Ford Class Action Lawsuit Complaint Filed Over Alleged Defect in 2004 & 2005 Model Year Ford Freestar and Mercury Monterey Transmissions & Torque Converters

Ford Freestar and Mercury Monterey Owners and Lessees File Class Action Lawsuit Complaint Against Ford Motor Company Over An Alleged Defective Transmission and Torque Converter In Model Year 2004 and 2005 Ford Freestars and Mercury Montereys That Allegedly Can Cause Sudden Power Loss and Loss of Acceleration.

A class action lawsuit has been filed against Ford Motor Company (“Ford” or “Defendant”) in the United States District Court for the Eastern District of New York, Brooklyn Office (styled Judy Azose v. Ford Motor Company, Case No. CV 10-3634) alleging, among other things, that the transmissions and torgue converters in Ford Freestar and Mercury Monterey 2004-2005 model year minivans suffer from an engineering design defect that manifests itself when, without warning or prior signs of transmission problems, the output shaft splines in the torque converter split and the Ford Freestar and Mercury Monterey vehicles suddenly lose power and cannot maintain speed or accelerate, according to class action lawsuit news reports.

The Ford Freestar and Mercury Monterey Model Year 2004-2005 transmission and torque converter power loss class action lawsuit complaint is reportedly brought on behalf of the following class, unless otherwise excluded:

All (i) current owners or lessees of a 2004 or 2005 Ford Freestar or Mercury Monterey minivans residing in the United States; and (ii) former United States owners or lessees of 2004 or 2005 Ford Freestar or Mercury Monterey minivans.

The Ford Freestar and Mercury Monterey class action lawsuit complaint reportedly alleges statutory violations of the New York General Business Law section 349, breach of express warranty, breach of implied warranty of merchantability, violation of Magnuson-Moss and unjust enrichment.

Same problem with the Trans. April 13, 2012 had it towed to the local Ford dealer. They took care of it. Upon driving it it would go down the road at 40 without touching gas. Returned to Ford Dealer and they had to turn the torque converter down. It is now leaking fluid from the transmission. They said its not sure smell like it is burning and the carboard under the engine says it is. Going back to Ford again today.

      Hi,

I bought my deceased fathers van, he took very good care of it. First of all, In June I took it in to get the safety done on, Ford said that it would be about 1,100.00 just for the basic safety. Then they said that it would be about 2,200 roughly to do the other work, I told them that is fine at this time money was not an issue. So they replaced the one side for ball joint and cv link. But never replaced the other side. It is known that once you replace one side the other is not far behind. I told the Ford dealer to fix anything that will not last 3 months or so. They said no problem. About a month later I got a letter from Ford stating that the tort converter was a recall. I got that done after they done that the transmission oil was leaking. I took it back and they said they fixed the leak, it still has the leak. Again I take it back and now they are saying that I have to pay for the tranny to be pulled out. Why should have to pay for it, when they had the tranny out of it last week and couldn’t find the problem. I am not paying for this I am not rich never will be and I think the dealers take advantage of women and men to make money.

This has really turned out to be a horrible experience for me and my family! When it first happened me, my wife, & our 2 daughters were on a very busy freeway cruising at around 65 mph in the fast lane, trying to pass a semi, when we lost all power without any kind of warning. Needless to say it was one of the scariest things we have ever been through in our lives. Luckily everyone around me was paying attention, and no one got hurt.

  • Tom May 5, 2012, 11:06 am

The same thing just happened to my wife today on the Long Island expressway at exit 43 area. She was passing a car in the passing lane doing 60 and suddenly lost power, she was lucky she was able to get over the 3 required lanes to safety. Now from what I have read Ford is trying to blow this off and it is real safety hazzard that must be addressed. I recived a letter a few months ago about the recall and that parts were not available till june in the meantime I have to pay for a tow and listen to the Ford dealer squealing like a pig saying ” well it may not be the recall problem and something else”. Well, my symptoms are the same as I have seen complained about everywhere on the web and reported in the recall letter. This means I MAY BE WITHOUT A CAR FOR THE NEXT 4 WEEKS?? This is unacceptable, I paid good money for that van NEW and Ford must do the right thing. We the taxpayers bailed them out and they did not deserve it. They give us a flawed transmission design ?? , as well as all the other problems I am seeing on the web with this model.

    • paul rosing August 16, 2014, 12:07 am

tom, ford did not get or asked for taxpayers money, only gm and chrysler got it. get your facts straght about who got bailed out. also they will give you a loner at no charge

My Mercury Monterey just stopped running as I drove down the street in September of 2010. I called the Mercury dealer I purchased my can from and they insisted there was nothing wrong, that they had no information about any similar problem. I had it towed to a independent Transmission repair shop that had a very good following and it cost me just under $2400. THe people at this shop had already done several Ford and Mercury’s with the same problem.
I have recently received a letter from the Ford Motor Co about the RECALL and have to wait until I get a second letter before I can take my car in to have the reapair check out to see if it was done correctly. Then they will decide if Iwill get a reimbursement for the repairs.

I have a 2005 Ford Freestar that, within a week of receiving a notice about a recall for the transmission issues, did exactly what the recall notice said it would do. My local Ford dealership wouldn’t even look at the transmission without me authorizing them to charge up to $800, which I wouldn’t do because I am a single parent and currently out of work. I asked them to please look at the transmission, and if it was in fact the issue described in the recall, please fix it at no charge to me as the recall said. I told them if it was not the same issue, then please do nothing as I can’t afford to fix the vehicle at this time.

They refused, saying because they weren’t sure Ford would cover the cost to tear it apart, and I wouldn’t authorize payment, their hands were tied.

I called Ford Customer Care. HA! They’re also sorry they can’t help me.

So, here I sit. Four months later. No job to fix my car (which is on a recall for the problem it’s having) and no car to find a job. It’s just sitting out there in my yard…dead.

How’s that fair and just?? I bought my Freestar. Paid it off. Thought, if nothing else, at least I had a decent vehicle to use, free and clear. Nope…Ford screwed me there.

I’ve repaired minor issues, but this one is just out of my price range…and seeing as it’s a known issue, I think Ford should fix it…at their cost…period. Even if there is other damage in the transmission, it probably all stems from their DEFECTIVE parts! My vehicle has under 70,000 miles on it. This is just completely unfair and morally, if not legally, wrong.

I will never, ever, ever buy a Ford again.

I have a 2004 Mercury Monterey, my son sat in the rear seat and it dropped and part of the something was rubbing on the rear drivers wheel. I took it into my mechanic and he said that the rear seat bracket has rusted so bad that it is coming through the floor. He said this is a safety issue and should NEVER happen. He wanted me to check to see if anyone else has had this issue. Seems to think that Ford Mercury would want to get this car off the road. Said that at the rate that rust grows I would only get to drive this car an other year or so. I can no longer put anyone in the third row of seats.

I bought a 2004 Freestar new having not learned my lesson with a Lemon of a Windstar. The thing that always attracted me to Ford was the layout and room as well as price compared to the imports. Thank God I also purchased an extended warranty. 2 AC compressors, a power steering pump and 4 electric power window motors it paid for itself. Right before the warranty ran out the transmission went haywire. I brought it in anf they “rebuilt” . I picked up and noticed a cluncking when it shifted.
By then the warranty was out but in my mind the repair was done when still covered. When i brought the van back they informed me the clunking was due to BAD MOTOR MOUNTS ! Motor mounts that size just don’t go bad in two weeks, DON’T YOU THINK STEVIE WONDER WOULD OF NOTICED THE MOUNTS WERE BAD WHEN THE TRANNY WAS TAKEN OUT TO BE REBUILT? On top of that they said the tranny was covered under Ford’s drive train warranty, not the extended.
It would be 850 to replace. I said no way and drove for 2 more years and just replaced. Now the ABS lite went on and it shifts funny. To my delight I got the recall notice in March of 2012 and PARTS ARE STILL NOT AVAILABLE ! Ford’s solution was to always want me to trade in but i did not want to strap myself with another payment. I WANT PART OF A CLASS ACTION SUIT! AFTER WAY I WENT THROUGH WITH THE WINDSTAR I’M DUE !!!!

  • kelly July 6, 2012, 11:51 am

I was at a busy intersection just yesterday and while I was pressing the break, it tried accelerating on it’s own! I slammed the break down harder as to not release it and hit the person in front of me:( The light turned green so I slowly released the break and then it wouldn’t even get past 20mph and the safe engine message came on. I was scared…

  • Christie Thomas July 14, 2012, 10:35 pm

I would like to be included in a class action lawsuit against Ford because my 2005 Ford Freestar has suffered complete transmission failure at 133,000+ miles. I have almost been hit five times in a busy intersection because of sudden loss of power. We paid over $800 a little over a month ago to repair cam shaft and sensors because it wasn’t part of the recall but the same problem kept occurring. I was notified by my dealer today that the repair would be at my expense and that they could not say if the failure is due to the recalled part. The recalled parts are still not available. We can not afford to repair or trade but we will have to do something because I need my van for work. Ford needs to be held accountable for this faulty vehicle. Too many people are having the same problems for this to be a coincidence. My NHTSA complaint numbers are 10465607 & 10465679. Ford needs to step up to the plate and help the consumers out since we helped them out!!

  • Bob July 18, 2012, 12:02 pm

I have a 2004 Ford Explorer that is in need of a new transmission after 70,000 miles. It had trouble going into reverse from the first day that I bought it with 18,000 miles on it. It would hesitate and then jump into gear. Now there are broken gears and pieces of the clutch in the transmission fluid. It’s going to cost me $2000.00 to have it rebuilt and was told that this is a common problem for Ford transmissions. I want to echo Tracy’s info about calling Ford at 1/800/392-3673 to add your vehicle to the list. They told me this is the only way anything will get done. Have your vin ready.

  • Brooke July 19, 2012, 8:40 pm

I, too, experienced the lack of throttle with my 2004 Monterey, on the freeway after having accelerated to squeeze between two semis in February, 2012. The local tv news commented on the recall in January. Lucky for me it was into the slow lane and I was able to run the skirt to the end of an offramp. Towed to a AAA recommended repair shop. They diagnosed “the internal transmission clutches are burned out”. I asked if it had anything to do with the recall. Well, we don’t tear the transmission down to discover HOW it happened, only that it happened. Please authorize $3200. The replacement part came from the local dealer’s parts inventory AND, of course, included a new torque converter. That’s apparently standard practice. The engine warning light wouldn’t turn off using the codes. The van was taken to the dealership for diagnosis. THAT transmission was replaced!!!~ with some comment about the torque converter malfunctioning (!) and it being an integral part. I got my first letter on 3/31/12 telling me that parts wouldn’t be available until 2nd quarter and to take my invoice t the Ford dealer. I now know that the Ford money has to go through the dealer. Ford has DENIED my claim!! a) Because they won’t pay for the transmission repair (not part of the recall/implied that the government accepted the torque control ONLY replacement); b) Too many miles (119K) to be covered under any kind of warranty; c) Disclaim ANY correlation between the transmission failure and the malfunction of the torque converter; and d) transmission failure is common (what???) in a car with 120K miles. They won’t even pay a part of the repair because “the transmission failed”, albeit in an unusual way by the complaint. The replacement came with a 100,000 mile warranty! What? A remanufactured part has a better warranty than the car’s new one of 36,000? I liked it better when, in looking under the hood, you found Nissan parts, stem to stern, in the Mercury minivans! Where do I sign on?

  • ShaMika July 21, 2012, 6:42 pm

I just had my 2005 Ford Freestar serviced by the Ford dealership within the past week. It had a recall on it for the torque converter which is part of the transmission. They “fixed” it at no cost to me, because I had spoken with the Ford Motor Company and my VIN was on the recall list. We picked it up this morning and literally within hours we were having the same problems as before. At least this time it’s giving us warning that the vehicle is about to stop accerating. Last time there was no warning and thank God I was in a right turning lane where cars could go around me when my van lost acceleration power. I spoke with the operator at my local Ford dealership and explained the problem. She told me to bring my vehicle in on Monday (Today is Saturday and everything shuts down early, so the service department was closed). I told her I don’t think my vehicle will make it there and she said they have a shuttle. She told me to call early Monday morning to see if the service could make arrangements to get my vehicle there. Last Friday I had to pay $75 to have it towed to their dealership and I’m not doing it again when they didn’t do their job. I can’t wait to see what they have in mind when I talk to them Monday.

  • Randy Johnson July 27, 2012, 1:09 pm

Asked two Ford dealers to do recall repair on father’s 2004 Freestar after he received the recall letter – first said parts not available yet and will call when ready, as letter stated parts expected by end of second quarter; second dealer said same thing after 1700+ mile trip over mountains fully loaded Kentucky to Utah. July 2nd car would not move by itself exactly as reason for recall stated in letter. Towed it to dealer, waited weeks for torque converter and other parts to arrive, they installed converter and said other transmission problems existed, did I want to pay $2,000+ dollars for those repairs including wear on torque converter stator shaft caused by faulty torque converter but not covered by recall. That didnot look serious enough to cause immediate problems so I told them to assemble it and when they called me to return the rental and come get it, Idid. I walked from the rental place over to pick it up and was told they had driven it from garage to parking lot out back. When I started it up, tried to put it in gear it still would not move at all. It is still there unfixed. Is this the company that my tax dollars bailed out of bankruptcy now supposedly making a profit and apparently gaining a deserved reputation for needing to be dissolved and never bailed out again. My advice is never buy Ford and tell your friends to do the same. For this kind of business practice to be allowed is not clear thinking. Toyota builds vehicles in Kentucky using American workers and turns out products with a much better reputation. Ford’s list of lemons is growing all the time and people are getting killed because of them. Almost half a million vehicles recalled just recently. If you don’t believe me, google it and find out.

  • Johnna Kaylor July 31, 2012, 8:03 pm

I just got a loan on a 2004 Mercury van with 83 thousnad miles on it and thought boy I did good, yeah right. Has been in shope because 1st thing my alarm would go off every night so that had to be fixed. Then I get the recall notice so that has been replaced, driving home from the shop didn’t even get home and it quite running on me 3 times……..I guess I am now paying for a van that I can not drive and can not find out what is wrong with it now. I have owned Fords ever since I learned to drive but I will NOT have another one. I am so unhappy with the dealership I got the van from because they didn’t even tell me there was a recall on it and that would of been my first clue not to buy it to begin with. I am like every one else live pay check to pay check and I think this whole deal with Ford is WRONG!

  • Johnna Kaylor July 31, 2012, 8:15 pm

Please add me to the lsit. I have a 2004 Mercury Moneray and have had nothing but problems with it since I got it 5 months ago. It only had 83 thousand miles on it when I got it and it has been in the shop 3 times. Just had the torque converter replaced and coming home from shop it quit on my 4 times! Please do some thing about this. Just wrong of Ford……..

  • Earlene Bray August 2, 2012, 2:57 am

I have an 04 Monterey that I bought new. Dec. 2011 I began having problems with car lurching when going uphill. It had just had the fuel system cleaned and I was told that it might stop after a while . It didn’t. In January I heard about the torque converter recall. I called the dealership repair shop and was told that would not make it do that.It got worse and I took it in. I was told it needed a coil pack. Got that done and it did not stop. After I got my recall letter I took it in and they replaced the torque converter. Still didn’t stop. Took it back in and they changed the transmission fluid.(should have done that I think when they replaced the converter.) I paid $159 to get it done.Still jumps into drive.I am a 73 yr old widow on a fixed income. I think Ford should have been required to replace affected transmissions as well as torque converters.I am going to be stranded without a car. Am afraid of getting caught on the road like others. But what can I do?

  • John Stegall August 8, 2012, 5:38 pm

Daughter has same problem with trans thank goodness it happened when she was near home. The freestar had been took in prior to trans failure for the the recall to have A.C. Repaired which should have been recalled for also for defective pressure line. That was 2000.00. Daughter was told that there were no parts avaliable for the recal repair on transmission and she would be called when parts were avaliable. This was in December the transmission went out in July. Taken to dealership no parts and they allowed her to keep driving it. Sondroppedoff last week to get fixed but recall parts didn’t fix problem and now they say it will cost 1800.00 to 2000.00 to replace transmission. When there defect is the cause of the transmission failure. They should also be charges filed against them for negligent for allowing my daughter to leave the dealership with a dangerous vehicle which she carries my granddaughters around. Now she has no dependable vechicle because they don’t do loaner cars for repairs anymore. I bet if it was their family members they would be pissed off to. Would do I do now.

  • Ken Maurer August 8, 2012, 6:38 pm

I have a 2005 taurus se wagon that just quit monday at 49,117 miles. No warning lights, shuddering. or slipping. Runs fine, won’t move. Pretty certain it’s the torque converter from what I’ve read. I’m gonna call the # posted here to add my complaint but will not expect much from a company completely devoid of integrity such as ford.

I live in the adirondack park in new york state and years ago people up here got their message across to Rockefeller by burning his place to the f’n ground. Really got me thinking….

  • Randy Gosdin August 28, 2012, 1:15 pm

We bought our 2004 Freestar new from the Ford dealer. In June of 2009 it began jerking at highway speeds as if the torque converter was dis-engaging and engaging. The OBD2 was giving 2 torque converter codes. The Ford dealer said the light had to be on for them to check it so we took it next time it acted up and they said the transmission and toque converter needed to be replaced. We paid around $2700 to have the work done. Now Aug 2012, when I called Ford they said the only option was to have the current torque converter replaced OR be refunded up to $1450 for a torque converter replacement already performed. My receipt only shows transmission reaplacement. Since Ford admits the part may be defective the least they should do is refund previous related charges AND replace current torque converter at no charge. What good would it do to take a partial refund and then have to replace a defective torque converter? Sounds like a win win for Ford….what about the customers!!

  • Gerald Iverson September 2, 2012, 12:55 am

Ford is ripping people off. They should be standing behind the cosumer.30,000 dollars for a 2005 ford freestar that already has had the transmission replaced once. Then asking for money to replace a rear seal on this recall. We should be reimbursed for all the trouble this has caused. SAD .Very stressful

  • Jolene Anderson September 3, 2012, 3:00 pm

I have had nothing but problems with my 2004 Freestar. Then 3 nights ago, while driving home, my van started pouring black smoke from under the hood. I immediately pulled over and got out. I then saw flames under the front of the van. I moved away and dialed 911. Within seconds my van was completely engulfed in flames. This was just 2weeks after getting my letter saying the recalled parts were available. Ford needs to step up to the plate and stop hiding behind their phones and desks. COWARDS.

  • Wanda September 5, 2012, 10:36 pm

Can you include the 2005 Ford Explorer in this too?? Mine’s sitting in the shop with a $3031.41 bill waiting for me to bail it out. I remember when Chevy had some adds with vehicles having over 200,000 miles. I don’t think we’ll get there.

Chevy is looking really good. I never had to replace transmission on a Chevy.

  • Kristie September 7, 2012, 8:32 am

Purchased 2004 Ford Freestar new. BEWARE!!! 3RD ROW SEAT LATCH, it is attached to the rear wheel wells and are rusting through. The driver’s side of our van, has completely rusted through (which, we obviously did not know). We disovered this when we had 2 kids (total weight of both kids about 225lbs, not much) in the 3rd row seat, going right off of a highway ramp. The weight of the the kids and the seat, pushed the rusted wheel well out and was rubbing the tire…. heard a horrible noise. Thank goodness it did NOT cut the tire… we all could have been in serious danger. Complaints are being filed with http://www.nhtsa.gov. This vehicle needs to be recalled, before someone has a van full of people in it,doesn’t realize this and a tire gets cut, causing a possible horrific accident. CHECK YOUR VAN!!! So now we have a 4 passenger vehicle. We have to keep the 3rd row seat down.

  • Tom B September 7, 2012, 6:10 pm

The 2006 and 2007 models are having the same problem, but are not being included in the recall. Does another suit need to be filed to get the to fix the problem. I know if I have to take this to court to get re-imbursed for the smae failure on my 2006. I will be referencing this article, and Edmunds on line article “Ford said it met with NHTSA personnel on November 9, 2011 “to further discuss the investigation, the complaint rate and the lack of real-world data to support any conclusion that this subject presented an unreasonable safety risk.” The automaker said it approved a recall in early January “to avoid a protracted dispute with the agency.”” and UNITED STATES of America, Plaintiff, v. FORD MOTOR COMPANY, Defendant. Civ. A. No. 76-29. in which the judge determined that the lose of vision from a design defect in the windshield wiper assembly posed an unreasonable risk with respect to the SAFETY ACT.

  • Kristie September 10, 2012, 9:52 pm

Adding to my post (2 above), we as well, had the transmission go out already, just before our warranty expired. Got a re-built one put in, it was the only choice we had. That was a nightmare!! And now after reading this, I know that I will be driving and it feels like, just for a second, that the van has lost all power. It’s like it just “stops running”. That whole repair ended up costing us a lot of money. Even though, it was under warranty. The back door handle broke, we had to pay to get that fixed. The sun visors have been broken, on their own. There’s more, I just can’t remember it all, But my husband has every single document on that van. I am not stopping. My next call is to the Attourney General.

  • Jason Paddock September 27, 2012, 5:59 pm

I would like to know how to get to be part of this claim? We have a 2005 Freestar and I need to know what is going on with this.

THEY TELL ME THEY HAVE NO CONTROL OVER DEALERS TOOK BACK TO DEALER IT’S MY PROBLEM .I KEEP CALLING NEVER CALL ME BACK. PLEASE LET ME KNOW HOW TO GET TO BE PART OF THE LAWSUITE.

  • Janice Buckner October 20, 2012, 8:53 am

We were coming around a curve leaving one highway and entering another and we lost all power in our 2004 Freestar. No warning, just no more power. Very scary being on the highway at night when the van suddenly no longer works.

  • Amy Rainey November 17, 2012, 11:44 pm

Had an appt. with Ford dealership to replace my torque converter on my 2005 freestar this coming up Monday. Needless to say, It was towed there today instead. I was driving with 2 of my children today, and had a sudden loss of power. Thank God everyone was safe. I called the Ford dealership to let them know the van was being towed there and explained what happened. The employee that I spoke with at the Ford dealership proceeded t tell me that The torque converter would not cause this and has nothing to do with my transmission. She actually said the transmission is in the front and the torque converter is in the back. Then she said or vice versa. I have a feeling I am in trouble. This is not a good sign that Ford is going to help me. If their own employee doesn’t have any idea that the torque converter has anything to do with the transmission, this spells trouble.

  • edna adrion December 22, 2012, 10:17 am

New transmission already now converter replaced having trouble with transmission sliPping when
Start up in low range. Dealer says water in the engine again, another 3000 dollars.ouch

  • Lisa Donovan February 13, 2013, 7:20 am

I need help also. I had my torque converter replaced last summer since it was recalled. Now my transmission is shot. The Ford dealer tells me the torque converter has nothing to do with the transmission. Really?! I see everyone is having similar problems. What is the recourse?

  • John Hensley June 30, 2013, 2:18 pm

I have a 2005 Monteray and these problems. Now I am being stuck with a $2000 bill for the replacement of the intake manafold. When I took it to Ford tom have it analized for emissions failure. They knew right away what the problem was. They had done so many that the parts were back ordered fo months. Does any one know if there is a recall for this problem. The Van had 70,000 miles and the baffle bearings in the manifold are all worn out. Any helpful coments?

  • Marsha Leffew July 9, 2013, 1:08 pm

My 2004 Monterey van lost power on interstate in 2010 . We had it towed and work done for around 1400$ then in March 2013 broke down while traveling , had to be towed to a dealership . They said parts were under warranty and it took a week to fix. Now in June it’s acting up again!!! The transaxle light comes on and it doesn’t want to go in reverse or it jumps when shifting out of first. I took it to be checked but of course it didn’t happen to the mechanic, he said it seemed fine. Now my son just drove it about 1 1/2 hrs away and the light is on again! I’m supposed to go on vacation and I’m scared it will break down on me w my kids and ill be stuck on side if road again! Someone help please !

I believe that everyone who has been told by ford that you now need another transmission because of “Internal Transmission Failure ” should consider joining together and filing a class action lawsuit against ford. I work for a attorney and have spoken with him about doing just this, the minimum number of Plaintiff’s in a class action is 10 but the more Plaintiff’s the better. A class action takes time and most times settle out before reaching the courtroom. We have another attorney in Houston who has a larger firm and likes to handle cases like this . I am the not so happy owner of a 2005 Ford Freestar, like others I have made complaints to Ford Corp offices and get the “save your receipts and if we recall we will reimburse you the cost” I call it the sorry bout your bad luck speech. If you are truly serious about filing a class action then email me – leglsearch@yahoo.com.

Taurus and Sable models should have been included in this class action lawsuit. There are numerous reports of tourque converter failures that can be found on the internet of the splines stripping out, causing the engine to be not coupled to the transmission. I bought a 2005 Taurus used with 45,000 miles on it. At 75,000 miles, the tourque converter failed without any warning. I had it fixed, and now at 110,000 miles, the transmission failed again-can only start in D1 with trans slipping. At about 20MPH, can shift to normal drive gear, and car will work OK until speed drops below 20mph. This is the worst peice of junk I have ever owned! Gas guage, and fuel pump also failed. Ergonomically the car is poorly designed, as to open the hood or trunk from inside, you have to open the door, and put your leg outside to access the release controls. I am considering cutting my losses short, and just junking this car. This car reminds me of some of the junk made by GM in the 1970’s that were known for transmission problems. Ford does not stand behind their products. They have lost my business forever. Perhaps it is time to look at imports.

I received a recall notice for my 05 freestar’s torque converter in the mail and quickly made an appointment at local Ford dealer to have it replaced.
After about a week in their shop I was told that work was performed and I could pick it up. After picking up the vehicle I was experiencing a loud clunk when shifting from park to drive or reverse. Upon taking it to my much trusted independent machanic, I was informed that I had two worn or completely failed motor mounts. Granted the vehicle had 237,000 miles and any kind of frailer is not surprising. What was surprising is that the Ford Dealer’s “senior machanics” failed to bring this to my attention. This started to make me wonder if the recall work was really performed at all. And upon closer forensic inspection it appeared that no separation had occurred between the motor and transmission which in my opinion indicates that indeed this work was not perform. My machanic confirmed my suspicion and said there is no way they dropped this motor and transmission which is required in order to install a new converter. When I ask the service manager if this was possible. He got very indignant and basically ran me out of his office. ( literally almost physically)! I can only guess what is really happening here, but it appears that the dealer blows off the required work, sends Ford Motor Company any torque converter core, and then charges the parent company plenty! I don’t like or trust almost any car Dealer’s Service Centers and will always be grateful to my honest and trusted independent machanic. My advise is to find one of your own so you’ll never be ripped off by Dealers again!

I am having the same problem with my 2005 Mercury Monterey. Could someone tell me the outcome of the class action lawsuit. Car loses power when trying accelerate and then misfires, can cause accident when trying to pass someone or cross overs. Took to mechanic 3 times that can not diognoses it.

the will accelarate with no warning and jerks when the weather is hot, while having my foot on brake really hard the kept going, I had a accident I hit a wall really hard because of this and the air bag did not work. How many people have to die. Is the government protecting Ford. They should be charge with murder regarding this problem. Where is our protection,or where is our government bail out.

I have a 05 mercury Monterey and today while trying to drive it would not go just sat there. Then finally got it to move. While going home it would not stop, and the power steering was acting up. After googling the problem it seems to be the torc converter of course it says mine is not part of e recall. Is it all 04 and 05 montereys?

I gave up on my van when in Dec 2012 it burned in the highway? Cause? No body will say but all started with transmission issues: I lost $40,000 in van purchase only with out all the repairs… worst investment in my entire life.

Last night while driving in terrible road conditions in Cleveland Ohio at 55 mph my car just quit running. How dangerous is that? My van was a 2004 Freestar SES and somehow was not involved in the recall but its totally apparent this is exactly the same problem as the ones that were recalled. If there had been a car behind me I might be dead now and no one would know that the problem was the vehicles transmission. Stalling at 55 mph. CRAZY this car is unsafe and Im reading that you can spend the money and have a rebuilt tranny put in but will have the same issue down the road. Has anyone been successful in getting Ford to pay for this repair?

My 2004 Mercury Monterey 76k miles, stalled while driving on 65 mph the freeway in the pouring rain. It almost caused an accident and is a very dangerous issue. The van started back up but im scared to death this will happen again under worse circumstance.

Just bought a 2005 Taurus… nice clean car… auction, great price… only 102,000. looks like new… Second day, drove just over 100 miles… and the transmission crapped… probably the converter… had to have it towed home… $160 ;o( now it’s already down for at least a week… Ford needs to be sued.
