Visa Prepaid Debit Card Call Recording Class Action Lawsuit Settlement

If you called any Visa Affected Phone Line prior to October 1, 2010 and spoke to a live person, and at the time of the call resided in or were located in California, Florida, Maryland, Nevada, New Hampshire, or Washington, your rights may be affected by a proposed class action lawsuit settlement.

A class action settlement has been reached in a class action lawsuit against Visa Inc. (“Visa” or “Defendant”) pending in the U.S. District Court for the Central District of California before the Honorable Dolly M. Gee, U.S. District Court Judge (styled Marenco vs. Visa Inc., Class Action Case No. CV10-8022 DMG (VBK)) alleging, among other things, that persons who called certain customer service telephone numbers and spoke to a customer service representative had their telephone conversations recorded without notice to or the consent of all parties, allegedly in violation of certain statutes in California, Florida, Maryland, New Hampshire, Nevada, and Washington, according to the Visa Prepaid Debit Card call recording class action lawsuit settlement notice.

Visa Prepaid Debit Card Call Recording lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:

Under the proposed Visa Prepaid Debit Card call recording lawsuit settlement agreement, Visa will pay total consideration in the sum of Eighteen Million Dollars ($18,000,000) which shall be placed into an interest bearing escrow account following preliminary approval of the Settlement (the “Gross Settlement Amount”).

The Court will hold a hearing on November 28, 2011 at 9:30 A.M. at 312 N. Spring Street, Los Angeles, California 90012 to determine whether the Visa Prepaid Debit Card Call Recording Settlement should be finally approved as fair, reasonable, and adequate.

    Please tell us what this is all about. We have no idea who marenco is all about. How can one remember all the calls we have made, and what were charged to our visa account,all of were paid as scheduled. Is this a scam to get personal info on my accounts????
    We would like to know why this letter was sent to us. Please reply.

    I receive a letter too. Im warry about it. Im not sure if is a scam or not. And is hard to remember like other people said. I want more info.

    I have no idea when we called and we no longer have the card. How are we suppose to remember what numbers we called I no longer work for the people who issued me the card. Please be more clear on how we know that this is not a scam. People should be very leery. I never give out my personal information just because someone sends me a letter on something that happened over a year ago…..

    i recieved one of these in the mail. i think it is real, i wouldnt be too certain about these cards. last summer i had a fraud charge on there from some hobby store located in Texas, and i live in Maryland. nobody could trace this hobby store back to any specific location, just that it was in Texas. again, i think this is real, i never remember being told my convos were being recorded when i would call customer service.

    You expect people to willingly give out their social sec number and phone number? Where is a legitimate phone number to call???How do you prove you talked to one of these phone numbers listed? What visa Card???? Where is the account number on the letter? Who is the Garden city Group??? What a bunch of crap. People DO NOT BE FOOLED BY SCAM ARTISTS!! HA!! NOW YOU HAVE MY EMAIL ADDRESS. I don’t believe any of this. At least I can put you in my phishing email deleted box since you now have my email address. This is too vague and strange. Hope more people do NOT agree to this.

    A scam? What do you mean? It’s a class action lawsuit settlement claim form. Read the notice. Or go to the website provided above and read the complaint and other documents.

    The lawsuit is real. I just went and viewed it using PACER. I also used RECAP for you folks so you don’t have to sign up for a PACER account yourself and pay for the document/search. If you have any doubts, just call one of the attorneys for the class.

    As for those people asking ‘what is this about’, why don’t you just try reading the notice? It’s against the law to record phone conversations in certain states without the consent of all parties involved. Visa or someone working for Visa allegedly recorded conversations in violation of these laws. Someone by the name of Francisco Marenco initiated a class action lawsuit against them. The notice is the proposed settlement offer. If you are a member of the class, you could possibly receive up to $1,000 or up to $5,000 if you live in CA. It’s all there in black and white. While it’s always a good idea to be a little paranoid when it comes to giving out your information, it’s also a bit ridiculous to jump to conclusions that everything is a scam, when this particular matter can be easily researched and verified by anyone with just a modicum of intelligence.

    I got the letter in the mail, Faxed it back and have been following it. I live in Cali and the case was finally settled and checks were processed to every one on Jan 23 I got $1432.35 after attorny fees and other fees.. I am Happy i did follow through on it and I reall needed the money.

    Subject to the Court’s approval, the terms of the Settlement are as follows:

    A. Total Payment to the Class. Visa will pay total consideration in the sum of Eighteen Million Dollars ($18,000,000) which shall be placed into an interest bearing escrow account following preliminary approval of the Settlement (the “Gross Settlement Amount”).

    B. Enhancement Fees, Attorneys’ Fees and Litigation Costs. From the Gross Settlement Amount, Class Representatives and Class Counsel will ask the Court to award a maximum of Eighteen Thousand Dollars ($18,000) to the Class Representative as compensation for being the Plaintiff in the Action and in settlement of his claims (“Enhancement Payment”) and to award attorneys’ fees for Class Counsel in an amount not to exceed Four Million Five Hundred Thousand Dollars ($4,500,000) plus expenses incurred by Class Counsel. These awards will be subject to Court approval.

    In addition, all expenses incurred in administering the terms of the Settlement Agreement, such as providing notice to the Class of the pendency of the Settlement, the acceptance of claims on behalf of the Class and the payment of Settlement funds, as well as all other aspects of the claims administration process, shall be paid for from the Gross Settlement Amount.

    C. Distribution of Net Settlement Amount to Class. The remainder of the Gross Settlement Amount following the payments described in paragraph B above (the “Net Settlement Amount”) will be divided among those who file a timely claim and prove to the Settlement Administrator that they are in the Class. Callers from California will receive five times the amount that callers from Florida, Maryland, New Hampshire, Nevada, or Washington will receive, but with that exception everyone who shows that he or she is in the Class will receive the same amount, up to a maximum for California callers of $5,000 and a maximum for callers from the other five states of $1,000. The Settlement Administrator’s decision about whether a person is in the Class, and what state he or she resided in or called from, will be binding, final, and non-appealable.

    Any unclaimed or undistributed funds will be given to charities proposed by the Parties and approved by the Court.

    5. When is the Final Approval Hearing?

    The Court held a hearing on November 28, 2011 and granted the motion for final approval of the Settlement. The Court also granted Class Counsel’s motion for attorneys’ fees, litigation expenses, and Class Representative’s Enhancement Payment.     Curious about this? Here is how it worked for our family. Several years ago while living in CA, we gave our four children a prepaid visa card purchased through our credit union. Apparently two of them called the number on the back of the card to check their balance. The other two spent their card entirely, so never needed to call. The two that called were sent paperwork about this class action suit. I researched as best I could and found it to be legitimate. Yesterday, both kids (20 and 16) received a check for $1,485.00. They are required to pay taxes on it, but hey, both could use it.

    I recieved a check and went to the bank but before i made the deposit i asked if it was a real.check the manager wasnt sure so ibwent to another tht was on the check and they told me it was real.So i went to my bank to deposit in my account hours later i get a call.from the manager saying the check may be a scam and now the check is on hold cuz apparantly they have recieved a few so now i have to wait to see what happens Has anyone else recieved a check and cashed it yet ?

    I went to a Chase bank and was told it was not eligible for cashing, but that it was a good check. So I deposited into my account (not a Chase account) and the check is on hold. My bank has put a hold on all the checks that are like mine, until the funds come through. It looks suspicious that within a matter of days more the 15 people are trying to cash same kind of check. The bank said they spoke with Chase and they said some checks are going to be legitimate and others will not be. The only way to know is to negotiate the checks. I guess there are some “fakes” going around that look like legit checks but are not??
