A class action settlement has been reached in a class action lawsuit against Cellco Partnership d/b/a Verizon Wireless pending in the United States District Court for the Northern District of California, San Francisco Division (styled Khalilpour v. Cellco Partnership d/b/a Verizon Wireless, Class Action Case No. C 09-02712 RS.), alleging, among other things, that Verizon Wireless did not adequately disclose that a subscriber could not transfer Unlimited Get It Now games downloaded onto one handset to a subsequent handset free of charge, according to the Verizon Wireless Unlimited Get It Now Game class action settlement notice.
The Court has decided that everyone who fits this description is a Verizon Wireless Unlimited Get It Now Game Class Member:
Those California residents who purchased Unlimited Get It Now game(s) on a handset and subsequently purchased one or more new handsets that were activated on the same mobile telephone line between January 1, 2004 and the date of the court’s preliminary approval of this Settlement.
Eligible class members who submit valid, complete, and timely claim forms can receive a minimum payment of $15 and a maximum payment of up to the full amounts paid for Unlimited Get it Now games.
The Court will hold a Settlement Hearing at 1:30 p.m. on November 1, 2012, at the United States District Court for the Northern District of California, San Francisco Division, Courtroom 3 (17th Floor), located at 450 Golden Gate Avenue, San Francisco, California, 94102 to consider whether the Verizon Wireless Unlimited Get It Now Game settlement is fair, reasonable, and adequate.
