A class action settlement has been reached in a class action lawsuit pending against Streetglow, Inc. in the District Court of Johnson County, Kansas, Civil Court Department (styled Fun Services of Kansas City, Inc. v. Streetglow, Inc., Case No. 09 CV 02674) alleging that Streetglow violated
the federal Telephone Consumer Protection Act (“TCPA”) by faxing unsolicited advertisements, according to the Streetglow TCPA Unsolicited Fax Advertisement Class Action Settlement Notice.
The Streetglow TCPA junk fax class action settlement reportedly provides, among other things, that if the settlement is finally approved by the court, Streetglow’s insurer will, without waiving any arguments about coverage, create a settlement fund of $5,000,000.
Each member of the Settlement Class who timely submits a valid claim form will receive a payment from the settlement fund of up to $500 for each fax Streetglow sent to the Settlement Class member (as reflected in a database compiled by Plaintiff’s attorneys) with a maximum of $1,500.
A final fairness hearing is scheduled to be held on June 3, 2010, at 11:30 a. m., in Division 4 in the Johnson County Courthouse, 100 N. Kansas, Olathe, KS 66061 to determine, inter alia, whether the proposed class action settlement should be finally approved.
