2):
All individuals in the United States who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicles equipped with an automatic transmission. (the “Class”)
All Class Members who are “consumers” within the meaning of California Civil Code s 1761(d) (the “CLRA Sub-Class”)
The Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit complaint reportedly asserts claims for alleged violation of California’s Consumer Legal Remedies Act, California Business and Professions Code s 17200, breach of implied warranty pursuant to the Song-Beverly Consumer Warranty Act, breach of express warranty and fraud by omission.

Me too. 2005 Nissan Maxima exhibiting same signs described above. transmission jerking randomly, after engine warms-up. Seems like it forgets what gear it supposed to be in, acting as if in Neutral, then jerks back into gear. This usually happens in 2nd gear; has happened both times when my children were in the car. The tires actually skidded last night it jerked back into gear so abruptly. Really unhappy to hear this problem is so rampant, a lawsuit has been filed, but hopeful of a resolution. I don’t see where anyone has posted anything on where to get current info on how lawsuit is progressing.

My 2005 is doing the same thing after it gets warmed up – jerking and acting as if in neutral then a hard shift back into gear. I have called Nissan Motors and filed a complaint and I am going to take my car into a Nissan service shop and have it diagnosed and then get back to them. The number is 1-800-NISSAN1 (1-800-647-7261).
Just replaced our transmission on 2005 Maxima for roughly $3300 at Edwards trsnamission plus 1 week rental car cost. Second Maxima in a a row that needed new transmission. Contacted Nissan. No interest in helping. Started experiencing problems just out of warranty. Jeff olbina 317-702-2939.
