Public Employees Credit Union (“PECU”) has reportedly agreed to a settlement of a data privacy class action lawsuit filed against it in the United States District Court for the Western District of Texas, Austin Division styled as, Scott Boyd v. Public Employees Credit Union, Case No. 1:22-cv-00825-LY, arising out of the alleged unauthorized access to PECU’s systems and certain files containing sensitive information about PECU’s current and former customers including, but not limited to names, addresses, email addresses, telephone numbers, dates of birth, financial account information (e.g., account numbers, credit, and or debit cards), social security numbers, and other types of personally identifiable information or PII, which was discovered by PECU on or about April 26, 2022 (the “Data Incident”).
PECU reportedly disagrees with Plaintiff’s claims and denies any wrongdoing.
Who Is Included In The Public Employees Credit Union (PECU) Class Action Settlement?
The Public Employees Credit Union PECU class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All persons who were sent written notification by Public Employees Credit Union (“PECU”) that their PII was potentially compromised as a result of the unauthorized access to PECU’s network that PECU discovered on or about April 26, 2022 (the “Data Incident”).”
What Settlement Benefits Does The Public Employees Credit Union (PECU) Class Action Lawsuit Settlement Provide?
Under the Public Employees Credit Union lawsuit settlement, PECU has reportedly agreed to provide the following settlement benefits to settlement class members: (1) up to $500 for documented out-of-pocket expenses, (2) reimbursement for up to three hours of lost time spent dealing with the Data Incident ($20 per hour), and (3) reimbursement for extraordinary losses up to $2,500 for documented expenses. PECU has also agreed to provide various security related improvements.
In addition, Settlement Class Members who previously enrolled in the credit monitoring product offered by PECU will reportedly have that term automatically extended for one (1) year, while Settlement Class Members who did not previously enroll for credit monitoring will have the ability to claim one (1) year of credit monitoring by the same service previously offered by PECU.
According to the Public Employees Credit Union settlement notice, PECU settlement class members must file a Claim Form to get any money and, for those Settlement Class Members who did not previously enroll in the credit monitoring services offered by PECU from the proposed Settlement, to get credit monitoring services. PECU settlement claim forms can be submitted online or via mail. The Public Employees Credit Union PECU settlement claims filing deadline is May 4, 2023
