Novartis Class Action Settlement In Gender Bias & Sex Discrimination Class Action Lawsuit Preliminarily Approved.
A class action settlement in a class action lawsuit against drug maker Novartis Pharmaceuticals Corporation pending in the United States District Court for the Southern District of New York (styled Amy Velez v. Novartis Pharmaceuticals Corporation, Case No. 04-cv-9194) alleging gender discrimination in pay, promotional opportunities and pregnancy-related matters in violation of Title VII of the Civil Rights Act has been preliminarily approved by the Court, according to class action settlement news reports.
According to the Novartis sex discrimination preliminary class approval order, the Novartis settlement class consists of all women who are currently holding, or have held, a sales-related position with Novartis Pharmaceuticals Corporation, including those who have held positions as Sales Representatives, Sales Consultants, Senior Sales Consultants, Executive Sales Consultants, Sales Associates, Sales Specialists, Senior Sales Specialists and District Managers I, from the start of the class period, July 15, 2002, through the Preliminary Approval Date (i.e., July 14, 2010).
The Novartis gender discrimination class action settlement makes available settlement benefits of up to $175,000,000 ($175 million) in monetary and non-monetary relief, comprised of a cash payment of up to $152,500,000 ($152.5 million) (the “Settlement Fund”) and of changes to Novartis’s employment practices (including its policies and practices regarding complaints of discrimination as well as compensation, performance evaluation and promotion of its field force employees) valued at $22,500,000 ($22.5 million).
Novartis settlement Class Members will reportedly be eligible to receive up to two monetary awards, in settlement of their claims for (1) backpay or lost wages, and (2) compensatory damages.
Formal notice of the Novartis gender discrimination class action settlement and settlement claims forms are reportedly scheduled to be mailed to settlement class members no later than September 9, 2010.
A final Novartis settlement hearing is reportedly scheduled to be held on November 19, 2010 at the Southern District of New York, 500 Pearl Street, Courtroom 14C, New York, New York 10007 for the court to decide, among other things, whether to finally approve the proposed class action settlement.
