Toyota Scion xB and tC Owners and Lessees File Class Action Lawsuit Against Toyota Over Allegedly Defective Rear Hatch Door Handle and Panel.

A class action lawsuit has reportedly been filed against Toyota Motor Sales, U.S.A., Inc. and Toyota Motor Corporation (“Toyota” or “Defendant”) in the United States District Court for the Central District of California (entitled Salvatore Amata and Daniel Walker v. Toyota Motor Sales, U.S.A., Inc. and Toyota Motor Corporation, Class Action Case No. CV 12-168-VAP SPx) alleging, among other things, that Toyota manufactured, distributed, sold, leased, services and warranted model year 2005 to 2011 Scion xB and tC automobiles that allegedly contain a design defect and/or flaw with the rear hatch door handle and panel (“door opening mechanism”) which breaks off during normal use, according to the Toyota Scion xB & tC Rear Hatch Door Handle defect class action lawsuit complaint.

The Toyota Scion xB & tC Rear Hatch Door Handle defect class action lawsuit is reportedly brought on behalf of the following proposed classes, unless otherwise excluded:

All current and former consumer owners and lessees of model year 2005-2011 Toyota Scion tC Vehicles purchased or leased in the United States of America.  (“tC Class”)

All current and former consumer owners and lessees of model year 2005-2011 Toyota Scion xB Vehicles purchased or leased in the United States of America.  (“xB Class”)

All persons who purchased or leased one of the Vehicles for primarily personal, family or household purposes, as defined by California Civil Code section 1791(a).  (“California Sub-Class”)

All current and former consumer owners and lessees of model year 2005-2011 Toyota Scion tC and/or xB Vehicles purchased or leased in Maryland.

The Toyota Scion xB & tC Rear Hatch Door Handle defect class action lawsuit complaint reportedly asserts claims for alleged violation of California’s Legal Remedies Act, Civil Code section 1750, Song-Beverly Act, Civil Code section 1790, Maryland’s MCPA, and California Business and Professions Code 17200.

    Gar: The lawsuit was recently filed in the U. S. District Court in downtown Los Angeles. As a member of the class, you should get something when the case is settled. To the extent I’m able, I will try to keep you updated.     2006 Scion TC – replaced mine in 09 $200 for the part…just found out from my mechanic that there appears to be a design flaw, at least in the 06 model where the door hatch knocks against the window channel in both the passenger & driver side doors…about 6 months ago just started noticing a knocking noise when opening and closing the doors…found out if window channel is damaged upon repair have to replace the entire door and could cost as much as $1500 to repair…had my vehicle for 80k miles before I had any problems with this…anyone else?

    My 2008 Scion TC trunk handle has just broke off! I take care of my car, even taking it to the dealer for maintenance, BUT to have this incident happen to me and other loyal clientele is unacceptable on Toyota ‘s part.

    I just bought a pre-owned Scion XB. Within 10 days of normal use, the back door hatch handle broke off. There is a little white plastic part in the upper right hand corner that holds it on; it broke off. I couldn’t use the rear door at all until it was repaired. Iwould like to know more about this Class Action Suit.

    I have an 2005 scion with the rear hatch issue. I have re-attached it several times with epoxy due the repair estimate from Scion. I have callled Scion and filed a formal bitch, complaint and them know that I think they are attempting to save millions by not announcing a recall due to an engineering defect. They stated that they are handling this on a case by case basis. I would like to be involved in this lawsuit.
    In the meantime I have a good, tested temporary solution if anyone is interested.
    I simply completely removed the the housing for the hatch release. I relocated the hatch release to the bottom of the license plate. It is wedged between the plate and the hatch. To open the hatch you simply reach down below the plate and push up on the release. It is very solid there. My daughter really likes it much better. All she wants is a little cover in place of the defective plastic housing with a sticker that reads “Scion Sucks”. If anyone wants pics of the temporary solution, email trk.734@gmail.com

    I replaced the back handle within the past year on my 2006 Toyota Scion TC. It just popped off in my hand one morning before work. It was not cheap to fix and the delaership just said that it happens a lot. Now, I am struggling with the third brake light not working. I am assuming that the problem is still related to the back door panel. The paneling has never fit right and the problems just seem to be snowballing. My husband replaced the backlight and it worked for one day. SO…there must be a wiring issue. On my way to another failed inspection, I got behind two Scions where the back LED brake light was out also.

    I will track this case to see if there are any updates.

    Scion should be responsible for putting a quality product on the road. My handle also broke off and I just got a quote from my local dealership and it is going to cost $392 to repair! Unbelievable! I really hope they end up doing the right thing for the consumer. Obviously this is an issue that most owners are experiencing and it is unacceptable. I am extremely disappointed in Toyota right now. My hard earned money should not have to go towards a little plastic part that took $5 to make in China.

    I would love to know how to get signed on for the lawsuit. I have an 09 Tc, its not even paid off yet and the handle broke off!! I’m an engineer and took one look at the 2 thin pieces of plastic holding it on and can tell this is a design flaw. How retarded of a design considering that with as much contact as there is for the rubber gasket lining the the hatch (its a long way around) that thing tends to stick, you have to have some damn leverage. It looks like they’ve redesigned it on the latest models.

    I will say that I seriously doubt any of us will ever see a dime even in the CAL prevails, after legal fees and whatever else the lawyers will pull out we probably will get $15/each. I’m just hoping this is covered under warrantee, it only has 36k miles and like I said isn’t even paid off yet. FAIL

    I have been so sick and tired of dealing with this dumb trunk issue. I paid off my car this year and it is a 2007 tC. Each time I try to open my trunk it gets jammed and doesn’t open so I try to keep pushing and prodding to get it open. I finally got it to open yesterday and the whole rubber/glue aligning the trunk came off with it. I HATE MY SCION TRUNK. How can we not get in like other normal cars with a button on the inside that pops the trunk open like the hood? How ridiculous is this??? Ugh.

    This class action lawsuit should be for all 2004 Scion XB’s as well. My XB is one of the originals and has the original design flaw. I’m not sure why everyone thinks this flaw only pertains to 2005 on up. IT PERTAINS TO THE 2004 ALSO!!!!

    And I have submitted my information for the class action lawsuit. Just hope something comes of it soon.

    Is this lawsuit for just those in california? i live in wa, but my scion TC hatch broke a year after i got it just snapped right off. The hidrolic pistons that hold the hatch back up went out the same time. Its going to cost a little over $700 to fix.

    Stupid trunk handle thing got me pulled over!!! It keeps covering my rear license plate and now I have to use JB Weld to keep it in place and avoid using my trunk. I purchased my vehicle in Dec of 2007 and it’s an 08. I am so pissed off and it’s very inconvenient, especially shopping with two kids. I can never load my groceries…not to mention when it’s pouring outside. At first I thought I was the one that caused it to break, but when I drive around, I notice others who uses TAPE to hold it up. WOW!!! #PissedConsumer

    My hatch broke ofc about two years ago. Been using tape and it is damaging the paint. My trunk sometimes gets stuck especially when its been raining. Love my car but hate the trunk

    If you’ve got a black one, black Gorilla Tape works better than duct tape. My handle broke off in my hand when I tried to open it with the doors locked on a cold day. I thought I’d developed super-powers or something. Finally fixed it with one I ordered online from ScionPro for $109.
    I wasn’t about to buy one from a Toyota dealer, besides probably costing a fortune, I’m sure it’d break too.

    2006 XB rear hatch rubber covering the switch is deteriorated, soft, sticky. Cannot buy just the rubber cover, but must replace entire switch $72. Related to whole handle falling off?

    The rear hatch handle of 2004 Scion xB is broken also, it happen on a very hot summer day August of this year, in a park lot while I was trying to load up groceries of a busy market while people walked by looking at me, while I was sweating like a pig, trying to figure what to do with a dangling rear hatch handle! For now I just drilled some hole on the broker handle and zipped tied it until I get a new, that will cost me i don’t how much and how much time it will take out of my day, this gave me headache just thinking of it, but I guess it my problem, not Toyota!

    The hatchback trunk handle has broken off three times in less than five years on my Scion tc with normal use. Twice I had it repaired under warranty at a Toyota dealership. It recently broke off a third time once it weakend completely. This time my vehicle is out of warranty. Toyota Scion refuses to repair the trunk handle unless I pay for it.     I own a 2005 XB & had the rear-door hatch break as well last year. 2 of my friends tried to fix it with an expoxy/plastic concontion which also broke. Tried using ” pretty patterened duct tape” to hold it on & of course, that eventually fell off. Dealing with the ugly tape marks which has been difficult to remove. Hum…What to do, what to do…Have been putting off buying a new one thinking it’s probably gonna cost alot plus the labor to install a new one. I definetly want in on the lawsuit. So glad I happened to run into this site before I decided to purchase a new system. I’m glad to know I’m not the only one running around embarrased about the hanging latch !!

    I’ve seen lots of tCs with that handle broken. The only way to avoid before it breaks and after repairs is to get better lift supports. I have my tC for over 7 years. I have avoided this by not pulling the handle hard when opening the hatch and lifting it from the sides. I also found a couple of clips that hold the bolts into the plastic broken when changing the 3rd brake light. The handle was unproperly design for the heavy hatch. Toyota should pay up.

    i have the same problem as well. mine is a 2009 scion tc and it broke off last year. i got a ticket just cause the button to the trunk was hanging off and it was obstructing the view of my license plate.

    I own a 2008 TC. Not only did the hatch completely break off last night, I recently was informed that there is something very wrong with approximately 11 parts in my car; which has resulted in excessive oil consumption. The owners manual says to change the oil every 5,000 miles but I have been changing it every 3,000 since I bought the car brand new. Now, before the 3,000 mark, there has been NO OIL in my car at all! Apparently, there is a technical service bulletin out describing the manufacturing issues with all of these parts but no recall. This is a HUGE safety concern! A car with no oil??? The oil light only comes on when there is absolutely no oil, not when it is low. This is so dangerous yet, there is no recall! I am disgusted with Toyota. The love of money, once again, coming before the safety of people. Shameful.

      Has Toyota said anything about the oil problem? I have been having the same issue.. along with the broken trunk latch. Would you mind telling me what the 11 parts are? I’ve been meaning to get it checked it. I changed my oil 2 weeks ago and it’s empty again. No leaks!

      You are right about oil consumption problem. It is listed as a TSB under the date of 10.14.2011. They state that there is a piston assembly default, which drains the oil. Many owners have had their engines blown due to this issue and paid out of their pocket to fix it. They are not aware of the TSB. Log onto baileycar.com/recalls and scroll down to find it. Also, go to Youtube and enter scion engine makes knocking noise and you will see and hear a video posted that is making the same noise. I took my scion to North Bakersfield Toyota and they told me it was the baring in the water pump. I informed them that I have not been having any radiator problem or overheating. I further mentioned that I have not seen any water underneath the vehicle. They explained that I wouldn’t notice the water due to a deflector. LOL. I’m taking it back because the noise and rough running continues.

    I live in massachusetts, and bought my tC in new hampshire…the the trunk handle has also detached. What the HECK!! I bought a Toyota because of its great reputation, but now feel like I got played for a fool. Will cost me $ 300 to get fixed not the o mention the ticket I got cause my plate light isnt working on one side. BAD BUSINESS. The trunk must get recalled and fixed once and for all.

    I am having all kinds of structual problems with my 2006 tc,including the rear hatch coming off in my hand. we must fight our cars fixed.
    My car was hit at about 10mph& my whole front bumper hood spoiler all of it damaged at 10mph!

    Mine broke too ! First it kept coming loose and I had to keep tightening up then it finally broke. I used duct tape too until I could get it fixed. I want in on that class action suit. I also have a problem with the air condition drain tube coming off and flooding the passenger side floor !

    My trunk hatch broke off last night (Feb 8th 2012) with the wiring still attached, so it was basically hanging off. I had to tape it down so it would sway while I drive. There is another Scion TC by a friend’s house who I’m ASSUMING had the same problem since they’ve had their trunk handle taped down for months now. I will find out who owns it and direct them here! Such a waste of money for that handle. $160 for the part, $185 for labor!! They said they need to go through the side door panel…

    The trunk hatch of my 2005 Scion TC broke off Saturday while attempting to open it. I just called my auto guy and now I am afraid for him to call me back. I was wondering if this was just my problem or if others are having the same problem and now I see my answer. I am the original owner of the car and this unacceptable. My car works fine other wise but I have not been satisifed with my purchase, not only did that break off but I am noticing the carpet in the car is starting to come out from underneath the plasitc inside, my sunroof has been fixed twice, my trunk now is rattling. I will not be purchasing another Scion or probably even a Toyota vehicle.

    I bought a 07 Scion tC for my daughter, and yes the latch broke. I have seen many TC’s with this problem. the rear hatch is way too heavy for a plastic latch. this is why they break

    I have received a letter from Scion explaining and extending the warranty for the detective rear hatch handle for 7 years. I live in MD. It also states those who paid to have theirs fixed will be reimbursed with proper documentation.

    I have a 2006 Scion Tc and just broke my hatch off with normal use, I feel that with enough complaints Toyota will be forced to recall this flaw.
    It is a shame that the consumer has to go through so much hassle to get a defected product fixed
    I would like to be part off this lawsuit, and hopefully if everyone gets on board we can have our cars back in quality shape.
    Toyota is a good product and very reliable Im sure they will get this issue resolved or be forced to provide a refund to anyone that has delt with this issue.

    2007 Scion Tc purchased in late 2006. My handle broke off early last year. I’ve been dragging my feet on the $400 repair. I saw the comments about receiving a letter in the mail and called my local dealership. I did not receive a letter, but they are still fixing it for free this afternoon. They mentioned that I caught the extended warranty by only a few months so act fast or the deal will expire.

        Just saw this today. I finally got the official letter from Toyota last week. Looks like they are fixing them across the US . The deal only extends your warranty, meaning it will eventually expire. Spread the word! I’ve already put a note on a windshield and ran across a parking lot to tell a stranger.

    I have the same problem , My latch broke about a month ago from NORMAL use , please contact me with information I live in Florida and do not want to pay to $200+ to get this fixed , and not to mention the tape im using to hold the latch is completley messing up my paint 🙁 !

    Hi, i still paying for a XB 2005 Scion. The rear hatch handle broke a couple months ago, (it doesn’t open). I went to Ira Toyota in Danver, MA and they told me that it is $60.00 to check it out and it could be more than $350.00 to fix it. Give me your advice, how should i procced? Thank you,

    Hi, My latch broke off from normal use abuot two ago, have not paid to have it fixed, just holding it up with gorrilla glue. How do i get myself included in this lawsuit?

    I have received from the Scion Warranty Enhanchment Notification Processing Center (POB 710367, San Diego, CA 92171-0367) on 5/9/2013 notification that my 2006 Scion xB is covered for repair of the broken Back Door Garnish. I had no knowledge that this problem was so widespread as it apparently is until seeing the problem addressed on this web site. I will be in touch with my local Scion dealer tommorow (5/14/2013) concerning covered repairs under the “Warranty Enhancement Program” that the Scion letter details.
    I reside in rural Maryland and don’t really see that many Scions in my daily travels. I hope this e-mail will help others resolve this problem with their local Scion dealer.

    My hatch is bad,panel.I have little ones,this scares we.
    I love my car,saves good on gas. But problems keep coming to my attention, befor l even hear of this lawsuit. Thank god,I’m not alone
    In my concerns.

    I also own a Scion Tc 2007 and my handle recently broke,I live in CT and I have seen a lot of the same model cars driving around without the handle. I definetly think it was a defect and no one should pay for a replacement, Toyota should. Keep me up date with any information regardless. Thank you.

    Update from May 13, 2013
    My local Scion dealer replaced the defective (broken) parts on the rear hatch garnish at no charge based on an extended warranty arrangement.
    Contact your local dealer ASAP about having this problem resolved at no cost to you.

    My back hatch broke off of my 2007 Scion tC a few months and is currently being held on by duck tape. My local Toyota preferred body shop quoted me $260 which I cannot afford at the moment. This has been forcing me to drive around in my first personal big purchase which I was once so proud of and now it’s an embarrassment! Considering is this such a common issue Toyota should have found a better method years ago considering is seems to be an on going issue to save people the hassle which myself along with anyother are dealing with. And not only that but to help better the Toyota brand which obviously has given many of us a sour taste in our mouths.

    Today I opened my trunk to take out groceries and the trunk handle fell right off and I caught it. It’s a 2005 tc. It’s just hanging there now by wires. By reading these posts I see what’s in store for me with this car. Now I’m looking at a couple hundred to replace it and I’m sure it won’t be the last time.

    I purchased a new 2005 scion xb and not too long after purchase the back hatch handle pulled off. I carried it back to Hoover Toyoto in Birmingham Al. and they fixed it …lasted a little while and came off again so I have used duck tape ever since to hold it on. Just heard of this class action suit sure hope I am included…..

    My hatch handle broke off while I was opening it after going grocery shopping. When looking at how it was buildt was so cheaply made! And to charge over $200 to replace is just another way for Toyota to make money. Having tape on the back of my car is so ugly. This really needs to be a recall and Toyota should be responsible for replacing it.

    This just happened to me today… I have noticed it hasn’t been opening properly for awhile including the support struts not helping anymore. I knew purchasing a car from Scion would be a bit cheaper in quality but not like this. Bringing my car in coming week to get this fixed hopefully all paid by Toyota…

    My hatch broke when I lifted to get the food out the back of the car. I thought this was a good car,but its not its light. when the wind blows the car move from side to side and sometimes its seem like your going to lose control of the car.

    My scion trunk handle broke off as well. I’m currently driving around with duct tape on the back of my car which looks very ghetto. I am so stressed out …I am so afraid this is going to fly off while I am driving! !

    I recently contacted Toyota Corporate office about this issue, and they are still denying free replacement on this manufacture defect. How do I get in on the class-action suit?

    Rear end rattling is driving me crazy. I’ve tried everything to fix it. Removed all personal belongings from vehicle, pushed rear seats down, tied down the seat belts., nothing works. Now I learn for the first time the rear hatch could be the problem. First I ever heard about this class action suit. Have to wonder why Scion failed to notify all owners. What’s going on? Is this car even safe to drive anymore? Another gripe. Just spent $700. replacing a gas charged strut. Consumer Rpt gives this car highest ratings, “Much better than average”. Not in my book.
