A class action lawsuit has been filed against Costco Wholesale Corporation (“Costco” or “Defendant”) in the United States District Court for the Central District of California (captioned Karen Thomas v. Costco Wholesale Corporation, Class Action Case No. CV 12-02908) alleging, among other things, that Costco sold Kirkland Signature Kettle Brand Potato Chips labeled “0 grams Trans Fat” that contained more than 13 grams of fat per 50 grams, according to the Costco Kettle Potato Chip “0 Grams Trans Fat” class action lawsuit complaint.

The Costco Kettle Potato Chip “0 Grams Trans Fat” class action lawsuit complaint is reportedly brought as a class action on behalf of the following proposed class (“Class”):

All persons in California who, within the last four years, purchased Costco Kettle potato chips labeled “0 grams Trans Fat” but which contained more than 13 grams of fat per 50 grams (the “class”).

The Costco Kettle Potato Chip “0 Grams Trans Fat” class action lawsuit complaint reportedly asserts claims for alleged unlawful, unfair and fraudulent business act and practices under California Business and Professions Code 17200, alleged untrue and misleading and deceptive advertising under 17500, alleged violations of California Legal Remedies Act, unjust enrichment or quasi-contract, alleged violations of Beverly-Song Act, and alleged violations of Magnuson-Moss Act.

The Costco Kettle Potato Chip “0 Grams Trans Fat” class action lawsuit complaint reportedly seeks, among other things, damages, injunctive relief, restitution, disgorgement and pre-judgment and post-judgment interest, punitive damages and attorneys’ fees and costs.
