Homeowners File Loan Modification Class Action Lawsuit Complaint Against Aurora Loan Services Over Aurora’s “Workout Agreements.

A class action lawsuit has been filed against Aurora Loan Services LLC (“Aurora Loan Services” or “Aurora” or “Defendant”) in the United States District Court for the Northern District of California (styled Mauder and Alice Chao and Deogeneso and Glorina Palugod v. Aurora Loan Services, LLC), alleging, among other things, that Aurora Loan Services induced homeowners into deceptive “workout agreements” that gave them false hope of avoiding or curing a loan default on their mortgages, according to class action lawsuit news reports.

The Aurora Loan Services loan modification and loan default cure class action lawsuit complaint is reportedly brought on behalf of the following class of persons, unless otherwise excluded:

All California homeowners who have entered into a Workout Agreement with Defendant, made payments under the Workout Agreement, and whose homes were foreclosed without such homeowners first receiving (1) notice that their modification requests had been denied and (2) the opportunity to cure their default.

    Bank of American Deceived and Lied

    B of A used deception and flat out lies to take my home. They are predators and they need to be stopped.

    I received notice of my “approved” loan modification in August of 2009. I gave them $2800 down payment requested and have made all payments ( 10 in all ) for the modified amount. After six months I mysteriously received a monthly statement from B of A for the amount due on my mortgage. I had never received a statement like this before. The statement show a past due amount and the payment was for the old loan amount. I immediately called them to explain that their records were incorrect as I have completed the loan modification process. I have the notarized copy of the loan docs to prove it.

    The customer service person on the phone pretended to be puzzled by the apparent mixed up and told me that they would contact the negotiator for my account and have them contact me. Needless to say, no one ever called back. This scenario repeated itself four more times over the next four months.

    Then, out the blue, I get a letter stating that they intend to foreclose on me. The letter, which is titled “Notice of intent to accelerate”, states that I owe them over $36,000.00 in past due balance. Obviously, there is no way that I can pay that so my house is as good as gone.

    I paid them the amount that I promised to, on time, every month for 11 months now but that doesn’t matter. They are dead set on taking my home. This whole modification process is nothing but a scam. They are taking my money and making false statements about the status my account.

    I am worse off than before as now I owe more than ever. I am now officially underwater so selling the house which was a possibility before is no longer an option.

    If anyone has any influence over B of A and their executives please put a stop to this so no one else is deceived and loses their home unnecessarily.

      I am exactly in the same process and finally given up on the loan mod program. I am thinking about hiring a attorney. You know how hard it’s for a
      comman man to go thru this legal process. I am asking my loan co. which
      is PHHMortgage, 2001 Bishop Gate Blvd,Mt. Laurel, NJ 08054. to give me a final settlement to go out of the loan mod program. I was $150 short everymonth per the loan mod payments they have set for me. After a year i am short $1800. But they’re asking for $8000 to bring the acct upto current status, this is outrageous. Instead of helping me they’re trying to milk dollars out of me.
      Anyone reading this and in similar position working with a attorney please forward the attorney info to me. Thanks.

        Hey Gill,

        I actually did speak to a paralegal who said that the loan mod. was a binding contract and that BofA is responsible for adhering to the terms.

        We spoke to BofA and the call was referred to someone in the “Customer Relationship Advocacy Group” who seemed genuinely concerned. ( I know that doesn’t mean anything but she seems to be cooperative at least in terms of escalating the issue up the food chain. ) Anyway, since I the “notice to accelerate” was about to expire I was very worried that BofA would foreclose before realizing how screwed up they are. I fully expected to be foreclosed on by a computer and not by a person. So I paid then what they said I owed them, including over $3,000 in fees. They are still sitting on the last 2 of the 12 payments that I made on the loan mod. and haven’t applied them to my loan. It’s been nearly 60 days now.

        I expect them return my money and modify the loan. We’ll see what happens. I should know if a few more days.

        I think I have case to sue for breach but I am waiting to see what they do before I retain legal counsel.

        Hi Gill,
        We did go the attorney route, here is a summary of what we learned. When selecting an attorney-get one in your state that has proven credentials in real estate law specifically foreclosure law. Lots of those who specialize in real estate will tell you they are experts but not in all areas of expertise homeowners in this situation need so beware. Also be vary wary about paying upfront. We spent at least 6 months trying to get our $4,500 back, (even with a money back guarantee)

      I’m so sorry to hear this. Thank you for warning us all not to accept BofA temporary modifications. Have you looked into BofA class action suits for false-hope temporary modification mal-paperwork? Apologies for not knowing the exact leagal name for this but I am in the process of shopping for a class-action. I will post what I learn as I go in the hope this could help you.

      Having issues with Aurora…they said we are denied for a modification after waiting to hear for 10 months. They told us the owner/investor denied us and they were just the servicer, but wouldn’t release the name of the owner/investor. They had their attorney send us a letter of foreclosure within days of the denial…funny how fast that part happens. Finally got them to cough up the name of the investor/owner after sending
      Aurora and their attorney a letter of dispute. Contacted the name they sent us and lo and behold…they have never heard of us. We are hiring an attorney and hope to have a deceptive practices lawsuit in force soon. Delayed the foreclosure by 5 months which is allowable on principle residence in the state of MN.

        Dealing with Aurora Loan Services. Make me fill sick. When i refiance my home. I had a good interst rate. 4 yrs ago. My rate was 5.25. When i applied for a new loan. They would give me a lower rate. They told me the only way i could get this loan .I would have to take a 6.52 rate. I never was late. Greed , making more money for the company. I new it was a lie. But they wouldn,t let me keep my lower rate.So now i pay a extra $125.00 a month. Not fair. They offer me a modifaction. They told me it would not miss up my credit score. They wouldnt report the modifaction th the credit bureau. They lie. I made one payment. Found out the credit bureau lower my credit score over 100 point. From my high of 700 point score to 600. I call the loan compay. Thet told me they would take care of it. I recived another credit bureau statement . I paid my self out of one month modifcation program. Besause that was the only way i could get my good credit rating back. It took over 120 days. I have to send a letter to all three credit bureaus. I had to clear it up my self.Aurora made a mistake. They said they where sorry. Some of my other credit card ompany started to go up on the intrest rate Because of what it said to the credit bureaus. I had to straiten. up my other credit. I can go out and buy a new $43.000 new car. on a stated income . But i cant refinace my home. . That isnot fair. 770-377.0932.Dont deal with them.

      3/10 Bank of America lost our “Pre-Modified” documents but cashed the cashiers check in the same envelope that was requested to complete the modification. .. 7/1/10 Aurora Loan Services took over the loan and wouldn’t honor the modif…even though we have cooperated in sending numerous
      (and duplicated) documents to ALS. They have done absolutely nothing for us!!! We have contacted an attorney, filed a complaint with Comptroller, and MN Atty General Office…it has been a complete nightmare.

        I am in the middle of “Negotiating a transfer to lender” as I like to say…I have sent an attorney in Minneapolis the information I received from the California attorney working on the Class Action Suit against Aurora. She wants to know if there are any other victims in Minnesota who have had Aurora rip them off…I figured I would comment here and check back if there is anyone else who would like to file a class action suit against Aurora who hails form Minnesota.

        Aurora is presently taking me for a run…they took 11 month of my money on the loan modification only to tell me that i am denied because of ecessive forebearance…bunch of theives..and they told me that while i was being modified that they would stop the foreclosure proceeding in the court…that never happen they continued to proceed with the foreclosure while i was been modify..i am in Ocala Florida and when i got a letter from the courts for final foreclosure judgement..i was told the Attorney for Aurora name Stern was being sued for fraud and he was the one handling my case…i am still residing in the home but it a matter of time before the foreclosure on me…if there is anyone out there who knows what to advice me to do to save my house.

    We have tried to modify our loan with Aurora since Feb 2009. After being rejected 6 times-and counting, and over 11 months + of re-submitting ‘lost paperwork’ we have come to a conclusion. That conclusion is home modification program’s only work for Freddy/Fanny loans. They do not work for private un-disclosed lenders of notes-sold-with-out-homeowners-knowledge situations like all of Washington State, otherwise we would not be experiencing a 2800-3000 note failure rate per month. In summary, where is the next class-action suit for the state of Washington? We’re going to join.

    Aurora Loan Services foreclosed on my house in California 11 days after I got my second loan modification denial. I also had a short sale package submitted before they denied the loan mod. They did not contact me or give me anything in writing stating my house was to be auctioned off.

    Aurora Loan Services agreed to do a loan modification for me and 2 months later stated they would not be abale to complete the modification because they were not going to do the program anymore. I was then three months behind. I entered into an another workout program for 1200.00 a month ( higher than previous loan payments)
    That was going to get me caught up and back on track. When I spoke to them again they told me my loan payment could possible go up and not be reduced at all. Then I heard about the Obama Hope for homeowners program.. I was interested and started calling around.. The price was too high, anywhere from 2000.00 to 3000.00 dollars.. Then I was called by American Law Firm.. They promised to reduce my payments by at least half of my current payment.. I was in the middle of my 2nd forebarence agreement with Aurora when I heard from the Law Firm that there was a problem with my mailing address. When I asked if I should call Aurora to find out what the problem was I was advised to do so. They refused to give the Law Firm the address where my modification agreement had been sent. It turned out that the Law Firm, with out my knowledge changed my mailing address to there address in Orange counts New Port Beach or Santa Ana. When I called Aurora they advised that my home was sold 3 days earlier due to the documents were not signed and returned. I never received anything to sign. Aurora said they would see about resending the sale that Friday and that I could call them back on Monday.. When I called they said no they would not resend the sale. I received a 3day notice for me and my children to get out in the same week..
    Please tell me something can be done to right this terrible wrong. I have contacted the attorney general and have heard nothing. Please help us.

    We live in Maine. We were in the 6 month mod program. We were told the difference in the payments would go to the end of the loan. On the last month we get a call saying we are 6 months behind. Today we got a letter from a lawyer, Is there help? Sylvia

    We too would like to join this lawsuit. We have had the runaround from them, implied promises and ill advisements,only to be denied almost two years later, while now owing thousands of dollars. We sent a letter to Aurora stating very similar issues if not the same mentioned in the complaint filed. Will be glad to provide a copy to add to the lawsuit!

      Aurora placed my loan on a repayment plan to get caught up on arrearages. I wasn’t able to access my account per the internet although Aurora sends me a statement once a month showing the payment due. I faxed Aurora a letter stating I was trying to make a payment on-line but their computer system would not let me do so. I received a garden variety letter stating that they were looking into the “issue” but they slyly didn’t address what the issue was. The next day they recorded a notice of default against the property even though THEY forwarded me the monthly payments due including the extra amount needed to cure the arreages! I was planning on paying the amount per THEIR statement but they were proceeding with a foreclosure proceeding all along!

    After 2 years of working with these criminals, Aurora Loans, we were denied our remodifcation after we told them we wanted them to send us the paperwork so we could think it over. They told we needed to decided over the phone and because we didn’t we were denied. I wish to join the class action law suit against them, in hopes to keep my home before they cease our home.

    We, John and Cora Hester would also like to join in the Class Action Lawsuit against AURORA LOAN SERVICES. We filed for modification and Aurora put us on a post petition payment plan, while they get the paper workout done, and it took them one year to do this, and in the meantime, they came back with paper work and it stated our payments were more than the post petion, they accused us of more payments and late charges behind, which we did not owe. Today we are paying over a thousand dollars per-month. Plus they charged us for doing the modification. We have contacted another source and are in the process of obtaining a lawyer. What are your suggestion?

    I read the class action filed through the link above, we definitely went through the same situation and could be part of this suit. We are currently in our home after undergoing over a year of promises and lost documentation to a final offer that included a $96k final payment, where they created out of thin air. The offer was by phone , by an assistant to the underwriter, and we had to make the decision in 24 hours whether to accept it. It was unreal, and just unbelievable that after a year of being told we qualified for the HAMP, they said we werent after grossing my husbands disability and ss disability they said he made too much, then they stated but ” you are entitled for the IN HOUSE ” mod and we could help you, another 6 months of hell and then this call with an offer only a fool would take. Please help

    I am a resident of Viriginia, and like alot of what I have read my loan was sold to Aurora. With some financial difficulties we did get behind on our payments. Aurora offered us a workout package and lowered our payment during the trial period. All paymets were made on time. We have been denied 2 times and now are in the process of a traditional modification. We have sent every piece of information that they have requested multiple times and can not get a straight answer from any one when we call. If there is any way I can get in on this class action, tell me what I need to do. We want to keep our home, but the stress of all this is really getting the best of us. Can someone please help?

    I have sat here reading evryones complaints about loan modification from aurora loan services, the thing no one has brought up is that they and the investor dont want you in the house. When they forclose or you short sale the investor is reimbursed thru the federal goverment for the loss on the amount due after the house is sold , so for instance if the loan is for $400.000.00 and the short sale or forclosure sale is for $280.000.00 then our goverment reimburses the mortgage company or investor the difference, so why would they want to help ! They win we the consumer and tax payers lose, To be considered for modification you must be at least 30 day behind in the mortgage this will drop your credit rating substancially this is the only negetive for the home owner. They dont want to do any thing to help, they want the house its in there best interest not to modify.
    I have been trying to do a modification for 6 months my credit score is trashed prior to this I had perfect credit, now its gone but what else is there to lose,a short sale allows them to get you out and resell the property and get reimbursed so why work for the comapny that is screwing you over and over, stay in the house save the money you would be making on payments rent for two years after and purchase your house back in 2-3 years for half or less of what you owe. to me this makes sence and at a better rate than what you have now.

    I was also a victim of Aurora. Sometime June 2009 they gave me 4 mos trial modification. After the 4th month of paying religiously, I asked about the status of the loan modification. They decision is still pending and is under study; they told me to continously pay the amount that was on my loan modification plan, which I did up to the 10th month. Suddenly, I saw a lady taking picture of my townhouse and she told us that it was foreclosed and sold to her. Called Aurora and said that the loan modification was disapproved. They did not even had the nerve to tell me that the loan was disapproved before selling the house. I even asked what will happen to the 11th month payment which I just mailed a day before; they said it will be refunded to me. I tried to seek the help of other government agencies to seek justice; but seems it feel on deaf ears.

    We need to get together and file charges against this company.

    My house was foreclosed on last month while I continue to receive letters from them asking for more documentation for the loan modification. It’s like they don’t even know they foreclosed on me!! A local attorney was able to keep me in my house until July 15. Is there anyone out there who can help me? I want to join a class action, but don’t know how, and need an attorney that can handle this, but don’t know who. If anyone can help, please post names/numbers/specific how-to’s on what to do. thank you!

    I have a predatory loan, which is registered with MERS (it says on the note) Who owns it, I do not really know. Aurora is the institution collecting the payments. They call and tell us that we are eligible for a loan mod under Obama’s plan. I do not trust Obama or Aurora. They call me to inform me about this.
    One they receive the payments, but do not hold the title. Who am I paying my payments to? GMAC? Deutsche Bank? Who knows. I told them to quit calling me, because I am not behind and unless they would bring down the loan to what the house is actually worth (about $300,00, the loan is $700, 000 and the house was worth $.900,000+, we lost the $200,000 equity we had) and give me a fixed interest rate, I am not interested. My next step is to research who owns the title and if I am paying it to the right institution. Fortunately we are able to make the payment. These institutions who supposedly help you, are nothing but legalized robbers. If anyone can help me complete this approach or give any direction, i would appreciate it. This legalized robbing us from our homes through wrong information, which they know they are doing and are nothing more than entrapments, NEEDS TO BE STOPPED. We as people would be thrown in jail if we conducted business like that.

    I’ve been there and done that with Aurora Loan Services!! They are not out to help anyone. I’ve jumped through there hoops until I’m blue in the face! It was not our fault what happened to the economy. The hamp program and loan modifications are just a way to make you think they are going to help you, then don’t! Anyway I’m in forclosure as well. I’m 65 years old now and have owned my home since 1981. I’ve raised my children here and now istead of retiring I’m possibly going to be living in a tent!! No joke! We are const owners and we all know that’s in the toilet. Some work and very little money. Worked hard all my life paid my bills and taxes, always played by the rules. Who would have thought this was where we would end up. Guess these are not going to be my golden years, more like GD years! Thanks to the banks and the down fall which we did not have any control of, so we all in this situation have to pay for dearly.

    Please include me in Law Suit action as well. I am in Washington DC and I have been in Modification since 2009 . Still they do not have an answer for me. Each time I call them they ask for the same document with updated date. They running circus not business. When I started the modification I did not owed them any back loan now I owe them close to $70K . Why no one get on them to help desperate home owners? I am sure they are going to deny me again . Since we have started the modification the process they put me on reduced payment plan and I have made every single of them. So I do not know why they won’t help people like me to keep their homes and get us out of this mess that they put us to start with. All these CEO of the wall street who sold bad loans to consumers and made quick millions and billions are criminals and need to go behind bars. Instead they get bail out by our tax paying hardworking citizen and who is the one loosing their home and hope and American dream that they made for themselves and their family. Where is Justice in here? I need help!!! I live in Washington DC.

    We are residing in CA, we went through Mediation w/our lawyer and was promised a mod and then they turned around and changed terms and then denied any agreement. I don’t want to go to court but Aurora Services keep breaching the contract. Anyone have any advice for my family? I am really stressed out over this whole thing! 2 years and nothing!

    To: whom it may concern this is terrible Aurora loans are liars they dnt work with the people they jst give you the run around.I’ve been trying to get a modification on my loan for two years already, and they send me a letter saying something is incomplete so I hired a agent in this line of work to do it for me.and what do I get the same letter again aurora loans are jst liars and thieves I’ve tried at least three times and all denied unbelievable so now they sent me a letter that my home is up for auction in trip weeks that’s crazy…I dnt know what to do don’t somebody stop this bank from doing this harm to all this people and leaving people homeless…:-(

    We have lost our home also. We live in Wisconsin and were told by our attorneys that Auroa was not even liscened to sell mortgages in Wisconsin. Currently the house is sitting empty and has already been vandalized by criminals. We are in a unique position as they do not have a potential roadway into the property because we still have ownership of the driveway and septic system. It is a country home that is located on three seperate parcels. We recently made an offer to repurchase but was turned down by the real estate agent.     I have a loan that is a ballon with a high rate and a high pre payment fee. My loan was sold to Aurora a few years ago. Anyway I fell victim to the colapse of property value. I asked Auroa for help last year while I was on time with payments. I spoke with George Ung assets Mgr. He put me through all the hoops you could think of and asked for a fee to do the loan mod. After I did every thing they asked including kill myself keeping payment on time, They tell me I di not quilify, They said the property did not appraise for enough. Now 8 months later I have fallen behind and I am asking them help me keep the property. Short sale is there only option. Well I dont want to give the property up and I will fight to the end with these people. I am will to refinance the property. All I ask is to let me have it for what its worth in todays market. We can then go our separate ways. If they try foreclose they cost everybody alot more time and expense. There has to be somebody at Aurora with some comon sense. All I am asking for is a fair shake, I am a victim of the economy like many others.

    For all of you out there who are going through this stay positive. I ahve been helping my parents through a similar aurora nightmare. We first spent $2000 to retain the help of a so called modification company who shortly after our deposit disappeared. So we lost $2k right out of the gate. Then we dealt with all of the same issues you are all dealing with. We live in NYS and I just purchased a house so I spoke to my attorney who put me in touch with another attorney who deals with this type of issue full time. We have had to lay out some money to retain his services and it has been somewhat tight for my parents, but without the help of a skilled professional this whole process can be quite difficult if not impossible to navigate. Without his help i am certain that they would have gotten away with it and my parents would have been forclosed on. I suggest you touch base with a professional lawyer, and not one of these companies who claim to help so many people. Most of these have proven to be scams! It has been a lengthy process, but I am happy to report that they are finally wrapping up the case and my parents will be keeping their home and having their payments recalculated to reflect a more fair amount. I hope this helps those of you out there who feel like there is no hope. I know my parents felt that way, and although i stayed positive through the whole thing there were times that I felt that way for them as well. There is hope just be smart and make the right decisions when it comes to who you choose to help you. Be patient and know that it does take some time and probably some sleepless nights. Hoever, IT CAN BE DONE!!!

    I have a wrongful foreclosue case going on against Bank of Americia. Does andyone know how to get a lawsuit loan for foreclosures. I’ve been reserching and have not found any lenders who will lend for foreclosures. There are loan companies owned by attornies and judges and the lend lawsuit loans. I’m looking for a company that will lend for foreclosure cases. Thnaknyou.

    Aurora Home loans is horrible…..they bought my loan 4 years ago..I NEVER missed a payment then I lost my job! They refuse to answer my questions..they sent me over 10 grand back saying it wasnt enough, they have a “single point of contact” that will put NOTHING in writing nor email so nothing is traceable plus never returns phone calls.
    Is then anyone in Florida who has fought these people and made them help you get a loan mod? ANY information would be a help!

      We have been invloved in trying to get resolution with Aurora for the past 5 years. As of March 2012 we retained an attorny and trying to get some closure. Would love to be part of this class action against them. what do we have to do.

    Aurora Loan Services should be shut down for their criminal behavior !! We have fought them for 3 years and its one hell of a story ! their pockets run too deep and their attorneys are well paid ! We currently have a judgement against them and somehow my attorney just dropped us ?? Can you all say payed off ? Im sure they are stupping to all levels ,anyone know a great attorney in Utah ?? Yes also add us to this class action .

    aurora loan services and there investor, is the same green point mortgage funding inc. just with another bank name, and now just aurora bank, but there guidelines that there using to modify this predatory mortgage loan. aurora bank are following the same exact originated predatory guidelines prepared by green point, the class action lawsuit in Ramirez,ET AL. V.Green Point Mortgage Funding inc., civil action case No. 08-CV-00369., the lawsuit did not go to trial, green point mortgage funding inc. settle out of court and chose not to go to trial, and paid a settlement fund consisting of $14,750,000.000

    I suffered a foreclosure as a result of Aurora’s ineptness to process my home modification. I had gone through a nasty divorce in CA, which is where the house was located. This met the requirements for home modification loan. Submitted the request through my Realestate agent. After 60 or 90 days we received notice that the request was denied due to missing paperwork. We resubmitted included all of the required documentation. Again after 6 weeks they denied the request for lack of paperwork. We spoke to a supervisor and walked through our submitted paperwork. She agreed the paperwork was all there but since the time had elapsed we had to resubmit again. We did this again with the same results which at this time there was no point, aurora had started foreclosure and the house was sold. Mind you we had also tried to short sale the house and got a fair market offer. They declined the offer for no reason. We requested the reason for the decline and they stated it was not enough money from the proposed purchaser. Of course at this point the buyers had moved on. The house sold for less then the short sale offer. I don’t fet it bad things happen to people and good people try to work things out. You can only try for so long before you raise your hands and surrender.

    I was foreclosed by Aurora back in 2010. Moved away being that I’m military so never paid much attention until recently, we received a notice that we might get some money for Auroras handling of foreclosures. I never wanted to pursue any legal action but that foreclosure follows me everywhere! If someone is doing a class action lawsuit I would like to be added. I lived in Northern California north of Sacramento so if anyone can help I would greatly appreciate it!

    I, too, received no help when trying to work out a way to keep from losing our home. Aurora Loans wouldn’t talk to any of our representatives, nor would they let us know when the auction of the home would take place, although they announced that it would. I had a friend who wanted to buy the house and let us continue on as renters. In the end, it never went up for auction. Aurora kept the house or sold it to someone else without ever going to auction. They were as crocked as Lombard Street! We lost our home and ruined our credit as well.

    In 2008 I became permanently disabled from my career teaching in a small town in Washington. My income dropped by 30%. I began to attempt a HEMP, which involved a first and second mortgage. They drew the process out three years, each month requesting another piece of paper, updated. Finally they sent me a non, HEMP proposal, which actually increased the rate, added a balloon and other items.
    I requested a mediation, which they agreed to and canceled at the last minute, I then received what they referred to as a re-work that fit the guidelines of a HEMP, which actually looked identical to the other proposal. I requested another mediation which was granted.
    I had the house up for sale, and switched it to a short sale. I attended the mediation, I was told I could not allow a friend to attend with me. There were four lawyers in the room, my mediators, were not. During the rather short meeting, which was also placed with corporate, via phone. I was informed that their offer was off the table, and no other would be provided. The reason I asked for the mediation, was to question the new proposal.
    I met with those provided as my representatives, they advised that I stop paying.

    Which I did. I had an offer on a short sale. Aurora then sold the note to another group. This group sold the house from underneath me. I was informed of this by a call from my realtor, who was also once my boss, that was fired from this school district. That it had been sold out and there were new owners, giving me three days notice to vacate. I kept all the documents. It was a three year nightmare that ended last year 27 September 2012. It took me a year to recover enough, to be in a position, to start looking into the practices of Aurora and their affiliates.
