Toyota Electronic Throttle Control System (“ETCS”) & Sudden Acceleration Economic Loss Class Action Settlement – In Re Toyota Motor Corp. Unintended Acceleration Marketing Sales Practices and Products Liability Litigation

If at any time prior to December 28, 2012 you owned, purchased, leased and/or insured the residual value as a Residual Value Insurer of certain Toyota, Lexus or Scion vehicles equipped or installed with an electronic throttle control system (ETCS) distributed for sale or lease in the United States or its territories or possessions, You May Be Entitled to a Payment from The Toyota Sudden Acceleration Economic Loss Class Action Settlement.

A class action settlement has been reached in a class action lawsuit against Toyota Motor Corporation and Toyota Motor Sales, U.S.A., Inc. (“Toyota” or “Defendants”) in the United States District Court for the Central District of California (styled In Re Toyota Motor Corp. Unintended Acceleration Marketing Sales Practices and Products Liability Litigation, Class Action Case No. 8:10ML2151 JVS (FMOx), alleging, among other things, that certain Toyota, Lexus and Scion vehicles manufactured by Toyota equipped with electronic throttle control systems (“ETCS”) are defective and may experience acceleration that is unintended by the driver, purportedly in violation of state consumer protection statutes and in breach of warranties and unjust enrichment, according to the Toyota Electronic Throttle Control System ETCS & Unintended Acceleration Economic Loss Class Action Settlement website Notice.

Who Is Included As A Settlement Class Member In The Toyota Unintended Acceleration Economic Loss Class Action Settlement:

The Toyota Economic Loss Settlement Class reportedly includes all persons, entities or organizations who, at any time as of or before December 28, 2012, own or owned, purchase(d), lease(d) and/or insure(d) the residual value, as a Residual Value Insurer, of all Toyota, Lexus and Scion Subject Vehicles equipped or installed with an Electronic Throttle Control System (“ETCS”) distributed for sale or lease in any of the fifty States, the District of Columbia, Puerto Rico and all other United States territories and/or possessions.

The Toyota Sudden Acceleration Class reportedly does not include: (a) Toyota, their officers, directors and employees; their affiliates and affiliates’ officers, directors and employees; their distributors and distributors’ officers, directors and employees; and Toyota Dealers and Toyota Dealers’ officers and directors; (b) Plaintiffs’ Class Counsel, Allocation Counsel and their employees; (c) judicial officers and their immediate family members and associated court staff assigned to this case, and all persons within the third degree of relationship to any such persons; and (d) persons or entities who or which timely and properly exclude themselves from the Class.

What Settlement Benefits Does The Toyota Unintended Acceleration Economic Loss Class Action Lawsuit Settlement Provide:

Under the Toyota Electronic Throttle Control System ETCS & Sudden Acceleration Economic Loss class action settlement (a) Toyota will pay $250 million into a settlement fund for distribution to Class Members to provide money payments to certain former owners or lessors and residual value insurers (b) Toyota will at no cost provide a brake override system installation to certain vehicles currently owned or leased by class members that will automatically reduce engine power when the brake pedal and the accelerator pedal are applied simultaneously under certain driving conditions, (c) Toyota will make certain money payments to current owners and lessees in lieu of the brake override system installation (up to a maximum of $125); (d) Toyota will implement a Customer Support Program that will last for ten (10) years after the expiration of any existing warranty (up to a maximum of 150,000 miles, but for at least three years) for each of the covered parts, i.e., engine control module; cruise control switch; accelerator pedal assembly; stop lamp switch; and throttle body assembly, which progam will provide prospective coverage for repairs and adjustments to correct defects in materials or workmanship in parts associated with the vehicle’s operation if such parts fail, break, or malfunction; and (e) Toyota will pay $30 million to fund auto safety research and education.

    really you don’t want my comments because the losers here and like in most CLASSACTION suits is the consumer and Toyota the winners or GREEDY LAYWERS, is there a discloser how much they receive ? , there is always going to be something inferior in every part of our lives , we don’t live in a perfect world , But we do live in a GREED full society, just guess the top two greediest.

    I Have a 1990 Toyota Celica and this happened to me one morning on the way to work. I was terrified!!!! And all the Toyota Dealer said was for $89.00 we can take a look at it!! Of course I said NO, not paying you to look at a problem that’s your fault!!! I had to pay to get it fixed. I didn’t die on my way to work that day, luckily ..
    What about the rest of us Toyota Owners who this happened too????

    I had four accident with my RX350 I ran into my own garage door 2 times. backing out of doctor parking lot. my car suddenly went full throttle . I was out in front of a truck coming around the parking lot. I was hit by truck on right side of my car. I was not able to get my car under control. before the truck hit my car. It was a shocking time for me. And the driver of the truck kept on going. I was in shock for some time. my car was new. And while backing from grocery store parking lot. I back into a pole in parking lot. My insurance company raised my rates. I became afraid to drive my car. It was a beautiful car with 18 inches tires and chrome wheels and beautiful red with gold flakes. I love my car.And tried everything I knew to have it fixed. The last things I was setting at parking light that was red. a truck hit me from behind. I got a back injury. I sold the car after it was fixed back to lexus/ Carol Joy Ramage

    August 2008, My FJ Accelerated over the curb and into a tree while I was parking at work one morning, 5k damage to the FJ which was easily repaired, The dealer repaired the body, bumper and lights but stated he could not find any reason the truck would have accelerated. Took me months to determine I broke a titanium screw in my back from a prior spinal fusion surgery, xrays weeks earlier showed no breaks before accident, had another spinal surgery to repair broken fusion and screws, unable to work since with 180mg of morphine, 30 mg vicodin in my system daily for the never ending pain, have since lost everything, 65k a year job, Our House, Land where we were building a new home, 401k and savings depleted, Sold the FJ, (2/3 of what I paid 1.5 years earlier) The Jeep, the boats, the motorcycles went too to sustain us. 35 years of hard work and savings obliterated between Bush, the Bankers and Toyota….while the government drags out my disability claim out for 2 years , we close this class action lawsuit without any admittance of guilt, or mechanical fault , or prior knowledge that may have avoided this accident, you admit to bad marketing practices that lowered the resale value of our cars and trucks, Thanks TOYOTA

    I have a 2002 Lexus RX 300 and it appears that only model years 2004 – 2010 addressed in the lawsuit. Is that 100% correct? The only problem I have had is when my car is in Cruise Control.

    I have a Lexus GS 400 model year 2000 ,I was out of state and my ETCS light came on my car start to act as if it had a mind of it’s own. It was very hard to control then my ABS light came on and I almost had a accident.
    I hit a big pot hole both lights was still on the car made it home.I took the car to shop had to replace brakes,then abs sensor ,alingment…this have cause me thousands of dollars.I have had problems with this before the

    I almost got hit 3 times in my 2004 Tacoma. My problem was no acceleration after breaking. Would rev like in neutral. Cars behind me would almost hit me after turning because I wasn’t going anywhere. Every time I brought it in they couldn’t find anything! After a year I threatened a lawyer and what a surprise…they found a bulletin. Now I have clunking in my transmission between 30-40 mpg and again, well, we hear it but can’t fix it. It’s just something in the computer! Really??

    I have a 2007 Toyota Tuundra and i go around curves my truck starts to jerk and accerlerate on its own it scares me. I am afraid to drive my truck and when i do my truck feels like it wants to drive on its own

    I havr a 2006 Toyota Sienna it accelates when I put my breaks on and when going down hill it seams like the tack omepter speads up . I got this card in the mail and sure hope I can get something done about it soon.

    what should be the case is all cars having safety concerns should be replaced or the money refunded. Personally, I have a toyota yaris and I truely regret ever purchasing the car. I dont want to elaberate on all the problems with the vehicle, but it seems the only thing it is good for is saving on gas.

    The windows control switch is a problem and several other………………..

    My Toyota Highlander 2004 when pulling into a parking space at a veterinary hospital went into full power unintended acceleration when I applied the brake. This caused the car to go through the building wall. fortunately no one was seriously heart. My wife and I had minor injuries and a fellow in the building was cut by flying glass. After reporting this to Toyota they sent an inspector to check the car and found no problems , of course. I rid of this death trap and will never own another Toyota. Not because they do not make good cars, but because of the callous way they treat there customers when there is a problem. A class action lawsuit is a money maker for the lawyers and lets Toyota get off the hook for cheep. The people having this problem. get next to nothing for almost being killed what a sad joke.

    August 5 2014 Scion xB 2008 2.4L engine with automatic and no floor mats
    Backed out of the parking space put the Scion in D and the car launched forward for approx 2 seconds without my foot on the gas pedal then returned to normal. Unfortunately I took out a 6″x6″x8′ pole before stopping and tore the right quarter panel off. I’m convinced. There is a problem with the design.
    The throttle was extremely sensitive before and I adjusted my driving to accommodate.
    Life is too short for this foolishness, no more Toyotas for me!
