A class action settlement has been reached in a class action lawsuit against Prudential Real Estate Affiliates, Inc. (“Prudential Real Estate Affiliates”) and Prudential Fox & Roach Realtors (“Prudential Fox & Roach Realtors”) (collectively “Prudential” or “Defendants”) pending in the Superior Court of New Jersey (styled Blasini v. Prudential Real Estate Affiliates Inc. et al., Case No. BUR-L-989-11) alleging, among other things, that Prudential Fox & Roach Realtors charged an Administrative Fee to persons and entities who purchased residential real estate in New Jersey between March 16, 2005 and December 31, 2009, where the purchase involved “a federally related mortgage loan” as set forth under the Real Estate Settlement Procedures Act (“RESPA”) where no separate services were allegedly provided for the Administrative Fee, according to the Prudential Real Estate Affiliates and Prudential Fox & Roach Realtors Administrative Fee class action lawsuit settlement notice.
If between February 25, 2005 to December 31, 2009, you paid an “Administrative Fee” to PFR related to your purchase of residential property in New Jersey, you may be a Prudential Real Estate Affiliates and Prudential Fox & Roach Realtors Administrative Fee Class member.
Under the proposed class action settlement, Prudential Fox & Roach Realtors has agreed to create a Common Fund of $270,000 that will be used among other things to reimburse the part of Administrative Fees it collected from Class members who file valid claims. Under the proposed settlement, Class members who submit a valid claim form and documentation showing that they paid Prudential Fox & Roach Realtors an Administrative Fee between March 16, 2005 and December 31, 2009 will be entitled to recover the amount of one-third of the Administrative Fee or a lesser pro rata amount.
