If you purchased a conventional grade Pennzoil oil change advertised by Pep Boys at a specific price subject to a disclaimer that “shop supply fees may apply,” and for which a mail-in rebate was offered (an “Advertised Oil Change”) any time between October 27, 2004 and July 21, 2010, your rights may be affected by a class action settlement.
A class action settlement has been reached in a class action lawsuit pending against The Pep Boys – Manny, Moe & Jack (“The Pep Boys” or “Pep Boys” or “Defendant) in the United States District Court for the District of New Jersey (styled Raymond Lozinak v. The Pep Boys – Manny, Moe & Jack, Civil Action Case No. 09 cv 05481) alleging, among other things, that Pep Boys knowingly misrepresented the price of certain advertised oil changes by indicating that shop supply fees “may” apply when they always apply, according to the Pep Boys Pennzoil oil change advertising class action settlement notice.
Pep Boys Pennzoil Oil Change Advertising Class Action Lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:
All persons who, between October 27, 2004 and July 21, 2010, purchased a conventional grade Pennzoil oil change from Pep Boys for which Pep Boys advertised or marketed a specific price for the oil change subject to the disclaimer that a “shop supply fee may apply,” and for which a mail-in rebate was offered (an “Advertised Oil Change”).
The Pep Boys Pennzoil oil change class action settlement reportedly provides that Pep Boys will change its advertising relating to shop supply fees applicable to Advertised Oil Changes. In addition, Rebate Subclass Members who timely submit a valid claim will also be able to receive cash refunds for shop supply fees paid in connection with the purchase of an Advertised Oil Change, up to $2.10 per Advertised Oil Change purchased.
The Court is scheduled to hold a settlement Fairness Hearing before the Honorable Michael A. Shipp at 11:30 a.m. on November 16, 2010 in Courtroom 2C of the United States District Court for the District of New Jersey, Martin Luther King, Jr. Federal Building and Courthouse, 50 Walnut Street, Newark, New Jersey to consider, among other things, whether the settlement is fair, reasonable and adequate.
