Palace Amusement Park Class Action Settlement Of FACTA Credit Card Receipt Lawsuit

If you received an electronically printed receipt from any of the following amusement parks affiliated with and/or managed or operated by Palace Entertainment Holdings, LLC, Festival Fun Parks, LLC, or Palace Entertainment Management, LLC (“Palace”) at the point of sale or transaction, in a transaction occurring between December 4, 2006 and December 20, 2011, you may, as part of a class action settlement, be eligible to receive one (1) admission ticket to that amusement park: Big Kahuna’s (Destin, FL); Castle Park (Riverside, CA); Emerald Pointe Wet n’ Wild (Greensboro, NC); Idlewild & SoakZone (Ligonier, PA); Kennywood (West Mifflin, PA); Lake Compounce (Bristol, CT); Mountain Creek (Vernon, NJ); Raging Waters (San Dimas, CA); Sandcastle (Pittsburgh, PA); Sea Life Park (Waimanalo, HI); Silver Springs (Silver Springs, FL); Splish Splash (Calverton, NY); Water Country (Portsmouth, NH); Waterworld (Concord, CA); and Wild Waters (Silver Springs, FL) (the “Participating Palace Parks”).

A class action settlement has been reached in a class action lawsuit against Palace Entertainment Holdings, LLC, Festival Fun Parks, LLC, or Palace Entertainment Management, LLC (“Palace” or “Defendants”) pending in the United States District Court for the Western District of Pennsylvania (styled Jeff Hanlon v. Palace Entertainment Holdings, LLC et al,, Class Action Case No. CV 11-00987) alleging, among other things, that Palace violated certain requirements imposed by FACTA by printing more than the last five digits of the credit card or debit card number, and/or the expiration date of the credit card or debit card on receipts presented to customers at the point of sale in its amusement parks, in violation of FACTA, according to the Palace Amusement Park debit and credit card receipt truncation class action settlement notice.

The Palace Amusement Park debit and credit card receipt truncation FACTA Settlement Class is defined as:

All persons who received electronically printed receipts at any Participating Palace Park at the point of sale or transaction in a transaction occurring between December 4, 2006 and December 20, 2011 wherein the receipt displayed: (1) more than the last five digits of that person’s credit card or debit card number, and/or (2) the expiration date of that person’s credit card or debit card number. Expressly excluded from the class is any individual whose identity was stolen as a result of the conduct being challenged in the underlying lawsuit.

Palace Amusement Park FACTA Settlement Class Members who submit a valid claim form will be entitled to receive one (1) free admission ticket to a Participating Palace Park for any day that the Park is open for business between June 1, 2012 and June 28, 2012 and September 4, 2012 and September 30, 2012, which has an estimated retail value of twenty-seven dollars and fifty-eight cents ($27.58).

Participating amusement parks include:

  • Big Kahuna’s (Destin, FL);
  • Castle Park (Riverside, CA);
  • Emerald Pointe Wet n’ Wild (Greensboro, NC);
  • Idlewild & SoakZone (Ligonier, PA);
  • Kennywood (West Mifflin, PA);
  • Lake Compounce (Bristol, CT);
  • Mountain Creek (Vernon, NJ);
  • Raging Waters (San Dimas, CA);
  • Sandcastle (Pittsburgh, PA);
  • Sea Life Park (Waimanalo, HI);
  • Silver Springs (Silver Springs, FL);
  • Splish Splash (Calverton, NY);
  • Water Country (Portsmouth, NH);
  • Waterworld (Concord, CA); and
  • Wild Waters (Silver Springs, FL)

The Settlement also imposes certain other requirements, which are set forth in detail in the Settlement Agreement. The Settlement Agreement requires that the Parties to the Litigation shall enter a Consent Decree pursuant to which Palace will agree to continue to abide by the truncation requirements of FACTA.

If you believe you are a member of the settlement class and desire to participate in this settlement, complete a claim form by February 13, 2012.

The District Court will hold a hearing to decide whether to approve the settlement. The Fairness Hearing will be held on March 30, 2012, at 1:30 p.m., in Courtroom 3A of the United States Courthouse, 700 Grant Street, Pittsburgh, PA 15219. At this hearing, the Court will consider whether the settlement is fair, reasonable and adequate.

    My wife had me fill in the claim form for her back in November (2011) and we haven’t had any response and can’t seem to find out any further info on this. Anyone know anything? Or was this whole issue blowing smoke with no tangible results?
