2002 through 2006 Mini Cooper Coupe Purchasers & Lessees And 2005 Though 2008  Mini Cooper Convertible Purchasers & Lessees File Class Action Lawsuit Complaint Against BMW Over Allegedly Defective Continuously Variable Automatic Transmissions.

A class action lawsuit has been filed against BMW of North America, LLC (“BMW” or “Defendant”) in the United States District Court for the Central District of California (styled Brad Aarons v. BMW of North America, LLC, Class Action Case No. CV 11-07667) alleging, among other things, that BMW failed to disclose that Continuously Variable Automatic Transmissions installed in 2002 through 2006 Mini Cooper Coupe models and 2005 through 2008 Mini Cooper Convertible models were allegedly prone to premature failure and could not reasonably be repaired, according to the BMW Mini Cooper Coupe & Mini Cooper Convertible Continuously Variable Automatic Transmission class action lawsuit complaint.

The BMW Mini Cooper Coupe & Mini Cooper Convertible Continuously Variable Automatic Transmission class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of the following persons, unless otherwise excluded:

All residents of California who, at any time before the filing of the Complaint, purchased or leased, a 2002 through 2006 Mini Cooper Coupe or 2005 through 2008 Mini Cooper Convertible in California.

The BMW Mini Cooper Coupe & Mini Cooper Convertible Continuously Variable Automatic Transmission class action lawsuit complaint reportedly asserts claims for alleged violations of the consumer legal remedies act, unfair business practices act and fraud.

    I purchased a 2003 mini cooper(?coupe) about 1 mth ago from a private dealer. The power steering immediately went out, then 2 days later the transmission went out. This has put me back approx $9000.00.I live in Nevada. Does this mean I can not a part of this class action?

    Thank you Brad A for suing BMW and taking this on. We bought a used 2002 Mini for our daughter attending college, I’m sure the dealer new of this problem when we bought the car, we had a mechanic check it out before we bought it and they gave the aok so we purchased it. she drove it for a short time and noticed slipping and growling so we took it back to the mechanic and then find out that “Yes, these minis have chronic problems with their transmissions”… That tidbit of information at the time of purchase would have changed our purchase decision! Now we have an estimes to repair the CVT Transmission for $5,500 and the car is only worth $7,500 and we still owe on the loan we took to purchase. WHAT DO WE NEED TO DO TO BE INCLUDED IN THIS SUIT.

      My story is exactly like Tony K above : I have a automatic 2004 Mini cooper with the faulty CVT transmission… Ahhh, love this car but seriously $ 6500-$8000 for another CVT tranny that could go out again ??? For a car that is worth $6000 and yes, I too still owe on it. Where do we line up and who do we contact for this suit ??

    We have a mini cooper coupe 2003 with only 30,000 miles on it in mint condition where the belt for cvt transmission disintegrated without any warning leaving me strainded in the middle of a busy highway. Transmission shop inquired about parts from BMW and was told they do not sell parts for that transmission and if you want it fixed you have to purchase a new transmission in a box for $6,000.00. This is not an option if the transmission is only going to last 30,000 miles.

    I also would like to know how to put my name on the list. I have a 2006 MINI S convertible. In April 2011, the dealership service center in Monrovia, CA, told me I needed a new transmission and it would cost 6,000 -7,000. I was shocked and asked if it was a known problem. He said no, that it was very unusual. My MINI is now a beautiful parked car, and will remain so. I can no longer drive it… I can’t sell it without taking a huge loss. I can’t trade it in. I can’t take a loan to fix it, because I am a freelance artist and I don’t think I will qualify. I am just very thankful that my BF and I are sharing his Jeep. It really makes me upset that they knew it was a problem.

    I did find a shop that will re-build the engine for $4,500, but it will only be guaranteed for 18,000 miles.

    If anyone is interested in giving me an offer on my car, let me know. I will provide details. (2006 Convertible S, 100,000 miles, clean record.)

    I have the same situation. 2006 Mini Cooper S with complete CVT transmission failure at around 80,000 miles. My car has been at the Mini dealership for weeks and still no repair. I am in North Carolina and am requesting advice on how to be involved in any class action lawsuit.

    Living in Missouri:
    Have 04 Mini Cooper, 40k, first owner, properly maintained.
    Told several times by a local BMW dealer that car is just fine, paid to have another transmission fluid replaced, updated software (?) having
    to do with sensors, spent too much an cannot afford a new transmission.

    If any chance of class-action in the Midwest, please let us know.

    Have 2004 Mini Cooper coupe with avt transmission problems,
    it has 40K on it, was well maintained until 2007 when we took the car to the dealership where it was purchased. They said they do not know of any problem, car is just fune… meanwhile, the car was towed about 5 times
    due to overheating, as on independent mechanic told us. He suggested we take it back to the dealership to have upgrade of software, MINI/BMW called about improperly covered sensors, but we also had lit this sensor regardless of tire pressure. Under this explanation, we agreed to have the dealership to check the sensors and update software, but although we were cyarged over 300, our son could barely drive the car home, they were not apparently do any software update, now they finally decided the cvt transission is the problem, surprised we did not add any mileage to it! Now we are stuck with a faulty avt transmission that they priced for over 8,000, sensors that are to check the tire pressure are still
    without repair, not to mention that we now could not use CD/radio,
    but the worst issue is this cvt transmission. The dealerhip was quick to point out that we no longer are covered by warranty (although the car was when we brought the car there in 07 and nothing was wrong !)

    We cannot join the CA lawsuit, cannot pay 8,000 for CVT when the car is not even worth this much, would anyone advise what to do in this situation? Does anyone know of. reputable MINI mechanic and whdre we could purchase tranzmission for $2,800, as was noted by one owner?
    We would join any class–action, it may be worthwhile to extend the class-action to other stTes,……. we all need to write about these problems to BMW corporate offices in the US and in Germany. How to locate their address nd the name of whoever makes decisions there?
    Please advise.

      I also live in Missouri and drive a 2003 Mini Cooper. I am second owner and paid over $8500 for a replacement transmission. I now have more money into the car than it is worth. If a class action lawsuit is started in Missouri please contact me. I will join in.

    our 2003 mini cooper left my daughter stuck on the highway with 2 dogs for 90 min waiting for AAA…reason: automatic transmission! Mini wanted 10,500 to replace (said it wasn’t repairable)..car has 77,000 and otherwise in great shape…called Mini, they offered 25% off repairs..still too much. The lawsuit in Calif. is for anyone regardless of what state. (I already checked). BTW, took the car to AAMCO…was quoted 5,000…still too much. Mini would only authorize the 25% off at a Mini location….screwed yet again! Hope this info helps anyone!!

    I understand that California has managed a class-action lawsuit but what about the rest of us? My tranny went out and ended up putting me in financial ruin and my credit is still suffering. I purchased the vehicle (and was a resident) in NEVADA. Help?

    Im also from Nevada with a 2003 mini cooper and had to replace my transmission (previous comment). One of the other comments stated the class-action was regardless of what state you reside. Is this true? Does anyone have any further info for mini owners out of the state of California and how do we participate?

    I am also an owner of a broken down 2005 MCS whose transmission went out at 100,000 miles and now in need of some help. All Mini would do is tell me that I needed an $8,000 transmission. When the car is not worth that. I am in NC and very interested in joining a class action lawsuit. Any advice?

    I have a 2006 Mini convertible with 41000 miles and the transmision is slipping and BMW won’t do anything about it because it is 2006. I want on the suit also.

    I have a 04 mini cooper with 118000 miles on it. The transmission of this car is terrible. Firstly the auto transmission won’t go above level 4 automatically unless you switch it to manual. And now, the transmission is broken totally. When I start it. the rpm will go 3000 and no power at all. That’s really dangerous if it happens on the freeway. I would like to be a part of the lawsuit. I am an international student in Los Angeles.

    This morning, after spending nearly $700 for repairing my 2006 MINI at a dealership two weeks ago, I took it for a second opinion because the transmission had got worse, not better. The shop owner drove it and announced that at 58000 miles, the transmission is surely failing. He got online at Motoring File, and showed me an article on the Baron and Budd class action and told me, for safety, I need to decide soon what to do. I’m nearly 80 and probably wouldn’t outlive a class action suit, (and if I repair it, I could outlive my retirement money.) I wish the rest of you a happier outcome in the suit. That 4 year warranty though, means MINI ‘s chances of weaseling out look disconcertingly good! I hope you get to court on this sad business practice by what should be a trusted company.
