Macy’s West Stores, Inc., Case No. 1:17-cv-00754 and Chiaraluce v. Macy’s Inc. et al., Case No. 2:20-cv-00081, alleging, among other things, that CVC Sheets sold by Macy’s were falsely and deceptively labeled because the thread count listed on the packaging was incorrect and that as a result the Plaintiffs each paid more for the CVC Sheets than they were worth and what they would have otherwise paid for the sheets
Macy’s reportedly denies all allegations of fault, wrongdoing, or liability made in the litigation, and denies that the CVC Sheets they sold were mislabeled, defective, or misrepresented in any way.
Who Is Included As Settlement Class Members In The Macy’s CVC Sheets Class Action Settlement?
The Macy’s CVC sheets class action settlement reportedly includes, unless otherwise excluded, the following settlement class:

What Settlement Benefits Does The Macy’s Class Action Settlement Provide?
Under the Macy’s lawsuit settlement, Macy’s has reportedly agreed to pay ten million, five hundred thousand dollars ($10,500,000) into a Settlement Fund to pay all Eligible Claims after payment of Attorneys’ Fees and Costs, Incentive Payments for the Named Plaintiffs, and Administrative Expenses.
How Much Money Will Class Members Receive Under the Macy’s Class Action Settlement?
Macy’s settlement class members who file valid claims can receive the following monetary relief (subject to a pro rata reduction there are insufficient funds remaining in the settlement fund) under the settlement:
- Members of the Settlement Class verified from Defendants’ records as actual purchasers of CVC sheets will receive $7.50 per unit of CVC Sheets purchased unless reduced as described above.
- Members of the Settlement Class who provide proof of purchase through a receipt will receive $7.50 per unit of CVC Sheets for which proof of purchase is provided unless reduced as described above.
- Members of the Settlement Class who attest under penalty of perjury that they purchased a unit of CVC Sheets and who do not fall within either of the paragraphs above will receive $2.50 (per Household) unless reduced as described above (and are not eligible to participate in any second distribution).
How Do Macy’s Settlement Class Members File a Claim To Get a Settlement Payment?
In order to receive a payment under the Macy’s CVC sheet count settlement, class members must file a claim by the claims deadline.
Macy’s settlement class members may file a claim by submitting a Claim Form online or by printing out and mailing a paper claim form to the Claims Administrator. Class members may also contact the Settlement Administrator to request a Claim Form by telephone, by email or by U.S. mail.
The deadline to submit a claim form is one hundred eighty (180) calendar days after the Effective Date (i.e., the later of: (i) the expiration date of the time for filing a notice of appeal from the Final Approval or (ii) if a notice of appeal is filed, but the Final Approval is affirmed or the appeal is dismissed, the date upon which the mandate of the Court of Appeals is issued) of the settlement. Mailed claim forms must be postmarked on or before that date and online claim forms must be submitted at or before 6:00 p.m. ET on that date.
When Will Claimants Get Paid Under the Macy’s Settlement?
Settlement payments will be distributed as soon as possible if the Court grants Final Approval of the Settlement and after any appeals are resolved.
The Court scheduled a Final Approval Hearing for the Macy’s settlement on October 20, 2023 at 10:00 a.m. ET to consider whether, among other things, the Macy’s CVC sheet settlement is fair, reasonable, and adequate.
If the Court approves the Macy’s settlement, there may be appeals. It is uncertain whether appeals will be filed and, if so, how long it will take to resolve them.
