If you were charged an Overdraft Fee by a UMB Bank from April 5, 2005 through August 31, 2010 you could get a payment from a class action settlement.
A class action settlement has been reached in a class action lawsuit against UMB Bank, N.A., UMB Financial Corporation, UMB Bank Colorado, N.A., UMB Bank Arizona, N.A., and UMB National Bank of America (collectively “UMB Bank” or “Defendants”) in the the Circuit Court of Jackson County, Missouri (styled Allen and Lande v. UMB Bank, N.A., et al., Civil Class Action Case No. 1016-CV34791) alleging, among other things, that UMB bank didn’t process transactions in the order that they were made and that, as a result, the number of Overdraft Fees (which includes overdraft fees, insufficient fund fees, returned item fees, continuous negative balance fees and other similar fees) charged to certain accounts increased due to overdrafts (i.e., when the amount of money to be paid from an account exceeds the amount of money available in the account), according to the UMB Bank Overdraft Fee class action lawsuit settlement notice.
The UMB Bank Overdraft Fee Class reportedly includes everyone who had a personal deposit account with UMB and was charged more than one Overdraft Fee on a single day as a result of the order that transactions were processed in their account from April 5, 2005 through August 31, 2010.
The UMB Bank Overdraft Fee class action settlement reportedly provides that a $7,828,683 settlement fund will be created by UMB to be used to make payments to Class Members, as well as cover their attorneys’ fees, costs and expenses.
The Court will reportedly hold a Fairness Hearing at 1:30 p.m. on Monday, October 31, 2011, at the Circuit Court of Jackson County, Missouri, 415 East 12th Street, Kansas City, Missouri, 64106-2706 at which time the Court may consider whether the UMB Bank Overdraft Fee settlement is fair, reasonable, and adequate.
