Duracell Ultra Advanced & Duracell Ultra Power Battery Life Class Action Lawsuit

Duracell Ultra Advanced & Duracell Ultra Power Battery purchasers file class action lawsuit against Duracell & Procter & Gamble over alleged promises of longer battery life.

A class action lawsuit has reportedly been filed against Duracell, Inc. and The Procter & Gamble Company (“Duracell” or “Procter & Gamble” or “Defendants”) in the United States District Court for the Northern District of California (styled James Collins v. Duracell, Inc. and The Procter & Gamble Company, Class Action Case. No 1:12-cv-1778) alleging, among other things, that Duracell falsely promised that Duracell Ultra Advanced and Duracell Ultra Power premium batteries would last longer than Duracell’s competing, lower cost batteries, according to the Duracell Ultra Advanced & Duracell Ultra Power Battery Life class action lawsuit complaint.

Plaintiffs bring the Duracell Ultra Advanced & Duracell Ultra Power Battery Life class action lawsuit on behalf of themselves and a class of persons defined as follows:

All persons who purchased Duracell Ultra Advanced or Ultra Power batteries in the State of California during the period beginning four years prior to the date of filing the complaint through the present.

The Duracell Ultra Advanced & Duracell Ultra Power Battery Life class action lawsuit complaint reportedly asserts claims for, among other things, alleged violations of the California Consumer Legal Remedies Act and Unfair Competition Law.

The Duracell Ultra Advanced & Duracell Ultra Power Battery Life class action lawsuit complaint reportedly seeks, among other things, declaratory and injunctive relief, restitution or disgorgement, pre-judgment interest, post-judgment interest and attorneys’ fees and costs.

Update:  A class action settlement has reportedly been reached in the Duracell Ultra Batteries class action lawsuit.

    We the people tend to have faith in what a company has stated about their product,however things like batteries in a gadget is something that is not easily judged for life expectancy, I have experienced cheap batteries and they last just as long as Duracell the most expensive; I feel it is a distrusting thing to collect(extra) money for nothing.

    Duracell Batteries with an expiration date of 2023 have ruined 2 book lights and a flashlight )that we’ve discovered so far. These batteries leaked battery acid all over the inside. We have attempted to clean the items, but to no avail. So far I have found two receipts, though I know there are others. I can claim two packages, one AA and one AAA, but that doesn’t buy new lights! I have the ruined batteries, but that doesn’t seem to matter. I am so disappointed in Duracell and in the settlement )or lack of one!”
