Mercedes-Benz Owners and Lessees File Class Action Lawsuit Complaint Against Mercedes-Benz Over Allegedly Defective Balance Shift Gears In Mercedes Benz M272 Engines & Idle Gears In Mercedes Benz M273 Engines.

A class action lawsuit has been filed against Mercedes-Benz USA, LLC (“Mercedes-Benz” or “Defendant”) in the United States District Court for the District of New Jersey (styled Greg Suddreth and Paul Dunton v. Mercedes-Benz USA, LLC) alleging, among other things, that Mercedes-Benz M272 engines are equipped with defective gears in their balance shafts and Mercedes-Benz M273 engines are equipped with defective idle gears which wear out prematurely, excessively and without warning, purportedly causing the vehicles to malfunction, the check engine light to illuminate and the vehicle to misfire and/or stop driving, according to the Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint.

The Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint is reportedly brought on behalf of a putative class of all owners and lessees within the United States of Mercedes vehicles equipped with M272 engines (bearing serial numbers up to 2729..30 468993) or M273 engines (bearing serial numbers up to 2739..30 088611), unless otherwise excluded.  The Mercedes Benz class action lawsuit also is reportedly brought on behalf of Illinois and Massachusetts subclasses.

The Mercedes M272 engine is reportedly installed on the following Mercedes Benz vehicles:

    My SEL kept coming on and I took it in Monday May 7th of this year and they said it was the balance shaft and they would have to take the engine out Thank God it is still under warranty because they said the repair would be about $6,000.00, my vehicle is a 2005 R350.

    I drive a 2006 ML 350, great car, however, just found out about a whole circuit board that needs to be replaced apparently Mercedes has not been recalled this faulty circuit board. The circuit board burns out your tail lights, your dashboard keeps flashing to replace bulbs, left, right,left,front, back,etc.. The dealer wants $160 to replace this circuit board. and replace 4 sensors from the check engine light at a cost of 560, plus replace and remove the headlight warning light markers for and added 320…whats wrong with this picture.

    I have 2006 pre certified R350 which stopped moving all of a sudden even though engine was on . I had to tow to the MB service center. They are demanding $800.00 FOR THE DIAGNOSIS. The repair could cost $1000.00 or $8000.00. I regret for buying this vehicle. I was sad to learn that judge dismissed the case against MBUSA. If there is any fresh lawsuit against them, I am interested .

    I also own 2006 e350 and have the same problem. I took my car to the local Mercedes dealer and they told me I have a problem with the balance shaft. They gave me a quote of $5400.00 just in labor. Sign me up also. This is outrageous.

    The dealer suspects I may have a balance shaft problem with the 2006 E350 Mercedes Formatic. The service engine light is on even after replacing the solenoids. But the car has no issues and runs very smooth. When would one know it is balance shaft issue.

    I have the same p0016 and p0017 codes on my 2006 C230 with 75k. Car is shaky at idle and has minor acceleration issues. I just ordered the solenoids.
    Has replacing them fixed the issue for anyone? I need to pass smog and cannot with the light on (i reset but it comes right back on)

    I have a 2006 r350 with 101,000 miles and the car is at Mercedes service, and yes, I have been told the car needs the balance shaft replaced as well as the intake manifold. Thankfully, I purchased the extended service agreement which expires at 104,ooo. The total cost of the repair will be in the range of $6,500-7,500 dollars. The car was purchased with the intent of driving this Mercedes quality product for 200k miles or more! Well I guess they are no better than the rest and charge more for marginal quality. Just sad….

    I purchased a used 2002 ML 320. Recently all of the brake lights came on as my daughter was driving this vehicle on the highway. She said the car jerked and began to quickly reduce speed, a dangerous thing on an interstate highway. I restarted the car later that evening and it seemed fine. I headed for home and after driving for about 7 or 8 minutes all of the brake lights once again came on. I was forced to pull over. I turned the car off for a few minutes, started it up and proceeded home only to have all of the lights come on again after driving approx 7 or 8 minutes. I took the vehicle to the dealer and he said I need a new ESP Control Unit which would run me about $1, 700. With three in college I don’t have that kind of money so the car sits in my driveway. I went on line and low and behold it seems a lot of ESP Control Unit complaints were lodged (among many other complaints) about the 2001 and 2002 ML in particular. I think it is clearly a safety issue and the company should be forced to conduct a recall to replace the ESP Control Unit. It seems to be a software problem, more so than a mechanical one and accordingly should not happen. I contacted MB and they said the vehicle was too old. I said given this is a software issue age is not a factor. I asked them to replace the ESP Control unit at their expense and they refused. This is my third MB and it will be my last. Even if I find the part elsewhere, they still soak you because they must “code the part to the vehicle”. I am considering filing a class action lawsuit.     i own 2006 r350 the check engine light came on @40.000 miles, codes p0016,and p0017, i change 2 of the solenoids, but nothing change, even the computer was reset ,i’m afraid i have to fix the balanceshaft, wich i can’t afford it,so is a piece of crap .i don’t know what i can do.count me in for a lawsuit.i would not buy a mb again thats for sure.

    I had engine light on long before warenty expire. The dealer told me it is sensor problem. Mercedes E350 is a big headache for me. The company should recall this car.

    i have a06 c230 whit p0016,p0017,p0018,p0019,. and i change all the sensor’s, the balanceshaft and still having the same problem ,so i’ll never buy another bm bm suck…..!

    2006 E350 – same issue. My dealer in Manchester, NH – Holloway has agreed to fix it with $750 out of my pocket and the rest that will bear out of goodwill. They also gave me a loaner.

    MB would have to issue a recall if there are so many issues with it.

    Elaine – Alabama: I have a 2006 E 350 Mercedes-Benz with 97,000 miles. My check engine light illuminated. I took the car to an authorized Mercedes-Benz dealership for service. I was told the problem is the balance shaft gears are worn and need to be replaced to the tune of $5000. I have always maintained my car’s service through authorized Mercedes-Benz dealerships. I am 65 years old and the only driver of the car. It is obvious to me, after reading the information about this class action lawsuit, that my car’s problem could also be caused by the manufacture’s defective balance shaft gear. Please include me in the class action lawsuit.

      I just bought a 2007 E230 M/B, the check engine light came on and is diagnosed with balance shaft problem I am told the repair could run as high as $7000.00 include me in this class action lawsuit

    I too have the balance shaft problem on my 2006 C230. Check engine light came on, so I took it to the Mecerdes dealer here in Silver Spring Maryland. To my surprise, I was told I needed a new balance shaft to the tune of $6K! I’ve always had maintenance done on time and at the dealer. Add me to the class action suit!!

      I just bought a use mercedes benz E55 and also have the check engine light issue. everytime i take it back to the dealer with the same problem they told me that the car need to be driven for about 200 miles, the light would go away but it would return later. What do you suggest? i think you should add me to this class action suit just in case this problem exist in my car.

    I’m in Arkansas and bought 2008 E350 4 Matic from used dealership. Only had it a few months and have 50,300 miles on it and check engine light came on and then suddenly felt like someone read-ended me. Took it in to used dealership and was told it was the conductor plate that was faulty and cost is $1700. Of course warranty ended only 300 miles ago :(. After seeing these posts I’m pretty sure my car has the same problem as all others. Include me in the class action suit as well.

      Where was this information when you needed it?

      I bough a certified ’06 CLS500 in May ’09 and a certified ’06 E350 in May ’10. Both fall under this class action suit.

      It is interesting to note the comments made by the dealships service representatives. I also was told the repair would cost in excess of $5,000 (bad news firs). (Then the good news) so the shock will not be so bad, ” Your cost will be about $2,200 because MB will pick up the balance. I was informed that a “Shop Bullitin” had been received on this issue and this is why MB in their corporate generosity had so generiously agreed to pick up the major cost of this repair.

      My question now is when will it happen to my CLS and has the issue bin resolved with the parts in question?

      As noted my E350 had 36,000 miles at purchase. At repair it had 46,000. That is 5,000 average per year of ownership.

      MB of NJ said that my complaint would be passed on to an advisor and I should receive a call back within 24 hr. We shall see.

        I have a E350 2006 that i have been diagnosed with the same problem as of NOV 2 , 2012. The vehicle only has 132,000 mile and the dealer is asking for over $6000 to repair it. How can i get involved in the lawsuit?

        I bought my ’06 in ’08 thinking, “Its a Mercedes, it’ll last forever”. I only have 63K on my car and the dealerships is telling me I need a new engine @ $15k . No one shared this faulty info with me. My dealership is not taking the blame on it by not fixing the issue. Their ‘goodwill’ is only $2K, I have to come up with the $13k or scrap a car with only $63K miles on it.

    I recently bought a 2007 C230 M272 engine. It serial number is covered by the law suit. It has only 45k on it and has the P0016 & P0017 codes. How do I join the lawsuit/ and how do I approach MB dealers to help with the costly repairs.

    I’m in California and own a 2007 c-280 with 90k. One day driving I noticeed the CEL illuminate and then felt the car backfire and stall. Took car to MB dealership where purchased brand new and maintained. Was informed it was the fuel pump. After recieving vehicle and a couple of days later the same thing happened again CEL–Stall. Took it back to dealer and then was told it was the Balance Shaft and that repairs would cost around $7500 after paying for a fuel pump. Something like this should have never happened. What hurts is that they knew. Is there a way to join in on the class action suit? I just want my vechicle fixed….This is not right!!!

    I have a 2006 C280. I recently learned that I have the same problem, in addition to a faulty Camshaft sensor. My estimate…$5500! I, too, would like to be added to this class action lawsuit. I feel so cheated as I was told by the mechanic, this is a known problem. I’m totally disgusted by what I thought was a top-of-the-line brand. I pray it’s not too late to join this lawsuit.

    I just bought an 2006 E350 with 122,000 miles on it. The car is tip top except for the CEL being on. (check engine) Lucky for me my research prior to purchasing the vehicle paid off and this problem had been corrected earlier with the last owner, however the light still stays on. If you are going to buy any of the cars outlined in the suit above, please be sure you check the carfax to ensure this problem was repaired. If so, you should be fairly trouble free all the way past 200k miles with only minor repairs. My rule of thumb with buying a MB (always make sure to buy pre-owned with over 95k miles and check the carfax and do your homework on recalls and common problems with the model you are looking at)

      IT APPEARS THAT MY 2006 E-350 HAS THE CAMSHAFT PROBLEM THAT IS PLAGUING SO MANY OTHER E350 OWNERS.
      A CLASS ACTION LAWSUIT HAS BEEN FILED,WHAT ARE THE RESULTS IF ANY.MB SEEMS TO BE DODGING THE ISSUE. I HAVE A 2002 S430 THAT STILL RUNS GREAT AFTER 303,000 MILES.

    I JUST PURCHASED a mercedes benz e350 and took it to a mercedes dealer to have it looked at before the papers were signed. MB told me the cars engine was good to go and there is no reason i shouldnt buy this car…. a week and a half later i take it to get an oil change and am told the balance shaft needs to be replaced. 4800 dollars and there is nothing they can do to help with the cost of the repair…. what a nightmare. please tell me there is something i can do to get mercedes to cover part or all of the cost.???????????

    I have a 2008 C300, I drive my mother who is 88 back to New Jersey around 4 times a year, so I’m the only driver. Last week a day after I got back to Louisville my car just stop, motor still running but nothing moving. Had the car towed to be told it will be around 4,000 to $6,000 to replace the transmission . I’m still paying on this car. I have 80,000 on it. I got this car new, took 6 weeks because I wanted this car to be the right color in and out, a few days after New Year 2009 I picked up my brand new MB. I guess I should have been a little more concern about what was under the hood. But it’s a MB, one of the best cars made. Fooled me.

    I drive a Mercedes R350 and recently saw the check engine light. I took it to Mercedes and was told that I had a balance shaft gear issue. Total cost to fix was over 6K!!!!! I couldn’t believe it. My car is very well maintained and the first advice of the service guy was to take it to CARMAX and sell it! REALLY? I am almost done paying this car off and had no intentions of another CAR NOTE! Is this what Mercedes is doing to get us to purchase cars every five years? It seems completely ILLEGAL! Especially since so many others are having this issue! Why haven’t they RECALLED this? Just fix it! PLEASE, PLEASE add me to the class action suit!

    This is so frustrating. I have always wanted a Mercedes. Bought a E350 with 48k miles on it.(06). Extremely happy until at 62k the car literally stopped runing. Had it towed to a Mercedes specialist who has taken care of the car since i bought it. Informed me that it had to go into a Mercedes dealer because of the defective balance shaft.
    WOW, and to think I traded in a Nissan without any problems for this vechile. He told me I am looking at a 7k bill for this. Very glad now I took out the extended warrenty. Hope it covers this mess. Please please add me to you class action law suite.

    I have a 2006 Mercedes E-350 with 42000 miles and got a “check engine” light on a recent trip. Took it to a dealer and was told balance shaft need replacing at a cost of $8400 dollars. Drove back to Florida and replaced to sensors with no change. An engine tear down is required to fix the problem. This may be my last Mercedes (my 3rd)
    unless Mercedes can take care of the problem

    I have a 2006 E 350 Mercedes-Benz with 69,000 miles. My check engine light illuminated. I took the car to an authorized Mercedes-Benz dealership for service. I was told the problem is the balance shaft gears are worn and need to be replaced to the tune of $5900. I have maintained my car’s service through authorized Mercedes-Benz dealerships. I love my E350 but this is obscene. Recall this part and give the customers some justice! I contacted my local state attorney’s office to file query on this pending complaint. Good luck.

    I buyed used Mercedes E350 4matic 60,000 miles from US last year in June, arriwed to Nuuk, (Greenland) in august last year. no problem in eight month.
    Got Check engine light on about 87,000 miles, I took the vehicle an authorized Mercedes dealer here in Nuuk, And there told me the balance shaft gears are worn need to be replaced at a cost 40.000 DKK (7,000 USD)(including fuel pump) And the mechanic told me this fail is from the factory but the warranty can`t uses.
    I got the vehicle back from the dealer one month and one week after, BUT! The “Check engine” light Still on, there told me there should not be problem if I use the vehicle 3-4 days before there can check what the problem is, because there have no time. another problem is I used 20 liters engine oil in 4 days, there checked why “Check engine” light still on, there found out that there have replaced the chain wrong, and there must order the new chain from Denmark, after one day stopped the engine, now problem is fuel pump,There replaced the chain and the fuel pump, BUT! (there is chain reaction) still “Check Engine” light on, So`there order the new chain again, and the new variable cam adjuster magnet, because there believe it is wrong with it, there replace theese , BUT! STILL “Check engine”light on. And there told me again that there will be no problem if I use the vehicle, and there will order another the new variable cam adjuster magnet, and before there replaced it, I used the vehicle about 14 days, and one day when I drived the engine started shacking very hard , I checked the coolant, there is engine oil on the coolant.
    more than three month I still Waiting for my Taxi .
    there told me yesterday the vehicle will be on monday or tuesday.
    what there will be next time? Little bit Paranoia, Ha,ha

    I have a 2006 C230 with 110K on it always maintained but the balance shaft was worn.as well it cost me 6K to fix it at the high end Indy shop I deal with. I contacted the attorney and added my name to the class action lawsuit but I dont think its going anywhere Mercedes is fighting it I believe. I have all the old parts and pictures and I’m contimplating suinng them as an individual to at least get some of my money back. I myself will never buy another Mercedes. I have had a Audi, BMW and they both maintained better.

    Going to an important meeting the car suddenly would not shift gears and almost caused me to be rear ended! I took it to a shop two times to try and fix this problem. Just got it back and haven’t tested it because I drive 52 miles to and from work and cannot have an unreliable car!!

    PLEASE anyone filing a lawsuit…please contact me c-lsaenz@juno.com I was driving my 2001 slk 230 on the highway when it felt as if i was rear ended and I realized my back tires locked up as I tried to regain control of my car. This scared me so much I am terrified to drive. My car only has just over 55k miles (I have taken extremely good care of her) . . . I read that these vehicles have a rare malfunction in the yaw system or the hand break sensor causing vehicle to lock up. . . After near death and nearly missing two cars and a wall I had my car towed to mechanic that only changed the light bulb 23.00 in the car…. I know this is not the repair needed…the more research i do, the more I find out its more of a 1700 to 21oo repair if taken to mercedes and I called mercedes to tell them of their faulty product endangering my life and they said bring in they will check for 220.00….that will be just to check it. . . I am terrified to drive it, I have been in three major accidents (rear ended from people on cell phones and have had brain surgery, total disc replacement in my neck-almost broke and spinal cord surgery that left me with some paralysis…. I can’t afford to be in another accident …yet again not of my own fault…PLEASE ANYONE PLEASE help…anyone know a lawyer involved in this??

    I just bought a 2008 MB R 350 at the Columbus Ga, dealer three month ago. TODAY I was surprised with a 7,164 dollar bill to replaced the intake manifold, and another 1,867 dollars to replce the air bag in the rear air suspension. Is there any hope that MB will take any serious responsibility. This vehicle have an abundance of problems that are common and it looks like a manufacture defects.     I have a 06 E350 with the same balance shaft problem. Took it my dealer and they told me that MB has a service campaign out on this issue and that they will pick up the cost of repairs. Maybe the issue is resolved.

    All these poor people thinking they’re going to get relief from a class auction lawsuit! Let me tell what’s going to happen; the lawyers will get a minimum of 2/3 of the total award. The people actually suffering the financial damage will get to split the remaining 1/3 of the award.

    They’ll be lucky to get a $2000 coupon for use on their next MB purchase.

    I also have a similar problem , check engine light is on took it MB and I was told I need a catalytic converter and new 02sensores after having this replaced I have the same noise coming from the motor or under the car and check engine light still on after 300 miles on my c230 kompressor I will like to be included in the class action suite , please contact me

    I bought a 2006 e 350 4 magic for 52k. I drove it 107k w/ the engine light on. The motor died. I sold it for parts for 7k. Now my 450 gl 2007 needs repair, the balance shaft. Add me to the class action lawsuit!!

    i have a 2006 e350 with 98k and check engine light came on, took it in and told that intake manifold runner control was stuck and would cost $ 1700 to fix. please add me to this class action lawsuit as they say its a matter of time before the balance shaft gives out as well as the tranny control unit which i believe is placed inside the transmission and is submerged in oil.

      Hello! so glad I found this site. i have a 2006 e350 with 100k and check engine light came on, took it in and told that intake manifold is the problem and need replace, cost $ 1800 to fix. please add me to this class action lawsuit as dealer told me that my car will come to stop running if it breaks completely.

    I purchased a Certified 2006 Mercedes Benz C280 4-Matic from International Autos of Elmbrook in Brookfield WI in 2009 with 43,000 miles on it. I also purchased a 3 year extended warranty to cover the car up to 100,000 miles or until 12/22/2012 whichever came first. I have had the car serviced at the dealership since I purchased the car. The car had 109,000 miles when the check engine light came on with code 1200 & 1209 indicating balance shaft and/or timing chain guide wheel worn. Of course the warranty had expired on mileage about 2 months earlier. The dealer said the cost would be $5700 and Mercedes Benz USA would “goodwill the defective parts” approximately $700 but would not cover any of the labor costs. For the supposed quality of Mercedes Benz I felt this was outrageous! I did have the repairs completed. It took about a month, September 5th to October 4th, 2012. Mercedes Benz recent advertising campaign “The Best or Nothing” apparently the answer should be Next to Nothing! Shame on you Mercedes Benz – what happened to your quality and customer commitment. I am a three time Mercedes Benz owner and after this, I will not own another Mercedes Benz. Please include me in your class action law suit.

    I have a C280 4Automatic 2006 Model with 40K miles The car has had issues since 15-20K miles and will suddenly stop or accelerator get stuck erratically while driving and I have had near misses. Check engine light comes on and goes off. Car is extremely unreliable and I can’t believe MBenz is not fixing the problem. Please let me know how I can be added to the law suit.

    I bought a used Mercedes ML350 60,000 miles from US in 2009..
    My check engine light went on @ 99,000, I took the vehicle to an authorized Mercedes Mechanic in Irvine, they told me that it could be 2 things, 1 my oil is low or 2 my balance shaft gears are worn and need to be replaced. I am still driving it waiting for some sign that it is my gears….worried because my warranty just ran out.
    This it is frustating.

    I purchased a 2006 e350 and have been having problems with the engine light and the camshaft/crankshaft sensors. I have just been told by Merceded Benz of annapolis that they need to be replaced. Huge bill as wll. i am very dissapointed in mercedes benz. I would like to be included on this law sut.

    Dushaun in San Diego- I have a 2007 CLS 550 with 94k miles and I’m having issues with my gears shifting and my check engingine light is coming on. The transmission get stuck in the upper gears and won’t drop. I have to turn off the car for them to reset. Please add me to the lawsuit. I always knew it was too soon for this to be happening on such a luxorious car

    My mom bought an 06 r350 brand new and now she only has 130,000 miles on it we had it checked out by an import service shop and they told us the balance shaft has to be replaced it has a stong vibration and at times the car runs and then die on the first start up can someone email me on how to join the lawsuit because my dealer says they will not even help with the repair cost.

    I have a 2006 ML350, it has same problem. It is canadian car, always serviced in MB dealership. I am so disappointed with the fact that they knew about it from the beginning and did not recall.. Obviously, it is a major defect in multiple models, and they knew about it from 2007, and newer models (after 2007) kept having same issue!!! isn’t this weired?!!!
    I am not too sure whether I can be added to the class lawsuit or not, but defenitly, I am in if possible

    I have a 2006 E350 check engine light has been coming on and off for about a year in a half. Stays off for months at a time, figured it could be fuel related until recently it came on and stayed on blinking occasionally. Now it has a shake to it when idling. Took it to dealer told me it was the cam solenoid sensor of course didn’t fix the issue now telling 5800 to replace cam shaft balance. Include me in this suit please. alsienew@gmail.com

    It appears that every mercedes that has been made in the USA since chrysler became involved is just like any other american made car except Lincoln and Gm. They will cause major problems around 5 yrs for you to purchase another. European vehicles should last 10-15 yrs with no major problems if serviced regulary. Mercedes should do the right thing and fix these problems.

    I too have a faulty Balance shaft gear. I recently took my vehicle in because the check engine light came on and the vehicle stalled and would not start. When I took the car in I asked that they check the balance shaft gear as I was aware of the issues surrounding this major part. According to the dealer balance shaft gear sensor went out so they replaced it. Of course the sensor when out for some reason, however, they did not divulge anything further. They charged me a minimal amount and sent me on my way. I am sure I will have to return for the major work soon. I would like to join in the class action. Please email me gynies1@aol.com

    I have a 2007 Mercedes CLS 550 with 75,000 miles. Just received a p0016 and p0017 check engine light code. I’m now being told this will cost $6,000 to $7,000 to repair. It’s a $90,000 car and only has 75,000 miles. Very disappointed in Mercedes…

    I too have check engine light illuminated on a 2007 R350, with 60,000 miles. Replaced air filters, plugs, and all cam magnets as recommended at a out of pocket cost of $700. Check engine light re-illuminated, now the diagnostic is: a faulty Balance shaft gear
    Please advise if anyone contacts you regarding joining class action suit. I’m receiving estimates of 12K-4K out of pocket for repairs/replace defaulty parts (timing chain & gear, sprockets, seals, guide rails, and adjusters & labor).

    I have a 2007 CLK with 100K miles. The service engine light has been on for the last 10K + miles and my independent mechanic diagnosed it as a balance shaft problem “like the one in the class action suit against Mercedes”. As a result I can not pass my emmission test and can’t renew my license registration in the county I live in. I am the only owner and have immaculate service records. The repair was quoted as $5,000-$7,000. The MB dealership I bought it from said they’d try and help and of course came back with there is nothing they can do. How do I join the class action suit and where does the suit stand now?

    Purchased my 2006 R350 2 months ago first problem was air shocks $1800.00 this morning driving to work check engine light came on. I have a call in to dealer, based on what I’m reading I dread the answer. I also want to investigate the class action. Benz are not what they use to be. 🙁

      I to purchased a 2006 R350 on 12/12/12 and check engine light came on. I went to dealer for diagnostic and dealer said it was a balance shaft problem and that it will cost about $5000 to get it fixed. When I purchased the vehicle it only had around 68,000 miles on it so it was out of the warranty. I called the MB manufacture contact number but they said nothing can be done. I also want to investigate the class action and hope that this matter is taken care of. Not sure why they would not do a Recall on this if there are too many problems coming in with this issue.

After relentless effort to convince MB HQ in NJ that the issue with MB R350 balance shaft is a probably a manufactured defect they agreed to provide a 1400 dollars goodwill repair covering the parts and I will have to paid 2919 dollars for labor. MB is not going to take care of the balance shaft issue with vehicles that are outside the 4 yrs.’ and 50k mile warranty. The courts took side with MB and we customers have to paid repairs, even if the percentage of problems reported, keep increasing. Their argument is based on the percentage of vehicles not manifesting these issues. HOWEVER, they are not willing to report the figures and to compare.

    I too have the balance shaft problem on my 2006 E350. Check engine light came on, so I took it to the Mecerdes dealer here in Bloomington, Minnesota. To my surprise, I was told I needed a new balance shaft to the tune of $6K! I’ve always had maintenance done on time. Add me to the class action suit!!

    I own a S550 and I swear it may be the worse car I’ve ever owned. Light after light comes on and repair after repair. I think the dealership knows how faulty the brand is and follows suit by taking advantage of customers. Its ridiculous because someone is gonna get really fed up with the foolishness.

    I purchased my 2006 R350 in 2008 with 28,000 miles and then I needed a new catalytic converter replaced. In 2010, my car start having leaning problems it took them 3 times to replace air bags and get it right. Then in 2011, the engine problems started. I then took it to the Merecedes dealer after I googled the check engine light problem. I always kept up on servicing my car and any repairs. I was told the cam balance shafts which they replaced, I thought it was fixed drove home and the check engine light reappeared. Returned back for a second time and was told it was fixed drove my daughter to visit her college and then it came on again. Returned back for the third time this time I was told it was manifold intake and my car began to shut off. Car was towed and remained in the shop for 3 weeks. The manifold intake was just replaced this week on another goodwill repair however, I drove home and the next day the light reappeared again. I was told that it might be the catalytic converter if the light came on again. How?? It was replaced in 2008 and that doesn’t cause a misfiring. So it was towed to the shop for the 4th time with continued engine misfiring and I’m waiting to see what the dealership is going to do this time. I am beyond tired and frustrated and needless to say after another $2600 bill, my car was leaning to the left and this time too with bad airbags, air compressor and spark plug. Please add me or tell me how can I be a part of this class action settlement suit. Please contact me.

    My Case is described in the following and looking for a legal action:

    A new Mercedes Benz C300 purchased in December of 2007 has never stopped generating problems from day one: oil leakage (several months), annoying noises (four years), engine malfunction (recent), etc. Complaints with requests of compensations were filed to Mercedes Benz USA and did not any positive response. The only recommendation is to continuously send the car back to dealership for repair at the cost of the owner. The mileage of the car is 31K miles at the present.
