General Mills & Yoplait YoPlus Yogurt Class Action Lawsuit

U.S. Court of Appeals For The Eleventh Circuit Affirms Trial Court’s Grant of Class Certification in General Mills & Yoplait YoPlus Yogurt False Advertising Class Action Lawsuit.

A class action lawsuit against General Mills pending in the United States District Court for the Southern District of Florida (styled Fitzpatrick v. General Mills, Inc.) alleging false advertising regarding the YoPlus digestive health yogurt manufactured and sold by General Mills and Yoplait USA, can proceed as a class action lawsuit, according to a General Mills & Yoplait YoPlus Yogurt class action lawsuit news report.

The General Mills & Yoplait YoPlus Yogurt class action lawsuit complaint reportedly alleges that General Mills advertised, purportedly without scientific support, that YoPlus yogurt provided digestive health benefits because it contained probiotic bacteria and fiber.

I am very disturbed by this lawsuit. We eat alot of natural foods. My family and I read all labels. Frankly I went straight to the ingredients and realized just how great this product is and that it didn’t contain anything that was harmful to you such as aspartame which is found in all yogurts. The next best choice would be the Chobani Greek yogurt but I dislike the texture. My feeling is that finally someone has come out with something with kosher gelatin probiotics yogurt and since it’s probably the best yogurt out there that someone else had to find some flaw in it. Its ok to make yogurt with aspartame which is a leading cause if cancer but not ok to ok to say this yogurt is actually good for you! Unbelievable!!! I’m fact the lawsuit should be against diet sodas and aspartame containing products it’s killing the people of our country!!

I learned i had been exposeddisease about 18 months ago, and have spent hundreds on this product, because of the pro biotics claimes made by them.

I’ve been eating this yogurt since it came out but can’t find it anymore. Where is it?? I want it back!! No other tastes as good.

    • Ellen August 5, 2012, 6:05 pm

General Mills has changed the name to Yoplait Fiber One 50. It comes in a 4 pack of 4oz cups. (u can use the kid’s yogurt coupons) general mills won’t tell you that. I’ve found it in 5 flavors: vanilla, blueberry, peach, strawberry & key lime our.
It now only has 50 calories!

  • Anna April 8, 2011, 10:32 am

I did try it for long . Couse as I was eating one day I felt something hard ,I though maybe a part of a pit of the fruit. So I swolled it the third time I though will what kind am I eating that it has pits ? Blueberrys so spit it out the pit it was a pease of metal ,so I called the company they told me to send it to them . After two weeks they a sent me a letter saying sorry and coupons. I never bought it again . So I don’t how healthy it was or if it work.

    • This is just stupid July 30, 2011, 6:42 am

You probably got the berry pit. So don’t buy that flavor anymore.

This lawsuit is absurd. Yoplus is far, far better than Activia. Activia does nothing and does not taste as good. I guess the didn’t like the competition.
I am at a loss without my Yoplus. What a sad country we have become.

  • Jamie July 7, 2011, 8:12 pm

This sort of thing really infuriates me! People find the most ridiculous things to sue over. If it didn’t have health and digestive benefits for you – stop eating it!! Some of us truly enjoyed the product and now a handful of whiners have ruined it for the rest of us. I have been eating YoPlus for over a year and have found that is really does work and it tastes great. I would eat one a day and the benefits were better than anything else I’ve tried. I’ve recommended it to several friends and they love it and were hooked on it too. Now they are disappointed since they can’t get it either. Activia does NOT work and tastes mediocre at best – I’ve know because it is what I have had to resort to since YoPlus is no longer available. I will not waste anymore money on Activia since it is not effective. Please drop this suit and bring YoPlus back!!

    • Cheryl August 15, 2012, 4:39 pm

I totally agree w/you! Activia doesn’t help at all. I loved YoPlus, it worked for me and I want it back!!!! It worked better than any
      Greek yogurt I’ve tried.

    • Fat2Fit2Foxy August 28, 2012, 10:02 am

I TOTALLY agree with you ladies!! I tried the Activia “because of the commercial” and it was a waste of money and time (forcing myself to eat it). One of my students brought me the strawberry kind and told me to try it because her mom eat it and it had helped her lose weight (so you know I’m all for that, lol). I ate both of them and enjoyed the taste as well as the results that it brought about (if you know what I mean). Therefore, I started buying the 4 pkg. and then 2 – 4pkgs at a time. And all of a sudden they disappeared. First from Foodlion and now Walmart. I loved that yogurt. I ate it daily and loved the taste.
      PLEASE BRING IT BACK!!!!!!!

  • myriam rebolledo July 18, 2011, 1:16 pm

    -YOPLUS REALLY WORKS-
    ITS TEXTURES IS PERFECT
ITS MUCH BETTER TASTING THAN ACTIVIA
    PLEASE BRING IT BACK

    • Madison August 11, 2012, 12:03 am

      YESSS AGREED. BRING IT BACK!!!

  • julie July 27, 2011, 10:26 am

This is ridiculous and the attorneys should be ashamed of themselves. Probiotics and fiber ARE beneficial for the digestive tract. If the product contains them then it is up to the consumer to read the content label and decide if the quantity is sufficient. If not then buy another brand.

  • This is just stupid July 30, 2011, 6:39 am

I have been buying this product for some time because it is the ONLY product that helps my IBS. The benefits contribute to my daily quality of life. Because of this stupid lawsuit, I am now in pain every single day because I am no longer able to find it in any stores. If it’s an advertising issue, change the packaging and keep the product going. Because of the benefits of this product, I could care less if it cost more…. it’s worth its weight in gold.

  • curtis August 8, 2011, 3:01 pm

BRING IT BACK !!!.. ITS THE HEALTHIEST, BEST TASTING YOGART ON THE MARKET. I’VE BEEN WAITING FOR IT TO RETURN. JUST BRING IT BACK.

    PLEZZZZZZZE !!!!!!!

  • okccal August 11, 2011, 9:36 am

Another episode of “Attorneys Gone Wild”. I’m amazed that the best tasting, best texture, yogurt on the market has disappeared because of maniacal greed. My understanding is that all yogurt has probiotics, and YoPlus was smart enough to add some fiber, which the vast majority of yogurt brands do not contain. Both of those are good for you, so advertising the facts, you would think, would be a good thing. And, as Alida said, it doesn’t contain artificial sweeteners. The class of this “class action lawsuit” is extremely questionable. It’s very sad.

  • Barbara Statler August 14, 2011, 11:28 pm

I just found out why I can’t find Yoplait/Yoplus any more and I’m furious == it’s the only yogert my 97 year old mother will eat — it has the best texture and flavor out there and this lawsuit is ridiculous!

  • Chris Eisch August 17, 2011, 1:28 pm

Too bad we live in a sue happy society. Not everything works for everyone – you have to find the product that is right for you. Yo Plus is the ONLY yogurt I can eat and it DOES help the digestive tract. Bring it back under a different name if you have to, but bring it back. This world is getting more disgusting every day.

  • diane August 22, 2011, 10:40 pm

I’ve been looking everywhere for yo plus yogurt and cannot find it! I have emailed the company and they assure me it’s not been discontinued and to use their “product locator”…which doesn’t help.
Love this yogurt and so frustrated it’s no longer in the stores!!!!
    :0(

  • Donna Graveline August 27, 2011, 8:02 am

I am very frustrated as well that I can no longer find this product. It had become my families favorite and we would go through an average of four to five 4-packs a week. Nothing tastes as good or has the same great texture and health benefits without aspartame. I am currently buying Raindows Roundy’s pro-biotics brand which is the closest this I could find. I originally blamed Rainbow for pulling off their selves to sell their like product and they assured me they just have not received it all of a sudden. I call G.M. and was told to use the product locator, but all that did was list all the stores that used to carry it, which are now not. I know! Please bring it back, we are missing it terribly. I could care less about all your new dessert flavors, just please work on bringing this back. I have a lot of upset friends to that I got switched over to this product. I will continue to buy Rainbow’s Roundys pro-biotics until I can get Yo-plus and I recommend it to all that are missing Yo-plus. It is a little runnier, but simular.

  • Jozie September 23, 2011, 12:34 am

NOW I KNOW WHY I CAN’T FIND IT IN THE STORES!!!
It really IS the only thing that works. And, NO, Activia DOES NOT WORK.

BRING IT BACK!!BRING IT BACK!!BRING IT BACK!!

  • Jozie September 23, 2011, 12:36 am

I refuse to buy Activia…its all over the shelves and I just leave it there. There is one other one I HAVE to buy now, but I miss my Yo-Plus.

    Bring it Back!!

  • Kay Gregory-Clark September 30, 2011, 11:39 am

Finally, I learn why I can’t find my Yo-Plus any more and I’m devastated. I have switched grocery stores 3 times, the last over 60 miles from my home, because the others quit carrying it, and finally no longer even there. I have an extreme digestive problem and Yo-Plus was the ONLY remedy I’d found in the last 5 years or so. I treated it like medicine, eating it every single day, because it helped so much. When I could no longer find it, I was beside myself. I tried Activia, with no results whatsoever. Plus, once I got the kind with Aspartame by mistake and had to throw out an 8 or 12-pack. I’d recommended Yo-Plus to several others, who also loved it. PLEASE PLEASE PLEASE!! Bring it back.

  • Rachel October 1, 2011, 3:07 pm

I am so sad to read this. I have been wondering why I have such trouble finding this yogurt. Activia is not as good, so fortunately there is a store in my town that keeps stocking it. My mother in law from out of state stocks up when she visits. I miss the peach flavor the most, can’t find it anywhere. I can’t believe this lawsuit! Where can people who think this is a bunch of baloney sign up to support General Mills?

  • Monica December 8, 2011, 4:58 pm

it took me this long to find out why i could not find this product in any store!!…very upset at the fact that “somebody” could not just “not purchase” this product if it didn’t work for them. It worked for me, like no other medicine prescribed by doctors would work for my digestive problems!!…i miss it terribly and my family too!!…i really hope that this product comes back to the store shelve otherwise, i, like many others will be an unhappy customer!!

  • Brad January 22, 2012, 2:45 pm

I am so sad right that my favorite healthy snack is no longer available due to some BS lawsuit. It is only yogurt which does taste good (most don’t) and is good for you. It won’t kill you or make you skinny without proper diet and exercise. I’m sure some dumbass fat person eating fast food every day and sitting on their big ass is behind this BS lawsuit… Stupid ass people! Please bring this product back!

  • Sandra January 29, 2012, 9:16 am

Our country has become such a mess and the attorneys and courts are not helping. I find it hard to believe that there’s no data to suppport the digestive benefits of this product. Does Activia not advertise the same thing? My family loves YoPlus and have since it came out….I have tried Activia and YoPlus is by far the best I can/could find. I have not been able to find YoPlus for a couple of weeks and my system is totally messed up..I did try Activia again, I just do not like the taste, texture and it does not regulate me like YoPlus! PLEASE, BRING IT BACK, TELL ME WHERE I CAN FIND IT!

  • Amy January 31, 2012, 9:14 am

I, too, love this yogurt and cannot find it at any of the grocery stores where I used to purchase it. The last one, which is quite large and has a huge yogurt section, said they were revamping that section and getting a lot of new products and just didn’t have room for it anymore. They implied it wasn’t a good seller. I didn’t know about the lawsuit until I went looking for another store that might carry it and found this website. I don’t understand why the grocery stores have to take it off the shelf b/c of the lawsuit. Isn’t this GM’s fight? GM, if you’re reading this, I’m with all the writers above . . . please bring it back in some form or another.

  • Lindsey February 3, 2012, 5:47 am

I have been wondering why I can’t find it in stores! Initially I bought this yoghurt because I liked the taste of it. I noticed it helped soften my bowel movements (constipation due to arthritis meds). So for me, it definitely works. The tall, Activia pots advertised by Jamie Lee Curtis do NOT work for me- they taste nice though! These products are trial & error: what may suit you may not help the next consumer, like medicine.

  • Angela February 3, 2012, 9:49 am

I am very disappointed that I can not find YoPlus in the stores! I love this yogurt! Please bring it back!!

  • mayrah February 6, 2012, 9:08 pm

I have been buying this product for its digestive benefits has no aspartame which i am allergic to and also has the least ww points. luckily is been only about 2 weeks that i have not been ablee to find it the publix by me was carrying but only in the strawberry flavor these past 2 months. i stii have some in my refrigerator. shame on lawsuits and attorneys. sadly a great product going down the drain.

  • Audrey February 17, 2012, 12:30 pm

This is my favorite yogurt, and far superior to Activia. It got to where I could only find it at my local Publix, but they carried my fav flavors (LOVED the blueberry acai!) so I would make a point to go there just for the YoPlus. Last time however they had completely redone the yogurt section and my YoPlus had disappeared, while the Activia area seemed to have doubled in size 🙁 I REALLY dislike Activia, that’s why I started eating YoPlus in the first place! The girl who was working in that section mumbled something about it not selling well, but I suspect this is a case of Activia simply forcing out the competition rather than actual supply/demand issues. Not sure what other alternatives there are, I don’t really care for the taste/texture of the greek yogurts I’ve tried, and they’re more expensive. Going to stop by an H.G. Hills today that’s near my grandmother’s house, I used to be able to find it there when I lived out here, but I have a feeling I’m going to be disappointed…

  • Steve Marchionda February 17, 2012, 8:28 pm

At the suggestion of my MD, I had been using Yoplait Yoplus for some time as a part of a treatment regimine for Myalgic Encephalomyelitis (Chronic Fatigue Syndrome). Eating Yoplus daily in conjunction with D-Ribose has allowed me to function far better on a daily basis (not perfect but way better than before). Once I could not purchase it any more, I tried about every other probiotic out there but none have been able to duplicate Yoplus results. For me this isn’t about taste or personal preference, it’s about a probiotic that actually helps me live with a disease that has no cure. PLEASE find a way to bring the product back.

  • Steve Marchionda February 17, 2012, 9:01 pm

As I read the posts to this story, I realized that almost all of them were focused on what a great product Yoplus was and how the posters want the product back. So I wrote to the CEO of General Mills and told him about this post. I urge you all to do the same. Can’t hurt. Here is the mailing address for the CEO.

  • Agnes Nickless February 20, 2012, 12:01 pm

I have been to every store in the area and could not find my blackberry/pomegranate. I hate all the other yogurts, wish I had know this was gong to happen because I would have bought them out. It is the only yogurt I like and I have tried hundreds. Please change the label and bring it back.

  • TRACIE February 21, 2012, 11:43 am

My husband and I discovered the YoPlus after several attemps at eating yogert a couple of years ago. Strawberry was our favorite..but after we were unable to find it we switched to the vanilla. All other yogerts were just plain “blah” in our opinion… we did not like their taste or the artificial sweetners used. the greek yogerts were too sour tasting – the YoPlus had a great taste and texture. I tried many stores searching for it over the past two weeks (typically purchased about 4-5 (4pk) at a time… so was quite disappointed not to find it in my local store without any signs of it not being offered any longer. To find this website – and realize some lawsuit causes a product line to be discontinued is disheartening. I hope they bring it back… rename it – just don’t change the formula…. it the best tasting yogert… Activia is the pits as well as all others. will have to find another source for my dairy and probiotic.

  • Ashley February 25, 2012, 10:17 pm

Just noticed i can no longer find yoplus so i googled and found the reason to be this lawsuit. It is just ridiculous. This is the best tasting yogurt out there and they better get it back. I swear everytime i find something i really love they quit making it!!! But this one just sucks bc activia is nasty and it is the only other option. UGH will not buy it, just hoping yoplus comes back!!!

  • Pat February 29, 2012, 9:06 am

I found this article while searching for reason Yoplus is not in my grocery store. I have been eating Yoplus every day for over a year with excellent results. Please get it back in stores.

  • Ellen February 29, 2012, 3:59 pm

    Guys & Gals –

I found it. This has to be it. Since General Mills owns Yoplait I think they’ve renamed it Fiber One 50. It comes packaged just like YoPlus did 4 – 4oz cups. My store had 5 flavor – vanilla, blueberry, strawberry, peach & key lime pie. It has the Yoplait logo on the package. Enjoy!

    • Fat2Fit2Foxy August 28, 2012, 10:39 am

Yes, but now that has disappeared from the shelves. Because that’s what I was buying on a regular. It disappeared from Foodlion and I was buying it from Walmart. Well one day I went into Walmart and there was ONLY 1 4 pkg left (1 of the 4 cups had burst somehow) so i left it. When I went back the next day and days after, the section was empty that’s when I started asking questions. I NEED THIS PRODUCT BACK NOW!

  • Pam March 2, 2012, 9:06 pm

I just finished a carton of Activia and was reminded why I prefer Yo Plus… YoPlus is SO much better! I can’t find it any more, so I broke down and bought Activia. Sorry I did and won’t again. Yo Plus works very well for digestion, but I can’t compare to Activia, because who wants to eat that every day? Please, please bring Yo Plus back!!

  • Julie Hopkins March 10, 2012, 11:25 am

I love Yo-Plus yogurt and miss it too! I went to several different stores trying to find it and then discovered by searching the internet that it had been pulled from the shelves. I hope you bring it back. I have tried other brands and they are not as good.

  • AMANDA JONES March 22, 2012, 4:59 pm

I love yo plus yogurt. It is the only yogurt in the world that helps my IBS and other stomach problems. Activia does not taste good and it does not help. I have been sick ever since I could not get my yo plus. Please bring yo plus back.

  • AMANDA JONES March 22, 2012, 6:23 pm

You can still get yo plus at Ingles in West Jefferson NC but that is too far from where I live to drive often. If they can sell it there, they can sell it at other stores too. They need to drop the foolish lawsuit and put it back in stores so that the people it helped can buy it again. The silly people that have a problem with it don’t have to buy it. People like that who want to sue over every little thing cause problems for the rest of us that have sense. BRING BACK YO PLUS AND IGNORE THE IDIOTS!!!

  • Stephanie May 4, 2012, 9:35 am

Thanks to this lawsuit (I assume) I can no longer find this amazing yogurt at my local market. As consumers, we have a duty to take responsibility for our own actions and choices. If you chose to purchase this product, it is your responsibility to read the label and not rely on advertisements that are intended to sell a product. Further, when using this product regularly, I noticed significant digestive benefits. Probiotics and fiber are both extremely good for the entire digestive process. This fact is widely know. If added to a product it is safe, in my opinion, to conclude that if eaten regularly your digestive health could benefit. It obviously will not help everyone as every body is different and will consequently react differently to the same products. I experienced first hand that this product did provide digestive benefits. Just because they did not do a scientific study to prove this does not mean it is not true. Also, it is my opinion that the already existing information regarding the benefits of probiotics and fiber to the digestive system would be enough to provide support for these advertising claims. I hope this is soon resolved so that I can again find this product.

  • Rob May 5, 2012, 9:29 pm

I love YoPlus. It tastes great and I lost weight while eating it on the 17 day diet. I can’t find it lately. I WANT IT BACK!

  • Mary Jane Johnson July 25, 2012, 9:04 pm

Yoplus works the best of anything I have ever used for my IBS including prescription drugs. If that isn’t improving colon health I don’t know what is. Drop the advertising; bring back the product with any flavor. Can you sell it under any other name? If you do please let me know.

  • Lenore August 2, 2012, 9:51 am

Ok, I’m a little late finding out why there is no Yo-Plus on the shelves. Very sad. It truly was the BEST. Someone said bring it back under another name. I agree.

  • Madison August 11, 2012, 12:01 am

This was my favorite yogurt 🙁 ridiculous.

  • Nikki August 11, 2012, 4:18 pm

My son, who suffers from digestive issues, LOVED this yogurt and preferred it to Fiber One 50 (they are NOT the same product as someone else stated) and it helped him with his disgestive issues. So disappointed this was taken off the market. 🙁

  • Carrie August 12, 2012, 8:33 pm

I am so upset that I can’t find my favorite yogurt anymore!!! Yo-plus was the BEST tasting yogurt out there and I loved that it had fiber. And, by the way, the Yoplait Fiber One yogurt is NOT the same. How very frustrating!

  • M.Watkins August 18, 2012, 2:22 pm

I am one of the people who have eaten YoPlus since it became available. I love it and think it truly helps my digestive system. I have tried Activia and I don’t like the consistency or taste as well as YoPLus.I seem to get gas from it also. So, where is the suit against Dannon for their claim that it helps the digestive system? Please bring back YoPLus even if you must stop making claims about it’s effectiveness!

  • becca August 21, 2012, 5:00 pm

My son has digestive issues and to keep him off of miralax, the Yo-plus has has worked MUCH better than the activia. Maybe different things work better for different people, but I am so sad that I cannot buy this anywhere, it was the only thing that helped his little tummy stay regular.

I learned the following information in Consumer Reports: “To help you identify yogurt that contains live and active cultures, the National Yogurt Association developed the Live & Active Cultures seal. Look for it on the yogurt products you buy to make sure you’re getting the most from your yogurt.”
Yo-Plus was the only yogurt that carried this seal. I was buying three four-packs at a time and eating it every day. It did wonders for my digestive problems.
I was greatly concerned when I couldn’t find Yo-Plus at any of my markets. Today I learned of this ridiculous lawsuit. I could find no other yogurt, including Activa, that carried the NYA seal and I was left with no other alternative yogurt.
Yo-Plus was the best tasting yogurt, it carried the NYA seal, and it worked for me. I’m going to look for the Yoplait Fiber One 50 mentioned in a previous comment. I hope I can find it, that it tastes as good, and works as well for me as Yo-Plus did. If it doesn’t, maybe one day Yo-Plus can be back on the market.

I was sick in 2010 and told I had IBS. Yoplus was the only thing that did not make me sick and really helped me get better. Plus it tasted better and my daughter loved it. Please bring it back!

  • dan November 27, 2012, 11:38 am

This was the only yogurt that i found to like.
I feel that it is horrible that this is why the product went away

  • Cathy January 9, 2013, 2:56 pm

Well thanks USA!! Here I am in Australia desperate to find the only yoghurt that I like ie Yoplait Yoplus Natural Low Fat Yoghurt but it has disappeared off the supermarket shelves, so I emailed my supermarket and they said it was a deleted line. This morning I was so annoyed I emailed Yoplait direct asking where I can buy this product and await their response. I then googled the product and found this site which tells the story. I am really just so annoyed that this suit denies people like us the opportunity to eat our favourite yoghurt (the others don’t come close). Why can’t they just make the yoghurt and leave off the information which is causing the problem? Boo hoo, I am grieving for Yoplus!

  • Chantel March 30, 2013, 3:31 am

I am not a yogurt eater and Fiber One was the only yogurt I have ever been able to eat. It helped me lose 15 pounds and now it’s gone 🙁

    Please bring it back!!!!

Shame on people who sue for some ridiculous reason and hurt the rest of us that really like the product.

  • Linda Furuya July 9, 2013, 10:00 am

I am very disturbed about the lawsuit and the disappearance of Yoplus Yogart. I looked everywhere for it because I had enjoyed it each morning for at least 2 years and it certainly seem to help my digestion. I just need to know when it will return.
