Pay Day Loan & Title Loan Class Action Lawsuit Settlement

If you are a South Carolina citizen who entered into a Deferred Presentment Services Transaction or “payday loan,” as defined in the South Carolina Deferred Presentment Services Act, in South Carolina with certain Payday Loan Companies from August 27, 2004 through December 31, 2009, your rights may be affected by a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against Advance America, Cash Advance Centers of South Carolina, Inc., Advance America, Cash Advance Centers, Inc., Carolina Payday Loans, Inc., Southern Fast Loans of South Carolina, Inc. d/b/a Quick Cash, Check Into Cash of South Carolina, Inc., Check ’N Go of South Carolina, Inc., Southern Specialty Finance, Inc., QC Holdings Cos., QC Financial Services, Inc., Local Cash Advance of SC, LLC, Local Cash Advance of South Carolina III, LLC, Local Cash Advance of South Carolina II, LLC, Local Cash Advance of SC IV, LLC, Express Check Advance of South Carolina, LLC, Check Advance, Inc., and Crusader Cash Advance of South Carolina, LLC d/b/a Crusader Cash Advance (collectively, “Defendants”) in the Court of Common Pleas, County of Richland, South Carolina (styled In Re: Pay Day Lending And Title Loan Litigation, Civil Action Case No. 2007-CP-40-07710), seeking compensatory damages and other relief stemming from Defendants’ alleged practices relating to Deferred Presentment Services Transactions, referred to as “payday loans,” in South Carolina under the South Carolina Deferred Presentment Services Act, according to the Payday Lending and Title Loan Litigation class action settlement notice.

The Payday Loan class action lawsuit settlement class reportedly includes the following persons, unless otherwise excluded:

All South Carolina citizens who entered into a Deferred Presentment Services Transaction or “payday loan,” as defined in the South Carolina Deferred Presentment Services Act, in South Carolina with any of the Defendants from August 27, 2004 through December 31, 2009.

  • Check ’N Go of South Carolina, Inc.
  • Southern Specialty Finance, Inc.
  • QC Holdings Cos.
  • QC Financial Services, Inc.
  • Local Cash Advance of SC, LLC
  • Local Cash Advance of South Carolina III, LLC
  • Local Cash Advance of South Carolina II, LLC
  • Local Cash Advance of SC IV, LLC
  • Express Check Advance of South Carolina, LLC
  • Check Advance, Inc.
  • Crusader Cash Advance of South Carolina, LLC d/b/a Crusader Cash Advance

The Payday Loan class action settlement benefits reportedly may include full or partial Debt Forgiveness (meaning that the Defendant providing Debt Forgiveness will not seek to collect any amounts due and owing it by the Class Member and also will not continue to report those amounts as outstanding to any consumer credit reporting agencies) for Delinquent Debt, certain extended payment plans (allowing certain class members to repay their Delinquent Debt in four equal payments, each due at a time corresponding to the Class Member’s regular pay periods) or certain monetary relief.

The deadline for settlement class members to submit claim forms is reportedly September 1, 2010.  The deadline to opt-out of (i.e., to be excluded from) the pay day loan class action settlement, or to object to it, is reportedly August 27, 2010.

The Court is scheduled to hold a settlement Fairness Hearing on September 15, 2010 at 2:00 p.m., in the courtroom of the Honorable Casey Manning, Judge of the Court of Common Pleas, County of Richland, South Carolina, 1701 Main Street, Columbia, South Carolina 29202, to consider whether to approve the proposed pay day lending class action settlement and to determine the amount of attorneys’ fees and expenses to award to Class Counsel, the amount of any incentive award to be paid to each Class Representative, and the amount of administering the Settlement.

    i went to title max and got a loan the people was very rude. one month i had car problem i went in the office to try to let them no and let then now i didn’t not have there payment for a couple of week they was not hear that so i left well about two days later i got wake up to a tow tuck dragging my car down the rode they rip the tires off the rims the marks on the rode was so deep all we had to do was followed them when i went to the office to find out where my car was and to find out what i need to to to get it back they would not even talk to me about it i need to find out what i can do about this matter
