NVIDIA Chip Class Action Settlement Of Class Action Lawsuit Over NVIDIA Graphics Processing Units GPUs and Media and Communications Processors MCPs

If you purchased certain models of notebook computers containing an NVIDIA graphics processing unit or media and communications processor, you could be entitled to benefits under a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against NVIDIA Corporation (“NVIDIA” or “Defendant) in the United States District Court for the Northern District of California (styled The NVIDIA GPU Litigation, Civil Action Case No. 08-cv-04312-JW) alleging, among other things, that NVIDIA sold defective Graphics Processing Units (“GPUs”) and Media and Communications Processors (“MCPs”) that affected the performance of some of the notebook computers in which they were incorporated (including certain Dell, Hewlett Packard HP Compaq and Apple computers), according to the NVIDIA class action settlement notice.

NVIDIA class action lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:

All persons and entities resident in the United States of America who purchased a “Class Computer” in the United States of America.

Class computers reportedly include certain notebook computer models that contain an NVIDIA GPU or MCP and were purchased in the time period corresponding to each model, including certain Dell Notebooks (such as certain Dell Inspiron, Dell Latitude, Dell Precision, Dell Vostro and Dell XPS computers), certain Hewlett-Packard HP-Compaq notebook or tablet computers (such as certain HP Pavilion, Compaq Presario computers) and certain Apple MacBook Pro computers.  Visit the NVIDIA settlement website for a complete list of affected computer models.

The NVIDIA Graphics Processing Unit GPU and Media and Communications Processor MCP class action lawsuit settlement reportedly provides that NVIDIA has agreed to provide a replacement of the NVIDIA GPU or MCP to Class Members who purchased certain versions of some Dell, Inc. or Apple Inc. notebook computers that contain an NVIDIA chip and who timley send in a valid Claim Form and appropriate supporting documentation.  As part of settlement, NVIDIA has also reportedly agreed to provide a replacement HP notebook computer to settlement Class Members who bought certain versions of some HP notebook computers that contain an NVIDIA chip and who send in a valid Claim Form, appropriate supporting documentation, and (if the Claim Form is approved) their eligible malfunctioning HP notebook computer.

In order to claim a settlement replacement remedy, the affected computer model reportedly must have experienced certain symptoms identified in the settlement agreement that may include distorted or scrambled video on the notebook computer screen, no video on the notebook computer screen even when the notebook computer is on, random characters, lines or garbled images on the notebook computer screen (Dell & HP), intermittent video issues (Dell & HP), failure to detect a wireless adaptor or failure to detect a wireless network (HP).

Under the NVIDIA class action settlement, NVIDIA has also agreed to provide a settlement fund in the amount of $2,000,000 to provide reimbursements if class members purchased a version of one of the affected notebook computer models, experienced certain identified symptoms, and have appropriate documentation proving that they paid to have the notebook computer repaired.

The Court is scheduled to hold a settlement Fairness Hearing at 9:00 a.m. on December 20, 2010, at the United States District Court for the Northern District of California, San Jose Division, Courtroom 8 (4th Floor), located at 280 South 1st Street, San Jose, California 95113, to consider, among other things, whether the NVIDIA class action settlement is fair, reasonable and adequate.

    Can anyone what determined which models would be included in this lawsuit? I own a HP Pavilion dv9930us. The video card went bad and the symptoms are the same as described for the other models that were included. From my research, this is a well know problem for this model.

    the settlement was unfair to people who spent more than 700.00 to 1,000 $ lets talk about fair they settled on a cheap notebook .that is not fair.
