Weichert South Jersey Inc., Class Action Docket No. BUR-L-736-11) filed on behalf of all persons or entities who sold residential real estate in New Jersey between February 25, 2005 and April 1, 2011, who in connection with that sale were charged an Administrative Fee by Weichert, sometimes known as Weichert Realtors, which Fee they paid or had paid on their behalf, where the sale involved “a federally related mortgage loan” as set forth under the Real Estate Settlement Procedures Act (“RESPA”) (hereafter the “Class”), according to the Weichert South Jersey d/b/a Weichert Realtors Real Estate Settlement Procedures Act RESPA class action lawsuit settlement notice.
Under the proposed Weichert South Jersey d/b/a Weichert Realtors Real Estate Settlement Procedures Act RESPA class action lawsuit settlement, Weichert has reportedly agreed to create a Common Fund of $525,000 that will be used among other things to reimburse the part of Administrative Fees it collected from Class members who file valid claims. Class members who submit a valid claim form and documentation showing that they paid Weichert an Administrative Fee between February 25, 2005 and April 1, 2011 will reportedly be entitled to recover up to one-third of the Administrative Fee.
