MFP, INC. d/b/a Financial Credit Services, Case No. 8:13-cv-1204-T-33 TBM) alleging, among other things, that MFP d/b/a Financial Credit Services violated the terms of the Fair Debt Collection Practices Act FDCPA, 15 U.S.C. § 1692, et seq. by allegedly sending a debt collection letter that stated that “Your past due account with YOUR CREDITORS” was referred to “Financial Credit Services some time ago to arrange for payment” without identifying specific creditors to whom money was owed, how many creditors it was collecting for, how much money was being collected for each creditor and the subject matter of the debt being collected, according to the court’s order granting the motion for preliminary approval of the MFP | Financial Credit Services Debt Collection Class Action Settlement.
MFP | Financial Credit Services Debt Collection class members reportedly include, unless otherwise excluded, all residents of the State of Florida who received debt collection notices and/or letters from FCS containing the words “YOUR CREDITORS” relating to a consumer medical debt between May 9, 2012 and May 15, 2013.
The MFP | Financial Credit Services Debt Collection settlement reportedly provides, among other things, that defendant has agreed to modify the language in the debt collection letters to address the issues raised in the law suit.
